The Swedish medico-legal concept of “science and proven experience” is both legally important and ambiguous. The conceptual uncertainty associated with it can hamper effective assessment of medical evidence in legal proceedings and encourage medical professionals to distrust legal regulation. We examine normative criteria a functioning medico-legal notion should presumably meet, e.g. clarity, acceptability and consistency with existing laws. We also survey healthcare professionals to see how they understand science and proven experience and thus determine the extent to which their understanding (...) meets the normative criteria. The survey suggests that medical professionals feel more certain about “science and proven experience” in the medical context than they do in a legal context. They still have substantial trust in the legal use of the notion, but they do not believe that legal professionals should be allowed to determine the meaning of “science and proven experience” in the legal context. With these results in mind, we argue that the best way to meet the normative criteria and resolve conceptual uncertainty is to specify sub-questions that clarify the notion. We recommend an analytical-deliberative approach that will close the gap between the medical and legal professions’ perceptions of how law and medicine relate. (shrink)

The standard of proof in criminal trials should require that the evidence presented by the prosecution is robust. This requirement of robustness says that it must be unlikely that additional information would change the probability that the defendant is guilty. Robustness is difficult for a judge to estimate, as it requires the judge to assess the possible effect of information that the he or she does not have. This article is concerned with expert witnesses and proposes a method for reviewing (...) the robustness of expert testimony. According to the proposed method, the robustness of expert testimony is estimated with regard to competence, motivation, external strength, internal strength and relevance. The danger of trusting non-robust expert testimony is illustrated with an analysis of the Thomas Quick Case, a Swedish legal scandal where a patient at a mental institution was wrongfully convicted for eight murders. We argue that the formulations and models available in the literature today are modest variations on a common theme and face very similar problems when it comes to risk analysis, which is here understood as a decision procedure comprising a factual assessment of risk, the risk assessment, and the decision what to do based on this (...) assessment, the risk management. Both the early and updated models of evidence-based clinical decisions presented in the writings of Haynes, Devereaux and Guyatt assume that EBM consists of, among other things, evidence from clinical research together with information about patients’ values and clinical expertise. On this A-view, EBM describes all that goes on in a specific justifiable medical decision. There is, however, an alternative interpretation of EBM, the B-view, in which EBM describes just one component of the decision situation and in which, together with other types of evidence, EBM leads to a justifiable clincial decision but does not describe the decision itself. This B-view is inspired by a 100-years older version of EBM, a Swedish standard requiring medical decision-making, professional risk-taking and practice to be in accordance with‘science and proven experience’. In the paper, we outline how the Swedish concept leads to an improved understanding of the way in which scientific evidence and clinical experience can and cannot be integrated in light of EBM. How scientific evidence and clinical experience is integrated influences both the way we do risk assessment and risk management. In addition, the paper sketches the as yet unexplored historical background to VBE and EBM. (shrink)

We investigate argumentation where an expression is substituted with a less precise expression. We propose that the effect that this deprecization has on the audience be called deprecization effect. When the audience agrees more with the less precise version of the argument, there is a positive deprecization effect. We conducted an experiment where the participants were presented with a court room scenario. The results of the experiment confirm the following hypothesis: If the participants find it hard to agree with the (...) precise version of the argument and accept the use of the imprecise term, they will agree more with the imprecise version of the argument. Furthermore, we show that a person who reacts in this way to deprecization commits the fallacy of equivocation. (shrink)

An argument that makes use of a generalization activates the prototype for the category used in the generalization. We conducted two experiments that investigated how the activation of the prototype affects the persuasiveness of the argument. The results of the experiments suggest that the features of the prototype overshadow and partly overwrite the actual facts of the case. The case is, to some extent, judged as if it had the features of the prototype instead of the features it actually has. (...) This prototype effect increases the persuasiveness of the argument in situations where the audience finds the judgment more warranted for the prototype than for the actual case, but decreases persuasiveness in situations where the audience finds the judgment less warranted for the prototype than for the actual case. In the 1980s, philosophical, historical and social studies of science underwent a change which later evolved into a turn to practice. Analysts of science were asked to pay attention to scientific practices in meticulous detail and along multiple dimensions, including the material, social and psychological. Following this turn, the interest in scientific practices continued to increase and had an indelible influence in the various fields of science studies. No doubt, the practice turn changed our conceptions and approaches of science, but (...) what did it really teach us? What does it mean to study scientific practices? What are the general lessons, implications, and new challenges? This volume explores questions about the practice turn using both case studies and theoretical analysis. The case studies examine empirical and mathematical sciences, including the engineering sciences. The volume promotes interactions between acknowledged experts from different, often thought of as conflicting, orientations. It presents contributions in conjunction with critical commentaries that put the theses and assumptions of the former in perspective. Overall, the book offers a unique and diverse range of perspectives on the meanings, methods, lessons, and challenges associated with the practice turn. (shrink)

There are strong reasons for assuming that Thomas Aquinas conceived of God’s existence in terms of logical necessity in a broad sense. Yet this seems to stand in some tension with the fact that he excludes the possibility of a priori arguments for the existence of God. One apparently attractive way of handling this tension is to use a two-dimensional framework inspired by Saul Kripke. Against this, this article demonstrates that a Kripke-inspired framework is inapt in this context because it (...) allows for the conceivability of God’s non-existence, thereby rendering his non-existence possible in some important, and for Aquinas inacceptable, sense. Drawing on David Chalmers, the article submits that the existence of God can only be necessary if God’s non-existence is ideally inconceivable. On the basis of Aquinas’ own understanding of God, however, the article argues further that God’s non-existence in fact is inconceivable. The alleged conceivability of God’s non-existence is ultimately due to our (human) inability to grasp the nature of being, whereas creatures who grasp the nature of being are unable to conceive of God’s non-existence. This removes God’s non-existence from the realm of relevant conceivability and, therefore, from the range of possible worlds. (shrink)

The Element reconstructs, analyses and compares different derivational routes to a grounding of the Arrow of Time in entropy. It also evaluates the link between entropy and visible disorder, and the related claim of an alignment of the Arrow of Time with a development from order to visible disorder. The Element identifies three different entropy-groundings for the Arrow of Time: (i) the Empirical Arrow of Time, (ii) the Universal Statistical Arrow of Time, and (iii) the Local Statistical Arrow of Time. (...) The Element will also demonstrate that it is unlikely that high entropy states will always coincide with visible disorder. Therefore, it will dispute that there is a strong link between the Arrow of Time and visible disorder. (shrink)

Saying so can make it so, J. L. Austin taught us long ago. Famously, John Searle has developed this Austinian insight in an account of the construction of institutional reality. Searle maintains that so-called Status Function Declarations, allegedly having a “double direction of fit”, synchronically create worldly institutional facts, corresponding to the propositional content of the declarations. I argue that Searle’s account of the making of institutional reality is in tension with the special theory of relativity—irrespective of whether the account (...) is interpreted as involving causal generation or non-causal grounding of worldly institutional facts—and should be replaced by a more modest theory which interprets the results of Status Function Declarations in terms of mere Cambridge change and institutional truth. I end the paper by indicating the import of this more modest theory for theorizing about the causal potency of institutional phenomena generated by declarations. (shrink)

Over the last few decades, philosophers and social scientists have applied the so-called powers ontology to the social domain. I argue that this application is highly problematic: many of the alleged powers in the social realm violate the intrinsicality condition, and those that can be coherently taken to be intrinsic to their bearers are arguably causally redundant. I end the paper by offering a diagnosis of why philosophers and social scientists have been tempted to think that there are powers in (...) social realm. (shrink)

I argue along the following lines: For Wollstonecraft, liberty is independence in two different spheres, one presupposing the other. On the one hand, liberty is independence in relation to others, in the sense of not being vulnerable to their whim or arbitrary will. Call this social, or political, liberty. For liberty understood in this way, infringements do not require individual instances of interfering. Liberty is lost in unequal relationships, through dependence on the goodwill of a master. In addition, liberty is (...) independence of mind, a state I am in when I trust my own reasoned judgement above any other authority. Call this moral liberty. Moral liberty needs social liberty. In other words, to the extent I am subject to the whim of others, I am not in a position to be guided by my own judgement. Moral liberty is one of two aspects of virtue: a disposition to independent deliberation according to reason. As such, virtue is a habit of mind. The second aspect of virtue is universal benevolence as its action guiding principle. This is how liberty, equality, and virtue fit together. Social liberty, understood as independence in relation to others, necessarily coexist with equality, and is necessary for moral liberty, the habit of mind that makes up one aspect of virtue, as well as for universal benevolence as virtue’s action guiding principle. This triad explains her views on property, on sex equality, and also on legitimate government. My second line of argument is that according to Wollstonecraft, we have a duty to be virtuous. Virtue is the main object of human life. But since virtue, in both its aspects, needs social liberty and since liberty is the birthright of man, the duty is conditioned on the right. The foundation for the triad of liberty, equality, and virtue is a theory of rights. The basis for the discussion of virtue is the right to the conditions necessary for its realization. The biofuel boom is placing enormous demands on existing cropping systems, with the most crucial consequences in the agri-food sector. The biofuel industry is responding by initiating private governance and certification. The Roundtable on Sustainable Palm Oil (RSPO) and the Cramer Commission, among others, have formulated criteria on “sustainable” biofuel production and processing. This article explores the legitimacy of private governance and certification by the biofuel industry, highlighting opportunities and challenges. It argues that the concept of output based legitimacy is (...) problematic in the case of biofuel as long as no consensus or commonly agreed “best” solution has been established on what sustainable biofuel production is. Furthermore, it shows that the private governance initiatives analyzed fail to adequately include actors from developing countries. Finally, the article argues that we need mechanisms for control and accountability in order to guarantee that the political output of biofuel certification serves the common welfare. (shrink)

Can institutional objects be identified with physical objects that have been ascribed status functions, as advocated by John Searle in The Construction of Social Reality (1995)? The paper argues that the prospects of this identification hinge on how objects persist – i.e., whether they endure, perdure or exdure through time. This important connection between reductive identification and mode of persistence has been largely ignored in the literature on social ontology thus far.

Many powers metaphysicians postulate both active and passive powers, understood as distinct kinds of intrinsic causal properties of objects. I argue that the category of passive power is superfluous. I also offer a diagnosis of how philosophers are misled to postulate passive powers.

In Elder-Vass’s response to my it is maintained: that a social object is not identical with but is merely composed of its suitably interrelated parts; that a social object is necessarily indistinguishable in terms of its causal capacities from its interrelated parts; and that ontological individualism lacks an adequate ontological justification. In this reply, I argue that in view of the so-called redescription principle defended by Elder-Vass ought to be reformulated and renamed; that the conjunction of and renders social objects (...) causally redundant; and that ontological individualism can be coherently formulated and theoretically justified within Elder-Vass’s own metaphysics of objects with causal powers. An alternative to the standard endurance/perdurance accounts of persistence has recently been developed: the stage theory (Sider, T. Four-Dimensionalism: an Ontology of Persistence and Time. Oxford: Oxford University Press, 2001; Hawley, K. How Things Persist. Oxford: Oxford University Press, 2001). According to this theory, a persisting object is identical with an instantaneous stage (temporal part). On the basis of Leibniz's Law, I argue that stage theorists either have to deny the alleged identity (i.e., give up their central thesis) or hold (...) that stages are both instantaneous and continuants. I subsequently show that, although stage theory is flexible enough to accommodate the latter claim, the cost for accommodating it is an excessive proliferation of persistence concepts. (shrink)

Setting off from a familiar distinction in the philosophy of properties, this paper introduces a tripartite distinction between sparse causation, abundant causation and mere abundant causation. It is argued that the contrast between sparse and mere abundant causation allows us to resolve notorious philosophical issues having to do with negative causation, causation involving institutional properties and physical macro-causation in a way that is unified, intuitive and in line with scientific doctrines and practices.

In this paper I explore how the tenseless copula is to be interpreted in sentences of the form “a is F at t”, where “a” denotes a persisting, changeable object, “F” stands for a prima facie intrinsic property and “t” for a B-time. I argue that the interpretation of the copula depends on the logical role assigned to the time clause. Having rejected the idea that the time clause is to be treated as a sentence operator, I argue: that if (...) “at t” is thought of as being associated with “a” or “F”, then the tenseless copula is most plausibly read as an “is” simpliciter; and that if “at t” is treated as being associated with the copula, then the tenseless copula is most plausibly understood as expressing a disjunction of tensed copulas. I end the paper by explaining the importance of the issue. I indicate the ramifications interpretation of the tenseless copula has for the so-called problem of temporary intrinsics. (shrink)

I argue that Mumford and Anjum’s recent theory of simultaneous causation among powerful meso-level objects is problematic in several respects: it is based on a false dichotomy, it is incompatible with standard meso-level physics, it is explanatory deficient, and it threatens to render the powers metaphysics incoherent. Powers theorists are advised, therefore, to adopt a purely sequential conception of causation.

Emotional AI is an emerging technology used to make probabilistic predictions about the emotional states of people using data sources, such as facial (micro)-movements, body language, vocal tone or the choice of words. The performance of such systems is heavily debated and so are the underlying scientific methods that serve as the basis for many such technologies. In this article I will engage with this new technology, and with the debates and literature that surround it. Working at the intersection of (...) criminology, policing, surveillance and the study of emotional AI this paper explores and offers a framework of understanding the various issues that these technologies present particularly to liberal democracies. I argue that these technologies should not be deployed within public spaces because there is only a very weak evidence-base as to their effectiveness in a policing and security context, and even more importantly represent a major intrusion to people’s private lives and also represent a worrying extension of policing power because of the possibility that intentions and attitudes may be inferred. Further to this, the danger in the use of such invasive surveillance for the purpose of policing and crime prevention in urban spaces is that it potentially leads to a highly regulated and control-oriented society. I argue that emotion recognition has severe impacts on the right to the city by not only undertaking surveillance of existing situations but also making inferences and probabilistic predictions about future events as well as emotions and intentions. Three arguments for the conclusion that objects cannot endure in B-time even if they remain intrinsically unchanged are examined: Carter and Hestevolds enduring-objects-as-universals argument (American Philosophical Quarterly 31(4):269-283, 1994) and Barker and Dowe's paradox 1 and paradox 2 (Analysis 63(2):106-114, 2003, Analysis 65(1):69-74, 2005). All three are shown to fail.

Describing the Seas: Writing Practices of the Masters of the Royal Navy in the Long Eighteenth Century. The masters of the Royal Navy in the long eighteenth century are usually associated more with practical knowledge and experience than with an involvement with learned or ‚book‘ knowledge. However, their professional practices were based to a high degree on the usage and production of texts. This article examines how literary practices shaped the production of hydrographic knowledge by masters, in how far these (...) practices resembled those of learned culture at the time, and how masters employed them to gain access to the scientific community. It is often claimed that the social sciences cannot be reduced to a lower-level individualistic science. The standard argument for this position is the Fodorian multiple realizability argument. Its defenders endorse token–token identities between “higher-level” social objects and pluralities/sums of “lower-level” individuals, but they maintain that the properties expressed by social science predicates are often multiply realizable, entailing that type–type identities between social and individualistic properties are ruled out. In this paper I argue that the multiple realizability argument for explanatory (...) holism is unsound. The social sciences are indeed irreducible, but the principled reason for this is that the required token–token identifications cannot in general be carried through. In consequence, paradigmatic social science predicates cannot be taken to apply to the objects quantified over in the lower-level sciences. The result is that typical social science predicates cannot even be held to be co-extensive with individualistic predicates, which means type–type identifications are ruled out too. Multiple realizability has nothing to do with this failure of co-extensiveness, because the relevant social science predicates are not multiply realized in the sense intended by the explanatory holists, a sense which presupposes reductive token–token identifications. In this article I will do three things: I will argue that solidarity is not necessary for political legitimacy, that non-domination is a strong candidate for legitimacy criterion, and, finally, that non-domination can legitimate the egalitarian welfare state.

What kinds of norms constrain mechanistic discovery and explanation? In the mechanistic literature, the norms for good explanations are directly derived from answers to the metaphysical question of what explanations are. Prominent mechanistic accounts thus emphasize either ontic or epistemic norms. Still, mechanistic philosophers on both sides agree that there is no sharp distinction between the processes of discovery and explanation. Thus, it seems reasonable to expect that ontic and epistemic accounts of explanation will be accompanied by ontic and epistemic (...) accounts of discovery, respectively. As we will show here, however, recent discovery accounts implicitly rely on both ontic and epistemic norms to characterize the discovery process. In this paper, we develop an account that makes explicit that, and how, ontic and epistemic norms work together throughout the discovery process. By describing mechanism discovery as a process of pattern recognition we demonstrate that scientists have to develop epistemic activities to distinguish a pattern from its background. Furthermore, they have to determine which epistemic activities successfully describe how the pattern is implemented by identifying the pattern’s components. Our approach reveals that ontic and epistemic norms are equally important in mechanism discovery. (shrink)

This thesis is about the conceptualization of persistence of physical, middle-sized objects within the theoretical framework of the revisionary ‘B-theory’ of time. According to the B-theory, time does not flow, but is an extended and inherently directed fourth dimension along which the history of the universe is ‘laid out’ once and for all. It is a widespread view among philosophers that if we accept the B-theory, the commonsensical ‘endurance theory’ of persistence will have to be rejected. The endurance theory says (...) that objects persist through time by being wholly present at distinct times as numerically the same entity. Instead of endurantism, it has been argued, we have to adopt either ‘perdurantism’ or the ‘stage theory’. Perdurantism is the theory that objects are four-dimensional ‘space-time worms’ persisting through time by having distinct temporal parts at distinct times. The stage theory says that objects are instantaneous temporal parts (stages) of space-time worms, persisting by having distinct temporal counterparts at distinct times. In the thesis, it is argued that no good arguments have been provided for the conclusion that we are obliged to drop the endurance theory by acceptance of the B-theory. This conclusion stands even if the endurance theory incorporates the claim that objects endure through intrinsic change. It is also shown that perdurantism and the stage theory come with unwelcome consequences. -/- Paper I demonstrates that the main arguments for the view that objects cannot endure in B-time intrinsically unchanged fail. Papers II and III do the same with respect to the traditional arguments against endurance through intrinsic change in B-time. Paper III also contains a detailed account of the semantics of the tenseless copula, which occurs frequently in the debate. The contention of Paper IV is that four-dimensional space-time worms, as traditionally understood, are not suited to take dispositional predicates. In Paper V, it is shown that the stage theory needs to introduce an overabundance of persistence-concepts, many of which will have to be simultaneously applicable to a single object (qua falling under a single sortal), in order for the theory to be consistent. The final article, Paper VI, investigates the sense in which persistence can, as is sometimes suggested, be a ‘conventional matter’. It also asks whether alleged cases of ‘conventional persistence’ create trouble for the endurance theory. It is argued that conventions can only enter at a trivial semantic level, and that the endurance theory is no more threatened by such conventions than are its rivals. (shrink)

Evolutionary theodicies are attempts to explain how the enormous amounts of suffering, premature death and extinction inherent in the evolutionary process can be reconciled with belief in a loving and almighty God. A common strategy in this area is to argue that certain very valuable creaturely attributes could only be exemplified by creatures that are produced by a partly random and uncontrolled process of evolution. Evolution, in other words, was the only possible way for God to create these kinds of (...) creatures. This article presents and examines two versions of the “only way”-argument. The anthropocentric version tries to justify God’s use of evolution by reference to the value of human freedom, and argues that freedom presupposes that God lets go of full control over the process of creation . The non-anthropocentric version presents a similar argument with respect to more inclusive creaturely properties, such as that of being “truly other” than God, or of being a “creaturely self” with a certain degree of autonomy in relation to God . With the help of a number of thought-experiments of the “Twin-Earth”-type, the author argues that both the anthropocentric and the non-anthropocentric only way-arguments fail. (shrink)

The transnational anti-gender movement often has a strong connection to conservative religious organisations. However, even if the anti-gender movement is easy to recognise in Sweden, it is impossible for it to propagate significant opposition to gender mainstreaming and gender studies by using the Church as a reference due to white Swedish people’s established and neo-colonial image of Sweden as exceptional, secular, modern, and a gender equal and tolerant nation. The aim of this article is to analyse how a transnational anti-gender (...) discourse transforms and produces fear in a Swedish context. In focus is the editorial writer for Svenska Dagbladet, one of Sweden’s most influential newspapers, Ivar Arpi and his critical articles and expressions in social media on gender studies and gender mainstreaming. The material shows that instead of connecting to religion in order to dismiss gender studies, gender studies is understood as the religion and conspiracy of our time, governing the state and its citizens. Drawing on Sara Ahmed, I argue that it is possible to follow how words and discourses act in affective ways and how gender studies, gender ideology and gender mainstreaming become a single body that inspires fear. Background Healthcare leader support and facilitation for ethics work are of great importance for healthcare professionals’ handling of ethical issues, moral distress, and quality care provision. A digital tool for ethical reflection in long-term care was developed in response to the demand for appropriate tools. Research aim This study aimed to explore healthcare leaders’ expectations of using a digital tool for ethical reflection among their home nursing care staff. Research design A qualitative research design with vignettes and focus group interviews (...) was used. The data were analyzed using reflexive thematic analysis. Participants and Research Context The sample comprised ten healthcare leaders from municipal long-term care in Norway. Ethical Considerations Participation was voluntary and based on informed consent. The Norwegian Agency for Shared Services in Education and Research approved this study. Findings The analysis resulted in the development of three themes representing leaders’ expectations of the tool: (i) giving staff a voice, (ii) revealing ethics in practice, and (iii) keeping the pot boiling. Discussion Leaders must be informed about the ethical issues experienced to engage in supportive measures for their staff. Digital channels can increase the democratization, safety, and efficiency of communication between employees and leaders and increase awareness of ethical aspects in daily care work. The leaders had positive expectations of employees’ activities and benefits from using the tool for ethical reflection. However, they admitted that realizing the tool’s potential to ensure continuity in ethics work requires considerable organizational and leader involvement. Conclusions This study shows that healthcare leaders are open to digital solutions for managing ethics work in home nursing care. Both opportunities and important prerequisites for successfully implementing the digital tool were identified. (shrink)

This paper asks whether persistence can be a matter of convention. It argues that in a rather unexciting de dicto sense persistence is indeed a matter of convention, but it rejects the notion that persistence can be a matter of convention in a more substantial de re sense. However, scenarios can be imagined that appear to involve conventional persistence of the latter kind. Since there are strong reasons for thinking that such conventionality is impossible, it is desirable that our metaphysical-cum-semantic (...) theories of persistence be able to account for such scenarios in terms of conventions of the first kind. Later parts of the article therefore investigate whether three of the currently most influential metaphysical-cum-semantic theories of persistence—the endurance theory, the stage theory, and the perdurance theory—can do this. Fortunately, for them, it turns out that all can, though some philosophers have disputed this. However, when we ask how they account for a typical case of “conventional persistence” some problematic features of the theories—having to do with reference, persistence conditions, how they relate, and the epistemology of persistence—are revealed. In this review essay, I examine the central tenets of sociologist Dave Elder-Vass’s recent contribution to social ontology, as put forth in his book The Causal Power of Social Structures: Emergence, Structure and Agency. Elder-Vass takes issue with ontological individualists and maintains that social structures exist and have causal powers in their own right. I argue that he fails to establish his main theses: he shows neither that social structures have causal powers “in their own right” (in any sense of (...) this expression) nor that they exist.
