In a recent comment on the HFEA’s public consultation on sex selection, Soren Holm claimed that proponents of family balancing are committed to embrace a laissez faire approach. Given that arguments in support of sex selection for family balancing also support sex selection for other social reasons, advocates of family balancing, he asserts, are simply inconsistent when calling for a limit on access to sex selection. In this paper, I argue that proponents of family balancing are in no way (...) inconsistent. Provided their advocacy of family balancing is aimed at preventing a severe distortion of the natural sex ratio, they are entirely justified in insisting on restrictions to sex selection. The real question is whether a concern for the sex ratio does indeed call for a limit on sex selection. Based on a recent survey on gender preferences and data from several Gender Clinics, I argue that a restriction on sex selection to family balancing is unwarranted. In the absence of any evidence for a pending sex ratio distortion, we are actually required to adopt a laissez faire approach to sex selection. (shrink)

In her paper, The case for physician assisted suicide: not proven, Bonnie Steinbock argues that the experience with Oregon’s Death with Dignity Act fails to demonstrate that the benefits of legalising physician assisted suicide outweigh its risks. Given that her verdict is based on a small number of highly controversial cases that will most likely occur under any regime of legally implemented safeguards, she renders it virtually impossible to prove the case for physician assisted suicide. In this brief paper, we (...) suggest some ways that may enable us to weigh the risks and benefits of legalisation more fairly and, hopefully, allow us to close the case for physician assisted suicide. Sharon Street vertritt einen Humeanischen Konstruktivismus in der Metaethik, nach dem die normativen Gründe einer Akteurin von dem System ihrer eigenen normativen Urteile abhängen. Ein normatives Urteil ist nach Street genau dann wahr, wenn es zu der ideal kohärenten Menge der normativen Urteile gehört, die die Akteurin im Überlegungsgleichgewicht hätte. In diesem Aufsatz wird die Frage diskutiert, wie diese Konzeption von Normativität mit einer Konzeption von Moral verbunden werden kann. Eine Möglichkeit hierfür besteht darin, an einer engen Verbindung von Normativität (...) und Moral festzuhalten. In diesem Fall muss die Wahrheit moralischer Sätze jedoch auf eine ähnliche Art als akteursrelativ verstanden werden, wie Street die Wahrheit normativer Sätze versteht. Eine zweite Möglichkeit besteht darin, an einem absolutistischen Verständnis moralischer Sätze festzuhalten. Dann wären nach Streets Konzeption von Normativität jedoch Fälle denkbar, in denen eine Akteurin keinen normativen Grund hat, moralisch zu handeln. Beide theoretische Optionen scheinen kontraintuitive Implikationen zu haben, die z.B. mit der Möglichkeit moralischen Tadels oder der Vorstellung der Kategorizität moralischer Sätze zusammenhängen. Aufbauend auf Überlegungen von Street, Bernard Williams und David Lewis wird jedoch dafür argumentiert, dass insbesondere die zweite der genannten Optionen nicht so sehr von einem herkömmlichen Moralverständnis abweicht, wie es zunächst erscheint. Over the course of the twentieth century, nationalistic approaches to the obstacles of racism in the United States have increasingly come to be seen as the more revolutionary of the various forms of anti-racist struggle. This paper explores several historical instances of Black Nationalism and seeks to demonstrate that, despite the many points on which they might diverge, they share in common a tendency to naturalize and embrace the category of race as a basis for political struggle, and that they (...) therefore constitute an ideologically accommodating and hence essentially regressive approach to the questions of race and racism. It is suggested that a critique of the modern category of race and a political practice aimed at its denaturalization will be a necessary aspect of any attempt to overcome racial oppression and inequality. At the heart of Paul Ricoeur’s hermeneutic phenomenology of religion one discovers a commitment to the diversity of religious expression. This commitment is grounded in his understanding of the linguistic and temporal conditions of religious phenomena. By exploring his contribution to the debate concerning the so-called ‘theological turn’ in French phenomenology in relation to his studies of translation, this essay explores Ricoeur’s understanding of religious phenomenality where meaning is experienced as the simultaneous advance and withdrawal of an originary event in (...) the traces of its interpretations. With such an understanding of religious phenomenality, the way is opened for philosophy of religion to advance a more robust consideration of religious diversity and, therefore, to reconsider notions of universality better suited to the things themselves. Deceased organ donation is widely considered as a case of easy rescue―that is, a case in which A may bestow considerable benefits on B while incurring negligent costs herself. Yet, the policy implications of this observation remain unclear. Drawing on Christopher H. Wellman’s samaritan account of political obligations, the paper develops a case for a so-called opt-out system, i.e., a scheme in which people are defaulted into being donors. Philosophy and science employ abstract hypothetical scenarios- thought experiments - to illustrate, defend, and dispute theoretical claims. Since thought experiments furnish no new empirical observations, the method prompts two epistemological questions: whether anything may be learnt from the merely hypothetical, and, if so, how. Various sceptical arguments against the use of thought experiments in philosophy are discussed and criticized. The thesis that thought experiments in science provide a priori knowledge through non-sensory grasping of abstract entities is discussed and rejected. The (...) thesis that thought experimentation consists in manipulations of mental models is examined and found to be of limited epistemological relevance. It is argued that thought experiments are associated with characteristic arguments in a manner similar to ordinary experiments. It is further argued that thought experiments function in the same way as experiments in general: by providing premises for their associated arguments. Like other experiments, a thought experiment is successful when the premises it provides are true. This holds both for philosophical and scientific thought experiments. An argument schema is proposed and shown to be a formal analogue to that associated with ordinary experiments; similar in being subject to epistemological holism; but differing in being modal: in employing statements about possibility and necessity. The evaluation of thought experiments thus depends on how modal statements may be justified. Intuition and conceivability are discussed as sources of modal justification and found problematic. Instead it is suggested that evaluation proceed by accommodation of the statements describing the experiment's hypothetical scenario. The method of accommodation is developed and applied to five influential thought experiments in philosophy: the brain in a vat; Putnam's Twin Earth; Burge's arthritis example; Searle's Chinese Room; and Newcomb's problem. Its application shows some of these to be failed, others to be successful only relative to controversial philosophical doctrines. (shrink)

The article examines the role of natural kinds in semantic theorizing, which has largely been conducted in isolation from relevant work in science, metaphysics, and philosophy of science. We argue that the Kripke–Putnam account of natural kind terms, despite recent claims to the contrary, depends on a certain metaphysics of natural kinds; that the metaphysics usually assumed—micro-essentialism—is untenable even in a ‘placeholder’ version; and that the currently popular homeostatic property cluster theory of natural kinds is correct only to an extent (...) that fails to vindicate the Kripke–Putnam account. Philosophical interest in thought experiments has grown over the last couple of decades. Several positions have emerged, defined largely by their differing responses to a perceived epistemological challenge: how do thought experiments yield justified belief revision, even in science, when they provide no new empirical data? Attitudes towards this supposed explanandum differ. Many philosophers accept that it poses a genuine puzzle and hence seek to provide a substantive explanation. Others reject or deflate the epistemic claims made for thought experiments.In this (...) paper I present a model for many thought experiments in philosophy and science. The model doesn't assume that thought experiments in fact manage to achieve epistemic justifi cation, but it allows us to see how they aspire to do so. The main topic of this essay is symbolic mathematics or the method of symbolic construction, which I trace to the end of the sixteenth century when Franciscus Vieta invented the algebraic symbolism and started to use the word ‘symbolic’ in the relevant, non-ontological sense. This approach has played an important role for many of the great inventions in modern mathematics such as the introduction of the decimal place-value system of numeration, Descartes’ analytic geometry, and Leibniz’s infinitesimal calculus. It was also (...) central for the rigorization movement in mathematics in the late nineteenth century, as well as for the mathematics of modern physics in the 20th century.However, the nature of symbolic mathematics has been concealed and confused due to the strong influence of the heritage from the Euclidean and Aristotelian traditions. This essay sheds some light on what has been concealed by approaching some of the crucial issues from a historical perspective. Furthermore, I argue that the conception of modern mathematics as symbolic mathematics was essential to Wittgenstein’s approach to the foundations and nature of mathematics. This connection between Wittgenstein’s thought and symbolic mathematics provides the resources for countering the still prevalent view that he defended an uttrely idiosyncratic conception, disconnected from the progress of serious science. Instead, his project can be seen as clarifying ideas that have been crucial to the development of mathematics since early modernity. (shrink)

Tocqueville pessimistically predicted that liberty and equality would be incompatible ideas. Robert Dahl, author of the classic _A Preface to Democratic Theory,_ explores this alleged conflict, particularly in modern American society where differences in ownership and control of corporate enterprises create inequalities in resources among Americans that in turn generate inequality among them as citizens. Arguing that Americans have misconceived the relation between democracy, private property, and the economic order, the author contends that we can achieve a society of (...) real democracy and political equality without sacrificing liberty by extending democratic principles into the economic order. Although enterprise control by workers violates many conventional political and ideological assumptions of corporate capitalism as well as of state socialism. Dahl presents an empirically informed and philosophically acute defense of "workplace democracy." He argues, in the light of experiences here and abroad, that an economic system of worker-owned and worker-controlled enterprises could provide a much better foundation for democracy, political equality, and liberty than does our present system of corporate capitalism. This article summarizes some of the results of the BIOMED II project “Basic Ethical Principles in European Bioethics and Biolaw” connected to a research project of the Danish Research Councils “Bioethics and Law”. The BIOMED project was based on cooperation between 22 partners in most EU countries. The aim of the project was to identify the ethical principles of respect for autonomy, dignity, integrity and vulnerability as four important ideas or values for a European bioethics and biolaw. The research concluded (...) that the basic ethical principles cannot be understood as universal everlasting ideas or transcendental truths but they rather function reflective guidelines and important values in European culture. The method of the research was conceptual, philosophical analysis of the cultural background of the four values or normative ideas that people use and find important in their existence. Moreover, this was combined with analysis of empirical legal material and policy documents. Also, a number of qualitative interviews with relevant experts were carried out. Another important result of the BIOMED project was the partner's Policy Proposals to the European Commission, the Barcelona Declaration, unique as a philosophical and political agreement between experts in bioethics and biolaw from many different countries. Two ways of characterizing natural kinds are currently popular: the Kripke-Putnam appeal to microstructure and Boyd’s appeal to causal homeostasis. I argue that these conceptions are more divergent than is often acknowledged, that they give no credence to essentialism, and that they are both faulty. In their place, I sketch an alternative view of natural kinds, which I call “bare projectibilism”. This conception avoids the appeal to explanation common to microstructuralism and the causal homeostasis view, but is still compatible with (...) scientific realism. (shrink)

In this paper, I discuss what the desiderata for a formal proposal are. Employing a comparison with general philosophy of science, I suggest that one important desideratum is to highlight recurrent patterns of disagreement surrounding cases. I advocate a proposal in propositional modal logic which, I argue, better meets this (...) desideratum than competing proposals. Häggqvist and Wikforss argued that in the case of so-called natural kind terms, semantic externalism relies on an untenable metaphysics of kinds: microessentialism. They further claimed that this metaphysics fails, for largely empirical reasons. Focussing on the case of water, Hoefer and Martí European Journal for the Philosophy of Science, 9, rejoin that suitably construed, microessentialism is correct. I argue that their defence of microessentialism fails.

Nearly all students believe academic cheating is wrong, yet few students say they would report witnessed acts of cheating. To explain this apparent tension, the present research examined college students’ reasoning about whether to report plagiarism or other forms of cheating. Study 1 examined students’ conflicts when deciding whether to report cheating. Most students gave reasons against reporting a peer (e.g., social and physical consequences, a lack of responsibility to report) as well as reasons in favor of reporting (e.g., concerns (...) about welfare, justice, and fairness). Study 2 provided experimental confirmation that the contextual factors referenced by Study 1 participants in fact influenced decisions about whether to report cheating. Overall, the findings indicate that students often decide against reporting peers’ acts of cheating, though not due to a lack of concern about integrity. Rather, students may refrain from reporting because of conflicting concerns, lack of information about school policy, and perceived better alternatives to reporting. (shrink)

Michael Della Rocca has recently argued that Kripkean essentialism is subtly self-defeating: to defend it, certain modal intuitions must be reconstrued in terms of similarity, but reconstruing them in this way threatens the principled rejection of similarity comparisons on which Kripke's essentialism depends. Della Rocca holds that Kripke's strategy must assume the necessity of identity, and that the necessity of identity already presupposes essentialism, which renders the defence circular. Against this, I argue that the necessity of identity may be accepted (...) independently; therefore no circularity need arise. I also argue that Della Rocca fails to rebut an objection raised by Stephen Yablo. (shrink)

This paper deals with Frege’s early critique of formalism in the philosophy of mathematics. Frege opposes meaningful arithmetic, according to which arithmetical formulas express a sense and arithmetical rules are grounded in the reference of the signs, to formal arithmetic, exemplified in particular by J. Thomae, whose “formal standpoint”, according to Frege, is that arithmetic should be understood as a manipulation of meaningless figures. However, Frege’s discussion of Thomae’s analogy between arithmetic and chess shows that Frege does not understand his (...) main point, which is that we must distinguish conceptually between statements about chess figures, and the chess pieces they represent. Indeed, Thomae’s fruitful use of this comparison undermines the ontological conception of arithmetic represented by Frege. The chess pieces do not go proxy for anything, but playing chess is not for that reason just manipulation of physical chess figures. This is also Wittgenstein’s point when he criticizes Frege for not seeing the “justified side of formalism”. Thomae’s formalism can be clarified by using the distinction between sign and symbol. Symbols are never meaningless or empty forms or signs, since they have a role or function in a symbolism, which one may call their meaning. The discussion of the chess analogy shows that Frege fails to see this operative aspect of the symbolism. We can conclude that the “formal standpoint” that Frege criticizes is his fabrication, rather than anything we can attribute to Thomae. (shrink)

In this article I argue for the continuity of Sartre's theory of alienation. Therefore, I will depict how the concept of 'alienation' is further developed by Sartre since his early writings, by discussing the different forms of alienation in his late oeuvre and in his works on moral philosophy. First, I will take up the differenciation of individual and social alienation and, furthermore, I will discuss Sartre's radicalized form of alienation, which is beyond pure forms of exploitation or recurrence and (...) was not discussed in the literature, yet. I will connect Sartres theory of value in his "L'Être et le Néant" with the theory of alienation in his "Cahiers pour une Moral" and the "Critique de la Raison dialectique". (shrink)

Background:Since the adoption of the Universal Declaration of Human Rights by the United Nations in 1948, human rights as set out in government documents have gradually changed, with more and more power being transferred to individual.Objectives:The aim of this article is to analyze how the position of the patient in need of care is constructed in Norway’s renamed and revised Patients’ and Service Users’ Rights Act (originally Patients’ Rights Act, 1999) and published comments which accompanying this legislation from the Norwegian (...) Ministry of Health and Care Service.Research design:A constructivist design was used, and Fairclough’s critical discourse approach was adopted to analyze the text of the Patients’ and Service Users’ Rights Act and comments.Findings:The analysis identified three discourses: (a) political discourse, containing ethical discourses about priority and economy, in which patients are constructed as powerless individuals; (b) expert discourse, containing a theme about patients’ trust in the healthcare team and its knowledge, in which patients are constructed as helpless individuals lacking knowledge; and (c) patient participation and patient autonomy discourse, containing ethical discourses about decision-making, in which patients are constructed not only as individuals with needs and rights but also as “troublesome.”Conclusion:Dominant paternalistic discourses in the legal text validate the power of medicine, the healthcare system, and heath personnel over the needs, rights, participation, and autonomy of the patient.
