This project explored what constitutes “ethical practice of mathematics”. Thematic analysis of ethical practice standards from mathematics-adjacent disciplines (statistics and computing), were combined with two organizational codes of conduct and community input resulting in over 100 items. These analyses identified 29 of the 52 items in the 2018 American Statistical Association Ethical Guidelines for Statistical Practice, and 15 of the 24 additional (unique) items from the 2018 Association of Computing Machinery Code of Ethics for inclusion. Three of the 29 items (...) synthesized from the 2019 American Mathematical Society Code of Ethics, and zero of the Mathematical Association of America Code of Ethics, were identified as reflective of “ethical mathematical practice” beyond items already identified from the other two codes. The community contributed six unique items. Item stems were standardized to, “The ethical mathematics practitioner…”. Invitations to complete the 30-min online survey were shared nationally (US) via Mathematics organization listservs and other widespread emails and announcements. We received 142 individual responses to the national survey, 75% of whom endorsed 41/52 items, with 90–100% endorsing 20/52 items on the survey. Items from different sources were endorsed at both high and low rates. A final thematic analysis yielded 44 items, grouped into “General” (12 items), “Profession” (10 items) and “Scholarship” (11 items). Moreover, for the practitioner in a leader/mentor/supervisor/instructor role, there are an additional 11 items (4 General/7 Professional). These results suggest that the community perceives a much wider range of behaviors by mathematicians to be subject to ethical practice standards than had been previously included in professional organization codes. The results provide evidence against the argument that mathematics practitioners engaged in “pure” or “theoretical” work have minimal, small, or no ethical obligations. (shrink)

This book offers a critical examination of those theories and advances a new argument for punishment's justification, calling it the 'duty view'.

The question “what is an interpretation?” is often intertwined with the perhaps even harder question “what is a scientific theory?”. Given this proximity, we try to clarify the first question to acquire some ground for the latter. The quarrel between the syntactic and semantic conceptions of scientific theories occupied a large part of the scenario of the philosophy of science in the 20th century. For many authors, one of the two currents needed to be victorious. We endorse that such debate, (...) at least in the terms commonly expressed, can be misleading. We argue that the traditional notion of “interpretation” within the syntax/semantic debate is not the same as that of the debate concerning the interpretation of quantum mechanics. As much as the term is the same, the term “interpretation” as employed in quantum mechanics has its meaning beyond (pure) logic. Our main focus here lies on the formal aspects of the solutions to the measurement problem. There are many versions of quantum theory, many of them incompatible with each other. In order to encompass a wider variety of approaches to quantum theory, we propose a different one with an emphasis on pure formalism. This perspective has the intent of elucidating the role of each so-called “interpretation” of quantum mechanics, as well as the precise origin of the need to interpret it. (shrink)

This debate, I shall argue, has everything to do with Aristotle. Aristotle raises the charge of epiphenomenalism himself against a theory that seems to have close affinities to his own, and he offers what has the makings of an emergentist response. This leads to controversy within his own school. We find opponents ranged on both sides, starting with his own pupils, several of whom are stout defenders of epiphenomenalism, and culminating in the developed emergentism of later commentators. Aristotle’s theory and (...) the debate that ensued are thus quite relevant to contemporary discussions. But first we need to get clear on terms. (shrink)

This paper concerns the credibility problem for commitments. Commitments play an important role in cooperative human interactions and can dramatically improve the performance of joint actions by stabilizing expectations, reducing the uncertainty of the interaction, providing reasons to cooperate or improving action coordination. However, commitments can only serve these functions if they are credible in the first place. What is it then that insures the credibility of commitments? To answer this question, we need to provide an account of what motivates (...) us to abide by our commitments. We first discuss two conceptions of the nature of the commitments present in joint action and of the norms that govern them. We contend that while normative considerations may have some motivational force, there are reasons to doubt that they, by themselves, could provide a sufficient motivational basis to fully explain why agents abide by their commitments and thus why their commitments are credible. In the next two sections, we discuss two proposals regarding further sources of motivation, reputation management and social emotions. We argue that while reputation management and social emotions certainly play a role in motivating us to act as committed, there are both theoretical and empirical reasons to think that neither captures the most basic motivational force at work in sustaining commitments. We propose instead that the need to belong, i.e., the need to affiliate with others and form long-lasting bonds with them, is what primarily motivates us to interact and engage with those around us and act so as to preserve and reinforce the bonds we have forged with them. We argue that the need to belong is a more basic proximate motivation for conforming to commitments, in the sense both that affiliative behaviors are evidenced much earlier in human development than either reputation management or social emotions and that the need to belong is at least part of an explanation of why we care for our reputation and why we care about others’ assessments of our behavior. In his recent book, Killing in War, Jeff McMahan sets out a number of conditions for a person to be liable to attack, provided the attack is used to avert an objectively unjust threat: (1) The threat, if realized, will wrongfully harm another; (2) the person is responsible for creating the threat; (3) killing the person is necessary to avert the threat, and (4) killing the person is a proportionate response to the threat. The present article focuses on McMahan's second (...) condition, which links liability with responsibility. McMahan's use of the responsibility criterion, the article contends, is too restrictive as an account of liability in general and an account of liability to be killed in particular. In order to defend this claim, the article disambiguates the concept of liability and explores its role in the philosophical analysis of the permission to cause harm to others. (shrink)

We discuss the ‘Consciousness Causes Collapse Hypothesis’ (CCCH), the interpretation of quantum mechanics according to which consciousness solves the measurement problem. At first, it seems that the very hypothesis that consciousness causally acts over matter counts as a reductio of CCCH. However, CCCH won’t go so easily. In this paper we attempt to bring new light to the discussion. We distinguish the ontology of the interpretation (the positing of a causally efficacious consciousness as part of the furniture of reality) from (...) metaphysics (the metaphysical character of that consciousness). That distinction allows us to map the philosophical theories of consciousness compatible with quantum mechanics under the tenets of CCCH. Also, it indicates that the problem will have to be discussed at a metaphysical level rather than at the physical level. Our analysis corroborates recent arguments to the effect that this interpretation is not ruled out so easily. (shrink)

It is sometimes argued that, given its detachment from our current most successful science, analytic metaphysics has no epistemic value because it contributes nothing to our knowledge of reality. Relatedly, it is also argued that metaphysics properly constrained by science can avoid that problem. In this paper we argue, however, that given the current understanding of the relation between science and metaphysics, metaphysics allegedly constrained by science suffers the same fate as its unconstrained sister; that is, what is currently thought (...) of as scientifically respectful metaphysics may end up also being without epistemic value. The core of our claim is that although much emphasis is put on the supposed difference between unconstrained analytic metaphysics, in opposition to scientifically constrained metaphysics, it is largely forgotten that no clear constraining relation of metaphysics by science is yet available. According to a particular interpretation of quantum mechanics, the causal role of human consciousness in the measuring process is called upon to solve a foundational problem called the “measurement problem.” Traditionally, this interpretation is tied up with the metaphysics of substance dualism. As such, this interpretation of quantum mechanics inherits the dualist’s mind-body problem. Our working hypothesis is that a process-based approach to the consciousness causes collapse interpretation (CCCI) ---leaning on Whitehead’s solution to the mind-body problem--- offers a better metaphysical (...) understanding of consciousness and its role in interpreting quantum mechanics. ‘Shallow’ and ‘deep’ versions of scientific realism may be distinguished as follows: the shallow realist is satisfied with belief in the existence of the posits of our best scientific theories; by contrast, deep realists claim that realism can be legitimate only if such entities are described in metaphysical terms. We argue that this methodological discussion can be fruitfully applied in Everettian quantum mechanics, specifically on the debate concerning the existence of worlds and the recent dispute between Everettian actualism and quantum (...) modal realism. After presenting what is involved in such dispute, we point to a dilemma for realists: either we don’t have the available metaphysical tools to answer the deep realist’s demands, and realism is not justified in this case, or such demands of metaphysical dressing are not mandatory for scientific realism, and deep versions of realism are not really required. Carnap's conception of linguistic frameworks is widespread; however, it is not entirely clear nor consensual to pinpoint what is the influence of his stance within the traditional realist/anti-realist debate. In this paper, we place Carnap as a proponent of a scientific realist stance, by presenting what he called “linguistic realism”. Some possible criticisms are considered, and a case study is offered with wave function realism, a popular position in the philosophy of quantum mechanics.

Why does symbolic communication in humans develop primarily in an oral medium, and how do theories of language origin explain this? Non-human primates, despite their ability to learn and use symbolic signs, do not develop symbols as in oral language. This partly owes to the lack of a direct cortico-motoneuron control of vocalizations in these species compared to humans. Yet such modality-related factors that can impinge on the rise of symbolic language are interpreted differently in two types of evolutionary storylines. (...) 1) Some theories posit that symbolic language originated in a gestural modality, as in “sign languages”. However, this overlooks work on emerging sign and spoken language showing that gestures and speech shape signs differently. 2) In modality-dependent theories, some emphasize the role of iconic sounds, though these lack the efficiency of arbitrary symbols. Other theorists suggest that ontogenesis serves to identify human-specific mechanisms underlying an evolutionary shift from pitch varying to orally-modulated vocalizations (babble). This shift creates numerous oral features that can support efficient symbolic associations. We illustrate this principle using a sound-picture association task with 40 learners who hear words in an unfamiliar language (Mandarin) with and without a filtering of oral features. Symbolic associations arise more rapidly and accurately for sounds containing oral features compared to sounds bearing only pitch features, an effect also reported in experiments with infants. The results imply that, beyond a competence to learn and use symbols, the rise of symbolic language rests on the types of signs that a modality of expression affords. (shrink)

There has been a longstanding bias in the study of spoken language towards using writing to analyse speech. This approach is problematic in that it assumes language to be derived from an autonomous mental capacity to assemble words into sentences, while failing to acknowledge culture-specific ideas linked to writing. Words and sentences are writing constructs that hardly capture the sound-making actions involved in spoken language. This book brings to light research that has long revealed structures present in all languages but (...) which do not match the writing-induced concepts of traditional linguistic analysis. It demonstrates that language processes are not physiologically autonomous, and that speech structures are structures of spoken language. It then illustrates how speech acts can be studied using instrumental records, and how multisensory experiences in semantic memory couple to these acts, offering a biologically-grounded understanding of how spoken language conveys meaning and why it develops only in humans. Recent work in cerebral neurology should be used to fashion a new synthesis with anthropological studies. Beginning with Paul D. Madean's model of the triune brain, we explore Ralph Wendell Burhoe's question whether creative processes result from a coadaptation, perhaps in ritual itself, of genetic and cultural information. Then we examine the division of labor between right and left cerebral hemispheres and its implications for the notions of play and “ludic recombination.” Intimately related to ritual, play may function in the (...) social construction of reality analogous to mutation and variation in organic evolution. Finally, we consider how our picture of brain functioning accords with some distinctive features of the religious systems dominant in human cultures. (shrink)

There is a longstanding and widely held view, often associated with Catholicism, that intrinsically nonprocreative human sex acts are intrinsically immoral. Some philosophers who hold this view, such as Edward Feser, claim that they can defend the view on purely philosophical grounds by relying on the perverted faculty argument. This paper argues that Feser's defense of the perverted faculty argument does not work because Feser fails to recognize the full implications of the species-dependence of natural goodness. By drawing on the (...) work of Peter Geach and Philippa Foot, this paper presents a view of natural goodness that adequately accounts for the species-dependence of such goodness. Using this adequate account, the paper argues that at least some intrinsically nonprocreative human sex acts contribute to human flourishing. (shrink)

One of the most interesting questions raised in Cecile Fabre’s Cosmopolitan War concerns war for the sake of resources. Fabre argues that it is sometimes permissible to go to war for the sake of resources that the poor are entitled to. I agree with this, but I think it is true only in very restricted circumstances. I consider a number of arguments in favour of resource wars, showing many of them to fail. The most promising argument, I suggest, is that (...) those who possess resources that have unjustly been secured are complicit in posing future threats by contributing to a market for unjustly secured resources. Whilst this argument has some promise, even it, I suggest, is in no way decisive. (shrink)

This chapter argues that the general philosophy of science should learn metaphilosophical lessons from the case of metaphysical underdetermination, as it occurs in non-relativistic quantum mechanics. Section presents the traditional discussion of metaphysical underdetermination regarding the individuality and non-individuality of quantum particles. Section discusses three reactions to it found in the literature: eliminativism about individuality; conservatism about individuality; eliminativism about objects. Section wraps it all up with metametaphysical considerations regarding the epistemology of metaphysics of science.

This essay is a response to the excellent contributions to the double special issue of Law and Philosophy on my book The Ends of Harm. I further defend the Duty View of punishment outlined in the book, responding to criticisms of that view. I also challenge the plausibility of retributivist accounts offered in response to the challenges to that view developed in The Ends of Harm.

The study examines a problematic hypothesis of possible approaches to identifying the quantum physical foundations of the functioning of consciousness. The authors proceed from the fact that in modern conditions, not a single science, nor all sciences taken together, gives a final answer to the question of the “mechanism” of the origin of thought. However, this does not mean at all that research in this direction needs to be stopped. The authors express confidence that modern and subsequent research into the (...) “quantum concept of consciousness” will lead to the identification of previously unknown patterns, opening the way to the formation of new principles and approaches. As an example, the corresponding Penrose - Hameroff concept is considered. Quantum mechanics complements the tools of neurobiology and other branches of neuroscience, which together form an interdisciplinary field of knowledge that is dynamically growing and developing. The authors are not apologists for the omnipotence of quantum physics. Quantum correlates of consciousness actually mean that it is not today’s quantum mechanics itself that explains the emergence of mental states, but the fact that in the birth of these states it is essential that in the very process of the formation of neurodynamic impulses in the neurons of the cerebral cortex that generate mental states, there are processes of quantum nature. It should also be recognized that the quantum-molecular level (nanolevel) of processes in the neurons of the brain really exists and it is this that is the source of proto-consciousness. Science strives to move forward, new research programs are emerging within the framework of quantum biology, quantum psychology, quantum information science, which in turn can shed light on the hypothesis of the “quantum concept of consciousness.”. Phylogeography, a relatively new subdicipline of evolutionary biology that attempts to unify the fields of phylogenetics and population biology in an explicit geographical context, has hosted in recent years a highly polarized debate related to the purported benefits and limitations that qualitative versus quantitative methods might contribute or impose on inferential processes in evolutionary biology. Here we present a friendly, non-technical introduction to the conflicting methods underlying the controversy, and exemplify it with a balanced selection of quotes from the primary (...) biological literature, to invite the philosophy of biology community to pay attention to the elements that have played a primary role in its presumed resolution. We also present the basic features of our own metascientific take on the debate, and point out—as a preliminary step in preparation for upcoming, more detailed treatments—the importance that appeals to authority in fields external to phylogeography per se have played in the current status of this highly visible evolutionary biology dispute. This paper presents and critically discusses the “logos approach to quantum mechanics” from the point of view of the current debates concerning the relation between metaphysics and science. Due to its alleged direct connection with quantum formalism, the logos approach presents itself as a better alternative for understanding quantum mechanics than other available views. However, we present metaphysical and methodological difficulties that seem to clearly point to a different conclusion: the logos approach is on an epistemic equal footing among alternative (...) realist approaches to quantum mechanics. Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. This article clarifies and further defends the view that the right to be presumed innocent until proven guilty, protected by Article 6(2) of the European Convention of Human Rights has implications for the substantive law. It is shown that a ‘purely procedural’ conception of the presumption of innocence has absurd implications for the nature of the right. Objections to the moderate substantive view defended are considered, including the acceptability of male prohibits offences, the difficulty of ascertaining intentions of legislatures and (...) the proper role of prosecutorial discretion. In this lucid and insightful study, Stephen Makin investigates a form of argument widespread in ancient Greek philosophy, where the absence of a reason for one alternative to be the case rather than another is used to establish substantive conclusions—where the alternatives are “indifferent”. Examples abound: Anaximander engages in such reasoning to show that the Earth does not move; Zeno of Elea to show that what is cannot be divided; Democritus to argue for finite divisibility, on the one hand, and (...) the infinite variety of atoms and worlds, on the other; not to mention the extensive use of such arguments in ancient skepticism. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different "degrees of contingency". We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. This article is a defence of a differentiated offence of rape. A differentiated offence is an offence which can be completed in a number of different ways that cannot be captured in a simple definition. It is argued that such an offence would meet several concerns that have been expressed in the feminist literature about the law of rape. It would assist certainty, it would reduce the extent to which the offence focuses on the conduct of the complainant, it would (...) allow the law to express that violence is central to the offence of rape where violence is present, but it would also allow convictions of rape where there is no violence. The argument is developed through critical engagement with the law of rape as set out in the Sexual Offences Act 2003. The Sexual Offences Act, it is argued, fails adequately to meet the concerns outlined above. (shrink)

Although recent Kant scholarship has focused on Kant's treatment of various emotions, one that has not received much attention is love. There are three main reasons for this. First, Kant does not have a single, sustained analysis of the emotion of love; what he does say appears scattered throughout his corpus. Second, Kant identifies a number of different kinds of love, and it is not always clear which kinds are emotions or how the different kinds of love are related. Finally, (...) in general Kant is quite critical of the emotion of love, and his critical remarks seem not to fit with the intuitions of some people when it comes to some of the more positive instances of love. In this paper I pursue two related aims. First, I identify and sort out the different kinds of love in Kant's writings, and I address a particular difficulty of interpretation, namely the status of love of human beings in Kant's writings. Second, I argue that, despite Kant's criticisms of the emotion of love, he views it as an expression of our unsocial sociability, and it plays a positive and indispensible role in the moral development of human beings. Partiendo de la comprensión de Heidegger en torno a los pensadores del inicio desplegada en los cuatros cursos de principios de los años cuarenta del siglo XX, querríamos mostrar la lectura de Heidegger de los pensadores del inicio en contraste con la de Gadamer en torno a los «presocráticos» mostrada en El inicio de la Filosofía occidental. Estudiaremos para ello la palabra Anfang en uno y otro autor contextualizando sus aproximaciones hermenéuticas a los textos griegos. Finalmente prestaremos atención a la (...) interpretación del poema de Parménides de Elea en El Inicio de la Filosofía occidental. Además de una diversa comprensión del final de la filosofía y la tarea del pensar, se nos irá revelando cómo Heidegger despliega indicaciones en torno a la articulación del pensar y la palabra en los pensadores del inicio, mientras Gadamer hace referencias al «valor poético» del poema de Parménides. Tras recorrer los diversos fragmentos transmitidos del poema, concluiremos señalando cómo la cuestión del ser y la verdad interpretada por Gadamer en Parménides remite a la pregunta por el carácter unitario —o al problema del continuo— de la presencia o aparecer que dice «ser», henologicamiente incomprensible sin atender a los cruces ἀλήθεια y φύσις. It is especially gratifying that philosophers of this calibre, not all of whom have worked directly on the philosophy of punishment and the philosophy of criminal law, have engaged with Ends in this way.One of my ambitions in writing Ends (...) was to connect the philosophy of punishment more directly with a set of broader issues in normative ethics than is common in the philosophy of punishment. I hoped this would encourage others to see the justification of punishment as a small part of a more general normative theory of permissible harm. The author shows that this aesthetics, which is the direct consequence of the current state of a technogenic, globalizing civilization and is its self-consciousness, is composed of three parts: classic aesthetic metaphysics; opposed to it nonclassical aesthetics, which emerged on the base of a verbal fixation on twentieth-century art practice ; and aesthetic virtualistics, which generalizes the experience of emerging digital and network art experiments.
