Informed consent may be unobtainable in online contexts. This article examines the difficulties of obtaining informed consent online through a Facebook case study. It is proposed that there are at least two ways informed consent could be waived in research: first, if the data are public, and second, if the data are textual. Accordingly, the publicness of the Facebook News Feed is considered. Taking account of the wide availability of Facebook users’ data, and reflecting on how public those users perceive (...) their information to be, this paper argues that some Facebook data are properly viewed as public to semi-public in nature. A second issue is whether the Facebook News Feed data collection ought to be classified as document-based or human subjects research. Since the Facebook News Feed involves social interaction that may elicit ‘ethically important moments’, this paper proposes that observing it may constitute human subjects research. While informed consent is desirable for human subjects research, it is suggested that Facebook News Feed observations are comparable to observational research in a public space, and thus waiving informed consent in this online setting could be justifiable. Lara Buchak sets out a new account of rational decision-making in the face of risk. She argues that the orthodox view is too narrow, and suggests an alternative, more permissive theory: one that allows individuals to pay attention to the worst-case or best-case scenario, and vindicates the ordinary decision-maker.

In Education Sciences, the notion of ‘competence’ is widely used, both as an aim to be reached with students and as performance in teachers’ education. This article advances a type of competence that is highly relevant for teachers’ work, namely the ‘ethical competence.’ Ethical competence enables teachers to responsibly deal with the daily challenges arising from their professional roles. In this study, I put forward a definition of ethical competence and I propose a conceptual structure, both meant to support the (...) illustration, description, and development of ethical competence for teachers. Drawing on a corpus of reader comments posted to the news reports about the “Colectiv” fire on the Gândul daily website, this article investigates how “the void signifier” People is disputed between ideological and mythical thought in a moment of political and societal crisis. The comments were made by readers to a series of 578 news reports and editorials. Our study aims to inquire whether the figure of the People keeps its resourcefulness in an online conversational discourse regime. Particularly, we (...) are interested in the way common people devise themselves as the People by mobilizing a specific political mythology established by both lay and religious tradition, and recently, by an utopian approach to empowering technological revolutions. The transfer of power between the theological concept of God and the secular concept of People is analyzed in a cultural and linguistic frame: 1. the Romanian Orthodox tradition and the modern developments of the Byzantine concept symphonia ; 2. the semantic and syntactic specificities of the Romanian language within online media. As shown by the analysis, the static, passive and dynamic renditions of Popor [People] pertain to a narrative of political transcendence. (shrink)

This essay argues that when setting climate policy, we should place more weight on worse possible consequences of a policy, while still placing some weight on better possible consequences. The argument proceeds by elucidating the range of attitudes people can take towards risk, how we must make choices for people when we don’t know their risk-attitudes, and the situation we are in with respect to climate policy and the consequences for future people. The result is an alternative to the Precautionary (...) Principle, an alternative that gives similar policy recommendations in many cases but is also sensitive to the costs of precautions. (shrink)

A natural view in distributive ethics is that everyone's interests matter, but the interests of the relatively worse off matter more than the interests of the relatively better off. I provide a new argument for this view. The argument takes as its starting point the proposal, due to Harsanyi and Rawls, that facts about distributive ethics are discerned from individual preferences in the "original position." I draw on recent work in decision theory, along with an intuitive principle about risk-taking, to (...) derive the view. (shrink)

Although the Internet is frequently referred to as a global public resource, its functioning remains predominantly controlled by private actors. The Internet brought about significant shifts in the way we conceptualize governance. In particular, the handling of “big data” by private intermediaries has a direct impact on routine practices and personal lives. The implementation of the “right to be forgotten” following the May 2014 decision of the Court of Justice of the European Union against Google blurs the boundaries between the (...) public and the private, and extends the responsibilities of the latter to court-style decision making. This article analyzes the regulatory developments in this area and the implications of outsourcing of important governance practices to private intermediaries. It looks at the decision-making process for the “right to be forgotten” to illustrate the extent to which the hybridization of such procedures results in new arrangements between public and private ordering in Internet governance. There are currently two robust traditions in philosophy dealing with doxastic attitudes: the tradition that is concerned primarily with all-or-nothing belief, and the tradition that is concerned primarily with degree of belief or credence. This paper concerns the relationship between belief and credence for a rational agent, and is directed at those who may have hoped that the notion of belief can either be reduced to credence or eliminated altogether when characterizing the norms governing ideally rational agents. It presents a (...) puzzle which lends support to two theses. First, that there is no formal reduction of a rational agent’s beliefs to her credences, because belief and credence are each responsive to different features of a body of evidence. Second, that if our traditional understanding of our practices of holding each other responsible is correct, then belief has a distinctive role to play, even for ideally rational agents, that cannot be played by credence. The question of which avenues remain for the credence-only theorist is considered. (shrink)

In this book, Lara Ostaric argues that Kant’s seminal Critique of Judgment is properly understood as completing his Critical system. The two seemingly disparate halves of the text are unified under this larger project insofar as both aesthetic and teleological judgment indirectly exhibit the final end of reason, the Ideas of the highest good and the postulates, as if obtaining in nature. She relates Kant’s discussion of aesthetic and teleological judgment to important yet under-explored concepts in his philosophy, and (...) helps the reader to recognize the relevance of his aesthetics and teleology for our understanding of fine arts and genius, the possibility of pure judgments of ugliness, Kant’s philosophy of history, his philosophy of religion, and his conception of autonomy. Ostaric’s novel and thoroughly integrative presentation of Kant’s system will be of interest not only to Kant scholars but also to those working in religious studies, art history, political theory, and intellectual history. A positive reconceptualization of vulnerability involves a number of levels of inquiry; arguably, a fundamental or, at least, central level is the phenomenology of vulnerability with which I am concerned in my paper. By drawing on existential phenomenology and by engaging with Pamela Sue Anderson’s positive account of vulnerability, I develop a phenomenological conception of vulnerability as “openness” and pursue it in new directions which connect it to the metaphysics and epistemology of vulnerability. This approach brings to the fore the (...) possibility of resilience in the face of serious adversities which affect our lives, and draws some ethical implications in relation to this. I engage with recent work in the area of the phenomenology of illness to elaborate certain parts of the investigation. (shrink)

The paper addresses two related questions: 1. the much debated issue concerning philosophy's proper way of engaging with religion, and 2. the extent to which religious concerns belong to our existence. If philosophy is understood as the hermeneutics of existence, that is, as the self-interpretation of existence, as the early Heidegger proposes, then the way the second question is answered bears on the approach to the first issue. While endorsing Heidegger's claim in the 1920s that philosophy should be autonomous and (...) neutral in relation to religious concerns, I reject his view that this can be achieved through a silencing attitude characteristic of a “fundamentally atheistic” philosophy. I link Heidegger's failure to offer a convincing response to the first question to the way in which he addresses the second question as to whether religious concerns essentially belong to our existence. In contrast with his views on the second question, which often seem to propose a negative answer to it (but which, I claim, are not as not as clear as it is sometimes assumed), I argue that spiritual comportment is an essential aspect of our life. How can then philosophy ‘transcend’ it and be religiously neutral without becoming silent about it? I argue that philosophy can be religiously neutral and, at the same time, speak about spirituality as an open question within a shared space. (shrink)

According to some views, natural language suffers from underdeterminacy, but thought doesn’t. According to the underdeterminacy claim, sentence types underdetermine the truth-conditions of sentence tokens. In particular, the semantics of a predicate type seems to underdetermine the satisfaction conditions of its tokens. By contrast, mental representation-types are supposed to determine the truth-conditions of its tokens. In this paper I critically examine these mixed views. First, I argue that the arguments supporting the indispensability of including in one’s theory mental representations that (...) are free of the underdeterminacy exhibited by natural language are not sound. As a result, the possibility that mental representation-types are as underdetermined as natural language sentence-types has not been ruled out. Second, I argue that Carston’s ad hoc concept-types are as underdetermined as word-types. I finish by arguing that mental representations are also underdetermined in a second sense—mental representation-tokens only determine a partial function from possible worlds to truth-values. Certain ethical views hold that we should pay more attention, even exclusive attention, to the worst-case scenario. Prominent examples include Rawls's Difference Principle and the Precautionary Principle. These views can be anchored in formal principles of decision theory, in two different ways. On the one hand, they can rely on ambiguity-aversion: the idea that we cannot assign sharp probabilities to various scenarios, and that if we cannot assign sharp probabilities, we should decide pessimistically, as if the probabilities are unfavorable. On (...) the other hand, they can rely on risk-avoidance: the idea that we should pay more attention to worse scenarios, even when we can assign sharp probabilities. I distinguish these two foundations. I also show how they can be modified to support versions of these views that pay more but not exclusive attention to worst-case scenarios. Finally, I argue that risk-avoidance provides a superior foundation than ambiguity-aversion for the Difference Principle and the Precautionary Principle; in particular, it correctly identifies which ethical facts should matter to those who champion these principles. The present paper is an attempt at examining the value configuration and the socio-demographical profiles of the local political elites in four countries of East-Central Europe: Romania, the Czech Republic, Bulgaria, and Poland. The treatment is a comparative one, predominantly descriptive and exploratory, and employs, as a research method, the case-study, being a quite circumscribed endeavor. The cases focus on the members of the Municipal/Local Council in four towns similar in terms of demography and developmental strategies (i.e. small-to-medium sized communities (...) of around 35,000 inhabitants, with economies largely based on food industry and commercial activities): Tecuci (Galați county, Romania), Česká Lípa (Liberec region, Czech Republic), Targovishte (Targovishte province, Bulgaria), and Oleśnica (Lower Silesia province, Poland). Hypothesizing that the local elites of the former Sovietized Erurope tend to differ in outlook, priorities, and value attainment, as compared to their Western counterparts, the paper considers the former’s attitudes and perspectives in regard to seven values: a series of values customarily connected with the concept of ‘democracy’ (i.e. citizen participation, political conflict, gradual change, economic equality), state intervention in economy, decentralization and increased local autonomy, cultural-geographical self-identification. The study uses, as well, five models of value attainment in what concerns the ‘ideal portrait’ of the local councilor (Putnam 1976): ethical, pragmatic, technocratic, political, and gender. According to the results of a study applying a standard written questionnaire among the local councilors of the three communities in the period December 2010-February 2013, the paper distinguishes among three corresponding types of local elites: (1) ‘predominantly elitistic,’ (2) ‘democratic elitist,’ and (3) ‘predominantly democratic,’ following two types of explanation accounting for the differences among the four cases: the legacy of the defunct regime and the degree of administrative decentralization. Introduction: Agricultural workers perform intense labor outside in direct sunlight and in humid environmental conditions exposing them to a high risk of heat-related illness (HRI). To implement effective cooling interventions in occupational settings, it is important to consider workers’ perceptions. To date, an analysis of agricultural workers’ experience and perception of cooling devices used in the field while working has not been published. -/- Methods: Qualitatively data from 61 agricultural workers provided details of their perceptions and experiences with cooling interventions. (...) -/- Results: The participants in the bandana group reported the bandana was practical to use at work and did not interfere with their work routine. Cooling vest group participants agreed that the vest was effective at cooling them, but the practicality of using the vest at work was met with mixed reviews. -/- Conclusion: The findings of this qualitative study support and extend existing research regarding personal cooling and heat prevention research interventions with vulnerable occupational groups. Personal cooling gear was well received and utilized by the agricultural workers. Sustainable heat prevention studies and governmental protection strategies for occupational heat stress are urgently needed to reduce the risk of heat-related morbidity, mortality, and projected climate change health impacts on outdoor workers. Anne Phillips argues that definitions of the human are a trap for the political claims to equality contained in humanitarianism or human rights discourse. However, defining the human also hides the ontological and political problem addressed by the Philosophical Anthropology. There is an ethical and political stake in the philosophical anthropology of the last century when it insists on the indefinability of the human. With this, it criticizes the politics implicit in the definition of the human. And also, it questions (...) the metaphysical positions that the act of defining implies. -/- //// La lógica de inclusión/exclusión presente en toda definición de lo humano no solo es una trampa para las reivindicaciones políticas de la igualdad contenidas en el humanitarismo o el discurso de los derechos humanos, como ha argumentado Anne Phillips, sino que también oblitera la problemática ontológica contenida en la pregunta fundamental de toda antropología filosófica y su correspondiente dimensión práctica. Las tesis de la indefinibilidad del ser humano y la problematicidad ontológica constitutiva de lo humano —desarrolladas por la antropología filosófica crítica del último siglo— cuestionan toda política de la definición de lo humano y las posturas metafísicas que tales políticas implican. My book Risk and Rationality argues for a new alternative to the orthodox theory of rational decision-making. This alternative, risk-weighted expected utility maximization, holds that there are three important components involved in rational decision-making: utilities, probabilities, and risk-attitudes. This essay explains the basic outline of the theory and precisely how it differs from the orthodox theory. It also summarizes the main threads of argument in the book.

This paper provides an account of what it is to have faith in a proposition p, in both religious and mundane contexts. It is argued that faith in p doesn’t require adopting a degree of belief that isn’t supported by one’s evidence but rather it requires terminating one’s search for further evidence and acting on the supposition that p. It is then shown, by responding to a formal result due to I.J. Good, that doing so can be rational in a (...) number of circumstances. If expected utility theory is the correct account of practical rationality, then having faith can be both epistemically and practically rational if the costs associated with gathering further evidence or postponing the decision are high. If a more permissive framework is adopted, then having faith can be rational even when there are no costs associated with gathering further evidence. (shrink)

This paper argues against the priority of temporality over spatiality, which Heidegger defends in Being and Time . The argument, however, does not follow the turn in Heidegger's philosophy and his later retrieval of the spatial but is developed as a delimitation—that is, as an internal critique and reconstruction—undertaken within the transcendental framework of his early thinking. This delimitation proposes a demonstration of the fundamental role of spatializing, defined as dissemination, in the constitution of human Being-in-the-world. A rethinking of human (...) Being-there in terms of the co-originality of spatiality and temporality permits a revisiting of the question of the transcendental and makes it possible to pursue the overcoming of a philosophy of the subject that, critics often point out, Heidegger unsuccessfully sought to transgress in his early work. Jaques provides a general theory that gives a dynamic scientific foundation for the understanding of all living behavior.

In the peer disagreement debate, three intuitively attractive claims seem to conflict: there is disagreement among peers on many important matters; peer disagreement is a serious challenge to one’s own opinion; and yet one should be able to maintain one’s opinion on important matters. I show that contrary to initial appearances, we can accept all three of these claims. Disagreement significantly shifts the balance of the evidence; but with respect to certain kinds of claims, one should nonetheless retain one’s beliefs. (...) And one should retain them even though these beliefs would not be supported by the new total evidence if one didn’t already hold them. (shrink)

I reply to two commentaries—one by Johanna Thoma and Jonathan Weisberg and one by James M. Joyce—concerning how risk-weighted expected utility theory handles the Allais preferences and Dutch books.

This paper examines medical scientists’ accounts of their rediscoveries and reassessments of old materials. It looks at how historical patient files and brain samples of the first cases of Alzheimer’s disease became reused as scientific objects of inquiry in the 1990s, when a genetic neuropathologist from Munich and a psychiatrist from Frankfurt lead searches for left-overs of Alzheimer’s ‘founder cases’ from the 1900s. How and why did these researchers use historical methods, materials and narratives, and why did the biomedical community (...) cherish their findings as valuable scientific facts about Alzheimer’s disease? The paper approaches these questions by analysing how researchers conceptualised ‘history’ while backtracking and reassessing clinical and histological materials from the past. It elucidates six ways of conceptualising history as a biomedical matter: scientific assessments of the past, i.e. natural scientific understandings of ‘historical facts’; history in biomedicine, e.g. uses of old histological collections in present day brain banks; provenance research, e.g. applying historical methods to ensure the authenticity of brain samples; technical biomedical history, e.g. reproducing original staining techniques to identify how old histological slides were made; founding traditions, i.e. references to historical objects and persons within founding stories of scientific communities; and priority debates, e.g. evaluating the role particular persons played in the discovery of a disease such as Alzheimer’s. Against this background, the paper concludes with how the various ways of using and understanding ‘history’ were put forward to re-present historic cases as ‘proto-types’ for studying Alzheimer’s disease in the present. Our relationship with technology has become co-dependent and somehow a personal and an intimate one. Generally speaking, we tend to think that we experience the world around us as it is, but that is not what we really do. In a lifetime, we learn and store knowledge, but we only use from it what we think and feel it will help us to realize the most important projects in our lives. Therefore, we invent things that have the purpose to make (...) our lives easier, just to have time to manage and work on the other part of life – the non-material part of it -, that concerns the personal development of human. First of all, that is or that should be the idea for developing technology, but on second thoughts, we somehow fail to adapt to it, and from that it deceives us – transforming itself in an insecurity, like high-tech products that are too hard to use, or too unreliable to be counted on, the lack of necessary knowledge in order to use it, the costs. Even if we have these technologies as available, we manage to lose ourselves, by becoming more into it than into us and those around us. We like to think we possess knowledge, that we are experts in some areas, we hold and keep lectures on ethics, moral values, efficient communication, but all become a strategic action – from ones that have the power to others that need guidance and confirmation for looking good for others, to win over, convince or convert new adepts to the proposed ideas of ones that have the power, to court those in power, to please everyone, except yourself. But all of that leads to failure – a self-failure, an inner weakness – and we are becoming our own adversaries, which are silent ones. But if technology is so worthy, why we do not manage so well on moral and ethical aspects? (shrink)
