Depuis 70 ans, les avocats peuvent créer des structures d’exercice pour exercer en commun la profession d’avocats. Depuis 1990, la grande innovation réside dans la possibilité pour les avocats de structurer leur activité au moyen de sociétés commerciales particulières, les sociétés d’exercice libéral (SEL), dont l’objectif est la préservation de l’indépendance et de la déontologie des professionnels qui exercent en son sein. En 2015, les avocats sont autorisés à avoir recours aux sociétés commerciales de droit commun (SA, (...) SAS, SARL), sauf celles qui confèrent à leur associé la qualité de commerçant (SNC et SCA). Ce dispositif vient d’être réformé par la très récente ordonnance no 2023-77 du 8 février 2023 qui soulève la difficile distinction entre les SEL et les sociétés de droit commun. L’étude de cette distinction met en lumière la caractéristique de ces sociétés, l’exercice en commun d’une profession libérale réglementée, dont le régime juridique est posé par des règles professionnelles d’ordre public. Le déplacement opéré par Vatican II dans la théologie des ministères oblige à repenser l’unité du sacrement de l’ordre et la diversité des trois ministères ordonnés. Des questions nouvelles se posent au sujet du diaconat et spécialement de la sacramentalité de ce ministère. Deux pistes sont à explorer: le diaconat comme participation à la plénitude sacramentelle de l’épiscopat et sa confirmation sacramentelle au Christ-Serviteur. L’article explore ces pistes à la lumière de la théologie de S. Thomas d’Aquin sur le caractère (...) sacramentel et sa finalité. En partant des tria munera qui ont conduit Vatican II à affirmer la sacramentalité de l’épiscopat, on peut mettre en valeur la spécificité du ministère diaconal : alors que la collégialité de l’épiscopat est immédiatement destinée à l’exercice conjoint des tria munera, la structure propre de l’ordo diaconal destine celui-ci à exercer l’un ou l’autre des tria munera au sein de l’Église locale. De là apparaît la plénitude « ministérielle » qui caractérise le diaconat au sein du sacrement de l’ordre. (shrink)

We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review (...) of what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

Le présent article est le fruit d’une recherche qualitative auprès de l’ensemble des acteurs concernés par le dispositif « Espace de rencontre » ( er ) en France. Ce dispositif tant judiciaire que répondant aux nouvelles aspirations sociales autour de la famille vient soutenir le lien parent-enfant dans le cadre de séparations conflictuelles ou en cas d’incapacité de l’un des parents d’accueillir son ou ses enfants. Cette recherche, conduite entre 2017 et 2020 au sein de douze structures, visait à (...) mieux appréhender les pratiques en er, à identifier tant l’intérêt que les limites du dispositif et à faire émerger de nouveaux questionnements sur le maintien des liens filiaux dans des situations complexes. Le vécu des parents, enfants et professionnels concernés y a été recueilli par des chercheurs issus des sciences humaines et sociales. Si cette mesure socio-judiciaire est bien admise par une majorité des usagers, la manière dont les enfants, eux, vivent les rencontres reste questionnante. (shrink)

When surveying recent philosophical work on the nature and status of collective intentionality and we-intentions, it is striking how much effort is spent on analysing the structure of joint action and on establishing whether or not the intention to, say, go for a walk or paint a house together is reducible to some form of I-intentionality. Much less work has been devoted to an analysis of shared affects and emotions. This is regrettable, not only because emotional sharing in all likelihood (...) is developmentally prior to and logically more basic than joint action, but also because it might constitute a way of being together with others, which we need to study if we wish to better understand the nature of the we. In the present contribution, my primary aim will be to offer an answer to the following question: does the we-experience, the experience of being part of a we, presuppose, precede, preserve, or abolish the difference between self- and other-experience? In pursuing this task, I will take a closer look at emotional sharing and draw on resources that are too frequently ignored in current social ontology, namely insights found in classical phenomenology and in contemporary research on social cognition. A wide-ranging study of the central concepts in epistemology - belief, truth and knowledge. Professor Armstrong offers a dispositional account of general beliefs and of knowledge of general propositions. Belief about particular matters of fact are described as structures in the mind of the believer which represent or 'map' reality, while general beliefs are dispositions to extend the 'map' or introduce casual relations between portions of the map according to general rules. 'Knowledge' denotes the reliability of such beliefs as (...) representations of reality. Within this framework Professor Armstrong offers a distinctive account of many of the main questions in general epistemology - the relations between beliefs and language, the notions of proposition, concept and idea, the analysis of truth, the varieties of knowledge, and the way in which beleifs and knowledge are supported by reasons. I have argued in other work that emotion, attentional functions, and executive functions are three interpenetrant global state variables, essentially differential slices of the consciousness pie. This paper will outline the columnar architecture and connectivities of the PAG (periaqueductal gray), its role in organizing prototype states of emotion, and the re-entry of PAG with the extended reticular thalamic activating system (“ERTAS”). At the end we will outline some potential implications of these connectivities for possible functional correlates of PAG networks that (...) are just starting to be mapped. Overall, we will look at many lines of evidence that PAG should be conceptualized as a peri-reticular structure that has a foundational role in emotion, in generating the meaningful organization of behavior by the brain through prototype emotional states, and in allowing the various emotional systems to globally influence and tune both the forebrain and brainstem. Finally, we address implications of these concepts for what is currently understood about consciousness, underlining the need for somewhat more humility within consciousness studies about our current level of understanding of consciousness in the brain, combined with a deeper appreciation of the intrinsic connections between emotion and consciousness. One hopes that more concerted empirical interest in structures underneath the thalamus, combined with a deeper appreciation for the fundamental role that organismic and social value must have in bootstrapping awareness in the developing brain, would begin more widely to influence the fundamental lines of neuroscientific research in both emotion studies and consciousness studies. Previous research suggests that children can infer causal relations from patterns of events. However, what appear to be cases of causal inference may simply reduce to children recognizing relevant associations among events, and responding based on those associations. To examine this claim, in Experiments 1 and 2, children were introduced to a “blicket detector,” a machine that lit up and played music when certain objects were placed upon it. Children observed patterns of contingency between objects and the machine's activation that (...) required them to use indirect evidence to make causal inferences. Critically, associative models either made no predictions, or made incorrect predictions about these inferences. In general, children were able to make these inferences, but some developmental differences between 3- and 4-year-olds were found. We suggest that children's causal inferences are not based on recognizing associations, but rather that children develop a mechanism for Bayesian structure learning. Experiment 3 explicitly tests a prediction of this account. Children were asked to make an inference about ambiguous data based on the base rate of certain events occurring. Four-year-olds, but not 3-year-olds were able to make this inference. (shrink)

The most compelling extant accounts of explanation casts all explanations as causal. Yet there are sciences, theoretical population biology in particular, that explain their phenomena by appeal to statistical, non-causal properties of ensembles. I develop a generalised account of explanation. An explanation serves two functions: metaphysical and cognitive. The metaphysical function is discharged by identifying a counterfactually robust invariance relation between explanans event and explanandum. The cognitive function is discharged by providing an appropriate description of this relation. I offer examples (...) of explanations from portfolio theory and population genetics that meet this characterisation. In each case the invariance relation holds between a statistical property of an ensemble and a change in structure of the ensemble. In neither case, however, does the statistical property cause the outcome it explains. There are genuine statistical, non-causal scientific explanations. (shrink)

This chapter offers a complete account of Aristotle’s underexplored treatment of the virtue of wittiness (eutrapelia) in Nicomachean Ethics IV.8. It addresses the following questions: (1) What, according to Aristotle, is this virtue and what is its structure? (2) How do Aristotle’s moral psychological views inform Aristotle’s account, and how might Aristotle’s discussions of other, more familiar virtues, enable us to understand wittiness better? In particular, what passions does the virtue of wittiness concern, and how might the virtue (and its (...) attendant vices) be related to the virtue of temperance (and its attendant vices)? (3) How does wittiness, as an ethical virtue, benefit its possessor? (4) How can Aristotle resolve some key tensions that his introducing a virtue of wittiness apparently generates for his ethics? In addition to exploring these questions, this chapter challenges some commonly accepted accounts of Aristotle’s views on the nature of the laughable. (shrink)

This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. This paper rigorously examines the primitive foundations of economic reasoning through a framework based on symbolic logic. Extending previous work, it formalizes economic conceptions (\(\mathbb{C}\)), symbols (\(s_i\)), and introduces a structured language (\(\mathcal{L_{\mathbb{C}}}\)) to define their formation and interpretation. Organized as a continuous chain of declarations and illustrations, the paper offers a concise, systematic approach to understanding the philosophy of economic reasoning through formal symbolic representations.

An appropriate kind of curved Hilbert space is developed in such a manner that it admits operators of $\mathcal{C}$ - and $\mathfrak{D}$ -differentiation, which are the analogues of the familiar covariant and D-differentiation available in a manifold. These tools are then employed to shed light on the space-time structure of Quantum Mechanics, from the points of view of the Feynman ‘path integral’ and of canonical quantisation. Aristote démonte les mécanismes du langage philosophique, aux confins de la linguistique et de la métaphysique. Il offre à cette occasion des développements fondateurs sur la formulation de la vérité, les règles de mise en contradiction, les propositions universelles, la contingence des jugements sur le futur, (...) ou encore les redoutables énonciations modales. S'appuyant sur ses prédécesseurs, Thomas d'Aquin en rédige un commentaire hautement structuré, reconnu comme l'un des plus explicites. Demeuré cependant inachevé, il est complété par Thomas de Vio, dit Cajetan, un des premiers grands thomistes et maître logicien. I briefly defend the philosophical cogency of inclusivism about human flourishing, the view that intrinsic goods are valuable for the sake of flourishing by somehow composing flourishing. In particular, I consider the stuctured inclusivist view that intrinsic goods are components of flourishing as body parts are components of a body. As a test case, I examine the conception of human flourishing offered by the early Confucian philosopher Mengzi (Mencius). I argue that by appealing to Mengzi’s account, one can respond to (...) worries (such as those of Richard Kraut) about how such a structured inclusivism could possibly make sense. (shrink)

In this article the structure of the models of decidable monadic theories of planar graphs is investigated. It is shown that if the monadic theory of a class K of planar graphs is decidable, then the tree-width in the sense of Robertson and Seymour of the elements of K is universally bounded and there is a class T of trees such that the monadic theory of K is interpretable in the monadic theory of T.

The variety of residuated lattices includes a vast proportion of the classes of algebras that are relevant for algebraic logic, e.g., \-groups, Heyting algebras, MV-algebras, or De Morgan monoids. Among the outliers, one counts orthomodular lattices and other varieties of quantum algebras. We suggest a common framework—pointed left-residuated \-groupoids—where residuated structures and quantum structures can all be accommodated. We investigate the lattice of subvarieties of pointed left-residuated \-groupoids, their ideals, and develop a theory of left nuclei. Finally, we (...) extend some parts of the theory of join-completions of residuated \-groupoids to the left-residuated case, giving a new proof of MacLaren’s theorem for orthomodular lattices. Revisiting African philosophy’s classic questions, D. A. Masolo advances understandings of what it means to be human—whether of African or other origin. Masolo reframes indigenous knowledge as diversity: How are we to understand the place and structure of consciousness? How does the everyday color the world we know? Where are the boundaries between self and other, universal and particular, and individual and community? From here, he takes a dramatic turn toward Africa’s current political situation and considers why individual rights and (...) freedoms have not been recognized, respected, demanded, or enforced. Masolo offers solutions for containing socially destructive conduct and antisocial tendencies by engaging community. There is consensus within the chemosciences that olfactory perception is of the molecular structure of chemical compounds, yet within philosophical theories of smell there is little agreement about the nature of smell. The paper critically assesses the current state of debate regarding smells within philosophy in the hopes of setting it upon firm scientific footing. The theories to be covered are: Naïve Realism, Hedonic Theories, Process Theory, Odor Theories, and non-Objectivist Theories. The aforementioned theories will be evaluated based on their (...) explanations of the (a) the olfactory quality of a smell, (b) smells as distal entities, and (c) our experience of smells as intentional objects. The paper concludes with a defense of Molecular Structure Theory that demonstrating its superiority in accounting for each of these three aspects of smell. (shrink)

Tools and technologies expand our capacities, including our cognitive capacities. Microscopes extend our perceptual capacities. Notebooks extend the natural limits of memory. These facts are important, for all that they are obvious. The extended cognition hypothesis wants more. Some external devices and processes are literal parts of cognitive processes themselves. When there is fast and reliable access to external data or processes, then the cognitive processes that occur uncontroversially inside the brain literally and controversially extend out into the world to (...) incorporate external structures or processes. Retrieval of an address from memory and retrieval of the same information from a notebook can both be fully cognitive processes involving fully cognitive representations. So say the proponents of extended cognition.It is an attractive metaphor. But is there any good reason to take it as literal truth? Central to Elements is an assay of the attributional union properties and relations have with their subjects, a topic historically left metaphorical. The work critiques eight Aristotelian assumptions concerning attribute dependence and ‘inherence’, per se subjects, attributes as agent-organizers, and unity-by-a-shared-one. Groups of these assumptions are seen to yield contradiction, vicious regress, or other problems. This analysis, joined with insights from an assay of ubiquitous structure, motivate ten theses explicating attribution and its primary ontic status. The theses detail: attributes proper (...) as individuated instances, structure as instance-generated facts and their two forms of composition, the conditioning role and universal nature of instances’ component intensions, the primacy of attribute instances for generating all forms of composition and complex entities, and identity and indiscernibility criteria for the latter. Principal is the insight that attribution is intension-determined combinatorial agency. It is its systematizing implications that provide solutions to classic problems, e.g., Composition, Individuation, and Universals, and in net generate a comprehensive one-category structuralist ontology. The view is advocated that to preserve a deductivist account of science against recent criticism, it is necessary to incorporate experimental error, or imprecision, in the deductive structure. The sources of imprecision in empirical variables are analyzed, and the notion of conceptual imprecision introduced and illustrated. This is then used to clarify the notion of the acceptable range of a functional law. It is further shown that imprecision may be ascribed to parameters in laws and theories without rendering the deductive (...) structure untestable. It is claimed that this analysis explicates the relation between laws and theories in a way that invalidates certain arguments against its deductive nature. (shrink)

We have seen through many examples that data science and artificial intelligence can reinforce structural inequalities like sexism and racism. Data is power, and that power is distributed unequally. This book offers a vision for a feminist data science that can challenge power and work towards justice. This book takes a stand against a world that benefits some (including the authors, two white women) at the expense of others. It seeks to provide concrete steps for data scientists seeking to learn (...) how feminism can help them work towards justice, and for feminists seeking to learn how their own work can carry over to the growing field of data science. It is addressed to professionals in all fields where data-driven decisions are being made, as well as to communities that want to better understand the data that surrounds them. It is written for everyone who seeks to better understand the charts and statistics that they encounter in their day-to-day lives, and for everyone who seeks to better communicate the significance of such charts and statistics to others. This is an example-driven book written with a broad audience of scholars, students, and practitioners in mind. It offers a way of thinking about data, both their uses and their limits, that is informed by direct experience, by a commitment to action, and by the ideas associated with intersectional feminist thought. This study examined the relationship between unethical employee behavior and the dimensions of the Ethical Climate Questionnaire (ECQ). In order to explore the relationship between the dimensions of the ECQ and unethical behavior, the factor structure of five previously identified empirical models and the hypothesized nine-dimension model for the ECQ was tested with a confirmatory factor analysis. The analysis revealed that the hypothesized nine-dimension model provided as good or even better fit to the data than the five empirically derived models. (...) Therefore, the nine-dimensional model was used to examine the criterion-related validity of the ECQ. The results demonstrated that the nine ethical climate dimensions were correlated with some of the unethical behaviors examined in this study, but not others. However, the results clearly demonstrated that most of the ethical climate dimensions were significantly related to an aggregate measure of unethical behavior. It was suggested that these results might account for the differences in previous studies on the criterion-related validity of the ECQ. The results also replicated a previous report that the association between unethical behavior and ethical climate is stronger in organizations that do not have a code of ethics. Finally, a difference was observed in the ethical climates for organizations with a code of ethics and organizations without a code of ethics. (shrink)

In four experiments using an artificial grammar learning procedure, the authors examined the links between the “classic” mere exposure effect [heightened affect for previously encountered stimulus items ] and the “structural” mere exposure effect [greater hedonic appreciation for novel stimuli that conform to an implicitly acquired underlying rule system ]. After learning, participants: classified stimuli according to whether they conformed to the principles of the grammar and, rated them in terms of how much they liked them. In some experiments unusual (...) and unfamiliar symbols were used to instantiate the AG, in others highly familiar characters were used. In all cases participants showed standard AG learning. However, whether the two exposure effects emerged was dependent on symbol familiarity. Symbols with high a priori familiarity produced a structural mere exposure effect. Moderately familiar symbols produced only the classic, but not the structural, mere exposure effect. Highly unfamiliar symbols produced neither exposure effect. Results are discussed in the context of implicit learning theory and implications for a general theory of aesthetics are presented. (shrink)
