After the death of Prophet Muhammad (p.b.u.h), one of the most significant debated topics of Muslims was the institution of caliphate. This institution caused crucial argumentations through the ages from Abu Bakr to Abd-al-Majid who was the hundreth khalifa. Some prominent issues in that regard as follows: How khalifa comes to power, who becomes khalifa, whether he is descended from Quraysh or not, which kind of traits khalifa should have, and how khalifa should behave in certain circumstances. While these arguments (...) were going on, caliphate was maintained based on the reign under some certain dynasties’ responsibilities after the Rashidun (rightly guided) Caliphs. Umayyads, Abbasids and Ottoman Dynasties were the most well-known ones of these dynasties. Throughout history, even though caliphate passed in one another’s hands among aforementioned dynasties, none of them did attempt to abolish this position. However, Turkish Muslims who became defeated with European occupation of non-western territories decided to abolish caliphate for the sake of modernization activities within the period of transition from imperialism to nation state. This decision brought about a trauma, which was much more critical than former argumentation around the position in Muslim world. Many congresses were organized in Islamic world in order to recover from this trauma. While this kind of quests were continuing, Muhammad Hamīdullah proposed “High Caliphate Council” in relation to rearrangement of caliphate in accordance with the conditions of Islamic countries. This proposal offers an applicable model to today’s modern nation states by establishing unity among them and leaving aside their conflicts and differences. This proposal offers a resolution of much-discussed matters of the position within the limits of principals. It also draws attention by showing a possibility of Islamic union in contemporary Islamic thought. Summary: The matters of who undertakes the management of societies, how rulers come to power and in what manners the rulers maintain the management have been discussed throughout history. It is seen that rulers adopted kingdom as regime before the period of the Prophet Muhammad (p.b.u.h). There was also two-person management. The discussions about this matter were also seen around khalifas who were the rulers of Muslims after the death of Prophet Muhammad (p.b.u.h). Some debated issues in that regards as follows: Who becomes khalifa, how he is elected, which traits he should possess, and so on. Caliphate continued its existence despite the discussions until the first quarter of the 14th Hijra era. Abolition of caliphate was a trauma for Muslims undoubtedly. From Anatolia to Egypt and from India to the Balkans, many attempts were carried out to recover from this trauma. However, this matter was oversimplified in the conditions of that period since it became a topic which was hushed over in just congresses and conventions. One of the people who wrote on this topic, which maintains its vitality even today was Muhammad Hamīdullah. He was an important Islamic scholar, a lawyer and a historian in Indian geography. Hamīdullah did deal caliphate by indicating its history broadly. The distinctive feature of Hamīdullah from others who wrote on this topic is that he also presented a considerable offer to solve the matter. In this sense, Hamīdullah experienced the trauma in his own life as all muslims did it with the abolition of caliphate. Hence he mentioned this matter in his writings in the mood of care and dignity of a scientist and also in feeling of a heartbroken muslim. Hamīdullah made clear that the method of election of the ruler differed throughout history. Indeed, the verses of Holy Qur’ān, the applications of the Prophet Muhammad (p.b.u.h) and the differences of Four Great Chaliphs on coming to power testified this claim. According to Hamīdullah, it is quite normal that the method of regime can vary according to the conditions of societies. He recommended acting based on timeless rules rather than the changes that vary according to conditions and places. He also stated that the regime which Islam approves is a combination of kingdom and democracy in his lines dealing with methods of regime. To him, kingdom is the method of regime of empire. Empire is the regime in which various nationalities live together with all their differences and interact with one another intensely and in which the rulers rule over wide borders. On the other hand, Islamic world lost its edges of empire, changed its regime and divided to nation states after the decline of the Ottoman Empire and Mughal Empire which were established by Muslims. On the contrary, westerners attempted to establish a head empire several times after building nation states in Europe. Some of them are UN, NATO, EU, to name but a few. In our opinion, in the transition process of Muslim rulers from empire to nation state, Hamīdullah made an offer to accomodate Islamic law in state law, Islamic politic and administrative principles in politics and administration practices, Islamic education system in education system, and principles of Islamic economics in economic decisions of government using the Prophet Muhammed’s life as a base. He also explained to Muslims that the method of regime can be changed and the essential matter is to apply Islamic management principles in such a new situation. He played a role in clearing the way for Muslims by indicating that the method of Islamic regime can be changed according to conditions but the principles of Islam are unalterable. To the writer of these lines, Hamīdullah intimates that it is not so true to stick to the form of the process in Muslim territories in which a compulsory transition from the empires or multinational social structures to the nation state structures have been experienced for the last two ages. However, the first matter to dwell on should be whether the ruler of the government behaves in accoradance with the principles of Islam or not. To Hamīdullah, the second matter is that even though Muslim countries had to enter in the process of becoming nation states, Muslims should make an effort to establish supra-state associations as required by Islam. In this respect, Hamīdullah’s proposal is “High Caliphate Council”. This council is a considerable offer presented to Muslim countries in the age when a universal caliphate is not possible and Muslims head towards a unified state form all over the world. Today, this offer recommends countries of which great majority is Muslims and in which Muslims are minority to meet on a common ground rather than conflict because of differences among them. The High Caliphate Council is an institute consists of presidents or hereditary administrators as leading and regular members and so it avoids regional competition. It is established by Muslim presidents who shares the chair alternately. Based on this, all Muslim presidents play a role altogether in this council without need to be Sunni, Shia, or from Quraysh. The High Caliphate Council is a reflection of a dream, which started a century and half a century ago but is required more today. It is also a reflection of the discourse of “Islamic Union” in Contemporary Islamic Thought. The Caliphate Council and International Islamic Legists’ Association, which is the first practical step of the council can be seen as the theory of a new world order based on the unity principle of Islam. Hamīdullah does not consider this order not only in the range of belief but also with the aim of institutionalizing ‘ijmā (consensus of Islamic legists) and qiyās(legal analogy). He stated that International Islamic Legists’ Association, which is a scientific institution could not be established beforetime by Muslims spread on three continents due to lacking of communication among them. However, thanks to today’s possibilities, the establishment of such association is easier today. Hamīdullah found dynamic solutions such these two institutions for the realization of caliphate, which is a religious necessity. The modern era has been a time of awakening on the part of the Muslim world in response to challenges from the West. The deeply rooted foundations of political and socio‐economic organization in Muslim societies have been shattered, and the traditional ideals and values of their culture have been challenged. At the same time, however, these challenges aroused national self‐awareness, and provoked a search for ways to escape from economic backwardness and spiritual stagnation.

Mohammed Arkoun is one of the Muslim world's foremost thinkers. His efforts to liberate Islamic history from dogmatic constructs have led him to a radical review of traditional history. Proceedings of the International Workshop "Islamic Peace Ethics: Legitimate and Illegitimate Violence in Contemporary Islamic Thought", organized 15-17 October 2015 by the Institute for Theology and Peace (ithf), Hamburg. More than 20 researchers from different countries including Indonesia, Pakistan, Iran, Germany, UK, USA, and Belgium discussed the peace and war in contemporary Islamic thought from different disciplines such as theology, philosophy, religious studies, cultural studies, and political sciences.

This paper examines parallels between contemporary Western and Islamic thought. It will propose that there is congruence between Western and Muslim political thought processes on issues of soft-foundationalism, negative theology, provisional truth claims and religious democracy, in order to offset hegemonic tendencies. This will be illustrated by a concise juxtaposition of the ideas of Davutoglu, Winkel, Sardar, Tariq Ali, Derrida, Foucault, Abdolkarim Soroush, Mohammed Arkoun and others. In the social sciences, namely political science, the neutralization of (...) ideology is also supported in relation to the concern of ideological encroachments into the discipline by William E. Connolly, that echoes Karl Mannheim’s sociology of knowledge. This paper concludes that similar concerns on the relationship between power and knowledge in contemporary Western and Islamic political thought processes are beneficial to the study of Islam and its transformation as a social and political phenomenon. This article attempts to touch on the presence of anthropological approaches in contemporary readings of Islamic thought, given that the latter raises questions and problems that express events that are still characterised by a permanent and urgent situation, which led to the employment of several approaches and visions that descended from contemporary Western knowledge in the field of human sciences, including anthropology. Despite the Western origin of Islamic thought – anthropology – and the delay (...) in its inclusion as a specialisation within the field of academic practice in Arab universities after independence for various reasons, the years that followed the independence of Arab countries since the second half of the 20th century carried with them the seeds of the formation of the first anthropological research that began to find its way towards gradual maturity. This paper by using the ijtihad paradigm of maqâshid al-syarî’ah of JasserAudah and the descriptive-analytical approach, would like to emphasize that the role of religion and economic welfare are two things that cannot be separated. Although in practice these two things often face obstacles, especially in the matter of diversity in religious life because of the superficial ijtihad paradigm of Islamic law. Based on the contemporary paradigm that seeks to provide new criteria in the conception of qath’i al-dlilalah (...) and dlanni al-dlilalah, it can be stated that the contemporary Islamic law paradigm that needs to be built must be based on the development of citizens’ welfare Muslims, but also must be the same as non-Muslims because of that we need to carry out financial and economic reforms ; protection of freedom of thought and freedom of religion is an important aspect that must be maintained to guarantee the peace and harmony of the nation’s life in the territory of Indonesia. What kind of duty do we have to try to stop other people doing wrong? The question is intelligible in just about any culture, but few of them seek to answer it in a rigourous fashion. The most striking exception is found in the Islamic tradition, where 'commanding right' and 'forbidding wrong' is a central moral tenet already mentioned in the Koran. This book discusses Asian medicine, which puts enormous emphasis on prevention and preservation of health, and examines how, in recent decades, medical schools in Asia have been increasingly shifting toward a curative approach. It offers an ethnographic investigation of the scenarios in China and India and finds that modern students and graduates in these countries perceive Asian medicine to be as important as Western medicine. There is a growing tendency to integrate Asian medicine with Western medical thought in the (...) academic curriculum that has led to a gradual decline of Asian medical thought and practices. At the same time, there has been a massive rise in patent drugs, health products and cosmetics being sold under the brand names of Asian medicine or herbal medicine. Most of these drugs and health products do not follow the classical formulas found in the Asian medical texts. The book analyses these texts and concludes that contemporary Asian medicine rarely follows the classical texts, and in fact uses Asian medicine brands to sell Western health products and practices. With a particular focus on the formal and professional sector of Chinese herbal medicine and Indian ayurvedic medicine in urban areas, this book appeals to a broad readership, including undergraduate students and academics as well as non-experts. A number of recently published studies by reformist-minded Muslim scholars have both questioned the normative nature of and emphasized the need to rethink some of the fundamental assumptions and interpretational models governing traditional Islamic legal theories and ethics. As part of this process they have emphasized the need to develop novel Islamic hermeneutics. One major element in this emergence of novel Islamic hermeneutics is the production of an increased number of what I term ‘gender equality affirmative scholarship (...) on Islam’. What is particularly interesting, if not intriguing, from the perspective of the author of this article is that the scholarship on gender equality affirmative interpretations of Islam is theorized by reformist-minded Muslim male scholars at historically unprecedented levels which is what this study seeks to highlight. This article examines the arguments employed by three prominent contemporary Muslim male reformist scholars, both Shī’ī and Sunnī, in developing gender equality affirmative interpretations of Islam – Nasr Abu Zayd, Mohsen Kadivar, and Khaled Abou El Fadl. The focus on male scholars in this article is intentional and seeks to highlight the most fundamental point and indeed the raison d’être behind it, namely to underscore the historically unprecedented support Muslim male scholars are providing to the development of feminist interpretations of Islam. In this paper, I examine several commentaries and glosses on the prolegomenon of Najm al-Dīn al-Kātibī’s (d. 675/1276–77) Shamsiyya that relate to debates on the Aristotelian and Ibn Sīnān theory of science in the postclassical period. Chief among the commentaries of the Shamsiyya is Quṭb al-Dīn al-Rāzī’s (d. 766/1365) Taḥrīr al-qawāʿid al-manṭiqiyya. This commentary, rather than the base text of the Shamsiyya, set the stage for later interpretations by Mirak al-Bukhārī (fl. 733/1332), Naṣīr al-Dīn al-Qāshānī (d. 755/1354), Saʿd al-Dīn al-Taftāzānī (...) (d. 792/1390), al-Sayyid al-Sharīf al-Jurjānī (d. 816/1413), Dāwūd al-Khwāfī (fl. 839/1465) and ʿIṣām al-Dīn Isfarāyinī (d. 945/1538). I focus on three issues that were raised in these interpreta­tions of the Shamsiyya’s prolegomenon: (1) the place of the elements of sciences in logical corpus, (2) the notion of the prolegomenon and its content, and (3) the real essence of a science. I attend to the particular debates and contentions on these issues to reveal the general idea of science at that time. (shrink)

Abortion is forbidden under normal circumstances by nearly all the major world religions. Traditionally, abortion was not deemed permissible by Muslim scholars. Shiite scholars considered it forbidden after implantation of the fertilised ovum. However, Sunni scholars have held various opinions on the matter, but all agreed that after 4 months gestation abortion was not permitted. In addition, classical Islamic scholarship had only considered threats to maternal health as a reason for therapeutic abortion. Recently, scholars have begun to consider the (...) effect of severe fetal deformities on the mother, the families and society. This has led some scholars to reconsider the prohibition on abortion in limited circumstances. This article reviews the Islamic basis for the prohibition of abortion and the reasons for its justification. Contemporary rulings from leading Shiite scholars and from the Sunni school of thought are presented and reviewed. The status of abortion in Muslim countries is reviewed, with special emphasis on the therapeutic abortion law passed by the Iranian Parliament in 2003. This law approved therapeutic abortion before 16 weeks of gestation under limited circumstances, including medical conditions related to fetal and maternal health. Recent measures in Iran provide an opportunity for the Muslim scholars in other countries to review their traditional stance on abortion. (shrink)

Contemporary Islam presents Europe in particular with a political and moral challenge: Moderate-progressive Muslims and radical fundamentalist Muslims present differing visions of the relation of politics and religion and, consequently, differing interpretations of freedom of expression. There is evident public concern about Western “political correctness,” when law or policy accommodates censorship of speech allegedly violating religious sensibilities. Referring to the thought of philosopher Baruch Spinoza, and accounting for the Universal Declaration of Human Rights, the Universal Islamic Declaration (...) of Human Rights, and various empirical studies on the religious convictions of Muslims, it is argued here that: (1) sovereign European state powers should be especially cautious of legal censorship of speech allegedly violating Muslim religious sensibilities; and (2) instead of legal moves to censorship, European states should defer to the principle of separation of religion and state (political authority). Further, a reasonable interpretation of Islamic jurisprudence allows that matters of religious difference may be engaged and resolved by appeal to private conscience and ethical judgment, rather than by appeal to public law per se. In so far as they are 1 representative of contemporary scholarship, the interpretative positions of Ziad Elmarsafy, Jacques Derrida, and Nasr Abū Zayd are presented in illustration of this latter point. The paper explores the role and meaning of maṣlaḥa and its possible appropriation in the field of Islamic legal and economic thought, as laid down by various medieval and contemporary Muslim scholars. Questions that are pertinent to the research are the following: how has maṣlaḥa been incorporated in legal reasoning and what kind of meaning does it convey; what type of economic reading does it presuppose; do ethics, law, and scriptural sources play equally important role as reference (...) in developing the concept in economic terms, are some of the questions that this paper will try to provide answer to. Further, as there is a tendency to believe that Islamic economic thought cannot be equated only with legal and juridical underpinnings, it is pertinent to pose a question if economic ideas have flourished independently from its legal framework. Maṣlaḥa in its capacity has always remained part and parcel of Islamic legal theory, and has been rarely addressed within the frame of economic thought; therefore a new reading is required to deal with the position of economic teachings within Islamic tradition. The paper consists of three sections, whereby the contributions made by Muslim medieval scholars on Islamic economics will be presented. The first chapter provides a historical overview of Islamic law and the concept of maṣlaḥa in relation to the field of Islamic economics, including Abu Hamid al-Ghazali’s monumental Iḥya ‘ulūm al dīn, which presents a milestone in converging Sufi ethical teachings of Islam in accordance with the legal methodology of Islamic law. The second part aims to discern and examine the economic jurisprudence and economic theory in Islam as it is understood by some of the mainstream theoreticians of Islamic studies, advocating the view that Islamic economics is inextricably related to the gist of Islamic legal reasoning. In this section the ideas of Muhammad Baqr al-Sadr will be presented as he proposes a new reading of Islamic economics as a doctrine and not a science. The third part questions Islamic legal establishment and its normativity, the claim that legal norms have always been part of the Islamic economic reasoning. This claim rests upon the idea that Islamic legal patterns were also socially constructed, including some aspects of Islamic economic reasoning. Concluding remarks will draw upon the idea that despite the fact that Islamic legal and economic literature are based upon the religious scriptures of Islam, the Qur’an and Tradition, it is more appropriate to claim that they rest upon the ethical cosmology that surpasses purely theological concerns. In lieu of an abstract, here is a brief excerpt of the content:THE PROBLEMS OF VIOLENCE AND CONFLICT IN ISLAM Qamar-ul Huda Boston College This paperis aworkin progress and itanalyzes theIslamic reasoning for the use of violence and conflict while also examining the reconciliation of violence in accordance to the Qur'ân and sayings of the Prophet Muhammad (Hadîth). Generally the ethics of violence and the interpretation of its use in the Islamic tradition was historically connected to legalists and theologians (...) who collaborated in devising policies for the imperial state. Their reading of the sources to support violence can be explained in areas of survival, self-defense, and resistance to oppression. Here, violence is explained in terms ofthe needs ofthe state, meaning that what is good for the government is good for the religion of Islam. More modern scholars of Islam are revisiting the problem of violence and the weaknesses ofclassical interpretations, and also examining, in light of the Qur'ân and Hadîths, contemporary issues like rights of the unborn, abortion, individual versus communal self-defense, domestic violence, and unprovoked aggression. The scope ofthis paperis, first, to discuss the ideas ofharmony and divine unity in Islamic theology and also the reasons Ithink they are crucial to any understanding of violence. Second, I proceed to analyze some of the ideas relating to violence "for" and "against" God in the Islamic tradition and how those ideas fit into the larger Islamic theology. Third, I am interested in presenting the specific verses from the Qur'ân, as well as Hadîths or sayings of the Prophet that deal with war, conflict and violence, and demonstrate that their contextuality is crucial. Islamic Theology, Muslims, and Divine Unity The beginning of all Islamic thought begins with God, or more specifically, with the testimony of faith or shahadâh,1 the statement that "There is no Godbut God, and the ProphetMuhammad is theMessenger.2" This attestation for Muslims is understood to be a unique certainty upon which all other truths depend and exist. With this as the starting point for Islamic beliefand practices, and indeed for all Islamic theology, the logical question for us here at COV&R is, then, to ask: "What is the Islamic perspective on peace and violence as it is related to God and to the testimony of faith?" Also, along the same line of thinking, one needs to pursue the question: "How does the Islamic faith respond to the problems ofviolence, i.e., destructive behaviorto oneselforto others by persons who thus believe that they are thereby serving and surrendering to God?" The word islam3 stems from the root salâm, "peace." The literal sense ofthe word is to be liberated from something or to gain peace in respect to it. Those who participate in this act of surrendering to the Divine are called Muslims, and through submitting one's will to God's Will, one gains safety from error, deviation, and corruption. One is integrally tied into the Divine Unity and is in harmony with the Divine. With this in the background, alThe shahadâh was established during the early period of the Prophet's missionary work. The belief that "There is no God but God, and the Prophet Muhammad is the final Messenger" was hostile to the religious practices of the Arab Bedouin culture. What distinguished the new Muslim converts was that they publicly affirmed the shahadâh and rejected contemporary cultural and religious norms of idolatry. After each reference of the beloved Prophet Muhammad, it is the custom in islam to recite or write "peace be upon him" (or pbuh). The actual Arabic benediction is sa'ala allahu alayhi wa salâm sometimes written in English as SAWS. This chapter aims to lay out a map of the diverse epistemological perspectives within the Islamic theological tradition, in the conceptual framework of contemporary analytic philosophy of religion. In order achieve that goal, it aims to consider epistemological views in light of their historic context, while at the same time seeking to “translate” those broadly medieval perspectives into contemporary philosophical language. In doing so, the chapter offers a succinct overview of the main epistemic trends within the (...) class='Hi'>Islamic theological tradition concerning religious epistemology. The chapter is divided into two main sections designated for discussions of differing accounts found in distinct trends of the tradition, namely the Rationalist and Traditionalist trends. The discussion concerning the Rationalist trend focuses on the philosophical-theologians of the dominant Mu’tazilite, Ash’arite, and Maturidite schools. The section on Islamic Traditionalism focuses on the Atharite scripturalism of Ibn Qudāma, and in particular the thought of Ibn Taymiyya. In order to map out these historic positions in light of contemporary religious epistemology, reference is made to a threefold typology of current views in the literature: (1) theistic evidentialism, (2) reformed epistemology, and (3) fideism. Debates about preserving, modifying and applying sharia through principles of taqlid or ijtihad are immensely useful in thinking through a sharper definition of tradition for political theorists and historians of political thought more generally. Political theorists and historians of political thought have tended to use tradition in a range of ways without specifying key elements of the concept. Building on debates in Islamic thought related to taqlid and its relationship to ijtihad, and through a focus on (...) the ideas of a contemporary thinker, Javed Ahmed Ghamidi, this paper proposes that tradition in political thought can be defined as a framework for knowledge production and consumption constituted of two key elements: method and sensibility. Further, the paper suggests that this definition allows us a better understanding of vibrancy in a tradition: vehement debate, contradictions and internal contestation are not signs of decay but of vitality within a tradition. It is the severe delinking of the two elements of a tradition, method and sensibility, which has greater potential to reduce its vibrancy. (shrink)

In recent decades, the trope that classical Muslim thinkers anticipated or influenced modern European thought has provided an easy endorsement of their contemporary relevance. This article studies how Arab editors and intellectuals, from 1882 to 1947, understood the twelfth-century Andalusian philosopher Ibn Ṭufayl, and Arabo-Islamic philosophy generally. This modern generation of Arab scholars also attached significance to classical Arabic texts as precursors to modern European thought. They invited readers to retrospectively identify with Ibn Ṭufayl and his (...) treatise, Ḥayy ibn Yaqẓān. Comparisons of Ibn Ṭufayl to European thinkers, and re-presentations of Ḥayy ibn Yaqẓān as the precedent or genesis of European thought, facilitated these editors’ global imaginaries, anti-colonial projects and political fantasies. This article tracks these projects and fantasies through the afterlife of Ḥayy ibn Yaqẓān from early printings and generalist surveys to later editions and studies, as Ibn Ṭufayl’s significance became sutured into his imagined importance for Europe, and for going beyond Europe.
