Muwāsāt encompasses the moral duty to provide aid to those in need, prioritising those closest to us while sharing what resources we can spare. However, should a person's legally protected values be at risk, assistance and solidarity become mandatory obligations. Islamic law recognises this social duty as fard al-kifāya, with muwāsāt as the justification for this sufficient obligation. On the other hand, muwāsāt is also included in the legal justification of in-kind obligations such as zakat and alimony. Muwāsāt actually has (...) a broad conceptual content that includes each individual in the society helping each other, sharing, and sharing what they have when necessary. The aim of muwāsāt is to keep social sensitivity towards those in need alive. Muwāsāt constitutes the wisdom of meeting the needs of the other party by sharing the resources available to each individual in the society when the legal values that Islam aims to protect are in danger. In this context, this study aims to evaluate the rights of those in need over those who have the means to meet their needs by considering the proposal in the context of the provisions. To prioritize the legal values of Islam and safeguard the sanctity of life, as well as protect bodily integrity and uphold the right to privacy, the principle of muwāsāt necessitates that all Muslims must uphold these responsibilities towards themselves, each other and the state. This study aims to investigate muwāsāt, which defines the duty to provide assistance to any individual who is cognisant of their plight, within their capacity, when their legal rights that must be safeguarded are threatened, in the framework of social accountability. In this context, it can be said that muwāsāt has a direct connection with the proposed obligations in Islamic law. Muwāsāt is included in the justification of fard al-kifāya obligations. However, the fact that the obligation of zakat, the obligation of fidya, and the responsibility of alimony are included in the legal justification of meeting the needs of the needy by those who are not dependent on anyone, shows us that muwāsāt is the basis of obligations involving cooperation. Similarly, the legal reason for banning interest is that it destroys the balance in society. In particular, the basis for the state to impose an upper limit on exorbitant prices is based on the principle that every individual has an equal right to meet basic needs. In other words, determining the profit margin in the prices of basic needs is a requirement of muwāsāt. The definition of the state’s obligation, along with individual responsibility in muwāsāt, aims to ensure that there is no individual in society whose basic needs are not met. Consequently, muwāsāt has an aspect that includes social responsibility and legal liability along with conscientious responsibility. This shows that Islam adopts the protection of life as the highest legal value. Muwāsāt is not limited to meeting basic needs, but also includes giving this support to a person when he needs moral support, sharing his pain by standing next to him, feeling him and internalizing his pain. For this reason, muwāsāt actually defines the moral stance that a Muslim should have. Based on this moral stance, it is safe to say that the most fundamental concern of Islam is to protect the material and spiritual integrity and human existence. This study aims to express, in the context of Islamic law, that the main purpose of Islam is to protect human beings in their material and spiritual integrity by examining and evaluating muwāsāt in its broad scope. Although Robert Zemeckis’s film Beowulf is a re-writing of the Old English epic Beowulf with a shifting of perspective, certain details in the film can only be understood by referring to the poem. That is, a better understanding of the film is tied closely to an awareness of certain narrative elements in the epic. The emphasis on Beowulf in the poem shifts to the Mother in the film. This shift obviously leads to a recontextualization of the narrative elements of the (...) former text. In the epic, Grendel is left without a father; however, in the film, he is fathered by Hrothgar but this biological fathering does not lead to linguistic castration. In their case, things are reversed: rather than the infant being castrated by the Law/language, the biological father is led to a psychic regression due to the son. This appears to be a dramatization of the conflicts between the Other and the shared Other/the representative of the paternal metaphor: that is, Hrothgar. This time, the Other conquers the representative of the paternal metaphor and annuls his masculinity, which radically changes the way in which we evaluate the course of events in the film. These departures make more sense if they are analyzed against the background of Lacanian epistemology. Biobanks act as the custodians for the access to and responsible use of human biological samples and related data that have been generously donated by individuals to serve the public interest and scientific advances in the health research realm. Risk assessment has become a daily practice for biobanks and has been discussed from different perspectives. This paper aims to provide a literature review on risk assessment in order to put together a comprehensive typology of diverse risks biobanks could potentially face. (...) Methodologically set as a typology, the conceptual approach used in this paper is based on the interdisciplinary analysis of scientific literature, the relevant ethical and legal instruments and practices in biobanking to identify how risks are assessed, considered and mitigated. Through an interdisciplinary mapping exercise, we have produced a typology of potential risks in biobanking, taking into consideration the perspectives of different stakeholders, such as institutional actors and publics, including participants and representative organizations. With this approach, we have identified the following risk types: economic, infrastructural, institutional, research community risks and participant’s risks. The paper concludes by highlighting the necessity of an adaptive risk governance as an integral part of good governance in biobanking. In this regard, it contributes to sustainability in biobanking by assisting in the design of relevant risk management practices, where they are not already in place or require an update. The typology is intended to be useful from the early stages of establishing such a complex and multileveled biomedical infrastructure as well as to provide a catalogue of risks for improving the risk management practices already in place. With agents relying more and more on information from central servers rather than their own sensors, knowledge becomes property not of a specific agent but of the data that the agents can access. The article proposes a dynamic logic of data-informed knowledge that describes an interplay between three modalities and one relation capturing the properties of this form of knowledge. ABSTRACT In this article I discuss Bernardine Evaristo’s Girl, Woman, Other as a transmodern narrative that gives voice to a marginalised group of black women living in Britain. Written in a hybrid style that combines prose and poetry and eschewing punctuation and long sentences, the novel interweaves sundry stories from the late nineteenth to the twenty-first century set in countries ranging from Africa, the Caribbean, and America to Britain. This networked structure exposes transtemporal and transnational patterns of diversity, connectedness and (...) relationality, as well as the distinctive genealogy of black British women and their maternal empowerment. I argue that the resilience of the characters in the face of social, racial and gender marginalisation springs from their empathic relatedness and solidarity. This emphasis on the importance of care for the other highlights the need for improving not only women’s rights and socioeconomic opportunities but of benefiting humanity on a broader scale. It is one of the main allegations impelled by feminist theorists against Kant's philosophy that the subject Kant placed at the base of his understanding of rationality is masculine, a Westerner and belongs to upper/middle class. In fact, there is considerable supporting evidence to promote this claim for mainstream Western philosophy in general and Kant's philosophy in particular. On the other hand, while reckoning with the history of philosophy, and examining whether it is possible to break away from philosophical concepts (...) and categories or not, is another matter of discussion. In this article, I try to focus on various possibilities that can reconcile Kant's philosophy with the demands of liberal feminism and an inclusive democratic participation principle. It is important that to discuss whether it is possible to make a new reading that can be reconciled with feminist demands by ignoring the misogynistic discourses in Kant's works, especially starting from the concepts of autonomy and personality. Today, many factors like traditions, prejudices, oppressive forms of government, etc. prevent women from taking part in public life as free agents and autonomously, and from being considered as “subjects with the status of rights”. Therefore, I argue that Kant's concepts such as autonomy, becoming a person and having the conditions for free action, do have something in common with feminist demands. (shrink)

Aydınlanma üzerine konuşmaya niyet eden birinin ilk kabulü, onun Avrupa‘da çıkmış olan bir ―durum‖ olduğu üzerine olacaktır. ―Durum‖ dedik çünkü Aydınlanma, hem ideolojik, hem siyasal, hem toplumsal, hem kültüreldir ve bu nedenle toplum içinde yaşayan bütün pratikleri etkilemiş ve etkilenmiştir. Yani Aydınlanma, yalnızca bunlardan biri değildir; o, hem düşünsel hem de eylemsel bir süreç olarak ele alınabilir. Bu eylemsel süreç bir şekilde Avrupa‘da başarıya ulaşmıştır. Ancak Türk Aydınlanması Avrupa odaklı hareket ettiği halde, kısmen başarılı olsa da genel olarak Osmanlı Devleti‘nin (...) çöküşünü hızlandırdığı kabul edilmektedir. Bu durumun sebebini ortaya koymak için ele aldığımız çalışmamızın asıl hedefi, bu iki aydınlanma arasındaki pratiklerin benzerlik ve farklılıklarını ortaya koymaktır. (shrink)

Covid-19, yeni koronavirüs salgını, insanoğlunun karşısına birdenbire çıkmış ve insan bu felaket karşısında yaşamını devam ettirebilmek için belli birtakım kurallara bağlı olmak zorunda olduğunu görmüştür. Pandeminin getirdiği yeni kurallara bağlı olarak kullanmaya başladığımız maske de bu şartlardan biridir. Tarih boyunca somut olarak maske kullanımı insana uzak ya da yabancı bir durum değildir. Maskenin sözlük anlamlarına baktığımızda tozdan ya da kimyasallardan korunmak için kullanılan bir araç olduğunu gördüğümüz gibi, bir de soyut anlamda kendini ötekine farklı bir şekilde yansıtma veya aktarma durumu (...) olarak ele alınabileceğini görmekteyiz. Biz bu çalışmamızda maskenin soyut kullanımından hareketle günümüzde kullandığımız bir araç olarak maskenin, ortak yönleri olup olamayacağını değerlendirmeye çalıştık. Öte yandan içinden geçmekte olduğumuz bu salgın hastalıkların tarihte ilk kez bizim başımıza gelen bir şey olmadığını görmezsek ve bu süreci değerlendirmezsek, geçiş döneminden sonra pandeminin birey, toplum, ekonomi, siyaset ve devlet görüşleri üzerinde ne tür değişiklikler yapacağını kontrol etmezsek, salgın günün birinde bitecek olsa bile olumsuz sonuçlarla karşılaşmayacağımızı söyleyemeyiz. Çünkü salgın insanın sadece biyolojik yönünü etkileyen bir felaket değildir, aynı zamanda insanın diğer yönü olan psikoloji tarafını da doğrudan ve dolaylı olarak etkilemektedir. İnsan psişik yönü de olan bir varlık olduğu için bu yönün de ele alınarak incelenmesi gerekir. Pandemi koşullarında birtakım kurallara uymayı alışkanlık haline getiren insan şu ana kadar getirmiş olduğu tüm değerlerinden hızlı bir şekilde kopma eğilimi göstermeye veya bu duruma gönüllü olmaya başlamıştır. Kurallara uymayan insanlar ise sorumluluk almadıkları için bir ahlak varlığı olmaktan uzak hale gelmişlerdir. Çalışmamız söz konusu salgının, insanın günlük hayatında kullandığı somut ve soyut maske tanımlarından hareketle, değerlerine nasıl yabancılaştığını ve öte yandan ahlaki sorumluluklarını ne şekilde göz ardı ettiği üzerine eğilmeye çalışmıştır. Çünkü insanın kendini bilmemesi yani eksikliğinin, aldatılırlığının ya da yanılabilirliğinin farkında olmaması onun temelde kendi benliğini, toplumsal rollerini, ahlaki ve siyasal varlık oluşunu yitirmesine sebep olacaktır. İnsan aklıyla ayakları yere basan ama kibriyle başını arşa kaldıran bir varlıktır. Eğer aklı onun kibirli başını eğdirmeyi başaramazsa kaçınılmaz olarak kibirli söz ve üslup, kibirli bakış ve görüş ortaya çıkacaktır. Kibir ile ortaya konulmuş her düşünce en temelde ahlaki sorunlar ortaya çıkaracağı gibi bir de, eksikliklerini kabul etmeyen dogmatik bir tutum (...) sergileyecektir. Kibir insana her yaptığının en doğru, en güzel, en kudretli olduğunu fısıldar durur. Bu fısıltı kişinin durup düşünmesine, aklın devreye girmesine izin vermedikçe de, hata yapılmaya devam edilir. Tüm bunlardan hareketle bu çalışmamızda günümüz felsefesinin temel bir sorunu olan, bir alanda uzmanlaşmış olma özgüveniyle birlikte kâinatın bilgisine bütünüyle sahip olunduğuna ilişkin bir düşünce geliştirmenin entelektüel dünyaya büyük bir darbe vuracağı, Yunus Emre’nin Risalet’ün Nushiye eserinin “Kibir Destanı” bölümünden hareketle ele alınacaktır. The problem of personal problem in philosophy is mostly handled as an identity or a “self” problem. When handled with the identity problem, personal identity means the identification of a person in a certain time point with a person at another time point. When handled together with the “self” problem; however, personal identity is considered a part of a substantive and metaphysical investigation. Hume’s philosophy includes both aspects of the discussions of personal identity in an opposing manner. In the present (...) study, Hume’s thoughts on the problem of personal identity will be examined. Firstly, the meaning of the idea of the self in his epistemology based on perception will be dealt with. Then, identity will be searched. It will be claimed that the thing that formed the theses of Hume about self and identity is his skepticism; and that Hume reinforces his thoughts on metaphysics with this investigation. In addition, it will be defended that in order to better understand the personal identity, it is necessary to consider his views on the nature of belief. (shrink)

There is a confusion over and inchoate understanding of how the past is made understandable through postmodernist historical orientation. The purpose of the article is to outline the characteristic features of the postmodernist movement in social sciences, to explain its confrontation with history, to document its critique of the conventional practice of history, and to discuss its implications for history education. The postmodernist challenge to the foundations of the discipline of history is elucidated with an emphasis on its epistemological underpinnings. (...) Purpose This study aims to investigate and comprehend the key factors that affect citizens’ adoption of electronic government (e-government) in Nigeria. In addition, the exploration intends to assess the potential determinants that may affect the Nigerian’s behavioural intention (BI) to adopt e-government services. The findings can be helpful for policymakers and government officials to provide e-government practices effectively. Design/methodology/approach The research adopted a quantitative method using the unified model of e-government adoption (UMEGA). In this study, data are collected from 410 (...) citizens aged above 18 years old and analysed using partial least squares path modelling technique. Findings The results showed that performance expectancy and effort expectancy positively influenced attitude (ATT) towards e-government. In contrast, perceived risk negatively impacted ATT towards e-government. However, social influence did not have a significant influence. The results showed that ATT and facilitating conditions (FC) positively influenced the BI to use e-government services. The explanatory and predictive power of UMEGA in Nigeria accounted for 63.9%. Originality/value To the authors’ knowledge, no prior studies analysed citizens’ adoption of e-government in Nigeria. This study, however, filled this gap. This study has contributed to the current knowledge of e-government adoption in Nigeria, which policymakers and government officials can use. (shrink)

Internationally, the need to advance science, technology, engineering and mathematics education is recognized as being vital for meeting social and economic challenges and developing a scientifically, mathematically, and technologically literate citizenry. In many countries, however, there are gender differences in the participation and achievement of girls and women in STEM education and STEM careers, usually to the disadvantage of females. This paper aims to identify challenges to female students’ participation in STEM both at post-primary level and beyond in the Irish (...) context. The research questions we aim to address in this paper are: what are student attitudes towards science, technology, engineering and mathematics as measured through interest and perceived ability in STEM, students’ valuing of STEM and students’ commitment to STEM? and what gender differences occur regarding students’ attitudes to science, technology, engineering and mathematics? A survey was completed by 308 post-primary students in Ireland as part of a one-year research project titled “STEMChAT: Women as catalysts for change in STEM education.” Data analysis compiled descriptive statistics, including response frequencies and percentages and median and interquartile range values, and compared gender differences in survey responses using the Kruskal–Wallis H Test. Results indicated that female students had significantly more positive attitudes to science compared to males while in comparison, males had significantly more positive responses to mathematics compared to females. Challenges regarding access to and understanding of STEM in the context of post-primary education are discussed. (shrink)

Bu çalışmanın amacı Martin Buber etiğinin özgünlüğünü keşfetmek ve geliştirmektir. Buber varlığı ilişki temelinde ele alarak Ben-O ve Ben-Sen ilişkisi olarak ayırmıştır. Ben-O ilişkisi insanın varlıkla sıradan tecrübesine karşılık gelirken, Ben-Sen ilişkisi insanın ötekiyle diyalog kurduğu anda ortaya çıkan daha derin bir ilişkidir. Ötekiyle ilişki; tüm etik değerlendirmeleri içinde barındıran, yaşamın dinamizmine uygun, insanlık tarihinin mitolojik ve etik dinamiklerini de içeren bir ilişkinin temellerini içermektedir. Ben-Sen ilişkisi yalnızca insanın insanlarla kurduğu bir ilişkiyi değil insanın canlı, cansız ve manevi tüm varlıklarla (...) kurduğu ilişkiyi açıklamaktadır. Ben-Sen ilişkisinin sadece insanın insanla olan ilişkiyi ele almaması etik üzerine yapılan çalışmalara yeni bir bakış sağlayacak niteliktedir. Buber’in etik anlayışı; diyalog etiği, ötekiyle ilişki etiği, durum etiği, antropolojik etik, varoluş etiği, meslek etiği, anarşist etik, postmodern etik gibi birçok etik anlayışla bağlantılıdır. Buber herhangi bir ahlaki norm ve etik koda bağlı olmayan, tarihsel, ontolojik ve ilişkiyi öncül kılan geniş çaplı içeriğe sahip bir etiğin temellerini ortaya koymaktadır. (shrink)

Infolge der tiefgreifenden Durchdringung unserer Lebenswelt mit digitalen Systemen hat sich die gesamtgesellschaftliche Anforderung formiert, diese Systeme gegen immer neue Formen von Angriffen absichern zu können. In diesem Beitrag zeigen wir, inwiefern der IT-Sicherheitsforschung hierbei eine zentrale Rolle zukommt, aber auch, dass im Rahmen dieser Rolle eine besondere forschungsethische Problematik entsteht. Weil IT-Sicherheitsrisiken strukturell neuartige Probleme für die gesellschaftliche Gewährleistung von Sicherheit aufwerfen, treten Forschende systematisch auch in die Rolle der Angreifenden. Dabei erhöhen Forschende durch den notwendigen Schritt der Veröffentlichung (...) gefundener Lücken die Gefährdungslage von IT-Systemen. Zugleich zielt die Entwicklung von Angriffstechniken normativ auf eine Stärkung gesamtgesellschaftlicher Sicherheit: die Sicherheitslücken sollen geschlossen und die Robustheit von IT-Systemen vergrößert werden. Hier wird ein Konflikt im Umgang mit IT-Sicherheitsrisiken deutlich, der einen Bedarf an ethischer Orientierung erzeugt. Im Beitrag zeigen wir, inwiefern sich in der Forschungspraxis auch bereits Anfänge einer systematischen ethischen Reflexion als Antwort auf diesen Bedarf herausgebildet und institutionalisiert haben. Da die Problematik im Umgang mit Sicherheitslücken aber noch nicht adäquat adressiert wird, vertreten wir die These, dass in der IT-Sicherheitsforschung der Schritt hin zu einer Bereichsethik für IT-Sicherheitsforschung erforderlich ist, um so adäquatere Orientierungsangebote für Forschende entwickeln und um die breitere gesellschaftspolitische Rolle der Sicherheitsforschung reflektieren zu können. In Ḥanafī legal thought, ta‘ātī (mutual delivery of goods and price) has been seen as a sales contract without the need for an additional legal transaction. This situation raises the question of whether the delivery transaction took place after a void (bāṭil) or invalid (fāsid) sales contract can be considered as a new contract that is revealed through ta‘ātī. In this study, which we aim to answer the aforementioned question, first of all, the issue of what kind of relationship is (...) established between the definition of the sales contract and the legitimacy of the ta‘ātī is discussed. Secondly, the relationship between the principles of “When something is void, what is implicit in that thing is also void.”, “What builds on what is invalid is also invalid” and the delivery transaction that took place after a void or invalid contract is discussed. Thirdly, it has been discussed whether the acceptance of the delivery transaction after a void or invalid contract as a new contract is dependent on the fact that the first contract has been legally terminated. In Ḥanafī thought two approaches have emerged regarding the relationship between ta‘ātī and void or invalid contract. According to Ḥanafī jurists based on the above-mentioned two principles, the delivery transaction that took place after a void or invalid contract is not a new contract. The fact that the delivery transaction becomes a new contract depends on the fact that the first contract was terminated in a legal way. In the approach of Ḥalvānī and Kāsānī, the fact that the delivery transaction that took place after a void or invalid contract gains the quality of a new contract is not dependent on the fact that the first contract is legally terminated. This approach is very important in terms of making it possible for the idea that “Delivery that took place after a void or invalid contract has the quality of a new contract.” to attribute the classical Ḥanafī thought. The ayn-dayn distinction in Ḥanafī legal thought shapes directly many regulations related to the law of obligations, from the legitimacy conditions of the contracts to the principles of compensation obligation. Three aspects are important in understanding the formative function of this distinction. The first of them is what is the conceptual content of ayn and dayn in Ḥanafī terminology. The second of them is what kind of relationship there is between the qualities of goods and ayn and dayn. The third (...) of them is what kind of differences exist between ayn and dayn in terms of their effects on legal regulations. According to Ḥanafī terminology, in a debt relationship, dayn means goods that have not yet been delivered to the creditor, whether they are in the hands of the debtor or not, in terms of goods (gold, silver and money) that are not suitable for determination by determining. Dayn represents the identical goods that is under the responsibility of the debtor in terms of non-existing identical goods. In terms of existing identical goods, dayn represents the identical goods that exist in clusters but have not yet been determined individually. Non-standard goods are goods that are not suitable for dayn because they are not suitable for abstraction from their material existence. Ayn represents the existing and determined goods in terms of non-standard goods and existing identical goods. Ayn represents the goods received by the creditor in terms of gold, silver, money and identical goods that are in the debtor's obligation from the beginning. What stands out among the differences between ayn and dayn is that although destruction and damage can be considered for ayn, they cannot be considered for dayn. In terms of some legal regulations, establishing a relationship between strict liability and dayn and between fault liability and ayn is a result of this. The other important differences between ayn and dayn are the fact that dayn is only determined by delivery and that postponement and remittance are specific to the dayn. (shrink)

As in all languages, Arabic and accordingly Quran which was revealed in a clear, fluent form of Arabic language, have words and concepts that are used in various meanings. The root “SHB” is one of these words which express different meanings depending on its context. This word is used ninety seven times in name and verb form in Quran to express “the togetherness/conversation which is constituted in different places and times, by people who have different ideas and beliefs, among themselves (...) (believer- believer or nonbeliever – nonbeliever) and with others (believer – nonbeliever) in this world and in the Hereafter”. -/- In this study, the basic/root meaning of the root “SHB” is identified firstly by the help of classical dictionaries, commentaries of Quran, and poems. Then the use of this word in Quran in name and verb forms is pointed, and its meanings which differ according to the verse, to the attaching words and to the context are identified. (shrink)

In On Not Expecting Too Much from Narrative, Lamarque (2004) challenges theories of narrative identity. For while narrativity might tell us something of interest about our selves, the requirements for this would be so strong that theories of narrative identity would not be able to meet them. In contrast, he identifies minimal conditions for narrativity, so that our identity could be of a narrative nature as well. But in that case, the concept of narrativity would be so weak that it (...) would hardly be able to tell us anything about ourselves. I first examine Lamarque's criticism of narrative concepts of identity. He shows that stories, understood in a minimal sense, are not found but told and that they establish a temporal relationship between at least two events. I then examine the concept of teleological explanations of action. Considering the problem of deviant causal chains that causalists are confronted with, they are at least a serious alternative to causal explanations of action. By doing that, I also attempt to render plausible the irreducibility of teleological explanations of action to causal ones. Subsequently, I outline some features of teleological explanations of action. Finally, I defend the idea that teleological explanations of action are essentially narrative explanations of action because they meet Lamarque's minimal conditions of narratives. I then make the case that these kinds of narratives are not trivial with respect to our personal identity but, on the contrary, are the prerequisite under which we can perceive ourselves as rational agents.
