In 1968, an antisemitic campaign, launched by the Polish government, caused around 13,000 Jews to leave Poland. About 2500 of these refugees came to Denmark, while only about 25 ended up in Norway. The migration to Norway could potentially have reached low hundreds, but as oral-history sources indicate, the Jewish congregation in Oslo turned down a government initiative in 1969. Based on written and oral sources, and secondary literature, I argue that there was an equally important factor differentiating the two (...) countries. Comparing the Danish and Norwegian refugee reception policies, the article finds that Danish authorities and their NGO partners at decisive stages in the process were more proactive than their Norwegian counterparts in their efforts to persuade Polish Jews to come. The most critical point was in June 1969, when Denmark’s embassy in Warsaw started issuing Jews with automatic visas, while Norway retained its existing application process. (shrink)

Although prisons provide on-site primary care, the corrections system relies on external hospitals to provide a variety of healthcare services. Compared to the general population, incarcerated patients experience higher rates of chronic medical conditions, mental illness, substance abuse, cancer, traumatic brain injury, assault, and communicable disease. Certain specialties of clinicians are likely to encounter patients who are incarcerated, which makes it important for clinicians to understand how medical decision-making may differ when the patient is a prisoner. The corrections system retains (...) custody of inmates and is responsible for their welfare, including facilitating necessary medical care. However, this does not permit corrections personnel or a warden to automatically assume the role of the patient's medical decision-maker. Except for narrow exceptions, prisoners do not lose their rights to medical decision-making. In some instances, corrections staff or the prison warden have improperly asserted authority to act as the patient's medical decision-maker, such as when the patient lacks decision-making capacity. This violates ethical principles of bodily integrity, respect, and fairness. This paper provides an overview of medical decision-making for incarcerated patients, how surrogate decision-maker hierarchies apply to incarcerated patients without decision-making capacity, and special considerations for this subset of patients. Therefore we can either discard it as generally irrelevant for the understanding of the cultural functions of texts, or use it as a point of departure for the formulation of both general and basic aspects of such functions. The position taken in this essay will opt for (...) the last possibility, although I know full well that already the term "metafiction" itself inevitably triggers a variety of skeptical reactions. Does it not just refer to some author's self-centered ruminations in the ivory tower? Or a topic for the nerds of literary studies with a taste for theoretical acrobatics? If so, in both cases following metafictional inclinations results in complete isolation from both the context of literature and its readers.However, one may also adopt the opposite position. The metafictional features of literature constitute one of the means by which literature reaches out to its context and also engages its readers. And critical endeavors are not necessarily devoid of anything but their own concepts. They may instead pave the way for methodological and didactic considerations that ultimately make difficult literature more accessible as a cultural phenomenon. Rather than dwelling upon subtle theoretical differences in the definition of what metafiction is, I will therefore engage in a methodological approach: what kind of questions can we put to the texts, and what kind of answers can we reasonably come up with when using metafiction in a methodological and didactic framework?I shall begin by proposing a set of definitions broader than metafiction that will allow me to zoom in on it as a relevant methodological concept that opens for didactic reflections. The notion of metalevel will constitute my starting point. In its broadest sense, a metalevel indicates a position outside a given field of objects or meanings and in relation to it. This is the role of, for example, the theory of science or of epistemology in relation to the particular knowledge of various sciences. We may call it an epistemological metalevel.In a more restricted sense, a metalevel comprises a level in relation to a given sign system — rather than to a given field of objects — from which we can observe and evaluate the basic principles defining the function, range and validity of the sign system. This is the role of, for example, musicology in relationto the acoustic arts, art criticism in relation to the visual arts, medicine in relation to bodily symptoms. We may call it an inter-semiotic metalevel.Finally, in its most restricted sense, a metalevel points toward a level inside a given sign system from which we can refer to this sign system itself,but not in relation to a given field of objects or in relation to another sign system. The paper places the trendy notion of virtuality and virtual reality in a conceptual and historical context that makes it useful in a semiotic perspective. Virtuality is connected with the classical notion of fictionality, in its meaning of both invention and deception. Historically an active, a passive, and a neutral version of the concept can be distinguished. The notion is reinterpreted as a variant of the semiotic processes of deixis. In relation to nature - scenarios, prognoses, hypotheses, etc. - virtuality (...) is seen as a means of anchoring the human subject in nature instead of constructing a nonreal universe separated from it. The power of algorithms has become a familiar topic in society, media, and the social sciences. It is increasingly common to argue that, for instance, algorithms automate inequality, that they are biased black boxes that reproduce racism, or that they control our money and information. Implicit in many of these discussions is that algorithms are permeated with normativities, and that these normativities shape society. The aim of this editorial is double: First, it contributes to a more nuanced discussion about algorithms (...) by discussing how we, as social scientists, think about algorithms in relation to five theoretical ideal types. For instance, what does it mean to go under the hood of the algorithm and what does it mean to stay above it? Second, it introduces the contributions to this special theme by situating them in relation to these five ideal types. By doing this, the editorial aims to contribute to an increased analytical awareness of how algorithms are theorized in society and culture. The articles in the special theme deal with algorithms in different settings, ranging from farming, schools, and self-tracking to AIDS, nuclear power plants, and surveillance. The contributions thus explore, both theoretically and empirically, different settings where algorithms are intertwined with normativities. (shrink)

Change can be difficult to achieve, and system inertia may be considered relevant. There is a tendency for dynamic systems to enter into specific states characterized by stabilizing factors. The present work attempts to define inertia processes and explores these with regard to pro-environmental behaviour and decision-making. Inertia processes can be considered both within an organizational context and from the level of the individual, and may involve a number of psychological processes and aspects of the decision-making process. Criminal offenders may be offered to participate in voluntary rehabilitation programs aiming at correcting undesirable behaviour, as a condition of early release. Behavioural treatment may include direct intervention into the central nervous system (CNS). This article discusses under which circumstances voluntary rehabilitation by CNS intervention is justified. It is argued that although the context of voluntary rehabilitation is a coercive circumstance, consent may still be effective, in the sense that it can meet formal criteria for informed consent. Further, for a (...) consent to be normatively valid (“take the wronging out of the act”) under a coercive circumstance, the subject to be treated must (1) have the sovereign authority to consent, and (2) the offer-giver must be in the right normative position to make the offer. While I argue that subjects do have the sovereign authority to consent to treatment, I also argue that inappropriate offers yield invalid consents. Considerations on inappropriate offers should therefore inform which kinds of CNS intervention-based rehabilitation schemes the state may propose as part of the criminal justice system. Yet as I conclude in this paper, while there are some intrinsic constraints on voluntary rehabilitation programs, the main constraints on voluntary rehabilitation are likely to be contingent overriders. However, CNS intervention is not ruled out as such in the context of voluntary rehabilitation. (shrink)

This paper seeks to expand our understanding of initial trust by looking at how variation in risk influences the nature of trust and the process of initial trust formation. Four hypotheses were tested in two experiments involving participants with and without work experience. A first hypothesis suggested a positive relationship between a general propensity to trust and initial trust; a second hypothesis, a negative relationship between risk and initial trust; whereas a third hypothesis posited that risk would increase the importance (...) participants place on benevolence and integrity. A fourth hypothesis suggested that risk would have a positive and moderating influence on the effect of out-of-role behavior when presented after role-conformant in-role behavior. Revisionists claim that the retributive intuitions informing our responsibility-attributing practices are unwarranted under determinism, not only because they are false, but because if we are all victims of causal luck, it is unfair to treat one another as if we are deserving of moral and legal sanctions. One revisionist strategy recommends a deflationary concept of moral responsibility, and that we justify punishment in consequentialist rather than retributive terms. Another revisionist strategy recommends that we eliminate all concepts of guilt, blame and (...) punishment, and treat dangerous criminals as we treat people with contagious diseases. I argue against both strong and moderate revisionism that it is not unfair to hold persons desert -entailingly responsible insofar as they take an interest in being treated as appraisable, and that it is unfair to persons not to treat them as desert -entailingly responsible contrary to their interests in being treated as such. The interest-based argument, I conclude, give us a justification for communicating retributive attitudes, but may still require a weak revision of our retributive practices, in the direction of a communicative theory of punishment. The similarities between virtuality and play are obvious, beginning with, for instance, the ubiquitous character of both. This paper deals with how insights from research on play can be used to enlighten our understanding of the ethical dimensions of activities in cyberspace, and vice versa. In particular, a central claim that play is beyond vice and virtue is debated and contested.

Recent debates in psychopathy studies have articulated concerns about false-positives in assessment and research sampling. These are pressing concerns for research progress, since scientific quality depends on sample quality, that is, if we wish to study psychopathy we must be certain that the individuals we study are, in fact, psychopaths. Thus, if conventional assessment tools yield substantial false-positives, this would explain why central research is laden with discrepancies and nonreplicable findings. This paper draws on moral psychology in order to develop (...) tentative theory-driven exclusion criteria applicable in research sampling. Implementing standardized procedures to discriminate between research participants has the potential to yield more homogenous and discrete samples, a vital prerequisite for research progress in etiology, epidemiology, and treatment strategies. Trust has a great potential for furthering our understanding of organizational change and learning. This potential however remains largely untapped. It is argued that two reasons as for why this potential remains unrealized are: (i) A narrow conceptualization of change as implementation and (ii) an emphasis on direct and aggregated effects of individual trust to the exclusion of other effects. It is further suggested that our understanding of the effects of trust on organizational change, should benefit from including effects of (...) trust on the formulation stage. It should also benefit from exploring the structuring effects of trust in organizations. Throughout this chapter, ways to extend current research on trust in organizations are suggested. The chapter also provides examples of relevant contributions where available. In order to capture organizational effects of trust, it is suggested that trust should be studied over longer time intervals, and include several referents of trust, spanning both horizontal and vertical relationships in the organization. What is the connection between dispositions and ethics? Some might think very little and those who are interested in dispositions tend to be metaphysicians whose interests are far from value. However, we argue in this paper that dispositions and dispositionality are central to ethics, indeed a precondition. Ethics rests on a number of notions that are either dispositional in nature or involve real dispositions or powers at work. We argue for a dispositional account of value that offers an alternative to (...) the traditional fact-value dichotomy. We explain the place of value within a structure that explains the possibility of ethics. Elsewhere in this structure, we argue that moral responsibility is a precondition for ethics and that it is a dispositional notion depending critically on what Mumford and Anjum have called the dispositional modality. Moral responsibility in turn depends on there being both agency and normativity. We argue that intentionality and agency are preconditions for agency and that value is a precondition of normativity. All these notions are dispositional and make best sense if there are real dispositions or causal powers of agents. (shrink)

The notion of quality features prominently in contemporary discourse. Numerous ratings, rankings, metrics, auditing, accreditation, benchmarking, smileys, reviews, and international comparisons are all used regularly to capture quality. This book paves the way in exploring the socio-political implications of evaluative statements, with a specific focus on the contribution of the concept of quality to these processes. One can (for the most part) formulate a model of a classical system in either the Lagrangian or the Hamiltonian framework. Though it is often thought that those two formulations are equivalent in all important ways, this is not true: the underlying geometrical structures one uses to formulate each theory are not isomorphic. This raises the question of whether one of the two is a more natural framework for the representation of classical systems. In the event, the answer is yes: (...) I state and sketch proofs of two technical results—inspired by simple physical arguments about the generic properties of classical systems—to the effect that, in a precise sense, classical systems evince exactly the geometric structure Lagrangian mechanics provides for the representation of systems, and none provided by Hamiltonian. The argument not only clarifies the conceptual structure of the two systems of mechanics, but also their relations to each other and their respective mechanisms for representing physical systems. It also shows why naïvely structural approaches to the representational content of physical theories cannot work. According to the received opinion there is a theoretical incompatibility between Herbert Hart'sThe Concept of Lawand Alf Ross'sOn Law and Justice, and, according to the received opinion, it stems above all from Hart's emphasis on the internal point of view. The present paper argues that this reading is mistaken.The Concept of Lawdoes not go beyondOn Law and Justicein so far as both present arguments to the effect that law is based on a shared understanding between participants in a project perceived (...) by every participant to be a project in common. The paper demonstrates that there are substantive parallels between Hart's combination of “acceptance” or “acknowledgement” and a “critical reflective attitude” and Ross's combination of “motivation” or “feeling” and a “coherent whole of meaning and motivation.” The main conclusion is that the views of norms and normativity put forward inThe Concept of LawandOn Law and Justiceare very close in essential respects, and, more specifically, that the two works are at root identical in their representation of the basis of normativity in reality.
