This article aims at contributing to the discussion about the relationships between ICT, computer science and policy-making by focusing on agent-based social simulation. Enabled, from a technical point of view, by the developments of Distributed Artificial Intelligence in the 1990s and by the features of the object-oriented programming paradigm, agent-based social simulations are a tool for the analysis of social dynamics that can be used also to support the design and the evaluation of public policies. After a brief description of (...) social simulation paradigm and of its impact on social sciences, the paper presents a simple agent-based model devised to analyze, even if in a very abstract way, a phenomenon that can rouse the interest of legal scientists: the interplay between damaging behaviors, punishment and social mechanisms of learning and imitation. Our goal is to show how agent-based simulation can be used not only to illuminate basic mechanisms underlying social phenomena but also to reflect, in an innovative way, on how society can deal with them. Law and economics scholarship has traditionally analyzed efficient breach cases monolithically. By grouping efficient breach cases together, this literature treats the subjective motives and the distributive effects of the breach as immaterial. The Restatement (Third) of Restitution and Unjust Enrichment introduced a distinction based on the intent and the effects of the breach, allowing courts to use disgorgement remedies in cases of ‘opportunistic’ breach of contract (i.e., ‘deliberate and profitable’ breaches). In this article, we evaluate this approach, focusing on the (...) effects of disgorgement remedies on allocative and productive efficiency, information-forcing and competitive effects, and restraint of breach-searching incentives. We show that, even from a purely consequentialist perspective, disgorgement remedies may be normatively warranted, especially when involving sellers’ breach. Recent experimental evidence revealed that the preferences and reactions of ordinary people are in line with our evaluation of the effects of opportunistic breach. (shrink)

L'ŒIL, Observatoire d'Ethique Interculturelle de Lyon, a pour objectif de préserver la dimension éthique de notre société démocratique et pluraliste dans son approche de l'homme. De nouveaux savoirs et techniques, le dynamisme de la recherche scientifique, les forces du marché, le souci de juste allocation des ressources, ainsi que les demandes de la société, mettent les acteurs des systèmes de santé dans des situations confuses. Cet ouvrage est le premier témoignage des rencontres et des recherches décidées par ces auteurs venus (...) d'horizons divers, engagés dans l'ensemble du monde francophone à partir de Lyon où se sont tenues les Premières Journées internationales francophones d'Ethique interculturelle, en 2004. Pour les auteurs de cet ouvrage, l'humanité peut mieux se constituer en s'ouvrant sur le différent, sur le multiple. Par regards croisés, ils questionnent la place relative du progrès, abandonnant le mythe simpliste selon lequel seul le progrès techno-économique entraîne les progrès sociaux, politiques et moraux... Au contraire, ils adoptent les principes d'incertitude et de complexité. Ils s'interrogent sur l'éthique interculturelle résultant d'une interaction à géométrie variable entre nos appartenances à différents groupes humains - culturels, sociaux, professionnels... sur le bon usage de la vie qui peut présupposer d'avoir en tête un archétype de la vie humaine, une vie exprimée dans sa plénitude. Certaines cultures ont exalté le héros, le chevalier ou le saint, avant de mettre en avant l'homme engagé ou l'entrepreneur accompli. Ils partagent la conviction que l'univers, la vie en général et la vie humaine en particulier ne sont pas des réalités monolithiques, mais résultent de l'interaction entre des polarités apparemment opposées, mais complémentaires. En effet, chaque être humain résulte des relations tissées avec l'Autre, s'enrichissant personnellement à travers chacune d'entre elles, s'ouvrant ainsi progressivement à toute l'humanité dans sa diversité. Nous construisons notre singularité en fonction de notre ouverture sur l'universel. We aim to do two things in this article. On the positive end, our goal is to explain how some seemingly incompatible aspects of belief live together, by presenting distinct mechanistic explanations of each of them: in particular we want to show how belief can be discerning, credulous, rational, and irrational. After clarifying our positive view, we take aim at some competitor views in the second half of the paper, particularly offering critiques of epistemic vigilance and social marketplace accounts of (...) belief. Herbert Lionel Adolphus Hart was born in Yorkshire in 1907 to second generation Jewish immigrants. Having won a scholarship to Oxford University, he went on to become the most famous legal philosopher of the twentieth century. From 1932-40 H.L.A Hart practised as a barrister in London. He was pronounced physically unfit for military service in 1940, and was recruited by MI5, where he worked until 1945. During his time at the Bar he had continued to study philosophy and at M15 (...) his interest was further stimulated by his philosopher colleagues in M16, Stuart Hampshire and Gilbert Ryle. After the war, Hart returned to Oxford to take up a philosophy fellowship, later to become Professor of Jurisprudence. H.L.A Hart single-handedly reinvented the philosophy of law and influenced the nation's thinking in the 1960s on abortion, the legalization of homosexuality, and on capital punishment. Hart's approach to legal philosophy was at once disarmingly simple and breathtakingly ambitious, combining as it did the insights of Austin and Bentham and the new linguistic philosophy of J.L. Austin and Ludwig Wittgenstein. He sought to elucidate a concept of law which would be of relevance to all forms of law, wherever or whenever they arose: his bestselling book, The Concept of Law, has sold tens of thousands of copies worldwide. In 1941, he married Jenifer Williams (a high-ranking civil servant, later an Oxford academic) with whom he had four children. Their relationship was an enduring if unconventional one. In the early 1950s, Jenifer was rumoured to be having a long-standing affair with Isaiah Berlin, one of Hart's closest friends. She was also, falsely, accused by the Sunday Times of having been a Russian spy, an allegation which was all the more scandalous given Hart's position at MI5 during the War. Nicola Lacey draws on Hart's previously unpublished diaries and letters to reveal a complex inner life. Outwardly successful, Hart was in fact tormented by doubts about his intellectual abilities, his sexual identity and his capacity to form close relationships. Her biography also sheds fascinating light on the origins of his ideas, and assesses his overall contribution. Above all, it chronicles of a life which had a depth ands impact far greater than many of Hart's readers have realized. (shrink)

It shows how the sense of taste informs our preferences for and relationship to nature, pushes us toward ethical practices of consumption, and impresses upon us the importance of aesthetics. Eating is often dismissed as a necessary aspect of survival, and our personal enjoyment of food is considered a quirk. Nicola Perullo sees food as the only portion of the world we take in on a (...) daily basis, constituting our first and most significant encounter with the earth. Perullo has long observed people's food practices and has listened to their food experiences. He draws on years of research to explain the complex meanings behind our food choices and the thinking that accompanies our gustatory actions. He also considers our indifference toward food as a force influencing us as much as engagement. For Perullo, taste is value and wisdom. The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. The empirical study of belief is emerging at a rapid clip, uniting work from all corners of cognitive science. Reliance on belief in understanding and predicting behavior is widespread. Examples can be found, inter alia, in the placebo, attribution theory, theory of mind, and comparative psychological literatures. Research on belief also provides evidence for robust generalizations, including about how we fix, store, and change our beliefs. Evidence supports the existence of a Spinozan system of belief fixation: one that is automatic (...) and independent of belief rejection. Independent research supports the existence of a system of fragmented belief storage: one that relies on large numbers of causally isolated, context-sensitive stores of belief in memory. Finally, empirical and observational data support at least two systems of belief change. One system adheres, mostly, to epistemological norms of updating; the other, the psychological immune system, functions to guard our most centrally held beliefs from potential inconsistency with newly formed beliefs. Refining our under- standing of these systems can shed light on pressing real-world issues, such as how fake news, propaganda, and brainwashing exploit our psychology of belief, and how best to construct our modern informational world. La philosophie hegelienne de la nature est le lieu singulier ou convergent la conscience scientifique moderne et la metaphysique pour fusionner en un moment inedit dans l'histoire de la pensee. Car nous opposons toujours d'une certaine maniere "theorie scientifique" et "discours philosophique", il nous est impossible de saisir la nature de la pensee de Hegel. L'auteur nous livre une interpretation de la mecanique de l'Encyclopedie des sciences philosophiques (1830) qui degage la pensee de Hegel des reductions kantienne et romantique. L'enracinement (...) du discours hegelien dans la conscience scientifique moderne est a la mesure des tensions qu'il entretient avec la science des modernes. La critique qu'opere Hegel de celle-ci n'est comprehensible qu'au regard de sa lecture de la Physique d'Aristote comme modele accompli du rapport entre philosophie et science empirique. During the thirteenth century, Aristotelian hylomorphism became the cornerstone of scholastic natural philosophy. However, this theory was fragmented into a plurality of interpretations and reformulations, sparking a rich philosophical debate. This article focuses on Robert Grosseteste (d. 1253), one of the earliest Latin philosophers to directly engage with Aristotle’s natural philosophy. Specifically, it delves into Grosseteste’s perspective on hylomorphism, emphasizing two controversial doctrines that characterized British scholasticism in the late thirteenth century: universal hylomorphism and formal pluralism. The former claims that (...) all substances, whether bodily or spiritual, are hylomorphic compounds, that is, they are made of matter and form. Formal pluralism, in turn, maintains that hylomorphic substances possess more than one substantial form simultaneously. After a brief introduction, the paper proceeds, first, to examine the type of hylomorphism endorsed by Grosseteste, shedding light on an obscure passage that seems to suggest universal hylomorphism. Second, the examination expands on Grosseteste’s theory of bodily form and emphasizes the apparent contradiction of this theory with universal hylomorphism. The discussion then turns to Grosseteste’s endorsement of formal pluralism and the functionality he envisioned being expressed by the bodily form. Finally, the paper draws conclusions about Grosseteste’s revised hylomorphic account. (shrink)

We first examine how these expressions are used, then how they are interpreted in their various uses. We then propose a model to account for these data, in which derived mass nouns denote instances of properties.

This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology. This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof as (...) a procedural matter preserves the complementarity of incentives created by the burden of proof and evidentiary rules. In social and cultural theory, topology has been used to articulate changes in structures and spaces of power. In this introduction, we argue that culture itself is becoming topological. In particular, this ‘becoming topological’ can be identified in the significance of a new order of spatio-temporal continuity for forms of economic, political and cultural life today. This ordering emerges, sometimes without explicit coordination, in practices of sorting, naming, numbering, comparing, listing, and calculating. We show that the effect of these practices (...) is both to introduce new continuities into a discontinuous world by establishing equivalences or similitudes, and to make and mark discontinuities through repeated contrasts. In this multiplication of relations, topological change is established as being constant, normal and immanent, rather than being an exceptional form, which is externally produced; that is, forms of economic, political and cultural life are identified and made legible in terms of their capacities for continuous change. Outlining the contributions to this Special Issue, the introduction discusses the meaning of topological culture and provides an analytic framework through which to understand its implications. With aims to both increase organ supply and better reflect individual donation preferences, many nations worldwide have shifted from ‘opt‐in’ to ‘opt‐out’ systems for post‐mortem organ donation (PMOD). In such countries, while a prospective donor's willingness to donate their organs/tissues for PMOD was previously ascertained—at least partially—by their having recorded positive donation preferences on an official register prior to death, this willingness is now presumed or inferred—at least partially—from their not having recorded an objection to PMOD—on an official organ donation (...) register. Using evidence regarding the presence and prevalence of selective donation preferences, and via exploration of how appeals to donation preferences are used to both motivate and legitimate shifts to opt‐out frameworks, this paper draws attention to a set of previously unexplored problems for opt‐out organ donation arising in contexts where: (a) individuals demonstrate selective post‐mortem organ/tissue donation preferences, (b) legislation provides prospective donors with the opportunity to selectively permit/refuse the donation of certain organs/tissues in line with these preferences. While selective preferences pose few problems for opt‐in systems where a selective occasion is built into the process of signing the donor register, this is not the case for opt‐out systems. The loss of this selective occasion can cause significant problems where appeals to preferences motivate/legitimate shifts to opt‐out but evidence regarding variable preferences does not feed into determinations regarding organ/tissue exclusions. The nature of these problems depends on how the authorization aspect of ‘opt‐out’ systems is framed (e.g. as presumed consent, deemed consent or, given the role of familial consent in many jurisdictions as consent in name only). The article discusses infinitism, the view that a belief is justified for a subject only if she possesses an infinite chain of available reasons for that belief. In its most recent and sophisticated version, the view allegedly escapes the problems that trouble its main competitors, foundationalism and coherentism, while avoiding the traditional objections which relegated it to a marginal place. The article argues that despite these improvements, sophisticated versions of infinitism face a pressing problem, viz. they are unable to appropriately (...) articulate propositional and doxastic justification. Structured argumentation systems, and their implementation, represent an important research subject in the area of Knowledge Representation and Reasoning. Structured argumentation advances over abstract argumentation frameworks by providing the internal construction of the arguments that are usually defined by a set of (strict and defeasible) rules. By considering the structure of arguments, it becomes possible to analyze reasons for and against a conclusion, and the warrant status of such a claim in the context of a knowledge base represents the main (...) output of a dialectical process. Computing such statuses is a costly process, and any update to the knowledge base could potentially have a huge impact if done naively. In this work, we investigate the case of updates consisting of both additions and removals of pieces of knowledge in the Defeasible Logic Programming (DeLP) framework, first analyzing the complexity of the problem and then identifying conditions under which we can avoid unnecessary computations—central to this is the development of structures (e.g. graphs) to keep track of which results can potentially be affected by a given update. We introduce a technique for the incremental computation of the warrant statuses of conclusions in DeLP knowledge bases that evolve due to the application of (sets of) updates. We present the results of a thorough experimental evaluation showing that our incremental approach yields significantly faster running times in practice, as well as overall fewer recomputations, even in the case of sets of updates performed simultaneously. World food production is facing exorbitant challenges like climate change, use of resources, population growth, and dietary changes. These, in turn, raise major ethical and political questions, such as how to uphold the right to adequate nutrition, or the right to enact a gastronomic culture and to preserve the conditions to do so. Proposals for utopic solutions vary from vertical farming and lab meat to diets filled with the most fanciful insects and seaweeds. Common to all proposals is a polarized (...) understanding of food and diets, famously captured by Warren Belasco in the contraposition between technological fixes and anthropological fixes. According to the first, technology will deliver clean, just, pleasurable, affordable food; future generations will not need to adjust much of their dietary cultures. According to the second, future generations should dramatically change their dietary habits (what they eat and how they eat it) to achieve a sustainable diet. The two fixes found remarkably distinct perspectives over dietary politics and the ethics of food production and consumption. In this paper we argue that such polarized thinking rests on a misrepresentation of the ontological status of food, which in turn affects the underlying ethical and political issues. Food is a socially constructed object that draws in specific ways on habits, norms, traditions, geographical, and climatic conditions. Although this thesis seems somewhat obvious, its consequences on the ethical and political perspectives on the future of food have not been derived properly. After introducing the issue at stake (¤1), we point out the polarities that characterize food utopias (¤2) and their ontological faults (¤3). We hence suggest that a socio-ontological analysis of food can better deliver the principles for a foundation of food utopias (¤4). (shrink)

Connected devices, such as smartphones and tablets, are exposed to a large variety of attacks. Their protection is often challenged by their resource constraints in terms of CPU, memory and energy. Security chains, composed of security functions such as firewalls, intrusion detection systems and data leakage prevention mechanisms, offer new perspectives to protect these devices using software-defined networking and network function virtualization. However, the complexity and dynamics of these chains require new automation techniques to orchestrate them. This chapter describes an (...) automated orchestration methodology for security chains in order to secure connected devices and their applications. This methodology exploits process learning to establish behavioral models and infer security constraints represented as logical predicates. It then generates and merges a set of chains of security functions on the basis of these predicates. These chains are finally compiled into low-level configuration rules and deployed into the network, optimizing for the underlying topology. The benefits and limits of such a methodology combining machine learning and verification techniques are evaluated by a set of experimental results. (shrink)

Nulle part aussi pathétiquement qu'en son œuvre ne s'opposent la clandestinité de l'ego et les jeux de la représentation. (shrink)

Dieu est Amour. Il est le Tout-Puissant, et l'homme, sa créature de prédilection, son enfant, se débat contre les forces du mal. Tel est le mystère! Le mal ne tourmente pas seulement la chair et le cœur de l'homme, il met en question sa confiance en Dieu et sa foi. Ce livre ne vise pas à donner à l'esprit une solution claire et suffisante, qui répondrait à ses questions. On ne résout pas un mystère. La tentation de se révolter contre (...) Dieu, à cause du mal qu'il permet, est fallacieuse, car la révolte n'a pas de sens en dehors de la Foi en ce Dieu qu'elle conteste; mais elle n'en a pas davantage à l'intérieur de cette Foi qui Le reconnaît comme infiniment bon et compatissant. Dieu est Amour et il est le Tout-Puissant : mais si son amour même introduisait au cœur de sa puissance une dimension de respect envers sa créature, qui se manifesterait en ce monde par une sorte d'impuissance? Si cette mystérieuse impuissance du Tout-Puissant était la condition nécessaire pour que l'Amour agisse en ce monde par la croix? Amère et incompréhensible ici-bas, la croix apparaîtra un jour comme elle est : instrument de victoire sur la mort, semence de vie et de joie dans la paix éternelle. C'est de cette « impuissance de Dieu » au sein de sa Toute-Puissance et au service de son Amour que l'auteur a osé traiter. (shrink)
