The concept of lying is generally assumed to be closely related to the concept of assertion. However, the literature on lying has focused almost exclusively on lies expressed by unqualified assertions. Sometimes a speaker chooses to qualify her assertion by hedging, making her utterance a hedged declarative. This paper defends the thesis that lies can be expressed by untruthful hedged declaratives, and explores the implications of this thesis for the definition of lying. Many standard approaches to the definition of lying (...) allow lies to be expressed by untruthful hedged declaratives, which may explain why these cases have been ignored in the literature. However, untruthful hedged declaratives present a problem for a recently-proposed theory that analyzes lying in terms of the Knowledge Norm of Assertion. According to this theory, a necessary condition on lying is that in asserting that p, the speaker represents herself as knowing that p; however, in making an untruthful hedged declarative a speaker represents herself as having an epistemic attitude weaker than knowledge. The fact that such a theory fails to adequately explain untruthful hedged declaratives provides a reason to prefer alternative theories of lying. The discussion draws out some important observations about the concepts of lying, assertion, belief, and the relations between them. (shrink)

McCoy, Liu, Lutz, and Sisti (2020) raise concerns about “partial representation,” in which nonelected advocates or advocacy organizations fail to engage and hold themselves accountable to the full range of people they purport to represent. They are right to point out that the autism community is vulnerable to partial representation. This open peer commentary notes some elements among those engaged with autism that may not fit under the type of “federated model” of representation McCoy, et al recommend. Advocates should tread (...) carefully to avoid some types of harm that do not arise when forming federations on other topics. The influence of antivaxxers and other questionable or harmful movements might even lead us to think, despite the value of open debate and engagement, that there is benefit to partial representation if it prevents potential harms that could arise from legitimizing dangerous practices. While Medical-Legal Partnerships (MLPs) have improved the health and well-being of the people they serve, most healthcare institutions will only invest in an MLP if they are convinced that doing so will improve its balance sheet. This article offers a detailed estimation of the cost savings that an MLP targeted toward the most acute legal needs would accrue to an academic medical center (AMC) in North Carolina.

Philosophers have begun exploring justifications, such as liability and lesser-evil justifications, for consumer boycotting that are rooted in just war theory. The libertarian challenge holds that even morally objectionable consumer boycotts are nonetheless morally permissible in the sense that doing their constituent acts violates no rights or duties: consumer choice, information sharing, and advocacy are already permissible actions; boycotters do not acquire any special permissions that they did not already possess. I argue that even if consumers’ activities are generally permissible, (...) they can become impermissible when done with certain intentions. Liability-based accounts of permissible boycotting should accept the view that intention is relevant to permissibility. Accepting this view marks a discontinuity between mere consumer choice and boycotting, and a discontinuity between permissible and impermissible boycotting, strengthening the argument that liability-based and lesser evil principles may sometimes be necessary for the permissibility of some consumer boycotts. Definitions of health and disease are of more than theoretical interest. Understanding what it means to be healthy has implications for choices in medical treatment, for ethically sound informed consent, and for accurate assessment of policies or programs. This deeper understanding can help us create more effective public policy for health and medicine. It is notable that such contentious legal initiatives as the Americans with Disability Act and the Patients' Bill of Rights fail to define adequately the medical terms on (...) which their effectiveness depends. In Ethics and the Metaphysics of Medicine, Kenneth Richman develops an "embedded instrumentalist" theory of health and applies it to practical problems in health care and medicine, addressing topics that range from the philosophy of science to knee surgery."Embedded instrumentalist" theories hold that health is a match between one's goals and one's ability to reach those goals, and that the relevant goals may vary from individual to individual. This captures the normative implications of the term health while avoiding problematic relativism. Richman's embedded instrumentalism differs from other theories of health in drawing a distinction between the health of individuals as biological organisms and the health of individuals as moral agents. This distinction illuminates many difficulties in patient-provider communication and helps us understand conflicts between promoting health and promoting ethically permissible behavior. After exploring, expanding, and defending this theory in the first part of the book, Richman examines its ethical implications, discussing such concerns as the connection between medical beneficence and respect for autonomy, patient-provider communication, living wills, and clinical education. This book addresses some basic questions about intrinsic value: What is it? What has it? What justifies our beliefs about it? In the first six chapters the author defends the existence of a plurality of intrinsic goods, the thesis of organic unities, the view that some goods are 'higher' than others, and the view that intrinsic value can be explicated in terms of 'fitting' emotional attitudes. The final three chapters explore the justification of our beliefs about intrinsic value, including coherence (...) theories and the idea that some value beliefs are warranted on the basis of emotional experience. Professor Lemos defends the view that some value beliefs enjoy 'modest' a priori justification. In this 2004 book, Noah Lemos presents a strong defense of the common sense tradition, the view that we may take as data for philosophical inquiry many of the things we ordinarily think we know. He discusses the main features of that tradition as expounded by Thomas Reid, G. E. Moore and Roderick Chisholm. For a long time common sense philosophers have been subject to two main objections: that they fail to give any non-circular argument for the reliability of (...) memory and perception; and that they pick out instances of knowledge without knowing a criterion for knowledge. Lemos defends the appeal to what we ordinarily think we know in both epistemology and ethics and thus rejects the charge that common sense is dogmatic, unphilosophical or question-begging. Written in a clear and engaging style, this book will appeal to students and philosophers in epistemology and ethics. (shrink)

I outline and defend a version of the aesthetic argument for the existence of God, according to which theism explains our capacity for subjective aesthetic experience better than its major competitor, naturalism. I argue that naturalism fails to adequately explain the nature and range of our aesthetic experiences, since these are amenable neither to standard Darwinian explanation nor to explanation in terms of more complex sociobiological mechanisms such as sexual selection or between-group selection. I concede that aesthetic experience may be (...) an evolutionary spandrel but argue that the conjunction of this thesis with naturalism is highly improbable given the prevalence of beauty in the natural world. Theism, on the other hand, furnishes a robust personal explanation of aesthetic experience, since on theism God has both good reasons to bring such experiences about and the power to do so. I address an objection to the theistic explanation from broadly negative aesthetic experiences, arguing that God plausibly has many reasons to allow these. I contend that this formulation of the argument is superior to other extant versions, since it does not depend on controversial probability judgments, dubious analogies between natural phenomena and human artefacts, or objectivism about aesthetic values. As a neurodevelopmental condition that affects cognitive functioning, autism has been used as a test case for theories of moral responsibility. Most of the relevant literature focuses on autism’s impact on theory of mind and empathy. Here I examine aspects of autism related to executive function. I apply an account of how we might fail to be reasons responsive to argue that autism can increase the frequency of excuses for transgressive behavior, but will rarely make anyone completely exempt from moral (...) responsibility in general. On this account, although excuses may apply more often to autists than to others, the excuses that apply to autists are just the same excuses that can apply to anyone. (shrink)

The roots of othering of non-Muslims in Saudi Arabia are seen in the perception of umma as special and superior, therefore automatically categorising “non-believers” as “other”. The in-group and out-group demarcation strategies and consequent marginalisation are considered from both perspectives as bilateral and mutually exclusive. The focus is placed on othering e-space, where marginalised voices can be heard via virtual communication. The effects of virtual reality on real life interaction and resulting involvement in (...) controversial and taboo topics are also discussed. The traditional problem of evil is set forth, by no means for the first time, in Part X of Hume's Dialogues Concerning Natural Religion in these familiar words: ‘Is [God] willing to prevent evil, but not able? then he is impotent. Is he able, but not willing? then he is malevolent. Is he both able and willing? whence then is evil?’ This formulation of the problem of evil obviously suggests an argument to the effect that the existence of evil in (...) the world demonstrates that God does not exist. The purpose of this paper is to examine this argument, with a view to showing that while it is not a conclusive argument, it is much stronger than some apologists for traditional theism allow. It discusses some of the main theories of justification, including foundationalism, coherentism, reliabilism, and virtue epistemology. Ethicists, researchers and policy makers have paid increasing attention to the ethical conduct of research, especially research involving human beings. Research performed with and by undergraduates poses a specific set of ethical challenges. These challenges are often overlooked by the research community because it is assumed that undergraduate student researchers do not have a significant impact on the research community and that their projects are not host to research posing important ethical issues. This paper identifies several features characteristic of research (...) in undergraduate environments. The paper pays special attention to selective small liberal arts colleges, an important segment of higher education in the US, and advocates integrating instruction in research ethics wherever undergraduates are engaged in research. We consider two categorical syllogisms, valid or invalid, to be equivalent if they can be transformed into each other by certain transformations, going back to Aristotle, that preserve validity. It is shown that two syllogisms are equivalent if and only if they have the same models. Counts are obtained for the number of syllogisms in each equivalence class. For a more natural development, using group-theoretic methods, the space of syllogisms is enlarged to include nonstandard syllogisms, and various groups of transformations (...) on that space are studied. Jacques Derrida's insistence on submitting politics to the test of undecidability elicits the common accusation that an aporetic form of thought can only end in dubious conclusions concerning the pressing matter of politics and that no normative claims can emerge from a thought of radical undecidability. In this paper, I articulate the structural undecidability (aporia) that constitutes politics according to Derrida, the manner in which this structural undecidability elicits judgments, and the importance for critique of not ignoring it. In particular, (...) this structural undecidability is articulated within the event of foundation of any state or set of social relations by way of a declarative act. In addition, the aporetic structure of the political renders visible the essential relationship between (revealed) religion and politics. Ultimately, due to a necessary reference to an ultimate authority at any event of foundation, the political is always already theologico-political in character. (shrink)

In 2017, the German ethics commission for automated and connected driving released 20 ethical guidelines for autonomous vehicles. It is now up to the research and industrial sectors to enhance the development of autonomous vehicles based on such guidelines. In the current state of the art, we find studies on how ethical theories can be integrated. To the best of the authors’ knowledge, no framework for motion planning has yet been published which allows for the true implementation of any practical (...) ethical policies. This paper makes four contributions: Firstly, we briefly present the state of the art based on recent works concerning unavoidable accidents of autonomous vehicles (AVs) and identify further need for research. While most of the research focuses on decision strategies in moral dilemmas or crash optimization, we aim to develop an ethical trajectory planning for all situations on public roads. Secondly, we discuss several ethical theories and argue for the adoption of the theory “ethics of risk.” Thirdly, we propose a new framework for trajectory planning, with uncertainties and an assessment of risks. In this framework, we transform ethical specifications into mathematical equations and thus create the basis for the programming of an ethical trajectory. We present a risk cost function for trajectory planning that considers minimization of the overall risk, priority for the worst-off and equal treatment of people. Finally, we build a connection between the widely discussed trolley problem and our proposed framework. (shrink)

In a time when we as a society are in the process of deciding what our basic rights to health care are, it is critically important for us to have a full and complete understanding of what constitutes health. We argue for an analysis of health according to which certain states are healthy not in themselves but because they allow an individual to reach actual goals. Recognizing that the goals of an individual considered from the point of view of biology (...) and the goals of the same individual considered as an agent in the world might be different, we introduce a distinction between the health of an individual qua organism and the health of an individual qua person. We then argue that this distinction characterizes the evaluations made by patients and healthcare providers better than the widely discussed distinction between disease and illness. (shrink)

This paper explores the editorial influence of Joseph Banks on the Philosophical Transactions—still, at the time of his accession to the Presidency of the Royal Society in 1778, the most prestigious scientific periodical published in English. In particular, it examines how Banks forged, and wielded, personal influence over what went into the Transactions. Nominally, at least, the periodical was under the collective control of the Society's council, with significant statutory safeguards in place to prevent editorship by a presidential clique. Yet (...) this was exactly what Banks was able to speedily create and maintain. In this essay I explore how Banks accomplished this and the pressures it produced, addressing two key questions. First, I examine the social dimension of Banks's management of the Transactions (and what contemporaries thought of it), including particularly the questions of how and to whom access to the periodical was afforded or denied by Banks and his associates; and second, I consider how Banks and the Society dealt with the emerging competitive pressure of new commercial and learned society periodicals. I outline a sphere of scientific sociability partly created by informal processes of communicating, circulating, and evaluating papers developed by Banks and his close associates, and its significance for the Transactions in its engagements with other sites, genres, and conventions of scientific publication. Gleason's theorem for ������³ says that if f is a nonnegative function on the unit sphere with the property that f(x) + f(y) + f(z) is a fixed constant for each triple x, y, z of mutually orthogonal unit vectors, then f is a quadratic form. We examine the issues raised by discussions in this journal regarding the possibility of a constructive proof of Gleason's theorem in light of the recent publication of such a proof.

In ”Epistemology and Ethics,” Noah Lemos suggests that moral epistemology is mainly concerned with “whether and how we can have knowledge or justified belief” about moral issues. After addressing skeptical arguments, he considers how the moral epistemologist and moral philosopher should begin their account of moral knowledge. Lemos favors a particularist approach whereby we begin with instances of moral knowledge and use these to formulate and evaluate criteria for moral knowledge. After relating his approach to concerns about the nature (...) of the epistemic justification of moral beliefs as dealt with by foundationalists and coherentists, Lemos responds to arguments against particularist approaches in moral epistemology. Specifically, he addresses the claim that our moral beliefs must receive their justification from an independent moral criterion developed from nonmoral beliefs. (shrink)

This paper responds to Goodwin Liu's argument in Volume II of this Journal that a pedagogy must be supported by an appropriate theory of knowledge, and that the epistemology which best supports the service-learning pedagogy is anti-foundational pragmatism. The author shows that Liu's characterization of the pragmatist model of knowledge does not avoid the dualism which he sees as a fault of the traditional epistemology. After suggesting a remedy to this, the author then extends Liu's argument by indicating the limits (...) to what the appropriately modified epistemological support will sanction. These limits are shown to be more restrictive than Liu suggests. The result is an improved philosophical justification of the service-learning pedagogy and some suggestions for evaluating proposed curriculum. (shrink)

The ways in which people conceptualize the human–nature relationship have significant implications for proenvironmental values and attitudes, sustainable behavior, and environmental policy measures. Human exceptionalism (HE) is one such conceptual framework, involving the belief that humans and human societies exist independently of the ecosystems in which they are embedded, promoting a sharp ontological boundary between humans and the rest of the natural world. In this paper, we introduce HE in more depth, exploring the impact of HE on perceptions of the (...) human–nature relationship, the role of culture in HE, and speculating on the origins of HE. We consider potential implications for environmental decision-making, conservation and environmental science, and promoting proenvironmental behavior. We present empirical evidence on the pervasiveness and consequences of HE in WEIRD (Western, Educated, Industrialized, Rich and Democratic) populations, and potential interventions. Finally, we close with implications of human-exceptionalist thinking on other sustainability-related fields, including conservation practices, nature management, climate change adaptation, and environmental science. Understanding the cognitive and social drivers of this disconnect is vital on a planet now dominated by environmental change, as not only are humans increasingly impacted by natural disasters, but the choices they make can have ever more dire consequences for the sustainability of ecosystems. True Faith and Allegiance is a provocative account of nationalism and the politics of turning immigrants into citizens and Americans. Noah Pickus offers an alternative to the wild swings between emotionally fraught positions on immigration and citizenship of the past two decades. Drawing on political theory, history, and law, he argues for a renewed civic nationalism that melds principles and peoplehood.This tradition of civic nationalism held sway at America's founding and in the Progressive Era. Is language understanding a special case of social cognition? To help evaluate this view, we can formalize it as the rational speech-act theory: Listeners assume that speakers choose their utterances approximately optimally, and listeners interpret an utterance by using Bayesian inference to “invert” this model of the speaker. We apply this framework to model scalar implicature (“some” implies “not all,” and “N” implies “not more than N”). This model predicts an interaction between the speaker's knowledge state and the listener's interpretation. (...) Reports of research fraud have raised concerns about research integrity similar to concerns raised about financial accounting fraud. We propose a departure from self-regulation in that researchers adopt the financial accounting approach in establishing trust through an external validation process, in addition to the reporting entities and the regulatory agencies. The general conceptual framework for reviewing financial reports, utilizes external auditors who are certified and objective in using established standards to provide an opinion on the financial reports. These standards have (...) become both broader in scope and increasingly specific as to what information is reported and the methodologies to be employed. We believe that the financial reporting overhaul encompassed in the US Sarbanes–Oxley Act of 2002, which aims at preventing accounting fraud, can be applied to scientific research in 4 ways. First, Sarbanes–Oxley requires corporations to have a complete set of internal accounting controls. Research organizations should use appropriate sampling techniques and audit research projects for conformity with the initial research protocols. Second, corporations are required to have the chief financial officer certify the accuracy of their financial statements. In a similar way, each research organization should have their vice-president of research (or equivalent) certify the research integrity of their research activities. In contrast, the primary responsibility of the existing Research Integrity Officers is to handle allegations of research misconduct, an after-the-fact activity. Third, generally accepted auditing standards specify the appropriate procedures for external review of a corporation’s financial statements. For similar reasons, the research review process would also require corresponding external auditing standards. Finally, these new requirements would be implemented in stages, with the largest 14 research organizations that receive 25% of the total National Institutes of Health funding, adopting these research oversight enhancements first. The ideal of value free science states that the justification of scientific findings should not be based on non-epistemic (e.g. moral or political) values. It has been criticized on the grounds that scientists have to employ moral judgements in managing inductive risks. The paper seeks to defuse this methodological critique. Allegedly value-laden decisions can be systematically avoided, it argues, by making uncertainties explicit and articulating findings carefully. Such careful uncertainty articulation, understood as a methodological strategy, is exemplified by the current (...) practice of the Intergovernmental Panel on Climate Change (IPCC). (shrink)
