The term “judicial restraint,” applied to courts engaged in judicial constitutional review, may refer to any one or more of three possible postures of such courts, which we here will distinguish as “quiescent,” “tolerant,” and “weak-form.” A quiescent court deploys its powers sparingly, strictly limiting the agenda of social disputes on which it will pronounce in the constitution’s name. A tolerant court confirms as valid laws whose constitutional compatibility it finds to be reasonable sustainable, even though it independently (...) would conclude to the contrary. A weak-form court acts on the understanding that its pronouncements on matters constitutional will be duly open to considered rejection by other political agencies. Theory commonly tends to treat the question of judicial restraint as turning on a bedrock political value of democracy. We may also, however, understand debates over judicial restraint in the light of a different bedrock value, that of political legitimacy. Where democracy is the focal concern, debaters may tend toward conflating into one measure the three dimensions of judicial restraint. A focus on legitimacy rather tends toward a dis-bundling of the three dimensions, thus complicating the choices while also clarifying the stakes. Global Justice and Avant-Garde Political Agency is, first and foremost, a manifesto for an approach to political philosophy*what Ypi calls ‘activist political theory’*and can, I think, be best understood as an attempt to disturb analytic political philosophy from its ‘dogmatic slumber’ and motivate its movement towards the tradition of critical theory. In the first section of this commentary, I will lay out the grounds for this view. Having thus sketched an account of the point (...) and purpose of this text, I will then focus on the relationship of both the methodological and the substantive arguments on global justice to the question of power. At a methodological level, I will argue that Ypi does not take the significance of power sufficiently seriously as an issue for political theory with emancipatory intent. With regard to her substantive arguments concerning global justice and state power, I will argue that she does not adequately address the character of power as a positional good because the analysis does not operate at the fundamentally appropriate institutional level of analysis. "Powers and Capacities in Philosophy" is designed to stake out an emerging, discipline-spanning neo-Aristotelian framework grounded in realism about causal powers. The volume brings together for the first time original essays by leading philosophers working on powers in relation to metaphysics, philosophy of natural and social science, philosophy of mind and action, epistemology, ethics and social and political philosophy. In each area, the concern is to show how a commitment to real causal powers affects discussion (...) at the level in question. In metaphysics, for example, realism about powers is now recognized as providing an alternative to orthodox accounts of causation, modality, properties and laws. Dispositional realist philosophers of science, meanwhile, argue that a powers ontology allows for a proper account of the nature of scientific explanation. In the philosophy of mind there is the suggestion that agency is best understood in terms of the distinctive powers of human beings. Those who take virtue theoretic approaches in epistemology and ethics have long been interested in the powers that allow for knowledge and/or moral excellence. This paper investigates the Turkish Constitutional Court (TCC)’s treatment of legal challenges brought against Turkey’s legal responses to the COVID-19 pandemic. Drawing on a detailed examination of the TCC’s institutional features, political origins and jurisprudential trajectory, and taking three politically salient judgments of the TCC concerning Turkey’s executive-dominated pandemic control as the point of departure, the paper argues that the TCC chose to exercise judicial restraint both in protecting fundamental rights and reviewing pandemic policies of the executive. It (...) also argues that the TCC’s judicial restraint during the pandemic was simply the re-manifestation of its ‘play-it-safe’ strategy — a judicial stance the TCC willingly adopted in the aftermath of the 2016 attempted coup despite possessing strong constitutional powers of judicial review, and its established attitude of assertive scrutiny in the past. From a more theoretical perspective, the analysis also explores how the passive role to which the TCC is consigned in an increasingly authoritarian regime since the 2016 failed coup relates to the global phenomenon of judicialization of authoritarian politics. In lieu of an abstract, here is a brief excerpt of the content:The Absolute and Ordained Power of God and King in the Sixteenth and Seventeenth Centuries: Philosophy, Science, Politics, and LawFrancis OakleyThe quintessentially scholastic distinction between God’s power understood as absolute and ordained (potentia dei absoluta et ordinata) has been described “as a ‘yes and no’ answer to the question whether God is able to do or arrange things other than he did in creating the orders (...) of nature and grace.” 1 The importance of that distinction the historical scholarship of the past forty years has served increasingly to indicate. 2 The idea that it expressed had emerged already in the twelfth century, and in the standard form familiar to us from later years we now know it to have surfaced among the theologians of Paris in the opening years of the thirteenth. We also know that long before the end of the thirteenth century it had come to be understood in the two distinct ways that were to persist on through the late medieval and early modern centuries and to be acknowledged in the neo-scholastic manuals of the late nineteenth century.According to the first of these understandings, embedded in the classical formulations given to the distinction by Albertus Magnus, Thomas Aquinas, William of Ockham, and many other later thinkers, the term potentia absoluta was used simply to denote God’s power in itself, taken in abstracto and without reference to the orders of nature and grace he has actually willed de potentia ordinata to establish. In contemporary democracies, global capitalism exerts a significant influence over how state power is exercised, raising questions about where political power resides in global politics. This question is important, since our specific considerations about justifiability of political power, i.e. political legitimacy, depend on how we characterize political power at the global level. As a partial answer to this question, I argue that our notion of global political legitimacy should be reoriented (...) to include the structural power of the Transnational Capitalist Class as its subject matter. Structural power is a social relation in which the institutional context makes some agents comply with others’ preferences regardless of actors’ intentional efforts to bring about such outcomes. Even when global business elites do not intentionally exercise power to obtain political control of global governance, their structural power has recognizable effects that partly enforce the world order. To advance my claim, I utilize the radical realists’ argument that the notion of legitimacy is applicable to a broader range of social practices that are beyond dyadic power relations, i.e. rulers intentionally exercising power over subjects. Some recent uses of artificial intelligence for facial recognition, evaluating resumes, and sorting photographs by subject matter have revealed troubling disparities in performance or impact based on the demographic traits of subject populations. These disparities raise pressing questions about how using artificial intelligence can work to promote justice or entrench injustice. Political theorists and philosophers have developed nuanced vocabularies and theoretical frameworks for understanding and adjudicating disputes about what justice requires and what constitutes injustice. The interdisciplinary community committed (...) to understanding and conscientiously using big data could benefit from this work. Thus, in the spirit of encouraging cross-disciplinary dialogue and collaboration, this piece examines contemporary scholarship in political theory and philosophy to illustrate some of the vocabularies and frameworks political theorists and philosophers have developed for thinking about justice and injustice. It then draws on these frameworks to illuminate how the use of artificial intelligence can implicate questions of justice, with a focus on institutional discrimination, structural injustice, and epistemic injustice. Ultimately, the piece argues that the use of artificial intelligence—far from representing a decision to take power out of human hands—represents a novel way of harnessing human power, making questions of justice central to its conscientious undertaking. This paper questions whether Critchley's ethical project can adequately talk about anarchism without acknowledging the critiques that political position has of philosophy. It argues that Critchley is too quick to dismiss "philosophical anthropology" as a way of understanding the link between politics and a certain notion of infinity. By a comparison of Noam Chomsky and Emmanuel Levinas, it attempts to show that there is a way of conceiving politics that does not give philosophy the final say.

The word Anthropocene, referring to a new era of humanity’s uncontrolled exercise of power over the Earth as a geophysical unit, could be translated using a cognitive metaphor as “the Age of Loss”. We have gained such power that we are unable to adjust or even fully track its manifestations. The relation between loss and power is continuous in all the basic areas of materialization of socio-political concepts: in politics, in economics, in law and the judiciary, (...) in legislation, environmental protection, etc. The philosophy of loss and power is inseparable from economic concerns. The entirety of Western civilization is built on the economic calculus of profit and loss, whose results are directly transformed into decisions of power made by the administrative, political, ownership and power-broking elites. The environmental and climate crisis is therefore also a crisis of privilege of one group over others. The question for politics is which political means can one use to achieve a state of uncorrupted voluntary depriviligization. This level of prosperity will itself be the subject of environmental self-limitation, being presented as “loss”. It will be posed as a political problem with the intention of depoliticizing the subject and inequality of civilizations; precisely in accordance with the posed political problem of democracy, which has already uncovered the basic connection: liberalism won’t make a poor country rich. Michel Foucault is one of the most preeminent theorists of power, yet the relationship between his militant activities and his analysis of power remains unclear. The book explores this relationship to explain the development of Foucault's thinking about power. Using newly translated and unpublished materials, it examines what led Foucault to take on the question of power in the early 1970s and subsequently refine his thinking, working through different models (war and government) and modalities (sovereign, disciplinary, (...) biopolitical, pastoral and governmental). Looking at Foucault's political trajectory, from his involvement with the prisoner support movement and Solidarity to his controversial engagement with the Iranian revolution, the book shows the militant underpinning of his interest in the question of power and its various shifts and mutations. We examine the `self-image of the state' through Supreme Court decisions in (...) the USA, Germany, and Israel. Because moral reasons are expressed especially clearly in cases regarding obligations to provide military service, we focus on these. In spite of their important constitutional and judicial differences, the three states support military obligations along similar lines, though with some differences. In all three countries, appeal is made to obligations of reciprocity. Individuals must serve in order to provide the important benefit of defense. This `service conception' of political obligation accords norms of fairness or equality a central role, in order to justify the service of particular individuals. Reasons for less emphasis on fairness in Israeli cases are examined, while we claim that the overall similarities of the three countries provide some measure of indirect support to a theory of political obligation based on the principle of fairness. Despite often being condemned for having a paradigmatically unrealistic or dangerous conception of power, Plato expends much effort in constructing his distinctive conception of power. In the wake of Socrates’ trial and execution, Plato writes about conventional, elitist, and radically unethical conceptions of power only to ‘refute’ them on behalf of a favoured conception of power allied with justice. Are his arguments as pathetic or wrong-headed as many theorists make them out to be – from Machiavelli (...) to contemporary political realists, from ‘political’ critics of Plato ranging from Popper to Arendt? And if not, has our understanding of power been impoverished? This question has been surprisingly unasked, and it is one I address by asking Plato and his critics: What are the dialectical moves Plato makes in refuting Socrates’s opponents and constructing his own conception of legitimate power? Exactly how does he interweave his conception of power with a kind of ethics? How does it compare to recent conceptions of political realism and the power-politics/ethics relationship – e.g., after Marx and Foucault? While addressing these questions I also attend to the issue of Plato’s historicity: to what extent do the limits of his language and world affect our reading of Plato and his political critics? Ultimately, I argue that and how Plato’s conception of power and its political dimensions realistically have much to teach us that we have not learned. (shrink)

Due to human equal rights, every particular human is weaker then the others. Hence for self-preservation of particular humans natural law has to be transformed into two distinct forms of power: into an absolute power of sovereign and into freedom of subjects, that from now on considers as an ability to obey to sovereign. In France there is a way of thinking about freedom that often impedes its realization. To understand this question first a fundamental contradiction of the tension between political rationalism and popular sovereignty is examined. The terms of this contradiction are presented along with the ways in which this tension manifested itself in France during the Revolution of the 19th Century. This is also shown by contrasting the French approach to producing the law-state with English liberalism which relies on a (...) balance of powers. The French case shows that there is a way, other than representative government, to think about protective rule: the establishment of a good, rational authority based on science. Do philosophers have a responsibility to their society that is distinct from their responsibility to it as citizens? This edited volume explores both what type of contribution philosophy can make and what type of reasoning is appropriate when addressing public matters now. In my dissertation, I derive a set of systematic principles and a conception of the political subject from Spinoza’s metaphysics and political writings and then bring these tools to bear on contemporary questions in democratic theory. I argue that Spinoza’s conception of the political subject answers feminist critiques of the liberal subject, while retaining an understanding of the need for empowered citizens in strong democracies. Spinoza’s normative political theory shows how political communities become stronger (...) through the empowerment and participation of their citizens. I argue that Spinoza’s naturalistic method provides a promising path for both ethics and political theory. In the first chapter of my dissertation, I sketch the history of the development and critiques of the ‘liberal’ conception of human nature. I argue that rather than a substantial conception of human nature, the liberal subject is a skeptical compromise developed for a very specific purpose following the post-Reformation Wars of Religion in Europe in the 16th century. I then take on a variety of critiques of the notion of human nature in general and of the liberal conception of human nature in particular. I argue that political theory requires a positive conception of human beings. Spinoza’s conception of the human individual, created in order to replace what Spinoza thought were problematic aspects of the theories of individuals proposed by Hobbes and Descartes, does not suffer from the problems of the liberal subject and is a good candidate for a positive conception of human nature. In Chapter Two, I set out the main components of Spinoza’s naturalistic conception of the human individual. Spinoza understands human beings as primarily affective, or emotional creatures, whose feelings mediate their conceptions of the world. For Spinoza, each individual can be understood to have an index of power, which can increase or decrease depending on the degree to which individuals understand and are able to control the forces that affect them. In Chapter Three, I show that Spinoza’s theory of the political state is parallel to his theory of the individual. For Spinoza, just as individual humans have an index of power that can increase or decrease depending on how their emotions are organized, so too states have different degrees of power depending on how the emotions and power of the human beings within them are organized. The challenge for a Spinozan state is to understand how to create social and political institutions to organize the emotions of the ‘multitude’ of individuals in the state in the best way to yield the strongest state. For Spinoza, the strongest, or most absolute state, is a democracy, which is also the freest kind of state. I set out Spinoza’s theory of democracy and show how it builds upon his notion of individual and collective power. In Chapter Four, I take up the potential objections of Iris Marion Young to Spinoza’s conception of democratic agreement. I say these objections are ‘potential’ because, although Young critiques Rousseau’s conception of the general will, she does not directly object to Spinoza’s view of ‘agreement’ as a necessary element in democratic deliberation. However, many of Young’s writings touch on this worry, particularly in her critiques of Rousseau, civic republicanism and contemporary deliberative democracy theory. I argue that Spinoza’s notion of agreement employs a different conception of reason than that found in Rousseau, or in the tradition of deliberative democratic theory. Reason, for Spinoza, is a collective achievement rather than a precondition for deliberation. Spinoza argues that agreements reached through large-scale discussion in a democracy are likely to be more ‘reasonable’ than those reached by few or by one. Spinoza and Young share, I argue, a similar conception of the role of affect in deliberation, and both recognize the importance of affects and imagination in social and political life. In Chapter Five, I contrast a Spinozan theory of empowerment to Martha Nussbaum’s capabilities approach. Nussbaum’s approach and that of Spinoza are consonant in many of their major aspects; however, I argue that in practice, Spinoza’s theory is better able to account for the contextual nature of empowerment and of the necessity to reform harmful social, moral and cultural norms through affective mechanisms. In the conclusion, I consider the larger implications for a Spinozan naturalist approach to political philosophy, and for the role that theories of human nature and metaphysics can play in political theory. I argue that by avoiding metaphysics and by avoiding conceptions of human nature, those interested in projects of emancipation can have no criteria for determining whether or not individuals have become emancipated or whether their power has in fact increased. The model I derive from Spinoza’s conception of individual power and his view of the power of political states as a function of the power of the coordination of individuals provides a promising alternative to liberal theories of the subject and to extant feminist theories of the human individual, which ignore the psychological and metaphysical aspects of human individual and collective power. This work seeks to highlight that an understanding of aesthetic practices is essential to the analysis of politics and political processes. If today, aesthetics has become a rather overused term, referring to a variety of historical periods and groups, even states of being (love, melancholy...), nonetheless its relevance as a connecting agent between individual, state and society remains strong. Placing it as a central theme for understanding processes of domination, contestation and transversal links highlights the mobilization of spaces, bodies (...) and objects in a struggle for the exercise of power and the challenges to it. It is impossible to study historical shifts or systems of power without examining the mobilisation of aesthetic languages: of splendour and display, austerity, asceticism, minimalism or restraint. In this book the concern is with the dynamics between the custodians of aesthetics and the dissenters, with the moment, and with change over time. This book approaches contemporary politics through the aesthetics of power and its practices: from the more formal and regulated presence of state power in the public space in the form of official buildings, commemorative monuments, to the aestheticisation of sacrifice in politics and judicial spectacles. The studies presented here promise to lead us further to deepening our understanding of the dynamics of political spaces and the politics of the aesthetic in contemporary politics. (shrink)

Debates over postmodernism, analyses of knowledge and power, and the recurring issue of Heidegger's Nazism have all deepened questions about the relation between philosophy and the social roles of intellectuals. Against such postmodernist rejections of philosophical theory as mounted by Rorty and Lyotard, Richard Peterson argues that precisely reflection on rationality, in appropriate social terms, is needed to confront urgent political issues about intellectuals. After presenting a conception of intellectual mediation set within the modern division of (...) labor, he offers an account of postmodern politics within which postmodern arguments against critical reflection are themselves treated socially and politically. In contrast to political realism's equation of the `political' with domination, Hannah Arendt understood the `political' as a relation of friendship utterly opposed to the use of violence. This article offers a critique of that understanding. It becomes clear that Arendt's challenge to realism, as exemplified by Max Weber, succeeds on account of a dubious redefinition of the `political' that is the reverse image of the one-sided vision of politics she had hoped to contest. Questioning this (...) paradoxical turn leads to a critique of Arendt's separation of violence and power and, consequently, her attempt to insulate a politics of friendship from one of hostility and coercion. However, political realism is not thereby affirmed. What is required, instead, is a view of the `political' that accepts the interwoven-ness of violence and power but also emphasizes the normative ideals of moderation and care. The Athenian sophist Philostratus completed a romanticised biography of Apollonius of Tyana in the second or third decade of the third century A.D. One of the most striking aspects of the presentation of this firstcentury Pythagorean sage and miracleworker in the Vita Apollonii (VA) is his role as 'politically active philosopher'. Not only does the protagonist of the VA regularly intervene in situa-tions of conflict in Greek cities and instruct their citi-zens on how they ought to live together, but he (...) also appears in contact with Parthian and Indian kings and Roman emperors. The present study deals with this promi-nent facet of Philostratus' portrait of the Tyanean sage. There are three main issues. The first is the question of the extent to which the Apollonius tradition provided support for the image of the contacts of the protagonist of the VA with cities and monarchs. The second is consideration of how the author dealt with and elaborated these elements in his source material. The third is the question of to what extent the protagonist of the VA may be regarded as a spokesman for the explicit political views of Philostratus. In other words, the aim is to analyse the image of the protagonist of the VA as a 'politically active philosopher' as the result of the interaction between the traditions associated with a sage and miracleworker who was regarded as a representative of Pythagorean wisdom, on the one hand, and the paideia, cultural baggage and mentality of a sophist, on the other. Americans cannot live with judicial review, but they cannot live without it. There is something characteristically American about turning the most divisive political questions - like freedom of religion, same-sex marriage, affirmative action and abortion - into legal questions with the hope that courts can answer them. In Judicial Review in an Age of Moral Pluralism Ronald C. Den Otter addresses how judicial review can be improved to strike the appropriate balance between legislative and (...) judicial power under conditions of moral pluralism. His defense of judicial review is predicated on the imperative of ensuring that the reasons that the state offers on behalf of its most important laws are consistent with the freedom and equality of all persons. Den Otter ties this defense to a theory of constitutional adjudication based on John Rawls's idea of public reason and argues that a law that is not sufficiently publicly justified is unconstitutional, thus addressing when courts should invalidate laws and when they should uphold them even in the midst of reasonable disagreement about the correct outcome in particular constitutional controversies. Jeremy Waldron objects to judicial review of legislation on the ground that it effectively accords the views of a few judges ‘superior voting weight’ to those of ordinary citizens. This objection overlooks that representative government does the same. This article explores the concept of political representation and argues that delegates may be institutionally bound to heed the convictions of their constituents, but they are not their proxies. Rather, they are best viewed as their trustees. They ought to decide (...) according to what they think is in their constituents’ interest. In this sense, a strong element of independent judgment is involved in their institutional role. So, if we have no problem with assigning their views superior voting weight, it should not be thought particularly objectionable to give judges the same power. What is more, once we acknowledge the independence they enjoy, the question arises whether and by what institutional means we ought to constrain and check their power. The judiciary is well suited effectively to carry out this supervisory function, because it is immune from political pressure by the legislature that would reduce it to its instrument. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard (...) to their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Modern jurisprudence has typically been presented as a debate between legal positivism and natural law. Though the demise of legal positivism has been touted despite its pre-eminence in past decades, it is clear that there remains a vigorous debate surrounding this theory. It is noteworthy that Hans J. Morgenthau’s legal thought and critique of legal positivism have remained unexplored in the context of this debate. Largely forgotten, his legal thought answers questions that lie at the heart of the natural (...) law and legal positivist debate. It showcases his deeply nuanced understanding of legal and political theory and contains a powerful and insightful commentary on the fundamental problems faced by international law. Building on existing literature, this paper unearths Morgenthau’s critique of legal positivism. It does this by re-examining his works, which address the question of whether moral considerations are relevant to determining the content of the law in force. It brings his legal thought to light, which highlights the artificiality of the division between law and morality and offers a nuanced analysis of problems inherent in international law. Ultimately, the paper challenges the claim that the law can be determined without resorting to moral judgement and shows how Morgenthau’s insights remain relevant to legal positivism and natural law debates today. When judges decide cases in courts of law, are they ethically obligated to apply the law correctly? Many people who think about legal systems believe so. The conviction that judges are “bound” by the law is common among lawyers, judges, legal scholars, and members of the general public. One of the most severe accusations one can make against a public official is that she has deviated from the law in her official capacity. The principle of judicial fidelity figures centrally (...) in one of the most celebrated Western political values: the rule of law. This is an ideal which some Western powers, notably the United States, aspire to export on a global scale. The principle of judicial fidelity implies many basic norms of adjudication. These vary from one legal system to another, but in Anglo-American systems they include the following: trial judges must take all admissible evidence into account; judges must follow recognized sources of law, such as constitutions, legislation, and common-law rules; inferior courts must follow superior court rulings on matters of law; courts should give at least substantial weight even to “horizontal” precedent; et cetera. Limits of Legality is a scholarly monograph, in progress, that advances our understanding of the principle of judicial fidelity and defends a refined and unorthodox version of it. The book draws on my background as both a lawyer and a philosopher, addressing issues at the intersection of legal philosophy and ethical theory. It breaks new ground in the normative theory of adjudication – the branch of legal philosophy that concerns how judges in courts of law should decide cases. Mine is one of the first projects to apply the resources of contemporary normative ethics to central questions concerning the rule of law and judicial obligation. I model the normative presuppositions of existing theories of the rule of law in terms that take into account developments in ethical theory over the past two decades.. (shrink)

Thomas Hobbes has been hailed as the philosopher of power par excellence; however, I demonstrate that Hobbes’s conceptualization of political power is not stable across his texts. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such a doctrine must be robustly complemented by an account of how the effective power commensurate (...) to this authority might be achieved. Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. (shrink)

In this book John Gray argues that we live in a time of endings for the ideologies that governed the modern period. The Enlightenment projects of universal emancipation animates all the political doctrines and movements that are central in contemporary western societies. Yet it does not reflect the reality of the plural world in which we live. The western cultural hegemony which the Enlightenment embodied is coming to a close. Western liberal societies are not precursors of a universal civilization, (...) but only one form of life among many in the late modern world. Our inherited stock of political ideas no longer tracks that world. The crisis of New Right thought is as profound as that of the Left. Green theorists and communitarian thinkers have not understood the deep diversity and intractable conflicts of contemporary societies. And postmodernists, whose thought is ruled by the dated utopias of the modern period, do not engage with the real conditions of the world's emerging postmodern societies. Late modern thought occurs in an interregnum between modern projects that are no longer credible and postmodern realities that many find intolerable. John Gray suggests that some Enlightenment hopes of progress must be extinguished if we are to learn to respect cultural diversity and accept ecological limits. Respect for the Earth and for other species and cultures means abandoning the utopian and arcadian projects that haunt modern thought. We should aim to moderate the impact of human activity on the Earth while alleviating the unavoidable evils of human life. Yet the hubris which treats the Earth as an instrument of human purposes, and which regards other cultures as approximations to a universal civilization, embodies ancient and powerful traditions. John Gray's aim is to question these traditions and thereby to prepare our thinking for a time of beginnings. (shrink)

One of the main moral costs of stare decisis lies in the continuous possibility of entrenching morally deficient decisions in the law. Although legal systems usually make provision for dealing with morally deficient precedents, there are cases in which the legal obligation of later courts to follow one of these precedents is undefeated. This possibility affects the overall justification of stare decisis. One traditional answer to this problem consists in accepting this moral cost, on the belief that the benefits of (...) stare decisis outweigh it. On this view, when there is an undefeated legal obligation to follow a morally deficient precedent, the court must simply follow precedent. In this article, I question this approach and defend an alternative solution. I argue that, under some conditions, a court facing a morally deficient precedent should have the power to either follow the precedent or suspend its application to the parties by ordering a temporary stay of proceedings and referring the case to a higher court with power to overrule the precedent. This proposal entails exercising an equitable power recognised by the legal system, which I defend against three possible objections. (shrink)

During a similarly vexed period, Niebuhr and Ramsey found themselves at odds over the morality of the Vietnam War. Carnahan’s project seeks to elucidate the underlying sources of this disagreement, examining in turn how each thinker construes the task of moral theology, the nature of political society, and the moral status of war. Throughout these treatments, Carnahan illustrates how Niebuhr and Ramsey elaborated “overlapping but divergent” positions profoundly influenced by their respective encounters with pragmatism and idealism.Even as he shows how Niebuhr modified the pragmatist inheritance and Ramsey the idealist, Carnahan highlights how both were shaped especially by the way in which these traditions sought to counter specific moral dangers. For pragmatists, the key danger lay in the kind of moral fanaticism that blithely assumes its own righteousness. Sensitized to this threat, Niebuhr articulated a moral theology centered upon an understanding of love as an ideal that is always relevant yet never fully realizable in history, a construal that subverts all pretensions to righteousness. Idealism, on the other hand, sets itself against the danger of atomistic individualism, which Ramsey opposed by depicting social institutions in their essential forms as “‘garments of skin’... with which God... clothed naked human relations” (129) and by characterizing love as fundamentally a matter of upholding the covenants implied in such institutions. Ultimately, Niebuhr’s opposition to fanaticism predisposed him to focus upon the idolatries at play in political society and war and allowed him rather early on to descry the pretentiousness of the Vietnam War. Meanwhile, Ramsey’s thought included a presumption in favor of supporting the policies developed by social and political leaders that led him to defend American intervention in Vietnam until sometime around 1973. Nonetheless, it complements existing scholarship on Niebuhr and Ramsey with an investigation of the philosophical premises of their ethical thought that each was eager to conceal. Such work will benefit scholars of Niebuhr and Ramsey as well as advanced students seeking to grasp the general architecture of their thought. Moreover, many will find Carnahan’s interpretations of Niebuhr and Ramsey impressive. For example, Carnahan portrays Niebuhr as a more Barthian and ecclessially minded thinker than most accounts. Although Carnahan understandably does not treat such indictments in detail, his rendering undercuts charges leveled by many of Niebuhr’s critics, including Bennett, Yoder, and Hauerwas. Unfortunately, though, Carnahan’s arguments on some of these disputed points are predicated upon a relatively narrow selection of essays. Still, the book unsettles assumptions and suggests further possibilities for inquiry.In addition to his expository work, Carnahan also makes a further contribution as he subjects both Niebuhr and Ramsey to constructive criticism that exposes—and identifies ways of reinforcing—some of the weaknesses of pragmatism and idealism. Eschewing a synthesis, Carnahan instead offers a mutually constructive dialogue capable of helping thinkers of both stripes think through the issues that confront contemporary America.
