The historical origins of the Kyoto School of Philosophy of modern Japan, represented by Kitaro Nishida and Hajime Tanabe, may be derived from both the ancient Chinese idea of Change and the ancient Indian Upanishadic idea of the mutual identity of Brahman and Atman. The ancient Chinese idea of Change signifies change as well as non-change, and even their dialectical unification. Both origins are structured by the self-identity of the opposed in logic, and these historical prototypes have been developed into (...) the various forms of Confucian, Taoist, and Buddhist philosophy. The notion of Nothingness or Emptiness rather than Being has been set up as the fundamental principle. The principle of Nothingness as ultimate reality has been connected with the logic of self-identity of theopposed, and this is evident in Nishida’s concept of the self-identity in absolute contradistinction that is equivalent to the Place of Absolute Nothingness. Even though Nishida’s idea of Place is directly and explicitly influenced by the ancient Greek idea of Topos, it has indirectly and implicitly been affected by the traditional agricultural society as well, in which the land is regarded as the self-identical substratum despite the cyclic time of the four-seasons change. The ancient Chinese idea of Change also reflects the agricultural society in which the cyclic time plays an important role on the basis of the unchanging self-identical land as the underlying substratum. Nishida succeeds in establishing the new logical expression of Eastern traditional thought, deeply hidden in consciousness, in relation toWestern philosophy. The uniqueness of Nishida’s idea of Place may have its main source in the traditional agricultural background, and in this sense his way of thinking may be rural in character. On the other hand, Tanabe, though following Nishida at first, turns to making criticism of the mentor with the establishment of the triadic logic of species as the dialectic, which is characterized by the perpetual self-negating conversion in action. In contrast to Nishida, Tanabe represents the urban type of thinking, which is in pursuit of transforming in life. While Nishida’s idea of Absolute Nothingness has an affinity with the ancient Chinese philosopher Laotzu’s idea of Nothingness from and into which every entity comes and goes, Tanabe’s concept of Absolute Nothingness as the principle ofconversion is more closed to the Buddhist idea of sunyata, i.e., Emptiness, which is devoid of any substance in itself. As regards evil, the difference between them is obvious in that for Nishida evil and time or history disappear into the ultimate horizon or place of Nothingness with the tendency toward a kind of monism of goodness, whereas for Tanabe evil copes with goodness and retains its own status throughout, never being reduced to the opposed. Even if so, both of them, however, fail to construct a philosophy of history from the epochal or durational viewpoint, compared to Heidegger and Jaspers. (shrink)

The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of (...) law. The reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. The problem of Confucius has been the subject of a most heated debate in philosophy circles for several years. Prior to 1962, the major points of debate were: whether the philosophical thought of Confucius is idealistic or materialistic; whether the political thought of Confucius represents [the interests of] the ruined slaveholders or the newly emerged landlord class; and whether the thoughts of Confucius are reactionary or progressive. However, since the spring of 1962 a new trend began to appear. Articles glorifying (...) Confucius began to appear in the press throughout the country. They dealt with Confucian ideas on a profusion of subjects, such as arts, music, military affairs, psychology, and so forth. Some of these articles presented an abstract analysis of Confucian thoughts as transcending all classes and times and made them eternal and "evergreen"; some went as far as to put Marxist ideology under the name of Confucius. Others maintained that we should treasure Confucian thoughts and that any criticism would ruin the legacy. Still others asserted that the policy of treasuring legacy of the Confucian thoughts should be "arrangement, consolidation, and elevation.". (shrink)

Metzger continues the effort started in _A Cloud Across the Pacific_ (The Chinese University Press, 2005) by viewing modern Chinese thought as political philosophy; placing it in a sociological context, noting its causal relationship with paideia; examining its historical context by emphasizing the lines of continuity with the Confucian tradition; and exploring its comparative context by describing it as sharing an agenda with and diverging from the leading forms of Western liberalism. East and West, he argues, are ivory towers (...) that use their rationalistic philosophies to insist that the great disasters of history are caused mainly by the bad decisions of political leaders, instead of seeing how their own philosophical discourses lend credibility to these decisions and trying to improve these discourses by uncovering their culturally inherited premises. This paper explores the encounter between traditional Confucian thought and contemporary Anglophone philosophy. It explores the evolution in philosophical methods and heuristics employed by "Western" thinkers in the past fifty or so years, often with the aim of extracting Confucian thought from its specific social and historical roots. Unlike the disciplines of intellectual or literary history, these philosophers have a distinctive variety of aims. These include: articulate dimensions of Confucian philosophy not explicit in traditional texts, develop (...) critiques of Western modernity, derive solutions to problems in Western philosophy, and attempt to reimagine Confucian thought for an East Asian modernity. Analyzing how contemporary philosophers have engaged the Chinese tradition makes clearer the meaning of the much-debated term “Chinese philosophy,” without becoming mired in definitional disputes, while also justifying the enterprise of engaging philosophically with the Chinese tradition. A metaphor is an effective way to show how something is to be conceived. In this article, I look at two Neo-Confucian Korean philosophical contexts—the Four-Seven debate and Book of the Imperial Pivot—and suggest that metaphors are philosophically expedient in two further contexts: when both intellect and emotion must be addressed; and when the aim of philosophizing is to produce behavioral change. Because Neo-Confucians had a conception of the mind that closely connected it to the heart (心 xin), metaphor’s (...) empathy-inducing and perspective-giving capacities made it an especially helpful mode of philosophizing in the history of Korean philosophy. While I liked his style, the vocabulary seemed awkward. His finite idealism confused me. I had problems with his ontology, and his tendency towards historicism seemed odd. I even wrote an essay critical of The Midworld (New York: W. W. Norton, 1982), though I never made an aggressive effort to publish it. [End Page 289]This is a good thing, because I would have regretted publishing that essay. I say this because both Michael J. McGandy's The Active Life: Miller's Metaphysics of Democracy, and the new edited collection of Miller's writings entitled The Task of Criticism, do an excellent job of revealing the contemporary significance of Miller's work. Collectively, they have convinced this skeptic that the midworld and its ontology of functioning objects are an important contribution to contemporary American philosophy.The Task of Criticism faces several challenges. First, George P. Brockway supervised the publication of five volumes of Miller's collected works, and Fell himself edited a 1990 volume on Miller's philosophy (The Philosophy of John William Miller, Lewisburg: Bucknell University Press), followed by Stephen Tyman's Decrying the Ideal (Carbondale: Southern Illinois University Press, 1993). Colapietro published Fateful Shapes of Human Freedom: John William Miller and the Crises of Modernity (Nashville: Vanderbilt University Press) in 2003. Do we really need another volume? Second, Miller's brand of idealism is not very fashionable these days. Is there any hope that pragmatic idealism can inform contemporary social theory, and make a contribution to the very real and concrete problems faced by modern democratic institutions?I believe that the answer to both of these questions is "yes." Recognizing the importance of previous volumes devoted to Miller's philosophy, the editors present The Task of Criticism as the first comprehensive introduction to Miller's philosophy, and it attempts to cut a middle ground between a complete collection of essays and a "best of" anthology. In particular, sentences with the character-word mei1 are often (...) sought in classical works and interpreted as speeches on or about beauty, which has led to frequent misunderstandings of the classical texts and of the ancient Confucian aesthetic theory.The most typical among these misunderstandings, we think, is the misinterpretation of one of Mencius's remarks on the goodness of human nature-"To possess these qualities of goodness fully is beautiful" (Chongshi zhiwei mei)2-as a representative statement of the Confucian aesthetic theory of "the union of the beautiful and good." Although it is not clear who was the first to put this interpretation forward, it is now widely accepted and almost unquestioned that the statement "Chongshi zhiwei mei" is the classical proposition of the Confucian aesthetic theory after countless repetitions by aestheticians and educationalists. In my reply to George Crowder’s criticism of my essay on the Soviet Revolution in the last issue of Analyse & Kritik, I discuss two problems: the nature of a reasonable value pluralism and the relation between ethics and philosophy of history. William Whewell raised a series of objections concerning John Stuart Mill’s philosophy of science which suggested that Mill’s views were not properly informed by the history of science or by adequate reflection on scientific practices. The aim of this paper is to revisit and evaluate this incisive Whewellian criticism of Mill’s views by assessing Mill’s account of Michael Faraday’s discovery of electrical induction. The historical evidence demonstrates that Mill’s reconstruction is an inadequate reconstruction of this historical episode and (...) the scientific practices Faraday employed. But a study of Faraday’s research also raises some questions about Whewell’s characterization of this discovery. As self-conscious curators and critics of moral history, the early Confucians are relevant to the contemporary debate over the fate of memorials dedicated to morally flawed individuals. The philosophy of “presence” seeks to challenge current understandings of meaning and understanding. One can trace its origins back to Vico, Dilthey, and Heidegger, though its more immediate exponents include Jean-Luc Nancy, Hans Ulrich Gumbrecht, and such contemporary philosophers of history as Frank Ankersmit and Eelco Runia. The theoretical paradigm of presence conveys how the past is literally with us in the present in significant and material ways: Things we cannot touch nonetheless touch us. This makes presence a post-linguistic (...) or post-discursive theory that challenges current understandings of “meaning” and “interpretation.” Presence provides an overview of the concept and surveys both its weaknesses and its possible uses. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. Pp. viii + 296.Anyone who looks for a quick taste of (...) what is exciting and important about the research of the past two decades on Chinese women's history should pick up the reader edited by Susan Mann and Yu-yin Cheng. In eighteen chapters, each with a translator's preface and an introduction to the selected text, Under Confucian Eyes: Writings on Gender in Chinese History covers the period from the Tang to the Qing (when the Confucian orthodoxy steadily became entrenched), includes twelve genres, foregrounds women's own voices, and repeatedly introduces the non-Han peoples to the spotlight. The guiding standard for the choice of the diverse, rich, and in many cases new historical materials in the book is that they form a "dialogue" with and provide a "counterpoint, critique, or confirmation" of Confucian values and norms about gender roles (p. 5). The clearheaded and balanced attention to not only "counterpoint" and "critique" but also "confirmation" produces a dynamic and nuanced picture of Chinese gender relations that is radically different from the old stereotypes and yet remains firmly grounded in the reality of a society where Confucianism provided the most important system of values and institutions against which almost all other ideas and practices in traditional China have to be understood.The most crucial confirmed point is perhaps the high value set on family and household in Confucianism, which serves here to explain the considerable power and influence that Chinese women were able to wield despite their confinement in the inner quarters. The funerary biographies by Chen Liang (chapter 4), Luo Rufang (chapter 6), and Zhang Xuecheng (chapter 14), all eminent Confucian scholars, commemorate [End Page 684] women who upheld their families with principle, courage, and practical wisdom and attribute to them their kinsmen's success and sometimes sheer survival. As evidence from the other end is a letter that Gu Ruopu, a seventeenth-century matriarch and poet, wrote to her sons, in which she asserts "every fiber and every grain that this family owns are the fruits of my industry and hardship over several decades" and offers household instructions with indisputable authority (chapter 9). Always keeping in mind the assertiveness and authority of a matriarch like Gu and the deep admiration and emotion shown in the three biographies by the male elite will help us understand the recognition of women's functions and contributions in Confucian ethics and put in the right perspective the alternative means of self-fulfillment for Chinese women that is abundantly featured in the same volume.In its broad representation of alternative value systems, multiple voices in a single author or text, and formerly ignored populations and practices, the book offers an excellent sampling of the recent research agendas in Chinese women's history. Religion provides a prime example of the areas where the discovery and celebration of diversity and multiplicity are the order of the day. The two Daoist and Buddhist hagiographies (chapters 1, 2) and a rare extant autobiography of a Buddhist laywoman (chapter 8) set religious salvation above and against the obligations of family life.These voices of discontent form a contrast with the biographies by Luo Rufang and Zhang Xuecheng (chapters 6, 14), which either suggest a possible resolution of the conflict within the domestic context or insinuate highly ambiguous meanings of religion for contented Chinese mothers and wives. Besides religious and spiritual cultivation, communities such as poetry societies are shown as providing women with strong intellectual and emotional support beyond the kinship network (chapters 11, 12), and literary authorship creates an illusory world in which a frustrated woman of talent seeks communion with former worthies (chapter 16). The transcripts of the three Kyoto School roundtable discussions of the theme of 'The standpoint of world history and Japan' may now be judged to form the key source text of responsible Pacific War revisionism. Published in the pages of Chuo Koron, the influential magazine of enlightened elite Japanese opinion during the twelve months after Pearl Harbor, these subversive discussions involved four of the finest minds of the second generation of the Kyoto School of philosophy. Tainted by controversy and (...) shrouded in conspiratorial mystery, these transcripts were never republished in Japan after the war, and they have never been translated into English except in selective and often highly biased form. David Williams has now produced the first objective, balanced and close interpretative reading of these three discussions in their entirety since 1943. This version of the wartime Kyoto School transcripts is neither a translation nor a paraphrase but a fuller rendering in reader-friendly English that is convincingly faithful to the spirit of the original texts. The result is a masterpiece of interpretation and inter-cultural understanding between the Confucian East and the liberal West. Seventy years after Tojo came to power, these documents of the Japanese resistance to his wartime government and policies exercise a unique claim on students of Japanese history and thought today because of their unrivalled revelatory potential within the vast literature on the Pacific War. As self-conscious curators and critics of moral history, the early Confucians are relevant to the contemporary debate over the fate of memorials dedicated to morally flawed individuals. They provide us with a pragmatic justification that is distinct from those utilized in the current debate, and in many respects superior to the alternatives. In addition to supplying this curative philosophic resource, the early Confucian practices of ancestral memorialization suggest preventative measures we might adopt to minimize the chances of establishing (...) divisive and oppressive memorials in the future. This is an editorial report on the outcomes of an international conference sponsored by a grant from the National Science Foundation to the School of Education at Boston University and the Center for Philosophy and History of Science at Boston University for a conference titled: How Can the History and Philosophy of Science Contribute to Contemporary US Science Teaching? The presentations of the conference speakers and the reports of the working groups are reviewed. Multiple themes emerged for K-16 (...) education from the perspective of the history and philosophy of science. Key ones were that: students need to understand that central to science is argumentation, criticism, and analysis; students should be educated to appreciate science as part of our culture; students should be educated to be science literate; what is meant by the nature of science as discussed in much of the science education literature must be broadened to accommodate a science literacy that includes preparation for socioscientific issues; teaching for science literacy requires the development of new assessment tools; and, it is difficult to change what science teachers do in their classrooms. The principal conclusions drawn by the editors are that: to prepare students to be citizens in a participatory democracy, science education must be embedded in a liberal arts education; science teachers alone cannot be expected to prepare students to be scientifically literate; and, to educate students for scientific literacy will require a new curriculum that is coordinated across the humanities, history /social studies, and science classrooms. It is important for the materialist historian, in the most rigorous way possible, to differentiate the construction of a historical state of affairs from what one customarily calls its "reconstruction." The "reconstruction" in empathy is one- dimensional. "Construction" presupposes "destruction." Almost fourteen years after the death of Jacques Derrida, the least one can say is that his inheritance is as contested and fraught with rivalries, rejections, and appropriations as at the time of the flowering of Deconstruction in American universities in (...) the seventies and eighties. A halt was observed in 1988-89 after the posthumous revelations about Paul de Man's past in Belgium and Derrida's embattled defense of his friend. Today, in France, one often hears that "Derrida a fait l'Ecole mais n'a pas fait ecole," meaning that Derrida passed the entrance examination of the prestigious Ecole Normale Superieure where he taught for a long time, where he met Paul Celan, Louis Althusser, Michel Foucault and many other luminaries, whereas he never had a real "school" in France-no real institutional backing beyond the various Parisian places at which he taught later, or those that he founded like the College de Philosophie; his following constituted of young philosophers, only a few of whom became university professors in their turn and disseminated his teachings. However, the mechanisms of power within the French university remained closed to Derrida until the end; besides, he wanted to prevent the stereotyped reproduction currently observed from master to disciple.
