We study probabilistic logic under the viewpoint of the coherence principle of de Finetti. In detail, we explore how probabilistic reasoning under coherence is related to model- theoretic probabilistic reasoning and to default reasoning in System . In particular, we show that the notions of g-coherence and of g-coherent entailment can be expressed by combining notions in model-theoretic probabilistic logic with concepts from default reasoning. Moreover, we show that probabilistic reasoning under coherence is a generalization of default reasoning in System (...) . That is, we provide a new probabilistic semantics for System , which neither uses infinitesimal probabilities nor atomic bound (or big-stepped) probabilities. These results also provide new algorithms for probabilistic reasoning under coherence and for default reasoning in System , and they give new insight into default reasoning with conditional objects. This essay argues that More’s Epigrammata contains a coherent political theory that is inspired by ancient Roman republicanism. More defines “liberty” as the people’s willing obedience to virtuous leaders who rule for the common good, and he claims that popular opinion is the source of legitimacy rather than divine sanction. In doing so, More critiques the Tudor regime and presents an alternative theory of kingship based on his understanding of liberty. However, More also criticizes hereditary monarchy as such and explicitly (...) prefers a republican regime of elected men who share authority among equal peers. This republican regime more effectively promotes the common good, but it depends upon virtue in the rulers and in the citizens. More’s satirical epigrams on virtue and vice are part of his political teaching insofar as they establish his conception of citizen virtue, which supports his republicanism. (shrink)

The received view on the nature of legal authority contains the idea that a sound account of legitimate authority will explain how a legal authority has a right to command and the addressee a duty to obey. The received view fails to explain, however, how legal authority truly operates upon human beings as rational creatures with specific psychological makeups. This book takes a bottom-up approach, beginning at the microscopic level of agency and practical reason and leading to the justificatory framework (...) of authority. The book argues that an understanding of the nature of legal normativity involves an understanding of the nature and structure of practical reason in the context of the law, and advances the idea that legal authority and normativity are intertwined. This point can be summarised thus: if we are able to understand both how the agent exercises his or her practical reason under legal directives and commands and how the agent engages his or her practical reason by following legal rules grounded on reasons for actions as good-making characteristics, then we can fully grasp the nature of legal authority and legal normativity. Using the philosophies of action enshrined in the works of Elisabeth Anscombe, Aristotle and Thomas Aquinas, the study explains practical reason as diachronic future-directed intention in action and argues that this conception illuminates the structure of practical reason of the legal rules' addressees. The account is comprehensive and enables us to distinguish authoritative and normative legal rules in just and good legal systems from 'apparent' authoritative and normative legal rules of evil legal systems. At the heart of the book is the methodological view of a 'practical turn' to elucidate the nature of legal normativity and authority. (shrink)

Literary historians have been working productively in recent years to reclaim the texture of early-fifteenth-century English poetry in contexts of politics and religion. To the list of major authors we should add John Audelay, chaplain of Knockin , setting him equally beside his contemporaries Thomas Hoccleve, John Lydgate, and Margery Kempe. As a vernacular poet with a name, a provenance, and a rich body of work, Audelay warrants serious regard. Background Inadequate knowledge among health care providers (HCPs) and parents of affected children limits the understanding and utility of secondary genetic findings (SFs) in under-represented populations in genomics research. SFs arise from deep DNA sequencing done for research or diagnostic purposes and may burden patients and their families despite their potential health importance. This study aims to evaluate the perspective of both groups regarding SFs and their choices in the return of results from genetic testing in the context of orofacial (...) clefts.Methods Using an online survey, we evaluated the experiences of 252 HCPs and 197 parents across participating cleft clinics in Ghana and Nigeria toward the return of SFs across several domains.Results Only 1.6% of the HCPs felt they had an expert understanding of when and how to incorporate genomic medicine into practice, while 50.0% agreed that all SFs should be returned to patients. About 95.4% of parents were willing to receive all the information from genetic testing (including SFs), while the majority cited physicians as their primary information source (64%).Conclusions Overall, parents and providers were aware that genetic testing could help in the clinical management of diseases. However, they cited a lack of knowledge about genomic medicine, uncertain clinical utility, and lack of available learning resources as barriers. The knowledge gained from this study will assist with developing guidelines and policies to guide providers on the return of SFs in sub-Saharan Africa and across the continent. (shrink)

Industrial emissions of greenhouse gases are significant contributors to climate change, which poses a grave threat to social and economic systems. Our understanding of what might drive firms to reduce their emissions of these gases, however, is incomplete, and it is not clear that the knowledge gained from other environmental issues will readily apply to these emissions. We argue and find that indicators of environmental injustice previously shown to relate to toxic pollutants, for example, are poor predictors of greenhouse gas (...) emissions. Instead, we show that the degree of belief in and concern about climate change in a local community is a significant predictor of the facility’s rate of emission improvements. Furthermore, we find that beliefs at both the facility and headquarter communities influence emission reduction, and that those effects are substitutes for each other. (shrink)

Many formerly incarcerated people have civil legal needs that can imperil their successful re-entry to society and, consequently, their health. We categorize these needs and assess their association with cardiovascular disease risk factors in a sample of recently released people. We find that having legal needs related to debt, public benefits, housing, or healthcare access is associated with psychosocial stress, but not uncontrolled high blood pressure or high cholesterol, in the first three months after release.

Since the 19th century, innocence has been a hallmark of childhood. The innocence of children is seen as both a sanctity worth defending and a feature that excuses the unavoidable mistakes of adolescence. While beneficial in many settings, notions of childhood innocence are often entangled with values judgements. Inherent in innocence is the notion that that which we are innocent of is undesirable. Further, attributing innocence to some implies the tolerability of blame for others. This has unique implications in a (...) medical setting. This essay explores the implications of espousing the innocence of paediatric patients. Ultimately, because attribution of innocence is both prone to bias and rooted in the same framework as blame, it degrades patient-centred care and compromises the patient–provider relationship. I argue that avoiding such characterisations may allow providers to more effectively promote paediatric health. (shrink)

This article describes the development, implementation, and evaluation of a complex methotrexate ethics case used in teaching a Pharmacy Law and Ethics course. Qualitative analysis of student reflective writings provided useful insight into the students’ experience and comfort level with the final ethics case in the course. These data demonstrate a greater student appreciation of different perspectives, the potential for conflict in communicating about such cases, and the importance of patient autonomy. Faculty lessons learned are also described, facilitating adoption of (...) this methotrexate ethics case by other healthcare profession educators. (shrink)

In this conversation, which took place across several months in the year 2021, Elizabeth Grosz describes her position with respect to “new materialism” and “the material turn”: while she emphasizes the necessity of materialist thought in the current situation marked by a global pandemic, she also stresses the equal importance of what she calls “the incorporeal”: an excess in and of matter, materiality’s heterogeneous virtuality, differentiality and becoming-other. Grosz describes the incorporeal as mutually implicated with materiality in a way that (...) eschews both monism and dualism. The conversation roughly follows five topics: 1. How does one conceive of ontology without fixity? 2. How does matter “make sense”? 3. Can we think sexual differences beyond cisgender binarism and oppositional dualism? 4. What are the ethico-political implications of a materialist thought predicated on becoming and immanence? 5. Is psychoanalysis compatible with materialism, and is there a materiality of the unconscious? Is the overall value of a world just the sum of values contributed by each value-bearing entity in that world? Additively separable axiologies (like total utilitarianism, prioritarianism, and critical level views) say 'yes', but non-additive axiologies (like average utilitarianism, rank-discounted utilitarianism, and variable value views) say 'no'. This distinction appears to be practically important: among other things, additive axiologies generally assign great importance to large changes in population size, and therefore tend to strongly prioritize the long-term survival of humanity over (...) the interests of the present generation. Non-additive axiologies, on the other hand, need not assign great importance to large changes in population size. We show, however, that when there is a large enough `background population' unaffected by our choices, a wide range of non-additive axiologies converge in their implications with additive axiologies—for instance, average utilitarianism converges with critical-level utilitarianism and various egalitarian theories converge with prioritarianism. We further argue that real-world background populations may be large enough to make these limit results practically significant. This means that arguments from the scale of potential future populations for the astronomical importance of avoiding existential catastrophe, and other arguments in practical ethics that seem to presuppose additive separability, may succeed in practice whether or not we accept additive separability as a basic axiological principle. 'Altruism' was coined by the French sociologist Auguste Comte in the early 1850s as a theoretical term in his 'cerebral theory' and as the central ideal of his atheistic 'Religion of Humanity'. In The Invention of Altruism, Thomas Dixon traces this new language of 'altruism' as it spread through British culture between the 1850s and the 1900s, and in doing so provides a new portrait of Victorian moral thought. Drawing attention to the importance of Comtean positivism in setting the (...) agenda for debates about science and religion, this volume challenges received ideas about both Charles Darwin and Herbert Spencer as moral philosophers. Darwin saw sympathy and love, not only selfishness and competition, throughout the natural world. Spencer was the instigator of an Anti-Aggression League and an advocate of greater altruism in Britain's dealings with the 'lower races'. It also sheds light on the rise of popular socialism in the 1880s, on the creation of the idealist 'altruist' in novels of the 1890s, and on the individualistic philosophies of Friedrich Nietzsche, Oscar Wilde, and G. E. Moore - authors considered by some to be representative of fin de siècle 'egomania.' This wide-ranging study in the history of ideas is highly relevant to contemporary debates about altruism, evolution, religion, and ethics. (shrink)

British systematics was distinctly marked by a raft of vituperative controversies around the turn of the 1830s. After the local collapse of broad consensus in the Linnaean system by 1820, the emergence of new schemes of classification—most notably, the “quinarian” system of William Sharp Macleay—brought with it an unprecedented register of public debate among zoologists in Britain, one which a young Charles Darwin would bitterly describe to his friend John Stevens Henslow in October 1836 as possessing a “mean quarrelsome spirit,” (...) conducted in “a manner anything but like that of gentlemen.” This article aims to provide a social and conceptual account of the remarkable tenor of zoological discourse in Britain in the late 1820s and early 1830s, with joint attention to the philosophical and interpersonal commitments at play. In doing so, it analyzes the three of the period’s most striking public controversies, each of which counted key advocates of the quinarian system as central participants. (shrink)

Abstract:This essay explores key values of John Lachs's work, especially freedom, diversity, and human flourishing, when applied to the history of the philosophy of education as well as to the practical problems of policy and implementation today in American schools. I consider the importance and tensions involved in these values in the thinking of Plato, Jean-Jacques Rousseau, and John Dewey. Next, I examine necessary and then avoidable challenges of operationalizing freedom and diversity in schools, especially in tensions with recent policy (...) initiatives that threaten freedom and diversity for human flourishing. The aim here is to note the central importance of the values that Lachs has long championed, while attending also to the risks and dangers that misunderstanding and narrow thinking pose about them when applied to American public schools. Ultimately, I argue that while advocacy for liberty sometimes raises profound problems in the sphere of public education, democratic education is enriched immeasurably when it enables and empowers freedom to pursue diverse forms of flourishing. The essays in this book began as a contributions to a Summer Workshop arranged by the Calgary Institute for the Humanities, and haled at the University of Calgary from July 7 to 14, 1978. The Institute, which was founded by the University in 1976 for the encouragement of humanistic studies, has held such conferences each summer as a part of its programme of research.

Reprise par les disciples allemands de Burke, cette critique de la méthode adoptée par la Constituante tirait des postulats empiristes des Lumières anglo-écossaises toutes les (...) implications conservatrices que recelaient déjà les textes politiques et historiques de Hume. Or c’est d’emblée sur ce terrain spéculatif que se joue, chez Fichte, la défense du droit de révolution. Reprochant à l’empirisme de réduire l’esprit au « mécanisme aveugle de l’association des idées », passivement déterminé par une extériorité en soi, Fichte entend au contraire fonder l’expérience elle-même sur l’activité d’un « Moi-en-soi », absolument indépendant. Conçu comme causalité libre, pouvant donc s’affranchir des « conjonctions coutumières » humiennes pour commencer une nouvelle série dans l’ordre des phénomènes, l’homme, pour Fichte, n’a pas seulement la « faculté de se perfectionner », mais la loi de sa liberté lui en fait même un devoir. Au regard de cet impératif catégorique de perfectionnement, il n’y a pas de Common Law qui tienne. Aussi Fichte ne recule-t-il pas devant la révolution, si les institutions du passé font obstacle à la destination de l’homme. (shrink)

The adjective λυσιμελής (“limb-loosening”) and related statements about bodies dissolving or melting are found in Greek literature in an astonishing variety of contexts, above all in relation to sleep, death and erotic desire. The present paper asks what made the idea of (limbs) loosening so attractive for authors and it traces their use from early Greek epic (Homer and Hesiod) through lyric (Archilochus, Alcman, Sappho, Ibycus, Anacreon and Pindar) to Plato’s Phaedrus. This brings several factors to light: the adjective and (...) related expressions describe existential experiences of loss of control in an embodied way that 1) points to real psychosomatic correlations, 2) contributes to vividness in the sense of ‘embodied cognition’ and often 3) switches between the concrete and the metaphorical, with the latter intensifying the expressive potential especially in lyric. At the same time, a gradual shift can be observed from an integrated concept of the body towards a (conceptual) metaphor. This apparently unremarkable adjective and its related notions thus permit a deep insight into both the cultural ideas and the literary strategies of early and classical Greece. (shrink)

This article contends that Dworkin's notion of ‘genuine’ theoretical disagreements, which is a fundamental pillar in his criticism of legal positivism and semantic disagreements, requires a realist reinterpretation. This view is defended according to two core arguments. First, a realist reinterpretation of ‘genuine’ theoretical disagreements enables Dworkin to avoid semantic criticisms such as the one advanced by Joseph Raz, who propounds a sophisticated model of criterial semantics to explain theoretical disagreements. Second, to make intelligible the distinction between theoretical and semantic (...) disagreements in law, we need to resort to realist elements. The conclusion is striking and in clear contradiction with Dworkin's ametaphysical and epistemic abstinence. The article shows that there is a problematic tension within Dworkin's constructivist project and that he should revise either its ametaphysical view and epistemic abstinence, or notions such as ‘genuine’ theoretical disagreements. In this paper, I discuss Goldberg and Zipursky’s Recognizing Wrongs and argue that there is a tension between their philosophy of action as applied to the law of negligence and the idea that the directive-based relationality thesis is central and, therefore, the action and conduct of the defendant should not be part of the core explanation of the tort of negligence.

Current relational phenomenologies of the Holy Mass remain on a fundamentally horizontal level. Here I develop a phenomenology of the Holy Mass and of Eucharistic devotion that explores the spiritual as well as the ethical transformations attendant on individuals of faith who engage in these practices. On the one hand, I hold as premise the traditional and magisterial teachings of the Church on the Sacrament and its devotion. On the other hand, I make use of the phenomenology of Emmanuel Levinas, (...) interpreting him in line with the minority but not unsubstantial spiritual reading of his work. After first summarizing Church teaching on the Mass and the Eucharist, I point out how the relational approach to a phenomenology of the Eucharist has been misapplied to the Sacrament. I then point out shortcomings in the phenomenology of two other Catholic writers on the Eucharist, Jean-Luc Marion and Michael Purcell. Finally, I develop a more adequate phenomenology of the Mass and the Eucharist, bringing together the spirituality and the ethics of the individual and of the Church as an ethical people. (shrink)

Los pueblos indígenas en México viven en un contexto de pobreza extrema, desigualdad social y discriminación que les obstaculiza el acceso y ejercicio del derecho a la educación, llave para mejorar su calidad de vida. La educación oficial, por disposición normativa, debe atender al criterio de interculturalidadderivado de la conformación multicultural de la sociedad mexicana, diferenciándose entre la educación intercultural con pertinencia cultural y lingüística para dichos pueblos, y la educación intercultural para toda la sociedad. Con esta premisa, considerando postulados (...) de la filosofía de la interculturalidad, se analiza argumentativamente el escenario de la educación superior para las etnias, materializado en instituciones de educación superior interculturales y convencionales; identificando la presencia de discentes de origen étnico en ambas. A partir de ello, se realizan propuestas para que las instituciones convencionales cumplan con el criterio de interculturalidad, que permita la incorporación de estudiantes indígenas sin menoscabo desu identidad cultural. In recent years, politically active Latinx and Asian American Pacific Islander youth have addressed anti-Black racism within their own immigrant and refugee communities, engaged in protests against police violence, and expressed support for #SAYHERNAME. Reflecting the broader patterns of a new political generation and of progressive social movement leadership, women and nonbinary youth have disproportionately committed to inclusive fights for racial justice. In this essay, through two biographical examples, we highlight the role of grassroots youth organizing groups in training their (...) diverse young members to become effective allies, introducing them to intersectional frameworks that motivate solidarity across racial and ethnic boundaries. Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition.
