Henri Atlan and Edgar Morin, in particular, greatly influenced by von Foerster and quite famous in French-speaking countries, give a helping hand to those who wish to explore their work further from the perspective of von Foerster's vision and thoughts. And Atlan and Morin take also the credit for the (...) fact that von Foerster has become better known in the French-speaking community. For the Quodlibeta, the Latin text is the critical edition of Delorme and Etzkorn and for the Summa the transcription of Delorme.The translation is prefaced by two introductory chapters: the first devoted to a concise presentation of the figure of John Peckham and the second to an extensive presentation of the translated texts.Chapter 1 opens with some basic biographical information about Peckham: his entering the Franciscan Order at Oxford and the great influence that two major figures, Roger Bacon and Robert Grosseteste, exerted on him at an early stage of his scholarly career; his move to Paris to study theology with Bonaventure and his disputes with Thomas Aquinas; his position as Archbishop of Canterbury from 1279 until his death in 1292. The second section of the chapter, “The Problem of Aristotelianism,” criticizes the traditional view according to which Peckham was hostile to Aristotle’s philosophy. As van Buren points out, the selection of translated texts clearly shows that Peckham relies on Aristotle in crucial contexts. Decisive evidence of Peckham’s Aristotelianism—discovered by van Buren herself—is that he wrote a commentary on Aristotle’s Ethics (preserved in a Florence manuscript but not yet studied). The third and last section of the chapter is about the most relevant background of Peckham’s philosophical thought: the teaching of Bonaventure. Van Buren’s presentation focuses on topics in Bonaventure’s philosophy that are of special importance for the understanding of the translated texts by Peckham: universal hylomorphism, universality of forms, individuation, and plurality of forms.Chapter 2 gives a very helpful overview and explanation of the main points of Peckham’s discussion in the translated texts. The problem here is that particulars are not the kinds of things that can affect the angelic mind, which, unlike the human mind, is in pure actuality. In van Buren’s reconstruction, Peckham solves this problem by defining a special role of particulars in angelic cognition: While they do not affect the angelic mind, they provide it with the occasion for the formation of the similitude required for their cognition starting from the cognition of the universal and of matter that the angelic mind already has in itself.Question 1.3 is about human cognition of universals. Nozick argues, in “Anarchy, State, and Utopia”, correctly I think, that we can go from an equal distribution of wealth to an unequal one through just means. Nozick then asks: If people voluntarily move from a just distribution of wealth, D1, to a different distribution, D2, “isn’t D2 also just?” While Nozick thinks the new distribution of wealth, D2, is just, I think that it is at least possible to go from a just state of affairs to an un-just state (...) of affairs by just means. I then argue that any unequal distribution of wealth can not maximize the good derived from wealth. Therefore, on the basis of plausible utilitarian ideas, any distribution of wealth that isn’t at least roughly equal is un-just, even it was arrived at by just means from aa equal and just distribution of wealth. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. This volume collects thirty years worth of articles on the emotions written by the distinguished philosopher Robert Solomon. Solomon's thesis is that we are significantly responsible for our emotions, which are evaluative judgments that in effect we choose. This is the first of several volumes that document work in the emotions.

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. The author's thesis is that there is a conceptually necessary connection between law and morality which means legal positivism must fail as a comprehensive theory. The substantiation of this thesis takes place within a conceptual framework which shows that there are at least 64 theses to be distinguished, concerning the relationship of law and morality. The basis for the author's argument in favour of a necessary connection, is formed by the thesis that individual legal norms and decisions as well as (...) whole legal systems necessarily make a claim to correctness. The explication of this claim within the frame of discourse theory shows that the law has a conceptually necessary, ideal dimension, which connects law with a procedural, universalistic morality. This book articulates and defends Fregean realism, a theory of properties based on Frege's insight that properties are not objects, but rather the satisfaction conditions of predicates. Robert Trueman argues that this approach is the key not only to dissolving a host of longstanding metaphysical puzzles, such as Bradley's Regress and the Problem of Universals, but also to understanding the relationship between states of affairs, propositions, and the truth conditions of sentences. Fregean realism, Trueman suggests, ultimately leads to a (...) version of the identity theory of truth, the theory that true propositions are identical to obtaining states of affairs. In other words, the identity theory collapses the gap between mind and world. Philosophy is general and systematic reflection about what there is, what ought to be done or is good, and how knowledge about both is possible. Legal philosophy raises these questions with respect to the law. In so doing, legal philosophy is engaged in reasoning about the nature of law. The arguments addressed to the question of the nature of law revolve around three problems. The first problem addresses the question: In what kinds of entities does the law consist, and how (...) are these entities connected such that they form the overarching entity we call “law”? The answer is that law consists of norms as meaning contents which form a normative system. The second problem addresses the question of how norms as meaning contents are connected with the real world. This connection can be grasped by means of the concepts of authoritative issuance and social efficacy. The latter includes the concept of coercion or force. The third problem addresses the correctness or legitimacy of law, and, by this, the relationship between law and morality. To ask about the nature of law is to ask about necessary relations between the concepts of normative meaning, authoritative issuance as well as social efficacy, and correctness of content. (shrink)

Robert Stalnaker is an actualist who holds that merely possible worlds are uninstantiated properties that might have been instantiated. Stalnaker also holds that there are no metaphysically impossible worlds: uninstantiated properties that couldn't have been instantiated. These views motivate Stalnaker's "two dimensional" account of the necessary a posteriori on which there is no single proposition that is both necessary and a posteriori. For a (metaphysically) necessary proposition is true in all (metaphysically) possible worlds. If there were necessary a posteriori (...) propositions, that would mean that there were propositions true in all possible worlds but which could only be known to be true by acquiring empirical evidence. Consider such a purported proposition P. The role of empirical evidence for establishing P's truth would have to be to rule out worlds in which P is false. If there were no such worlds to be ruled out, we would not require evidence for P. But by hypothesis, P is necessary and so true in all metaphysically possible worlds. And on Stalnaker's view, the metaphysically possible worlds are all the worlds there are. So there can be no proposition that is true in all possible worlds, but that we require evidence to know. In this way, the motivation for Stalnaker's two dimensional account of the necessary a posteriori rests on his denying that there are metaphysically impossible Worlds. I argue that given his view of what possible worlds are, Stalnaker has no principled reason for denying that there are metaphysically impossible worlds. If I am right, this undercuts Stalnaker's motivation for his two dimensional account of the necessary a posteriori. (shrink)

[Robert Stalnaker] Saul Kripke made a convincing case that there are necessary truths that are knowable only a posteriori as well as contingent truths that are knowable a priori. A number of philosophers have used a two-dimensional model semantic apparatus to represent and clarify the phenomena that Kripke pointed to. According to this analysis, statements have truth-conditions in two different ways depending on whether one considers a possible world 'as actual' or 'as counterfactual' in determining the truth-value of the (...) statement relative to that possible world. There are no necessary a posteriori or contingent a priori propositions: rather, contingent a priori and necessary a posteriori statements are statements that are necessary when evaluated one way, and contingent when evaluated the other way. This paper distinguishes two ways that the two-dimensional framework can be interpreted, and argues that one of them gives the better account of what it means to 'consider a world as actual', but that it provides no support for any notion of purely conceptual a priori truth. /// [Thomas Baldwin] Two-dimensional possible world semantic theory suggests that Kripke's examples of the necessary a posteriori and contingent a priori should be handled by interpreting names as implicitly indexical. Like Stalnaker, I reject this account of names and accept that Kripke's examples have to be accommodated within a metasemantic theory. But whereas Stalnaker maintains that a metasemantic approach undermines the conception of a priori truth, I argue that it offers the opportunity to develop a conception of the a priori aspect of stipulations, conceived as linguistic performances. The resulting position accommodates Kripke's examples in a way which is both intrinsically plausible and fits with Kripke's actual discussion of them. (shrink)

Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. At the heart, lies the justification and the application of the rules of discourse. An argument consisting of three parts is pre sented to justify the rules of discourse. The three (...) parts are as follows: a transcen dental-pragmatic argument; an argument which takes account of the maximisation of individual utility and an empirical premise about an interest in correctness. Within the framework of the problem of application, the article outlines a justification of human rights and of the basic institutions of the democratic constitutional state on the basis of discourse theory. In this significant contribution to Hegel scholarship, Robert Williams develops the most comprehensive account to date of Hegel's concept of recognition. Fichte introduced the concept of recognition as a presupposition of both Rousseau's social contract and Kant's ethics. Williams shows that Hegel appropriated the concept of recognition as the general pattern of his concept of ethical life, breaking with natural law theory yet incorporating the Aristotelian view that rights and virtues are possible only within a certain kind of community. When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration.
