What kind of discourse is likely to build up constitutional norms? How do legal-philosophical insights get along with competing political claims? This book presents the main conclusions from the CITC (Congreso Internacional de Teoria Constitucional) in Cordoba, Argentina. While addressing the very foundations of Constitutional Law, leading scholars from Europe and America got together to debate legal and political issues which impinge upon institutional design and polity assessment, political representation and rights protection. One of the important determinants of development during the transition to adulthood is the undertaking of social roles characteristic of adults, also in the area of finishing formal education, which usually coincides with beginning fulltime employment. In the study discussed in this paper, it has been hypothesized that continuing full-time education above the age of 26, a phenomenon rarely observed in Poland, can be considered as an unpunctual event that may be connected with difficulties in the process of identity formation. (...) Relationships between identity dimensions and identity statuses, and age and educational context were analyzed. 693 individuals aged 19-35 took part in the study. The participants attended three types of educational institutions: full-time university studies, part-time university studies, and full-time post-secondary school. Among the students of full-time university studies predictable dependencies, also in respect of highlevels of indicators of identity crisis and a high frequency of diffused identity occurrence, were observed. Such dependencies were not found in the group of full-time post-secondary school students. (shrink)

There is no longer any doubt that the coming decades will bring serious threats to humanity from anthropogenic climate change. As we have suggested elsewhere, horrible scenarios are far more realistic than non-horrible ones, and science and technology are incapable, especially in our non-ideal world, of equitably distributing wealth, access to resources and adaptations to climate change. In this article, we offer an alternative to these inevitable horrible scenarios. The alternative is to implement either an anti-natalist policy, or procreative beneficence (...) and reproductive rights policies aimed at radically reducing the birth rate. These alternatives, however, are potentially unfair and quite possibly unthinkable to most of humanity. (shrink)

The Chinese parallel to the Pali-Kutadantasutta marks one of the major turning points in Old Indian history of ideas: the transition from magic to ethics. The paper explores the relationships and interconnections in the philosophical and sociopolitical concepts of Günther Anders and Hannah Arendt. Both philosophers, who were married to each other for a short time, not only shared a similar fate in that they both had to flee from National Socialism, but both dealt with similar questions, albeit in different manners: with Auschwitz and the Holocaust, with the problem of totalitarianism, with the development of the Modern, which is defined by technology and industrial labour. (...) A comparison shows that many themes in the thinking of these philosophers are near to each other, but the methods and foci are other. At the foreground of Anders’ thinking is the question of the destructive influence of modern technology and weapons of mass destruction. However, Arendt concentrates on totalitarian political structures and the possibility of people to take action. Nevertheless, they both are concerned that people’s humanity is at risk under the political and technological conditions of the Modern. (shrink)

We examine second order intuitionistic propositional logic, IPC². Let $F_\exists $ be the set of formulas with no universal quantification. We prove Glivenko's theorem for formulas in $F_\exists $ that is, for φ € $F_\exists $ φ is a classical tautology if and only if ¬¬φ is a tautology of IPC². We show that for each sentence φ € $F_\exists $ (without free variables), φ is a classical tautology if and only if φ is an intuitionistic tautology. A legal theory which merely describes legal norms is able to report about symptoms, not about structures and causes. Only if legal analysis is not exclusively focussed on the syntactical components of law, but also includes its semantical and pragmatical components, a comprehensive vision of law can be obtained. Personal identifications belong to the pragmatical components which in many aspects constitute subconscious prerequisites for the functioning of a legal system.

This essay articulates one way to conduct a cultural intervention from the Asia/Pacific region that recognizes the cultural governance of “Other” traffics. I investigate the discursive framework of Charlie Chan and Hawai'i detective fiction to inform the ways in which nation-states police cultural difference and enact geo-cultural homogeneity. I contend that Charlie Chan acts as a narrative of containment by inscribing and transcribing those spaces, times and bodies that would otherwise disrupt the national field of America. In particular, the imaginative (...) geography of Charlie Chan not only affirms the tropical paradise coding of Hawai'i, it attempts to provide disciplinary insights from the perspective of a “native informant”; the figure of Charlie Chan translates and forecloses the discordant rhythms of minority and “native” communities in ways that enable the production of popular television shows such as Hawaii Five-O, Magnum P.I. and Baywatch Hawaii. However,despite this national deployment of Charlie Chan, I want to suggest that Charlie Chan can also be read as a tactic of geopolitical resistance. His figure can assume a parodic and critical stance in the form of a native mis-informant, and by so doing, his character insecures dark bodies, times, spaces of the Orient and the Oceanic. (shrink)
