Keine wissenschaftliche Debatte ist in den letzten Jahren mit soviel Vehemenz in der Öffentlichkeit ausgetragen worden, wie der Streit um die Willensfreiheit. Der traditionelle Begriff von "Willensfreiheit", der auch dem deutschen Strafrecht und seinem Schuldbegriff zugrundeliegt, setzt voraus, daß Menschen jenseits aller psychologischen und neurobiologischen Determinanten entscheiden und handeln können. Eine solche Konzeption von Willensfreiheit ist weder begrifflich-philosophisch noch empirisch akzeptabel. In diesem Buch entwickeln Gerhard Roth und Michael Pauen gemeinsam ein neues Konzept der Willensfreiheit. Grundlage ist ein "aufgeklärter Naturalismus", (...) der vorwissenschaftliche Phänomene, philosophische Begriffe und wissenschaftliche Methoden gleichermaßen ernst nimmt. Hieraus ergibt sich ein Verständnis von Freiheit, das die Fähigkeit zu selbstbestimmtem Handeln auf der Basis eigener Wünsche und Überzeugungen in den Mittelpunkt stellt. Roth und Pauen entgehen damit den Schwierigkeiten vieler traditioneller Konzeptionen, erfassen das Alltagsverständnis von Willensfreiheit und werden zugleich auch den Erkenntnissen der Neurobiologie gerecht. Ihr Konzept, so argumentieren die Autoren, macht zudem ein wesentlich differenzierteres Verständnis von Schuld und Verantwortung möglich, aus dem sich weitreichende Konsequenzen für das Strafrecht und den Strafvollzug ergeben. Die philosophische Rede von der Schuld umgreift ein breites Bedeutungsspektrum, von der Existenz- und Religionsphilosophie bis zur Ästhetik. Violence turns hope and expectation into guilt and shame. This publication discusses the outcome of a philosophical and artistic investigation into complex patterns of behaviour. Negative connotations and positive aspects of guilt and shame are connected convincingly to the artistic process which is used by the artist to produce new work. As a consequence, a different light is shed on the concepts of guilt and shame. In Abelards Kommentar zum Römerbrief erscheint das Handeln contra conscientiam als eines gegen das eigene Urteil über andere. Abelard bezieht sich hier vor allem auf eine frühere Stelle im selben Brief, wo Paulus schreibt, jeder werde nach dem Gesetz gerichtet, das er sich selbst gibt (Rom 2,1). Was wir an Anderen verur- teilen, erläutert er, stehe dadurch auch unserer eigenen conscientia entgegen, und nur ein Handeln gegen die conscientia sei Sünde. Damit wird die goldene Regel, auf die Abelard ad Rom (...) 2,15 verweist, zu dem Gebot, nach der eigenen Überzeugung zu handeln. So, wie wir tun sollen, was wir von Anderen erwarten, müssen wir auch einfach nur tun, was wir von uns selbst erwarten. Der enge Zusammenhang zwischen goldener Regel und dem Gebot, nach der eigenen conscientia zu handeln, beruht auf einer Einsicht in die Natur von Regeln und Handlungsgründen: Eine Regel, ebenso wie ein Grund oder eine Rechtfertigung, gilt nie allein für eine konkrete Handlung, sondern immer für eine Klasse von Handlungen. Da jeder, der sein Handeln allgemeinen Regeln unterwirft, diese auch Anderen nahelegt, unterliegt das eigene Handeln umgekehrt, was seine Rechtfertigung angeht, deren Urteil, so weit sich nämlich die allgemeinen Regeln darin niederschlagen. The aim of this paper is to reconstruct Kant’s theory of error in theoretical and practical terms, not only from a moral-psychological perspective, but also from the broader perspective of his transcendental philosophy. Kant’s theory of error will be interpreted as a central part of his transcendental philosophy, insofar as it is related to his doctrine of reason. For it is precisely Kant’s theory of dialectic as the »logic of appearance« that deals with the reasons that concern theoretical error as (...) well as moral misconduct and that traces theoretical and practical error back to a common root: the phenomenon of rational self-deception. This work undertakes an innovative analysis of the feelings of shame and guilt. These feelings do not merely involve self-critical judgment. Instead, they are a form of anxiety about loss of recognition. People who achieve recognition have authority, and such authority is not based solely on good arguments. As a consequence, we should question whether feelings of shame and guilt are truly reconcilable with the ideal of autonomy.

The subject ofthe essay is guilt and atonement and conciliation in theological, ethical andjuridical respect. Especially the author examines the relevance of a theological concept of atonement for the criminallaw and judgement.

Daran ist die Gesellschaft schuld: Der Titel dieses Bandes macht eine in der Moderne verbreitete Redeweise namhaft. Aus historischer Sicht erscheint sie allerdings keineswegs plausibel. Denn wie konnte es dazu kommen, dass in einer Kultur, die seit alters her die moralische Verantwortung des Einzelnen herausgestellt hat, die gesellschaftlichen Verhältnisse mit der Schuld für alle Missstände belastet werden? Dieser Frage geht das hier angezeigte Buch nach und sucht eine Antwort in den Prämissen der neutestamentarischen Nächstenliebe auf. Die von Rousseau (...) postulierte Belastung der Gesellschaft mit der Verantwortung für die Übel der Welt wird als das Ergebnis einer Säkularisierung der christlichen Ethik beschrieben, die sich vor allem in der Moralistik der Frühen Neuzeit vollzieht. Proceeding from the current discourse on guilt, blame, and debts this essay discusses three theoretical positions which trace the origin of guilt from debts or derive debts from guilt respectively. In a second step the author relates the corresponding proposals of Nietzsche, Heidegger and Levinas to specifically modern positions maintaining that we owe nothing to others or rather that we are indebted to others for almost everything. This essay tries to elaborate an accurate description of shame and guilt from the agent’s point of view by focusing on typical cases of such experiences. In a first step, we approach the peculiarity of a phenomenological investigation by introducing three methodical directions. All of them are formulated in a negative mode, i.e., in terms of prohibition, namely: the instruction not to adhere to a naïve notion of phenomenon, not to project reflective attitudes into the prereflectively given, and not to (...) go beyond the relevant situation of experience. Following these methodological considerations, we discuss the familiar characteristics of shame and guilt. According to a wide-spread view, we are faced with self-related feelings that are, more or less overwhelmingly, encountered as troublesome. These feelings either, in case of guilt, trigger special types of social interaction (avowal and reparation) or, in case of shame, entail isolation, an intensified self-perception and introspective embarrassment. Whether and to what extent this current picture can be sustained, will be discussed on phenomenological grounds. We take it that the social features of shame and guilt result from their inherent self-relatedness. Thereto, we try to answer, among others, the following questions: Do feelings of shame and guilt, apart from their social functions, represent characteristic modes of self-awareness? How are they correlated with specific modes of time-consciousness? Can a phenomenological description contribute to our understanding of the moral impact of shame and guilt? (shrink)

In what we might call its particularly Christian manifestation, “guilt” denotes the feeling or fact of having offended, the failure to uphold an ethical code. Under such terms, “guilt” connotes negative consequences: shame, punishment, and estrangement. Yet, penetrating further into its meaning and value, one finds that guilt extends beyond this narrow classification, playing a productive, necessary, and ineluctable role for recognitive sociality. This paper examines guilt as it appears in Hegel’s thinking. I find that Hegel’s understanding of Schuld (...) (guilt) in the Phenomenology , undergoes a crucial development over the course of the chapter titled, “Spirit,” culminating in a robust understanding of guilt that represents not a hopelessly broken bond, but a bond that awaits its fulfillment, its very incompleteness exerting a palpable pull upon the guilty party towards its fulfillment. I examine three key moments in “Spirit”: Hegel’s treatments of Antigone , the French Revolution, and the confession and forgiveness of evil. By comparing these moments, I distinguish between “abstract guilt,” guilt that only brings about shame and punishment, and what we might call “determinate guilt”: guilt that brings about action, reminds one of her/his indebtedness to the other. Understanding the development of guilt from the beginning to end of “Spirit” provides an entryway into a discussion of the social and political relevance of Hegel’s conception of the subject as—in a certain sense—always already guilty. I go on to argue that guilt as indebtedness and responsibility only exists as embedded within an already recognitive social structure. Re-thinking guilt as responsibility is not, therefore, a call to a new objective a priori moral system. Rather, it invites us to think through our recognitive being-together in a way that shakes off its metaphysical fetters. Such an ethics of recognitive intersubjectivity is an infinite task—not in the futile sense of the “unhappy consciousness”—but in the sense that we are responsible for constantly understanding, critiquing, and reforming ethical commitments that can only be (understood as) ours.
