While there are numerous doubts, controversies and lack of consensus on alternative definitions of human death, it is argued that it is more ethical to allow people to choose either cessation of cardio-respiratory function or loss of entire brain function as the definition of death based on their own views. This paper presents the law of organ transplantation in Japan, which allows people to decide whether brain death can be used to determine their death in agreement with their family. Arguably, (...) Japan could become a unique example of individual choice in the definition of death if the law is revised to allow individuals choose definition of death independently of their family. It suggests that such an approach is one of the reasonable policy options a country can adopt for legislation on issues related to the definition of death. (shrink)

This is a revision of game theory which takes account of agents' own descriptions of their situations, and which allows people to reason as members of groups.

It is commonplace to suppose that the theory of individual rational choice is considerably less problematic than the theory of collective rational choice. In particular, it is often assumed by philosophers, economists, and other social scientists that an individual's choices among outcomes accurately reflect that individual's underlying preferences or values. Further, it is now well known that if an individual's choices among outcomes satisfy certain plausible axioms of rationality or consistency, that individual's (...) class='Hi'>choice-behavior can be interpreted as maximizing expected utility on a utility scale that is unique up to a linear transformation. Hence, there is, in principle, an empirically respectable method of measuring individuals' values and a single unified schema for explaining their actions as value maximizing. (shrink)

Game theory is central to modern understandings of how people deal with problems of coordination and cooperation. Yet, ironically, it cannot give a straightforward explanation of some of the simplest forms of human coordination and cooperation--most famously, that people can use the apparently arbitrary features of "focal points" to solve coordination problems, and that people sometimes cooperate in "prisoner's dilemmas." Addressing a wide readership of economists, sociologists, psychologists, and philosophers, Michael Bacharach here proposes a revision of game theory that resolves (...) these long-standing problems. In the classical tradition of game theory, Bacharach models human beings as rational actors, but he revises the standard definition of rationality to incorporate two major new ideas. He enlarges the model of a game so that it includes the ways agents describe to themselves their decision problems. And he allows the possibility that people reason as members of groups, each taking herself to have reason to perform her component of the combination of actions that best achieves the group's common goal. Bacharach shows that certain tendencies for individuals to engage in team reasoning are consistent with recent findings in social psychology and evolutionary biology. As the culmination of Bacharach's long-standing program of pathbreaking work on the foundations of game theory, this book has been eagerly awaited. Following Bacharach's premature death, Natalie Gold and Robert Sugden edited the unfinished work and added two substantial chapters that allow the book to be read as a coherent whole. (shrink)

Does the unequal participation of non-traditional students in higher education indicate social injustice, even if it can be traced back to individuals' choices? Drawing on luck egalitarian approaches,this article suggests that an answer to this question must take into account the effects of unequal brute luck on educational choices.I use a framework based on expected utility theory to analyse qualitative studies on educational choice.This reveals a variety of mechanisms through which differences in background conditions make non-traditional students less likely (...) to apply to university and/or particular institutions; the unequal participation of nontraditional students in higher education remains a problem of social justice. Alexis de Tocqueville is recognized as one of the most important nineteenth-century historians. In this perceptive study, Harvey Mitchell examines afresh Tocqueville's works, including the Souvenirs of 1848 and his voluminous correspondence, to shed new light on his philosophy of history. Tocqueville's concern with historical forces and individual choice emerge as central to his work. Professor Mitchell reveals in Tocqueville a unity of thought and a deep involvement with the philosophical questions raised by historical continuity and change.

Governments across the globe have squandered treasure and imprisoned millions of their own citizens by criminalising the use and sale of recreational drugs. But use of these drugs has remained relatively constant, and the primary victims are the users themselves. Meanwhile, antimicrobial drugs that once had the power to cure infections are losing their ability to do so, compromising the health of people around the world. This chapter explores a philosophical hypothesis about the nature of (some) probabilities encountered in social sciences. It should be of interest to those with philosophical concerns about the foundations of probability, and to social scientists and philosophers of science who are somewhat puzzled by the nature of probability in social domains. As will become clear below, the chapter is not intended as a contribution to an empirical methodology such as a particular way of applying statistics.

Liberal societies are built on a foundation of personal rights, including the right to make decisions about the medical treatment that one will receive or decline to receive. So essential to the liberal project is the power of individual choice that it will be abrogated only in the most extreme situations, in which persons seem to be unable to make rational decisions and thereby to protect their interests. A small number of decision-related abilities have been identified as relevant (...) to the determination of when a person will be deemed decisionally incapable: understanding, appreciation, reasoning, and choice. Normative individualism appears to be an obvious normative premise underlying a liberal conception of the desirable social order. The shortcomings of some common Interpretations of this premise are discussed and a more consistent as well as a more workable standard for assessing the ‘goodness’ of alternative socio-institutional arrangements is specified. With such an Interpretation of normative individualism, a contractrarian conception as advocated by J.M. Buchanan can be viewed as a systematic extension of classical liberalism.

Probably the main purpose of reproductive technologies is to enable people who choose to do so to avoid the birth of a baby with a disabling condition. However the conditions women want information about and the ‘price’ they are willing to pay for obtaining that information vary enormously. Individual women have to arrive at their own prenatal testing choices by ‘trading off’ means and ends in order to resolve the dilemmas facing them. We know very little about how individuals (...) make these trade-offs, so it is difficult to predict how new technologies will affect their choices and preferences. Uptake decisions can be expected to change, especially in the group of women who now are put off by some aspect of the current screening approach, where the avoidance of miscarriage risk may have provided a kind of ‘psychological shelter’, protecting a lot of people from having to make other decisions. Technologies such as Pre-implantation Genetic Diagnosis may remove a second ‘psychological shelter’ because they offer the means of avoiding the birth of an affected child without terminating a pregnancy. Even if new technologies will make some decisions easier in terms of their cognitive demands, they will also create new dilemmas and decision making will not necessarily become less stressful in emotional terms. This is a volume of twelve essays concerning the fundamental tension in personalised medicine between individual choice and the common good.

Patient choice, we might think, is the popular version of the ideas of informed consent and the principle of respect for autonomy and intimately connected to the politics of liberal individualism. There are various accounts to be given for why patient choice, in all its forms, has dominated thinking in bioethics and popular culture. All of them, I suggest, will make reference to the decline of paternalism. The bad old days of ‘doctor knows best’ are gone and were (...) replaced by the primacy of patient choice and informed consent.The response to the dominance of the principle of patient choice has been slow in building but it has come in a number of ways. Two sets of papers in this issue of the Journal of Medical Ethics show just how far this response has come and the degree to which the pendulum is swinging back in the other direction. Neil Levy's Feature article, ‘Forced to be free? Increasing patient autonomy by constraining it’, argues that we should go to greater lengths to correct patients' mistaken decisions . In the ‘Author meets critics’ section, Sarah Conly's book, Against Autonomy: Justifying Coercive Paternalism is the focus of comment . Both authors draw on a similar range of empirical evidence to undermine the sanctity of patient and individual choice. An array of commentators draw on these target pieces to give a clear picture of the ways in which the popular view can justifiably be undermined.Levy's paper focuses on the process of informed consent in clinical contexts. He argues that, while this process is crucially important, it systematically fails because of well-documented frailties of human reason. The evidence of these frailties comes from cognitive and social psychology, on biases and heuristics. The key question is how …. (shrink)

This paper tries to explain how individuals manage adaptive individual choice (i.e., the decision to acquire a fitter than average behavior or idea rapidly and tractably) in cultural evolution, despite the fact that acquiring fitness information is very difficult. I argue that the means of solving this problem suggested in the cultural evolution literature largely are various types of decision rules employing representations of fitness correlated properties or states of affairs. In this work I analyze the effects of the global market economy, manifested by a mode of production and distribution of goods and services in the form of a global network of economic relations, which involve people, transnational corporations and political and social institutions in moral sphere of people, affecting their choices and the realization of these (...) choices. Individual freedom can be understand as a freedom to realize our choices in the environment of a global economic market, but it is still problematic in the sense that the choices of goods and services available in this market do not reflect individual choices, but a set of preferences standardized according to the market itself. In this paper I will reflect about the individual freedom in economic globalization pointing from the debate between Pettit and Berlin that social freedom advocated by Republican Petit can be satisfactory for a start. A new landscape of prenatal testing is presently developing, including new techniques for risk-reducing, non-invasive sampling of foetal DNA and drastically enhanced possibilities of what may be rapidly and precisely analysed, surrounded by a growing commercial genetic testing industry and a general trend of individualization in healthcare policies. This article applies a set of established ethical notions from past debates on PNT for analysing PNT screening-programmes in this new situation. While some basic challenges of PNT stay untouched, the new development (...) supports a radical individualization of how PNT screening is organized. This reformation is, at the same time, difficult to reconcile with responsible spending of resources in a publicly funded healthcare context. Thus, while the ethical imperative of individualization holds and applies to PNT, the new landscape of PNT provides reasons to start rolling back the type of mass-screening programmes currently established in many countries. Instead, more limited offers are suggested, based on considerations of severity of conditions and optimized to simultaneously serve reproductive autonomy and public health within an acceptable frame of priorities. The new landscape of PNT furthermore underscores the ethical importance of supporting and including people with disabilities. For the very same reason, no ban on what may be analysed using PNT in the new landscape should be applied, although private offers must, of course, conform to strict requirements of respecting reproductive autonomy and what that means in terms of counselling. The introduction of genetically modified organisms (GMOs) in Europe has been characterized by controversy. In 2002, the European Union introduced the concept of “coexistence” as a compromise solution that, through the establishment of science-based technical measures, should allow the market to operate freely while reducing policy conflicts on GMOs. However, the concept remains highly contested and the technical measures difficult to apply. This paper presents qualitative research on the conceptualization and implementation of the coexistence framework in two regions of Spain (...) (Catalonia and Aragon), where 42% and 55% of maize was GM in 2006, respectively. In this context, the concept of coexistence and its proposed implementation both fail to resolve previous conflicts and actually work to generate new ones through the individualization of choice and impacts. Considerations of the social conditions in which the technology and the management measures are implemented were not taken into account. This resulted in the promotion of biotechnological agriculture over other alternatives. (shrink)

This paper presents four theorems that connect continuity postulates in mathematical economics to solvability axioms in mathematical psychology, and ranks them under alternative supplementary assumptions. Theorem 1 connects notions of continuity (full, separate, Wold, weak Wold, Archimedean, mixture) with those of solvability (restricted, unrestricted) under the completeness and transitivity of a binary relation. Theorem 2 uses the primitive notion of a separately continuous function to answer the question when an analogous property on a relation is fully continuous. Theorem 3 provides (...) a portmanteau theorem on the equivalence between restricted solvability and various notions of continuity under weak monotonicity. Finally, Theorem 4 presents a variant of Theorem 3 that follows Theorem 1 in dispensing with the dimensionality requirement and in providing partial equivalences between solvability and continuity notions. Investors who are more willing to accept risks when evaluating their investments less frequently are said to exhibit myopic loss aversion (MLA). Several recent experimental studies found that, on average, subjects bet significantly higher amounts on a risky lottery when they observe only a cumulative outcome of several realizations of the lottery (long evaluation period). In this article, we reexamine these empirical findings by analyzing individual rather than aggregate choice patterns. The behavior of the majority of subjects is (...) inconsistent with the hypothesis of MLA: they bet an intermediate fraction of their initial endowment and these bets, on average, are not significantly different across two treatments with short and long evaluation period. We discuss several alternative explanations of this finding, including the Fechner model of random errors and the financial asset pricing model. (shrink)

It integrates the ethical aspects of the subject, with positive aspects of decision mechanisms that centre on the revelation of true preferences. The literature on the subject presently consists of a great many papers. This book draws them together in common notation and points out interpretations which are often missing in specialist papers. Applications in economics, electoral politics, and ethics are discussed. There is a collection of exogenously given socially feasible sets, and, for each one of them, each individual in a group chooses from an individually feasible set. The fact that the product of the individually feasible sets is larger than the socially feasible set notwithstanding, there arises no conflict between individual choices. Assuming that individual preferences are random, I characterize rationalizable collective choices.

Women’s right to exercise choice has been one of feminism’s central political claims. Where second wave feminism focused on the constraints women faced in making free choices, choice feminism more recently reorients feminist politics with a call for recognition of the choices women are actually making. From this perspective the role of feminism is to validate women’s choices without passing judgement. This article analyses this shift in orientation by locating women’s choices within a late modern gender order in (...) which the ideal of choice has increasingly been associated with a new form of femininity characterized as self-determining, individuated and ‘empowered’. Instead of offering an effective analysis of the changing social conditions within which the relationship between feminism, femininity and individual choice has become increasingly complicated, choice feminism directs criticism at feminist perspectives characterized as overly prescriptive. This critique fails to appreciate how feminist ideals have been recuperated in the service of late capitalism and neoliberal forms of governance. By failing to engage critically with processes currently impacting on the social organization of gender choice feminism aids in the constitution of an individuated neoliberal feminist subject which performs cultural work vital to the reproduction of neoliberal governmentality. Amartya Sen has recently suggested that certain issues which arise in the application of the capability approach can be seen in terms of social choice. This article explores certain connections and tensions between Kenneth Arrow's celebrated discussion of social choice and the capability approach while focusing on one central link: pluralism. Given the variety of values people hold, substantive issues which arise in the application of the capability approach can be seen as social choice problems. Seeing them (...) in this way helps to explain some of Sen's suggestions about applying the approach in the light of an analogue of Arrow's theorem. However, it also poses a potential problem because of the focus on preferences in social choice theory, given that the capability approach is motivated in part by problems which `adaptive preferences' raise for `utility'-based views. In this article, it is argued that Sen's writings about public reasoning allow him to address this problem to some degree. The reading underlying this argument clarifies issues about the relationship between the individual and society in his approach. It also illuminates the extent of Sen's debt to John Rawls's writings on `public reason', while clarifying some points on which Sen and Rawls diverge. Loss aversion can occur in riskless and risky choices. We present novel evidence on both in a non-student sample (660 randomly selected customers of a car manufacturer). We measure loss aversion in riskless choice in endowment effect experiments within and between subjects and find similar levels of average loss aversion in both. The subjects of the within study also participate in a simple lottery choice task which arguably measures loss aversion in risky choices. We find substantial heterogeneity in (...) both measures of loss aversion. Loss aversion in riskless choice and loss aversion in risky choice are strongly positively correlated, but on average riskless loss aversion is higher than risky loss aversion. We find that in both choice tasks, loss aversion increases in age, income, and wealth, and decreases in education. Our results provide novel supportive input to the debate about the reality of loss aversion. (shrink)

In models of multi-level selection, the property of Darwinian fitness is attributed to entities at more than one level of the biological hierarchy, e.g. individuals and groups. However, the relation between individual and group fitness is a controversial matter. Theorists disagree about whether group fitness should always, or ever, be defined as total (or average) individual fitness. This paper tries to shed light on the issue by drawing on work in social choice theory, and pursuing an analogy (...) between fitness and utility. Social choice theorists have long been interested in the relation between individual and social utility, and have identified conditions under which social utility equals total (or average) individual utility. . Fresh evidence from Free Choice Items (FCIs) in French question the current perception of the class. The role of some standard distinctions found in the literature is weakened or put in a new perspective. The distinction between universal and existential is no longer an intrinsic property of FCIs. Similarly, the opposition between variation-based vs intension-based analyses is relativized. We show that the regime of free choiceness can be characterized by an abstract constraint, that we call Non-Individuation (NI), and (...) which can be satisfied in different ways that match current distinctions. NI says that the information conveyed by a sentence containing a FCI should not be reducible to a referential situation, that is a situation in which particular individuals satisfy the sentence in the current world. The widely used resource of modal variation becomes a particular scenario of free-choiceness, not its essence. In fact, we show that under certain conditions, FCIs can occur in episodic, non-modal sentences, a fact that NI can accommodate. We also discuss more fine-grained aspects of the semantics of FCIs, such as their emotional colour.
