This research note argues that political theorists of refuge ought to consider the experiences of refugees after they have received asylum in the Global North. Currently, much of the literature concerning the duties of states towards refugees implicitly adopts a blanket approach, rather than considering how varied identities may affect the remedies available to displaced people. Given the prevalence of racism, xenophobia, and homophobia in the Global North, and the growing norm of dissident persecution in foreign territory, protection is not (...) guaranteed after either territorial or legal admission. This research note considers the case of LGBTQ refugees in order to demonstrate the analytical potential of more inclusive and diverse normative approaches. Taking the origin and extension of harm seriously requires a conceptualization of sanctuary after asylum that accurately reflects the experiences of the displaced. In doing so, questions arise regarding the nature and efficacy of territorial asylum. (shrink)

Descartes is widely portrayed as the arch proponent of “the epistemological transparency of thought” (or simply, “Transparency”). The most promising version of this view—Transparency-through-Introspection—says that introspecting (i.e., inwardly attending to) a thought guarantees certain knowledge of that thought. But Descartes rejects this view and provides numerous counterexamples to it. I argue that, instead, Descartes’s theory of self-knowledge is just an application of his general theory of knowledge. According to his general theory, certain knowledge is acquired only through clear and distinct (...) intellection. Thus, in his view, certain knowledge of one’s thoughts is acquired only through clear and distinct intellection of one’s thoughts. Introspection is a form of intellection and it can be clear and distinct. Ordinarily, however, introspection isn’t clear and distinct but is instead confused with dubitable perceptions of bodies. To make introspection clear and distinct, we need to “sharply separate” it from all perceptions of bodies by doubting all perceptions of bodies. Without such radical doubt, introspection remains confused and we lack certain knowledge not just of the specific features of our thoughts, but even of the minimal claim that a thought exists. Far from being the high priest of Transparency, Descartes is radically opposed to it. (shrink)

Recent work on the hole argument in general relativity by Weatherall has drawn attention to the neglected concept of models’ representational capacities. I argue for several theses about the structure of these capacities, including that they should be understood not as many-to-one relations from models to the world, but in general as many-to-many relations constrained by the models’ isomorphisms. I then compare these ideas with a recent argument by Belot for the claim that some isometries “generate new possibilities” in general (...) relativity. Philosophical orthodoxy, by contrast, denies this. Properly understanding the role of representational capacities, I argue, reveals how Belot’s rejection of orthodoxy does not go far enough, and makes better sense of our practices in theorizing about spacetime. Most democratic theorists agree that concentrations of wealth and power tend to distort the functioning of democracy and ought to be countered wherever possible. Deliberative democrats are no exception: though not its only potential value, the capacity of deliberation to ‘neutralise power’ is often regarded as ‘fundamental’ to deliberative theory. Power may be neutralised, according to many deliberative democrats, if citizens can be induced to commit more fully to the deliberative resolution of common problems. If they do, they will be (...) unable to get away with inconsistencies and bad or private reasons, thereby mitigating the illegitimate influence of power. I argue, however, that the means by which power inflects political disagreement is far more subtle than this model suggests and cannot be countered so simply. As a wealth of recent research in political psychology demonstrates, human beings persistently exhibit ‘motivated reasoning’, meaning that even when we are sincerely committed to the deliberative resolution of common problems, and even when we are exposed to the same reasons and evidence, we still disagree strongly about what ‘fair cooperation’ entails. Motivated reasoning can be counteracted, but only under exceptional circumstances such as those that enable modern science, which cannot be reliably replicated in our society at large. My analysis suggests that in democratic politics – which rules out the kind of anti-democratic practices available to scientists – we should not expect deliberation to reliably neutralise power. The Resource-Based View (RBV) has been instrumental in shaping strategic management theory by underscoring the significance of a firm's unique, valuable, and hard-to-copy internal resources in securing competitive advantage. However, the conventional RBV framework, with its emphasis on static, possession-oriented resource conceptualization, falls short in addressing the dynamic and relational nature of resources in contemporary business environments. This paper aims to bridge this gap by introducing a processual perspective to the RBV, grounded in process philosophy. In this study, we delve (...) into the philosophical underpinnings of RBV, critiquing its static ontological assumptions and proposing a shift towards a more dynamic and relational ontology. Drawing from the insights of process philosophers such as Whitehead and Bergson, and differentiating between 'strong' and 'weak' process views, we reconceptualize resources not as static entities, but as dynamic elements continually constituted and reconstituted within networks of relationships and ongoing organizational processes. This approach allows for a more nuanced understanding of resources, recognizing their evolutionary and interconnected nature. Our methodology involves a rigorous theoretical analysis and synthesis of existing RBV literature, coupled with philosophical inquiry to construct a novel framework for resource conceptualization. We demonstrate how this reconceptualization offers fresh insights into strategic management, particularly in formulating strategies that leverage the dynamic interplay of resources and in understanding the boundary between internal and external resources. This paper contributes to the RBV literature by offering a process-oriented perspective that aligns more closely with the complexities of modern strategic landscapes. By challenging and extending traditional RBV assumptions, we pave the way for future empirical research and theoretical development in strategic management, highlighting the significance of process philosophy in enriching management theories. Abstract: Contemporary analytic philosophers of the “reactive attitudes” tend to share a simple conception of guilt as “self-directed blame”—roughly, an “unpleasant affect” felt in combination with, or in response to, the thought that one has violated a moral requirement, evinced substandard “quality of will,” or is blameworthy. I believe that this simple conception is inadequate. As an alternative, I offer my own theory of guilt’s logic and its connection to morality. In doing so, I attempt to articulate guilt’s defining thought (...) or proposition through an extended investigation and analysis of guilt’s many competing metaphors, which I trace from the Hebrew Bible to the New Testament to Shakespeare to contemporary vernacular. My interpretation of this literary genealogy offers a way to understand guilt’s seemingly disparate metaphors in terms of a single master-image that illuminates our self-conceptions and our relationship to morality. I conclude by making a very brief start toward a moral vindication of guilt against the backdrop of Nietzschean and Freudian analyses that explicitly call guilt’s place in a healthy social and personal life into question. I suggest that once guilt’s logic is made explicit, we can see that it makes sense of, honors, and addresses some of our deepest aspirations and needs. (shrink)

I provide an analysis of sentences of the form ‘To be F is to be G’ in terms of exact truth-maker semantics—an approach that identifies the meanings of sentences with the states of the world directly responsible for their truth-values. Roughly, I argue that these sentences hold just in case that which makes something F is that which makes it G. This approach is hyperintensional, and possesses desirable logical and modal features. These sentences are reflexive, transitive and symmetric, and, if (...) they are true, then they are necessarily true, and it is necessary that all and only Fs are Gs. I close by defining an asymmetric and irreflexive notion of analysis in terms of the reflexive and symmetric one. (shrink)

This book examines three issues: the principle of ought implies can ; the principle of alternate possibilities ; and Kant’s views on the duty to promote one’s own happiness. It argues that although Kant was wrong to deny such a duty, the part of his denial that rests on a conception of duty incorporating both OIC and PAP is sound.

Samuel Pufendorf is one of the most important moral and political philosophers of the seventeenth century. His theory, which builds on Grotius and Hobbes, was immediately recognized as a classic and taken up by writers as diverse as Locke, Hume, Rousseau, and Smith. Over the past twenty years there has been a renaissance of Pufendorf scholarship. On the Duty of Man and Citizen is Pufendorf's own epitome of his monumental On the Law of Nature and of Nations, and it (...) served as a basic text in European universities throughout the Enlightenment. This edition has a lucid and historically sensitive translation by Michael Silverthorne, the first since the early twentieth century. James Tully's introduction sets the text in its context, summarizes the main arguments, surveys recent literature on Pufendorf, and shows how Pufendorf transformed natural law theory into an independent discipline of juristic political philosophy that dominated reflection on politics until Kant. In the course of this response, the paper discusses the nature of scientific and metaphysical explanation, the aim of science and the structure of modal space.

This book examines the evidential status and use of linguistic intuitions, a topic that has seen increased interest in recent years. Linguists use native speakers' intuitions - such as whether or not an utterance sounds acceptable - as evidence for theories about language, but this approach is not uncontroversial. The two parts of this volume draw on the most recent work in both philosophy and linguistics to explore the two major issues at the heart of the debate. Chapters in the (...) first part address the 'justification question', critically analysing and evaluating the theoretical rationale for the evidential use of linguistic intuitions. The second part discusses recent developments in the domain of experimental syntax, focusing on the question of whether formal and systematic models of gathering intuitions are epistemically and methodologically superior to the informal methods that have traditionally been used. -/- The volume provides valuable insights into whether and how linguistic intuitions can be used in theorizing about language, and will be of interest to graduate students and researchers in linguistics, philosophy, and cognitive science. This article is a critique of Thaddeus Metz’s modal relational approach to moral status in African ethics. According to moral relationalism, a being has moral status if it exhibits the capacity for communal relationship as either a subject or an object. While Metz defends a prima facie plausibility of MR as an African account of moral status, this article provides a fresh perspective to the debate on moral status in environmental and ethical discourse. It raises two objections against MR: the (...) capability criterion inherent in MR is not only exogenous to African thought but also undermines the viability of MR; and MR cannot account for the standing of species populations. Both objections have severe implications for biodiversity conservation efforts in Africa and beyond. (shrink)

This essay is a critical notice of David Dyzenhaus's book, The Long Arc of Legality. I argue that Dyzenhaus’s criterion for distinguishing legal pathologies that undermine law's contractarian claim to legitimacy and political pathologies that do not is unsustainable. It relies on a categorical distinction between the threat to law's legitimacy posed by treating some subjects as de jure second-class citizens, whose formal legal status is compromised, and other threats to political legitimacy grounded in the treatment of some subjects as (...) de facto second-class citizens, who retain full formal legal equality but suffer from thoroughgoing substantive subordination. But some forms of de facto second-class citizenship are a greater threat to contractarian legitimacy than some forms of full formal equality. So formal equality for subjects and legal legitimacy come apart. I consider and respond to several responses on Dyzenhaus's behalf, and conclude by proposing a version of his jurisprudential theory that relaxes this distinction. (shrink)

When Kuhn first published his _Structure of Scientific Revolutions_ he was accused of promoting an “irrationalist” account of science. Although it has since been argued that this charge is unfair in one aspect or another, the early criticism still exerts an influence on our understanding of Kuhn. In particular, normal science is often characterized as dogmatic and uncritical, even by commentators sympathetic to Kuhn. I argue not only that there is no textual evidence for this view but also that normal (...) science is much better understood as being based on _epistemically justified_ commitment to a paradigm and as _pragmatic_ in its handling of anomalies. I also argue that normal science is an example of what I call Kuhn’s program of _revisionary rational reconstruction_. (shrink)

I have two main goals in this paper. The first is to argue for the thesis that Kant gave up on his highest good argument for the existence of God around 1800. The second is to revive a dialogue about this thesis that died out in the 1960s. The paper is divided into three sections. In the first, I reconstruct Kant’s highest good argument. In the second, I turn to the post-1800 convolutes of Kant’s Opus postumum to discuss his repeated (...) claim that there is only one way to argue for the existence of God, a way which resembles the highest good argument only in taking the moral law as its starting point. It was not until the emergence, in the 19th century, of new technical devices – such as the telegraph and the phonograph – that the term medius came to serve as a collective noun (media) for advanced communication technologies. Although mediation is extensively theorized in philosophy and sociology, and is approached by medium theory and media studies, the concept remains undertheorized in the field of communication theory.By exploring the problem of mediation and by challenging its representationalist and transmissive accounts, this (...) paper posits mediation beyond the medium. It traces mediation as a relational principle which can be best understood as modulation involving inherent translation, inflection and movement. Mediation is not a simple transportation of meaning through a passive intermediary. It is not just something which stands or comes between things otherwise separated or opposed. Mediation is neither a middle-thing linking separate entities, nor do things get mediated: They are already forms of mediation. From Plato’s contempt for “the madness of the multitude” to Kant’s lament for “the great unthinking mass,” the history of Western thought is riddled with disdain for ordinary collective life. But it was not until Kierkegaard developed the term chatter that this disdain began to focus on the ordinary communicative practices that sustain this form of human togetherness. The Chattering Mind explores the intellectual tradition inaugurated by Kierkegaard’s work, tracing the conceptual history of everyday talk from his formative account of (...) chatter to Heidegger’s recuperative discussion of “idle talk” to Lacan’s culminating treatment of “empty speech”—and ultimately into our digital present, where small talk on various social media platforms now yields big data for tech-savvy entrepreneurs. In this sense, The Chattering Mind is less a history of ideas than a book in search of a usable past. It is a study of how the modern world became anxious about everyday talk, figured in terms of the intellectual elites who piqued this anxiety, and written with an eye toward recent dilemmas of digital communication and culture. By explaining how a quintessentially unproblematic form of human communication became a communication problem in itself, McCormick shows how its conceptual history is essential to our understanding of media and communication today. O estudo consiste na discussão da perspectiva larrosiana do conceito de experiência, a partir do livro Tremores. Partiu da pergunta: O conceito de experiência como acontecimento fundamenta a necessidade de uma nova língua educacional? O método tratou de pesquisa bibliográfica que teve o início na revisão de literatura sobre o tema, análise sistemática do livro Tremores, da mesma forma que problematização em torno do conceito de acontecimento em Martin Heidegger e de experiência em Walter Benjamin. Como resultado, o conceito de (...) experiência se expressa como raridade e deve ser pensado como acontecimento capaz de trazer novos sentidos. Para Larrosa, pensar novos sentidos é pensar novas realidades, tendo como base os sentidos gerados pelos mecanismos de subjetivação que existem em cada indivíduo. Sendo o sentido individual e subjetivo, é responsável por mostrar a cada indivíduo uma forma de experiência. Assim, a aposta diz respeito à necessidade de se repensar as linguagens, das quais emergem o mundo de cada indivíduo, e, além disso, de pensar a pedagogia como transformadora do que já existe por meio da linguagem. A linguagem possibilita a compreensão de si e do outro, em uma realidade abstrata que se perdeu das palavras e se distanciou da verdadeira experiência e do mundo real, enquanto acontecimento. Por derradeiro, o estudo demonstrou a necessidade de uma nova língua para a educação em Jorge Larrosa, como necessidade de fortalecimento da potência que habita entre aqueles que escutam e aqueles que falam, dos que não desejam colocar fim à identidade do sujeito, destruí-la, mas dar possibilidades para que a identidade se abra a novas significações, a fim de construir o acontecimento, a abertura e o conhecimento. This book argues that analytical legal naturalism, which avoids the arbitrary principles associated with legal positivism and the odd properties associated with natural law, is a superior alternative for solving hard legal cases, where no close precedent arises or where conflicting precedents seem relevant.

In this essay I consider the question of whether Elliot D. Cohen has justified sufficiently the metaphysical basis for his Logic-Based Therapy as presented in his paper on “The Metaphysics of Logic-Based Therapy (IJPP, this issue). Although Cohen discusses four different foundations of his cognitive theory, I focus only on one. It is the most important basis of his theory, viz., that human beings logically deduce the cognitive-behavior com­ponents of their emotions from premises. First, I question Cohen’s analysis of the (...) emotion rules we use to deduce evaluations of actions from. Second, I challenge Cohen’s view that we deduce our evaluations from emotion rules. Although I do not think my challenges completely undermine Cohen’s theory, they do raise serious concerns for a theory faced with a preponderance of causal therapies. (shrink)

In this paper, I address human-induced environmental ills we face using an ubuntu-inspired ethical lens. I follow ubuntu scholars to stress the significance for moral agents to embody virtues. Virtue development is essential to carry out obligations and address human impacts on the environment. Thaddeus Metz, in particular, has drawn attention to how embodying ubuntu virtues of humility and friendliness can prompt moral agents to be other-regarding. The view I developed in this paper differs from his ubuntu-inspired account in at (...) least two significant ways. First, humans cannot be in harmonious relationships with some species such as Black Mambas, Hyenas and sea urchins even if they can interact. Second, we must acknowledge the consequentialist dimension of ubuntu ethics and prioritise the different aspects of ubuntu ‘mixed’ ethics, ranking them to offer possibilities for a more realistic recommendation to change our moral life. This paper demonstrates that the three dimensions of ubuntu ‘mixed’ ethics are fundamental because we need to think about moral consequences, right action and our virtue in accounting for our actions. Recently, Horsman et al. have proposed a new framework, Abstraction/Representation theory, for understanding and evaluating claims about unconventional or non-standard computation. Among its attractive features, the theory in particular implies a novel account of what is means to be a computer. After expounding on this account, I compare it with other accounts of concrete computation, finding that it does not quite fit in the standard categorization: while it is most similar to some semantic accounts, it is not itself a semantic (...) account. Then I evaluate it according to the six desiderata for accounts of concrete computation proposed by Piccinini. Finding that it does not clearly satisfy some of them, I propose a modification, which I call Agential AR theory, that does, yielding an account that could be a serious competitor to other leading account of concrete computation. Proponents of the “negative program” in experimental philosophy have argued that judgements in philosophical cases, also known as case judgements, are unreliable and that the method of cases should be either strongly constrained or even abandoned. Here we put one of the main proponent’s account of why philosophical cases may cause the unreliability of case judgements to the test. We conducted our test with thought experiments from physics, which exhibit the exact same supposedly “disturbing characteristics” of philosophical cases.

In the Laws, Plato argues that the legislator should attempt to persuade people to voluntarily obey the laws. This persuasion is accomplished through use of legislative preludes. Preludes (also called preambles) are short arguments written into the legal code, which precede laws and give reasons to follow them. In this paper, I argue that Plato’s use of persuasive preludes shows that he endorses the core features of a public reason theory of political justification. Many philosophers argue that Plato’s political philosophy (...) is deeply at odds with contemporary liberal political philosophy. While Plato certainly does not affirm (and even rejects) some of the main features of liberalism, if it could be shown that he endorses some account of public reason (which is a liberal idea to its core), this would suggest that there is more in common between Plato and liberalism than many philosophers think. Furthermore, if combined with the work of philosophers, like C.C.W. Taylor, this could form a cumulative case against those who argue that there is little in common between Plato’s political philosophy and liberalism. In short, by showing that Plato endorses the core features of public reason, I endeavor to show that there is more in common between Plato and liberalism than is often thought. (shrink)

Two families of positions dominate debates over a metaphysically reductive analysis of knowledge. Traditionalism holds that knowledge has a complete, uniquely identifying analysis, while knowledge-first epistemology contends that knowledge is primitive—admitting of no reductive analysis whatsoever. Drawing on recent work in metaphysics, I argue that these alternatives fail to exhaust the available possibilities. Knowledge may have a merely partial analysis: a real definition that distinguishes it from some, but not all other things. Since the classical period, Jewish scholars have drawn on developments in philosophy to enrich our understanding of Judaism. This methodology reached its pinnacle in the medieval period with figures like Maimonides and continued into the modern period with the likes of Rosenzweig. The explosion of Anglo-American/analytic philosophy in the twentieth century means that there is now a host of material, largely unexplored by Jewish philosophy, with which to explore, analyze, and develop the Jewish tradition. We can clarify a certain difficulty with regard to the phrase ‘the best and most perfect virtue’ in Aristotle’s definition of the human good in Nicomachean Ethics I 7 if we make use of two related distinctions: Donnellan’s attributive–referential distinction and Kripke’s distinction between speaker’s reference and semantic reference. I suggest that Aristotle is using the phrase ‘the best and most perfect virtue’ attributively, not referentially, and further that even though the phrase may refer to a specific virtue (semantic reference), (...) An investigation of public support for coastal adaptation options and public finance options in Florida evaluated stakeholder judgments and how they changed through a participatory engagement process. The study found that public finance mechanisms that imposed fiscal burdens on those who directly benefit from hazard reduction were rated as more acceptable than others. Significantly, visualisations and data on local economic damage and return on investment of potential adaptation options further increased acceptability ratings. The question of whether a development fee for (...) adaptation or any other public purpose supported by private funds is a legal issue that depends on a test called the rational nexus. One concern of this article is to explore options for such fees to cover adaptation to climate change. This raises issues about the potential conflict with the community-wide and intergenerational nature of long-term adaptation. We also explore the relevance of environmental attitudes using the 'new environmental paradigm' (NEP) scale and political party affiliation. Results have implications for infrastructure improvements that require public approval for financing. (shrink)

Relative essentialism, the view that multiple objects about which there are distinct de re modal truths can occupy the same space at the same time, is a metaphysical view that dissolves a number of metaphysical issues. The present essay constructs and defends relative essentialism and argues that it is implicit in some of the ideas of W. V. Quine and Donald Davidson. Davidson’s published views about individuation and sameness can accommodate the common-sense insights about change and persistence of Aristotle and (...) Kripke. Aristotle and Kripke have to give up unmediated direct reference resting on a unique correct articulation of reality into entities. Davidson has to acknowledge a distinction between descriptions giving accidental and those giving essential features of an object. Quine and Davidson were in a position to be a relative essentialist, but were over-impressed by supervenience. The relative essentialist view of beings developed from Quine and Davidson strongly suggests the Heideggerian distinction between beings and Being, and is the perspective from which analytic philosophy can engage that topic. Relative essentialism also connects analytic philosophy to Derrida’s thinking about differance. (shrink)
