The transition economy of Vietnam enjoyed remarkable achievements in the first 20 years of economic renovation (Doi Moi) from 1986 to 2006. Notably, the economy grew at an average annual rate of 7.5% in 1991-2000 period. Vietnam’s Amended Constitution 1992 recognized the role of private sector in the economy. U.S.-Vietnam Trade Bilateral Agreement (US-BTA) was signed in 2001. The country's stock market made debut trading in 2000. Vietnam became a member of Association of Southeast Asian Nations (...) (ASEAN) in 1995, then proceeded to full membership of the World Trade Organization in 2007, following which registered foreign direct investment (FDI) reached an all-time high of US$71.7 billion in 2008. Together with the impressive economic achievements, Vietnam also saw its diplomatic and political status constantly improved in the international arena. The country has established diplomatic relations with more than 170 countries in the world, strategic partnerships with 12 important economies, both developed and emerging, namely China, Japan, Russia, India, England, France, North Korea, Italy, Germany, Indonesia, Malaysia and Thailand. The rediscovery of the silver-backed chevrotain, an endemic species to Vietnam, in 2019, after almost 30 years of being lost to science, is a remarkable outcome for the global conservation agenda. However, along with the happiness, there is a tremendous concern for the conservation of the species as eating wildmeat, including chevrotain, is deeply rooted in the socio-cultural values of Vietnamese. Meanwhile, conservation plans face multiple obstacles since the species has not been listed in the list of endangered, precious, (...) and rare wildlife prioritized for protection and is still classified by the IUCN as lacking data. Given the limited effectiveness of conservation measures, this essay discusses the determining roles of local actions, community cooperation, and humanistic values oriented toward eco-surplus culture in addressing the global biodiversity conservation agenda, specifically the conservation of the silver-backed chevrotain. Local actions and community cooperation for conservation can be actualized to achieve conservation goals through citizen and community sciences, integration of modern technologies (e.g., Internet, crowdfunding platforms, social media, AI, etc.), and the bonding capability of humanistic values that prioritize environmental healing. Communicating conservation information to the community, especially the children, has to stimulate their thinking and imagination about nature, develop their curiosity and desire to protect wildlife, and eventually build eco-surplus core values in their mindsets. To successfully awaken the humanistic values within the community and incorporate them into conservation endeavors, the conservation message with the name “mouse-deer”, “chevrotain”, or scientific name (Tragulus versicolor) is largely insufficient as they show an unfamiliar feeling. Therefore, we suggest calling the mouse-deer “cheo cheo”, a local name that can create familiarity and closeness, awaken the environmental conscience and humanistic values, and stimulate thinking and imagination. All these factors are essential for conservationists, scientists, and the government to support the community in building the eco-surplus culture. (shrink)

Morgan examines the career of Wesley Fishel, a political scientist who vigorously supported American intervention in the Vietnam War, which he deemed a "great, and tragic, American experiment." Morgan demonstrates how Fishel continued to champion the prospect of an independent South Vietnam, even when Vietnamese resistance and infighting among American and Vietnamese leaders undermined this effort. We need a few words on the economic system and structure of the country before the sea change brought about by French colonialists could be fully appreciated in terms of economic performance and social context. Generally speaking, until early Xth century, Vietnam–with many name variants adopted by various feudalist kings–had been most of the time under the Chinese domination, approximately 1053 years.

Vietnam is home to a prospering technology community and numerous enterprises that range from small start-ups to development giants. Virtually all public services are offered online. In fact, the country even has a system for e-residency and “data embassies.” This achievement derives in part from the nation’s transparent and enduring political preferences, but more importantly from Vietnamese law and its regulatory system regarding information, the digital general public, and intellectual property rights (IPR) protection. In this examination of the most (...) pertinent aspects of Vietnam’s digital economy legislation, this study explores the nation’s regulatory structure regarding copyright and patents within the context of digital transformation. The study discusses the relationship between foreign and national regulations in terms of IPR protection and the advancement of digitalization. Research on Vietnamese regulations and the practical application of major patent and copyright regulations has revealed that in many respects, the nation is highly reliant on the effective operation of a broader foreign institutional and legal framework. Thus, in the near future, technological advancement will necessitate the establishment of additional transnational regulatory systems. (shrink)

Corporate bond appeared in 1992-1994 in Vietnamese capital markets. However, it is still not popular to both business sectors and academic circles. This paper explores different dimensions of Vietnamese corporate bond market using a unique and perhaps, most complete data set. State not only intervenes in the bond markets with its powerful budget and policies but also competes directly with enterprises. The dominance of state-owned enterprises and large corporations also prevents small and medium enterprises from this debt financing vehicle. Whenever (...) a convertible term is available, bondholders are more willing to accept lower fixed income payoff. But they would not likely stick to it. On the one hand, prospective bondholders could value the holdings of equity when realized favourably ex ante. On the other hand, the applicable coupon rate for such bonds could turn out negative inflation-adjusted payoff when tight monetary policy is exercised and the corresponding equity holding turns out valueless, ex post. Given the weak primary market and virtually non-existent secondary market, the corporate bond market in Vietnam reflects our perception of the relationship-based and rent-seeking behaviour in the financial markets. For the corporate bonds to really work, they critically need a higher level of liquidity to become truly tradeable financial assets. Updated entries in 2010 affirm the findings and conclusions. Vietnam’s response to the pandemic is in accordance with the ethics of care which emphasizes solidarity and responsibility. Vietnam’s approach to the COVID-19 pandemic is also in accordance with the third generation of human rights that promote solidarity and responsibilities towards the community. Vietnam is a country with many spiritual beliefs that reflect the values of its inhabitants, being an important component of their traditional culture. A special place is occupied by faith in the Mother Goddess. This kind of beliefs, which is completely unique for Vietnam, has a long history and emphasizes the feminine principle through the image of a woman with the power and ability to create, enrich and develop everything that exists. Faith in the Mother Goddess reflects the (...) values and high human qualities of the Vietnamese, and it has been recognized by UNESCO as an object of representative intangible cultural heritage of humanity. Confucian ethics was adopted in Vietnam, but it was influenced by the Vietnamese belief in the Mother Goddess. The cult of the Mother Goddess also had a great influence on the ideas about the role of women in society. The study analyzes the origins, features and values of this cult and indicates its influence on the Vietnamese Confucian ethics. It is established that the activities of the worship of the Mother Goddess contribute to strengthening the sense of community of the Vietnamese nation. In connection with the development of Confucian ethics within the framework of Vietnamese culture, the attitude towards women has changed to a more humane and open one. In modern times, the cult of mother worship has acquired secular features and can be seen as a sign of gender equality. (shrink)

My reflections on the Vietnam Veterans Memorial were provoked some time ago in a quite natural way, by a visit to the memorial itself. I happened upon it almost by accident, a fact that is due at least in part to the design of the Memorial itself . I found myself reduced to awed silence, and I resolved to attend the dedication ceremony on November 13, 1982. It was an extraordinary event, without question the most moving public ceremony I (...) have ever attended. But my own experience of the Memorial on that and other occasions is far from unique. It is almost commonplace among the many visitors to the VVM—now the most visited of all the memorials in Washington—a fact so striking as to have compelled journalists, art historians, and architects to write countless articles about the monument. And although philosophers traditionally have had little to say about architecture in general or about that of memorials in particular, there is much in the VVM and its iconography worthy of philosophical reflection. Self-knowledge includes, I hazard to say, knowledge of ourselves as members of the larger social and political context, and so includes knowledge of that context.Architecture need not memorialize or symbolize anything; or it may symbolize, but not in a memorializing way, let alone in a way that is tied to a nation’s history. The structures on the Washington Mall belong to a particular species of recollective architecture, a species whose symbolic and normative content is prominent. After all, war memorials by their very nature recall struggles to the death over values. Still further, the architecture by which a people memorializes itself is a species of pedagogy. It therefore seeks to instruct posterity about the past and, in so doing, necessarily reaches a decision about what is worth recovering. It would thus be a mistake to try to view such memorials merely “aesthetically,” in abstraction from all judgments about the noble and the base. To reflect philosophically on specific monuments, as I propose to do here, necessarily requires something more than a simply technical discussion of the theory of architecture or of the history of a given species of architecture. We must also understand the monument’s symbolism, social context, and the effects its architecture works on those who participate in it. That is, we must understand the political iconography which shapes and is shaped y the public structure in question. To do less than this—if I may state a complex argument in hopelessly few words—is to fall short of the demands of true objectivity, of an understanding of the whole which the object is. To understand the meaning of the VVM requires that we understand, among other things, what the memorial means to those who visit it. This is why my observations about the dedication of the VVM and about the Memorial’s continuing power over people play an important role in this essay. Charles L. Griswold, associate professor of philosophy at Howard University, is the author of Self-Knowledge in Plat’s “Phaedrus” and has published widely in the areas of Greek philosophy, German Idealism, hermeneutics, and political philosophy. This article develops a discursive explanation of mixed constitution: mixed constitutional ideas and discourse generate mixed constitutional design and practice. On that base, it explores the nature, factors, and functions of the mixed constitution in Vietnam. The emergence of competing constitutional ideas (Confucian, socialist, liberal, universal) animates a constitutional discourse in which different actors adhere to different ideas. Consequently, the 2013 Constitution of Vietnam embodies a mixture of the ideas in its provisions on political institutions, economy, and especially (...) human rights. The enforcement of the constitution induces competing claims to constitutional meanings. The mixed constitution is shaped by path dependency and global diffusion of constitutional ideas. It functions as the base to constrain ideational monopoly and widen the public discourse on constitutional development. (shrink)

A war narrative gives the assembly a common identity, a sense of solidarity, and a mandate for action. This paper examines the ethical significance of war narratives, with particular reference to the Vietnam War, and how war narratives can continue to foster enmity for decades after the fighting. The paper discusses two war narratives that played vital roles (...) in the Vietnam conflict: the Revolution narrative, and the Republic narrative. Drawing from the works of Jon Sobrino and Jurgen Moltmann, who identify the crucified Christ with the victims of violence, this paper demonstrates that the cross can offer a new vision for peaceful coexistence beyond war and animosity. Although most Asian states are signatories to UNCLOS, which offers options for dispute resolution by either voluntary or compulsory processes, in reality fewer than a dozen Asian states have taken advantage of such an approach. The decision to adopt third-party mechanisms comes under great scrutiny and deliberation, not least because of the entailing legal procedures and the politically sensitive nature of disputes. Vietnam claims the second-largest maritime area in the South China Sea dispute after China. A comparison of two (...) recent cases—the arbitration between the Philippines and China and the conciliation between Timor-Leste and Australia—highlights the importance of selecting between binding and nonbinding decisions and framing a complaint. In particular, any legal action under UNCLOS should specify China’s claims and actions in areas that encroach on Vietnam’s claimed exclusive economic zone (EEZ) and violate international law. Vietnam tries to respond to changing international situations, while attempting to stay in accordance with its own ambitions. China and the USA, the two superpowers, are the most important partners of Vietnamese strategy, which is determined by these two countries. The most important economic partner and ideological ally is China. But both sides have some serious problems to resolve such as maritime disputes. The situation imposes the need to seek counterbalance, a reliable ally who provides protection for its own (...) interests. So Vietnam looks to balance improved relations with China while seeking deeper and multidimensional relations with the USA. The United States offers many advantages that are attractive to Vietnam. Inevitably, economic ties and new projects e.g. TPP, political, cultural and scientific cooperation make up these advantages. However, the United States can only provide support for the Spratly and Paracel Islands’ dispute and improving cooperative measures in the South China Sea with the presence of U.S. naval vessels and dialogue that assists Vietnam defense. Vietnam has again become an element in the American strategy of pivoting to Asia. (shrink)

Conceived to commemorate the victims of South Korea’s participation in the Vietnam War, the statue of the Vietnam Pieta invites us to question who shapes the memory of this neglected facet of the conflict. The present article analyzes the various actors involved in this contentious process in and across both countries, starting with the South Korean activists behind the statue’s making and the movement for recognizing the crimes committed by their army. Examining these activists’ advocacy work since the (...) late 1990s, the article argues that they are triply situated in the fight over remembering South Korea’s intervention in Vietnam. Truth advocates first appear in a position of privilege and leadership vis-à-vis Vietnamese victims of South Korean military wrongdoings, which raises the issue of the material and political asymmetries at stake in the construction of memory. Simultaneously, the same advocates occupy a position of marginality vis-à-vis the dominant public discourse held on the war by Hanoi and Seoul, whose common interest lies in deepening their mutually beneficial but unequal economic partnership. Thirdly, the memory of the conflict pits truth activists against another group within their own civil society: veterans’ organizations aggressively denying all war crimes accusations. Ultimately, remembering the war is not the object of a bilateral dispute between the South Korean and Vietnamese states, but rather a site of domestic tensions within South Korea itself. (shrink)

Vietnam’s money and capital markets continue to see dramatic stages in the remaining months of 2011 due to high bank rates and also increasing foreign-exchange exposure faced by domestic enterprises.

Reviewing the record of American intervention in Indochina in the Pentagon Papers, one cannot fail to be struck by the continuity of basic assumptions from one administration to the next. Never has there been the slightest deviation from the principle that a noncommunist regime must be imposed and defended, regardless of popular sentiment. The scope of the principle was narrowed when it was conceded, by about 1960, that North Vietnam was irretrievably "lost." Otherwise, the principle has been maintained without (...) equivocation. Given this principle, as well as the strength of the Vietnamese resistance, the military power available to the United States, and the lack of effective constraints, one can deduce with precision the strategy of annihilation that was gradually undertaken. Vietnam is implementing global socio-economic integration, so the law must also be renovated to meet the requirements of international integration. Because the law is attached to the country's institutions, it shows the consistency in Vietnam's politics, economy, and diplomacy. In the world, the rule of law is a typical value that humanity aims for because it upholds the law, expressing our nation's aspiration for a democratic and equal society. Therefore, Vietnam has built a socialist rule of law. (...) To achieve this, Vietnam must ensure the free power of its citizens, promote the democracy of the state, and ensure that power belongs to the people. The paper uses a materialist dialectical method to examine the building of civic consciousness that promotes the perfection of Vietnam's current socialist rule of law. At the same time, the article also uses analytical methods and synthetic methods to clarify the sense of citizenship in the Vietnamese state, Vietnam's political institutions, and the development of the socialist rule of law is correct. C’est grâce à eux que Tolstoï devient alors célèbre à travers le pays. Dans cet article, nous tentons de donner un aperçu général de la réception de Tolstoï au (...) Vietnam dans la première moitié du XXe siècle. Nous analysons en particulier la biographie de Tolstoï publiée en 1939 et considérée comme l’une des biographies modernes les plus réussies. Conçue et rédigée par Nguyen Phi Hoanh qui souhaitait donner aux lecteurs une compréhension complète de la vie, de l’œuvre, mais aussi des idées de Tolstoï, cette biographie interroge également la pertinence de la philosophie du romancier russe, en particulier sa doctrine de la non-violence dans un contexte colonial. In the meantime, critically needed is a comprehensive regulatory framework that enables not only state-owned but also non-state enterprises to be able to issue a wide range of bonds legitimately. This move will certainly pave the way towards a functional corporate bond market and open up the funding channel for enterprises via bond issues.

Attitude à adopter envers soi-même, envers l'Autre et l'autre culture. Pour ce, il s'appuie sur les quelques notions de l'interculturel, analyse la (...) façon dont le Vietnam a su gérer ses rapports à soi et à l'Autre, d'hier à aujourd'hui, et propose une attitude à adopter pour chaque pays, dans l'espace francophone et face à la mondialisation. Ce questionnement se veut d'être une voix parmi d'autres et non la seule voix représentative du VietnamThis article’s aim is to ask questions about the attitude that should be adopted by Vietnam, a French-speaking country bearing its "heavy" colonial past. After so many events and delays caused by the war, the country is now interested in catching up with the train represented by the rest of mankind which is moving forward. The question is thus to define the attitude Vietnam could adopt towards itself, towards the Other and the other culture. Thus, this article has made use of certain notions of interculturality, analyzed the way in which Vietnam has managed relations with itself and with the Other, and proposes an attitude for each country to adopt in the French-speaking Community and in reaction to globalization. I aim to develop an understanding about these nurses that might place their experiences into a wider context. My conclusions provide starting points for future studies on myth, remembering and oral history.

The study of cultural evolution has taken on an increasingly interdisciplinary and diverse approach in explicating phenomena of cultural transmission and adoptions. Inspired by this computational movement, this study uses Bayesian networks analysis, combining both the frequentist and the Hamiltonian Markov chain Monte Carlo (MCMC) approach, to investigate the highly representative elements in the cultural evolution of a Vietnamese city’s architecture in the early 20th century. With a focus on the façade design of 68 old houses in Hanoi’s Old Quarter (...) (based on 78 data lines extracted from 248 photos), the study argues that it is plausible to look at the aesthetics, architecture, and designs of the house façade to find traces of cultural evolution in Vietnam, which went through more than six decades of French colonization and centuries of sociocultural influence from China. The in-depth technical analysis, though refuting the presumed model on the probabilistic dependency among the variables, yields several results, the most notable of which is the strong influence of Buddhism over the decorations of the house façade. Particularly, in the top 5 networks with the best Bayesian Information Criterion (BIC) scores and p<0.05, the variable for decorations (DC) always has a direct probabilistic dependency on the variable B for Buddhism. The paper then checks the robustness of these models using Hamiltonian MCMC method and find the posterior distributions of the models’ coefficients all satisfy the technical requirement. Finally, this study suggests integrating Bayesian statistics in the social sciences in general and for the study of cultural evolution and architectural transformation in particular. (shrink)

The COVID-19 pandemic prompted a nudge for public–private cooperation in healthcare to rapidly cope with limited resource. However, Vietnam’s historical reliance on a public healthcare system, combined with a traditional emphasis on socialization in the Polanyian sense, hindered the swift integration of the private sector. This research investigates path dependency in Vietnam’s public health sector, using theories including path dependency, Karl Polanyi’s double movement with legal analysis method to analyze the interplay of historical decisions, and socialist policies in (...) healthcare. Recognizing these institutional and market governance flaws, a deeper understanding of the role of law becomes vital in crafting strategies for a more resilient and sustainable healthcare system in Vietnam. In this article, Ho Chi Minh City is chosen as a case study due to its notable mix of public–private healthcare facilities and its status as a leading area in infection cases during the third COVID-19 wave. The article suggests that there should be a change in the way public and private sectors work together, one that is more in line with market-driven solutions which requires solid legal framework for cooperation beyond merely mobilizing resources. This paper is the first major and a thorough study on the Merger & Acquisition (M&A) activities in Vietnam’s emerging market economy, covering almost entirely the M&A history after the launch of Doi Moi. The surge in these activities since mid-2000s by no means incidentally coincides with the jump in FDI and FPI inflows into the nation. M&A industry in Vietnam has its socio-cultural traits that could help explain economic happenings, with anomalies and transitional characteristics, far better than (...) even the most complete set of empirical data. Proceeds from the sales of existing assets and firms have mainly flowed into the highly speculative industries of securities, banking, non-bank financials, portfolio investments and real estates. The impact of M&A on Vietnam’s long-term prosperity is thus highly questionable. An observable high degree of volatility in the M&A processes would likely blow out the high ex ante expectations by many speculators, when ex post realizations finally arrive. The effect of the past M&A evolution in Vietnam has been indecisively positive or negative, with significant presence of rent-seeking and likelihood of causing destructive entrepreneurship. From a socio-economic and cultural view, the degree of positive impacts may result in domestic entrepreneurship which will perhaps be the single most important indicator. (shrink)

Vietnam’s forests are at risk - carbon offset schemes could be the best chance of saving them, say Dr. Quan-Hoang Vuong and Minh-Hoang Nguyen. The value of forests is deeply ingrained in Vietnamese culture. Rừng vàng, biển bạc” [“forests of gold and seas of silver”] is both a metaphor for Vietnam, and a description of its natural wealth. The phrase is everywhere, from political speeches to daily conversation, as is Nhất phá sơn lâm, nhì đâm hà bá [“the (...) worst crime is to destroy the mountains and forests, the second worst is to kill the river”]. We arrived on April 10, and departed on the same flight, a week later. Since my visit to Vietnam was so brief, my impressions are necessarily superficial. Since I do not speak Vietnamese, an interpreter was usually necessary, and although the interpreters were highly skilled, the process of translation is time-consuming and certainly retards communication.
