The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of law. The (...) reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. This article shows how sixteenth- and seventeenth-century arguments about historical evidence and elite humanist traditions of textual criticism and historical method evolved into the secular political theory of the eighteenth century. It shows how the French crown sponsored scholars who worked on empirical, source-based history as a tool for political prudence, but as this critical historical methodology became public, the crown realized it could be used against its interests, as in the case of the Affaire de Thou. In the (...) mid-seventeenth century, Colbert sought to suppress the old royal humanist historical tradition; however a number of political critics such as Amelot de La Houssaye and Pierre Bayle worked to publicize the tools of historical, political criticism, setting the stage for Enlightenment critics of absolutism such as Durey de Meinières and ultimately Montesquieu and Gibbon. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. It is important for the materialist historian, in the most rigorous way possible, to differentiate the construction of a historical state of affairs from what one customarily calls its "reconstruction." The "reconstruction" in empathy is one- dimensional. "Construction" presupposes "destruction." Almost fourteen years after the death of Jacques Derrida, the least one can say is that his inheritance is as contested and fraught with rivalries, rejections, and appropriations as at the time of the flowering of Deconstruction in American universities in (...) the seventies and eighties. A halt was observed in 1988-89 after the posthumous revelations about Paul de Man's past in Belgium and Derrida's embattled defense of his friend. Today, in France, one often hears that "Derrida a fait l'Ecole mais n'a pas fait ecole," meaning that Derrida passed the entrance examination of the prestigious Ecole Normale Superieure where he taught for a long time, where he met Paul Celan, Louis Althusser, Michel Foucault and many other luminaries, whereas he never had a real "school" in France-no real institutional backing beyond the various Parisian places at which he taught later, or those that he founded like the College de Philosophie; his following constituted of young philosophers, only a few of whom became university professors in their turn and disseminated his teachings. However, the mechanisms of power within the French university remained closed to Derrida until the end; besides, he wanted to prevent the stereotyped reproduction currently observed from master to disciple. The debate about secularization in recent decades has challenged long-held assumptions about Western modernity and the purported decline of religion in modern societies. However, the impact of this criticism on the idea of history has so far not received as much attention as it deserves. Jayne Svenungsson’s analysis of the influence of biblical motives on contemporary political theology illustrates one way in which the concept of history might be rethought in the wake of the crisis of the secularization (...) thesis. In dialogue with Karl Löwith’s classical argument that modern philosophy of history and the idea of historical progress are secularized versions of Christian eschatology, she argues that the prophetic vision of history as a struggle for a justice that supersedes every current law or moral system is a viable and promising alternative that ought to be considered in contemporary discussions of politics and history. Svenungsson’s analysis thus amounts to what one might call a postsecular challenge to a secular historical discourse. (shrink)

Scholars often turn to Livy’s famous digression on Aulus Cossus and the spolia opima (4.17–20) to shed light on his larger political inclinations. These readings generally regard Livy as either an Augustan (or at least a patriotic Roman) or an apolitical skeptic. Yet neither view, I argue, fully explains the Cossus affair. What is needed is an interpretation that recognizes the political nature of the Cossus digression and its skepticism toward Augustus. Attending to Livy’s rhetorical strategy in the digression allows (...) us to see it as an instance of oblique criticism of Augustus and his control over Roman life. The explanatory power of this reading extends to episodes from the life of Romulus as well. I argue Livy uses these stories to make a theoretical argument about the nature of despotism, namely, that it seeks to control narratives of the past just as much as it aims for political domination. The present article tries to show the originality of Lukács’s theory of Actuality (Wirklichkeit) by comparing it with the same notion in Hegel’s Logic. It results that Lukács’s interpretation of Marxism and the Russian Revolution depends on a clear and independent theoretical position with regard to Hegel and his Idealistic theory of Modality. Particular importance is given to the new conception of the Dialectical interplay between the notions of Objective Possibility and Historical Necessity.

Many years ago Degas said "Il faut décourager les arts." I am far from agreeing, but I am ready to say that critics of a certain kind are in need of active discouragement. Too much is written about matters that should be taken in by the beholder as he hears or scans the work. It is not desirable that his conscious mind should entertain - or be prepared to entertain - clear statements of what he experiences under the spell of (...) a masterpiece. The very reason why art is finer when it shows rather than tells is that comprehension is then immediate, not discursive. Ideally, the spectator must absorb - in order to be absorbed; and this means that the critic should shut up until he is wanted. We have no need of a study of "Punctuality in Thomas Hardy." I am making up the subject, but everybody can think of dozens of comparable works of pseudo-scholarship and pseudo-criticism. The article focuses on an analysis of Hart Crane’s essay “Note on the Paintings of David Siqueiros.” One of Crane’s few art-historical texts, the critical piece in question is first of all a tribute to the American poet’s friend, the Mexican painter David Siqueiros. The author of a portrait of Crane, Siqueiros is a major artist, one of the leading figures that marked the history of Mexican painting in the first half of the twentieth century. While it is interesting (...) to delve into the way Crane approaches painting in general and Siqueiros’ œuvre in particular, an analysis of the essay with which the present article is concerned is also worthwhile for another reason. Like many examples of art criticism—and literary criticism, for that matter—”Note on the Paintings of David Siqueiros” reveals a lot not only about the artist it revolves around, but also about its author, an artist in his own right. In a text written in the last year of his life, Hart Crane therefore voices concerns which have preoccupied him as a poet and which, more importantly, are central to modernist art and literature. This essay brings psychoanalytic theory on trauma together with film and television criticism on rape narrative in an analysis of Michael Coel’s 2020 series I May Destroy You. Beyond the limited carceral framework of the police procedural, which dislocates the act of violence from the survivor’s history and context, Coel’s polyvalent, looping narrative metabolizes rape television’s forms and genres in order to stage and restage both trauma and genre again and anew. Contesting common conceptions of vulnerability and susceptibility that (...) prefigure a violent breach of autonomy, Coel’s series and her interviews about it invite an ethics of looking that embraces a curiosity in the unknowable and untreatable kernel of subjective experience and defies and resists a policing of the survivor’s thoughts and emotions. By emphasizing and exploring what psychoanalysis calls the “afterwardness” of trauma, Coel foregrounds her main character’s subjectivity prior to her victimization, widens the sphere of consequence beyond the victim and criminal justice system to the survivor’s larger community, and entreats that community to preserve a space for her to look and look again at everything, without judgment. Having accepted the invitation to write a regular column about art from Elizabeth Pochoda, then the literary editor of The Nation magazine, Arthur Danto wrote a lot of criticism. Danto wrests himself free of the history of art criticism when, in writing about recent predecessors, he claims that their critical approaches must be understood as artifacts of their historical time. The lack of an autonomous history of art criticism, one that would make current practice intelligible in terms of (...) its own history, should puzzle us. Many other genres of criticism plainly have histories that shape their current practice in terms both of subject and method. While I liked his style, the vocabulary seemed awkward. His finite idealism confused me. I had problems with his ontology, and his tendency towards historicism seemed odd. I even wrote an essay critical of The Midworld (New York: W. W. Norton, 1982), though I never made an aggressive effort to publish it. [End Page 289]This is a good thing, because I would have regretted publishing that essay. I say this because both Michael J. McGandy's The Active Life: Miller's Metaphysics of Democracy, and the new edited collection of Miller's writings entitled The Task of Criticism, do an excellent job of revealing the contemporary significance of Miller's work. Collectively, they have convinced this skeptic that the midworld and its ontology of functioning objects are an important contribution to contemporary American philosophy.The Task of Criticism faces several challenges. First, George P. Brockway supervised the publication of five volumes of Miller's collected works, and Fell himself edited a 1990 volume on Miller's philosophy (The Philosophy of John William Miller, Lewisburg: Bucknell University Press), followed by Stephen Tyman's Decrying the Ideal (Carbondale: Southern Illinois University Press, 1993). Colapietro published Fateful Shapes of Human Freedom: John William Miller and the Crises of Modernity (Nashville: Vanderbilt University Press) in 2003. Do we really need another volume? Second, Miller's brand of idealism is not very fashionable these days. Is there any hope that pragmatic idealism can inform contemporary social theory, and make a contribution to the very real and concrete problems faced by modern democratic institutions?I believe that the answer to both of these questions is "yes." Recognizing the importance of previous volumes devoted to Miller's philosophy, the editors present The Task of Criticism as the first comprehensive introduction to Miller's philosophy, and it attempts to cut a middle ground between a complete collection of essays and a "best of" anthology. The editors want to provide a framework for understanding Miller's philosophy, and in this attempt they succeed admirably.Why? Because the editors have provided a structure for Miller's thought that was lacking in earlier collections, and by focusing on the issues of philosophical method, historiography, and community, they have provided a framework for understanding Miller's philosophy. Criticism of the Soviet Union post 1956, together with the increasing prominence of anti-colonial struggles and a series of experiences that would find their condensation in 1968, pushed Sartre to a continuous rearticulation of his political ideas, on the basis of an intense confrontation with Marx. This article analyses Valla’s historiographical stance in the light of his dialectical assumptions about possibility, verisimilitude, and truth. I argue that, at variance with most humanists, Valla believed that historical truth should satisfy the requirements of logical necessity, being therefore incompatible with verisimilar reconstructions of past events. However, Valla also realized that a critical method of assessment grounded in verisimilitude was indispensable to the analysis of doubtful accounts and traditions. In order to explore these matters, Valla developed a genre distinct (...) from history proper and closer to the forensic, inquisitorial tradition. While history had to deal with necessary truths, the aim of ‘historical inquisitio’ was to draw probable conclusions from pieces of conjectural evidence. According to Valla’s dialectical principles, these conclusions were not absolutely true but could be considered true thanks to the notion of intellectual acumen, which allowed Valla to take a leap from the field of possibility or verisimilitude to that of truth and necessity. Nikolai Lossky is key to the history of the Husserl-Rezeption in Russia. He was the first to publish a review of the Russian translation of Husserl’s first volume of the Logische Untersuchungen that appeared in 1909. He also published a presentation and criticism of Husserl’s transcendental idealism in 1939. An English translation of both of Lossky’s publications is offered in this volume for the first time. The present paper, which is intended as an introduction to these documents, situates Lossky (...) within the Rezeptionsgeschichte of Husserl in Russia and explains why he is central to it. It also explains what Lossky principally found in Husserl: he saw in the latter’s critique of psychologism support for his own ontology, epistemology, and axiology. Lossky characterizes his ontology as an ideal-realism. According to ideal-realism, both the realm of ideal beings and the realm of real beings are mind-independent. Per his epistemology, which he calls “intuitivism,” real beings are intuited by sensual intuition and ideal beings by intellectual intuition. The realm of ideal beings includes the subrealm of values, which is intuited by axiological intuition. This thoroughly realist conception contrasted sharply with the subjectivist tendencies of the time. So, when Lossky took cognizance of Husserl’s critique of psychologism, he thereupon found an ally in his battle against the various subjectivisms. But, when Husserl took the transcendental idealist turn, Lossky was at the forefront of the backlash against the new direction Husserl wanted to give to phenomenology. (shrink)

The focus of this essay will be on Freud, although my approach is informed by certain aspects of “post-Freudian” analysis. In the works of Freud, however, history in the ordinary sense often seems lost in the shuffle between ontogeny and phylogeny. When Freud, in the latter part of his life, turned to cultural history, he was primarily concerned with showing how the evolution of civilization on a macrological level might be understood through—or even seen as an enactment of—psychoanalytic (...) principles and processes. And he openly acknowledged the speculative nature of his inquiry into prehistory, “archaic” society, and their putative relation to the civilizing process.One might nonetheless argue that throughout Freud’s work there are theoretical bases and fruitful leads for a more delimited investigation of specific historical processes for which documentation is, to a greater or lesser extent, available. This kind of investigation is, moreover, required to test the pertinence of Freud’s speculative and at times quasi-mythological initiatives. At present one can perhaps do little more than tentatively suggest how such an investigation might proceed and the sorts of issues it might conceivably illuminate. For its elaboration has been relatively underdeveloped in the research of those who looks to Freud for guidance. The philosophy of “presence” seeks to challenge current understandings of meaning and understanding. One can trace its origins back to Vico, Dilthey, and Heidegger, though its more immediate exponents include Jean-Luc Nancy, Hans Ulrich Gumbrecht, and such contemporary philosophers of history as Frank Ankersmit and Eelco Runia. The theoretical paradigm of presence conveys how the past is literally with us in the present in significant and material ways: Things we cannot touch nonetheless touch us. This makes presence a post-linguistic (...) or post-discursive theory that challenges current understandings of “meaning” and “interpretation.” Presence provides an overview of the concept and surveys both its weaknesses and its possible uses. In this book, Ethan Kleinberg and Ranjan Ghosh bring together an interdisciplinary group of contributors to explore the possibilities and limitations of presence from a variety of perspectives—history, sociology, literature, cultural theory, media studies, photography, memory, and political theory. The book features critical engagements with the presence paradigm within intellectual history, literary criticism, and the philosophy of history. In three original case studies, presence illuminates the relationships among photography, the past, memory, and the Other. There are a large number of different models of history acceleration. This article discusses the models proposed by S. P. Kapitsa, S. V. Tsirel and A. D. Panov. They are based on the prerequisites of a synergetic methodology, the concepts of Big History and singularity, as well as the interpretation of the acceleration of history as a consistent reduction in the duration of significant historical epochs. In order to explore these matters, Valla developed a genre distinct (...) from history proper and closer to the forensic, inquisitorial tradition. While history had to deal with necessary truths, the aim of ‘historical inquisitio’ was to draw probable conclusions from pieces of conjectural evidence. According to Valla’s dialectical principles, these conclusions were not absolutely true but could be considered true thanks to the notion of intellectual acumen, which allowed Valla to take a leap from the field of possibility or verisimilitude to that of truth and necessity. The volume gathers eleven studies on the intellectual exchanges during the Middle Ages among the three cultures which existed side by side in the same geographical area, i.e. the vast space from the British Isles to the Sahara Desert, and from the Douro Valley to the Hindu Kush. These three cultures – who may not be reduced to their confession or ethnicity – are historically related to each other in many respects, both material (trade, wars, marriages) and immaterial (the interdependence (...) among their religious narratives and their philosophical speculations). The studies herein presented focus on some peculiar examples of the transcultural interactions among exponents of the Arabic, Hebrew and Latin philosophical and theological traditions. While we do not want to downplay the fundamental role of the religious contexts, our focus on the linguistic denominations of these cultures aims at drawing attention to the conceptual medium, or rather media, which underlined and shaped the interactions and interplays among these traditions – interplays that were characterized by the contact of these three languages being used by people of different religious beliefs in their quest for knowledge: Spanish Jews writing in Arabic, Jews collaborating in the translation of Arabic texts into Latin through the vernacular, Western Muslims whose writings were read mainly by Jews and Christians in Hebrew and Latin.
