This paper will examine the effects of gender, age, work experience, academic status and legality on certain ethical decisions. Six scenarios representing ethical dilemmas were presented to both undergraduate and MBA students in an attempt to determine if various demographic factors influenced ethical decision making. While some past studies have suggested that gender has an important effect on ethical decision making, this study does not completely support this conclusion and suggests that age and/or length of work experience should be included (...) in any study of ethical decision making.The legality of the decisions was determined and compared to the reason given by the students for their decisions. In some cases the choice made by a majority of the students was not the one that was supported by the legal authorities which suggests that there may be conflicts between the ethical system of the respondents and the behavior expected of them by society. The present study is not a series of disconnected essays concerning select ed Western philosophies. All its parts belong organically together and constitute one whole. For this reason, the reader is warned not to use it as a reference book for one or another philosopher here treated. The study begins with the declaration of the exposition of fundamental event in Western philosophy which prevails with a different hue in each of the major philosophies and which relates these to pre-philosophical or (...) mythical thought. The study then treats selected Western philosophies se parately with the tendency to disclose the major event of philosophy in them. Finally it approaches contemporary man from the perspective of the fundamental event in philosophy. An inquiry into Western man's greatness is maintained here all along as intimately bound up with the historical development of philosophy. Philosophy involves greatness - not one of many philosophies, how ever, but Philosophy as such. Philosophy as such is not a composite of the various major philosophies in history; it precedes these, and is present in each one of them in a concealed way. It holds sway over them, and they belong to it. Philosophy rules the thought of thinkers; it is the Ordinance which directs the way of thought, and which is responded to by the thought of the thinkers. In this way, the major philosophies in history are diverse phases which, like the bends and turns of a river, belong to Ordinance - to Nature's thought. (shrink)

More than thirty-four years after the United States Supreme Court initially recognized a woman’s constitutional right to choose whether or not to terminate a pregnancy (at least within the first two trimesters) in its landmark abortion decision Roe v. Wade, the issue of whether women ought to have this right continues to affect public debate. Presidential candidates are asked about the issue, and potential Supreme Court nominees and their prior judicial decisions, academic writings, and speeches are thoroughly scrutinized for any (...) inkling of how they would likely rule in a future case on the issue. Perhaps even more important is the way the debate over this issue has impacted federal funding for stem cell research in the United States. Because of moral concerns regarding the personhood status and level of dignity owed to the human embryo as a form of human life, in September of 1999, the National Bioethics Advisory Commission recommended against providing federal funding for the use and derivation of embryonic stem (ES) cells and embryonic germ (EG) cells except when obtained from “cadaveric fetal tissue” or “embryos remaining after infertility treatment.” In this article, I will suggest that the abortion debate and its offshoots into embryonic medical research persist because of a failure to properly separate human personhood from human biology. I will argue further that a proper analysis of the problem will not only enlighten the abortion and fetal tissue research debate, but will have implications for end-of-life issues as well. (shrink)

Large-scale data brokers collect massive amounts of highly personal consumer information to be sold to whoever will pay their price, even at the expense of sacrificing individual privacy and autonomy in the process. In this Article, I will show how a proper understanding and justification for a right to privacy, in context to both protecting private acts and safeguarding information and states of affairs for the performance of such acts, provides a necessary background framework for imposing legal restrictions on such (...) collections. This problem, which has already gained some attention in literature, now becomes even more worrisome, as government itself becomes a consumer of this information to fight off a domestic instantiation of the global Covid-19 pandemic. This Article proposes some definite ways in which the courts and Congress might limit both the private sector and the government’s use of such data to ensure individual autonomy will not be sacrificed. The article argues that lesbian, gay, bisexual, and transgendered (LGBT) rights are a particular instantiation of human rights. But in order to make this argument several things must be done first. Preliminarily, it should be noted that some transgendered issues fall under the rubric "gay rights," even though strictly speaking, they center most prominently on gender and not sexual orientation. Still, there gender aspects are often ignored because of concerns related to sexual orientation, such as whether a transgendered female can (...) use a woman's washroom. Arguably, the reverse may also be true of gays, lesbians, and bisexuals, as many of society's concerns regarding this group involve their following gender roles, even though the discrimination against them is not usually seen as sex discrimination. Bearing that in mind, among the various responsibilities of this article is to define--in the broad sense--what gay and lesbian rights are. This is followed by a similar set of expressions defining what human rights are and an argument for how such rights get justified. Once that is done, the connection between gay and lesbian rights and human rights is pursued within the context of a theory of political morality that establishes the centrality of human rights to all moral concerns. Recent U.S. Supreme Court decisions regarding the scope of the Establishment Clause have failed to provide a clear framework for determining what government actions are prohibited. Part of the problem concerns what kinds of actions constitute an establishment of religion. What criteria should determine the boundaries of an establishment challenge? Are governmental actions that may only indirectly affect religion (either positively or negatively) prohibited? This article aims to provide a coherent and normatively justified understanding of the Establishment Clause to help (...) answer these questions by considering not just the history of the Clause or the cases the Court has decided under it, but also considering overlaps from various philosophical justifications for the Clause—including justifications from rights theory, political liberalism, utilitarianism, and communitarianism. In the process, the article eliminates from consideration the Supreme Court’s so-called “accommodationist” approach and presents a new understanding of the neutrality test that anchors itself between strict separation and the current neutrality approaches. This it does by also taking into account what in moral theory is known as the doctrine of double effect and by showing how the doctrine further limits the various judicial views to just neutrality in the new sense I suggest, while also providing both clearer and firmer conditions. In June 2015, in Obergefell v. Hodges, the Supreme Court of the United States determined that there is a fundamental right to marriage that extends to same-sex couples. This Article analyzes the Obergefell decision in light of the Court’s 2014 decision in Burwell v. Hobby Lobby regarding religious protections that might by analogy be afforded under state Religious Freedom Restoration Acts. In particular, the article considers whether a government official may claim the right to religious freedom to deny issuing marriage (...) licenses to same-sex couples. Additionally, the article suggests that a new standard for the separation of church and state may be required. Although the 2015 decision prevents the government from denying marriage to same-sex couples, the decision does not directly affect private businesses that choose not to provide services for same-sex weddings. It may, however, have an important indirect effect if laws are already present that prohibit sexual orientation discrimination. Therefore, the article explores possible avenues for protection from private. (shrink)

Terrorist attacks throughout the world and particularly within the United States have given rise to a new chapter in the ongoing debate over liberty versus security. The most recent manifestation of this dispute focuses on whether Muslim refugees can be denied entry as a class into the United States, based on their religion alone, for fear they might be harboring potential terrorists. This Essay shows that such a policy cannot be justified under the First Amendment Establishment Clause, as well the (...) United States’ expressed international commitments to preserving international human rights. What can be done is to engage a broader set of investigative approaches that are more likely to provide greater security than any policy focused on religion alone. (shrink)

I see our body as the locus of human desire, defined as a dynamic energy towards the meaningfulness of life. Because of the emergence of consciousness and its intentionality, we have a further development of life of our intentional feelings. "Intentional feeling" denotes those feelings with intentionality that directs iself towards meaningulness and values, especially those intending higher levels of mental activities such as aesthetic feeling, moral feeling and religious sentiment. We will discuss first how aesthetic feelings emerge from body as lived, in the way that desire as dynamism of meaning develops into a world of aesthetic values. Intentional feeling has its ethical dimensional, in the sense determined by Aristotle's idea of ​​phronesis, Confucian idea of ​​moral praxis and Daoist idea of ​​life praxis. In recent years, Charles Sanders Peirce has emerged, in the eyes of philosophers both in America and abroad, as one of America’s major philosophical thinkers. His work has forced us back to philosophical reflection about those basic issues that inevitably confront us as human beings, especially in an age of science. Peirce’s concern for experience, for what is actually encountered, means that his philosophy, even in its most technical aspects, forms a reflective commentary on actual life and on the world (...) in which it is lived. In Charles S. Peirce: On Norms and Ideals, Potter argues that Peirce’s doctrine of the normative sciences is essential to his pragmatism. No part of Peirce’s philosophy is bolder than his attempt to establish esthetics, ethics, and logic as the three normative sciences and to argue for the priority of esthetics among the trio. Logic, Potter cites, is normative because it governs thought and aims at truth; ethics is normative because it analyzes the ends to which thought should be directed; esthetics is normative and fundamental because it considers what it means to be an end of something good in itself. This study shows that pierce took seriously the trinity of normative sciences and demonstrates that these categories apply both to the conduct of man and to the workings of the cosmos. Professor Potter combines sympathetic and informed exposition with straightforward criticism and he deals in a sensible manner with the gaps and inconsistencies in Peirce’s thought. His study shows that Peirce was above all a cosmological and ontological thinker, one who combined science both as a method and as result with a conception of reasonable actions to form a comprehensive theory of reality. Peirce’s pragmatism, although it has to do with "action and the achievement of results, is not a glorification of action but rather a theory of the dynamic nature of things in which the "ideal" dimension of reality – laws, nature of things, tendencies, and ends – has genuine power for directing the cosmic order, including man, toward reasonable goals. Dans cet article, je discuterai de l’idée selon laquelle l’École polytechnique au xixe siècle ne permettait pas aux acteurs de réaliser des travaux mathématiques originaux. En fait, plusieurs historien⋅ne⋅s pensent que les programmes d’examens empêchaient les élèves et les enseignants de prendre des initiatives. J’essayerai de nuancer cette idée, en prenant en compte plusieurs exemples liés à l’enseignement des équations numériques au cours du xixe siècle. Plus précisément, je présente dans cet article trois théorèmes attribués à trois enseignants de l’École (...) polytechnique et qui ont circulé parmi les élèves de l’École et parmi des milieux d’enseignement. Ces exemples sont intéressants car ils donnent des informations à propos de l’École polytechnique et à propos de l’enseignement et de l’apprentissage qui s’y pratiquaient. Ils permettent aussi de mieux connaître la façon dont la recherche de résultats mathématiques nouveaux pouvait, dans ce contexte, être liée à des activités pédagogiques et je vais expliquer comment ce lien a de nombreuses conséquences sur l’activité d’un enseignant comme Edmond Laguerre par exemple. According to the standard argument from targetless higher-order representations, the possibility of such representations presents a dilemma for higher-order theorists. In this article I argue that there are two theoretically well-motivated replies to the standard argument. Consequently, the standard argument against higher-order theories fails. I then go on to argue that while certain versions of higher-order theory can adequately respond to the standard argument, they both, nevertheless, fail to explain the fineness-of-grain that phenomenally conscious experience appears to have.

V obravnavanih zadevah je bila pravdna sposobnost Srbije večkrat izpodbijana, odgovori Sodišča pa so sprožili številne polemike. Avtor se s strnjeno predstavitvijo sodb loti razčlembe sodniškega razlogovanja in tako poskuša razumeti, kako je Sodišče za obdobje med letoma 1992 in 2000 lahko prišlo do nasprotujočih si rešitev glede vprašanja dostopa Srbije do Sodišča. Pour illustrer le combat commun des deux correspondants pour le progrès des sciences théologiques en France, il présente enfin les passages qui concernent le (...) projet de création d’une revue scientifique. Il suggère au passage l’influence insoupçonnée de M. Nicolas sur la théologie protestante française, en particulier sur l’évolution des sciences bibliques. The author, who proposes to publish, for the bicentennial of Edouard Reuss’ birth , his correspondence with Michel Nicolas , presents the state of these yet unpublished letters and the circumstances in which they were written. He shows that they enlighten the literary production of both protagonists and the evolution of French Protestant theology in the 19th century. To illustrate their common struggle for the advance of theological sciences in France, he presents at last passages which concern the project to create a scientific periodical.
