Society has historically not taken a benign view of genetic disease. The laws permitting sterilization of the mentally re tarded~ and those proscribing consanguineous marriages are but two examples. Indeed as far back as the 5th-10th centuries, B.C.E., consanguineous unions were outlawed (Leviticus XVIII, 6). Case law has traditionally tended toward the conservative. It is reactive rather than directive, exerting its influence only after an individual or group has sustained injury and brought suit. In contrast, state legislatures have not been (...) inhibited in enacting statutes. Many of their products can be characterized as hasty, unnecessary, ill-conceived, and based on the heart rather than the head. Moreover the lack of expert consultation sought has also been remarkable. One state legislature, for example, has advocated immunization for sickle cell anemia! Many others have enacted laws for the screening of inborn errors of metabolism, e.g., phenylketon uria, but have poorly defined the lines of responsibility to secure compliance. A spate of specific disease-related bills has emerged in the u.S. Congress, each seeking recognition and appropriations. Sickle cell anemia, hemophilia, Cooley's anemia and Tay-Sachs disease have been among the front-runners for support. Finally, in 1975, Congress has begun to examine an omnibus bill concerning all forms of genetic disease. The bill, termed the National Genetic Diseases Act is, however, still far from being enacted. As China and the United States strive to be the primary global leader in AI, their visions are coming into conflict. This is frequently painted as a fundamental clash of civilisations, with evidence based primarily around each country’s current political system and present geopolitical tensions. However, such a narrow view claims to extrapolate into the future from an analysis of a momentary situation, ignoring a wealth of historical factors that influence each country’s prevailing philosophy of technology and thus their overarching (...) AI strategies. In this article, we build a philosophy-of-technology-grounded framework to analyse what differences in Chinese and American AI policies exist and, on a fundamental level, why they exist. We support this with Natural Language Processing methods to provide an evidentiary basis for our analysis of policy differences. By looking at documents from three different American presidential administrations––Barack Obama, Donald Trump, and Joe Biden––as well as both national and local policy documents (many available only in Chinese) from China, we provide a thorough comparative analysis of policy differences. This article fills a gap in US–China AI policy comparison and constructs a framework for understanding the origin and trajectory of policy differences. By investigating what factors are informing each country’s philosophy of technology and thus their overall approach to AI policy, we argue that while significant obstacles to cooperation remain, there is room for dialogue and mutual growth. The American Foundation Myth in Vietnam deals with how the results of the Vietnam War challenged the long-standing belief in America's role in the world as a unique nation favored by God that carries a global responsibility with it. The author disputes the commonly held belief that America discarded this foundation myth, developed out of John Winthrop's idea of a "city on a hill," following Vietnam. He reexamines the myth in the context of American history to show that (...) the country still firmly attaches itself to the rhetoric of the foundation myth. The analysis divides Americans into one group that believes America's mission cannot be fulfilled without active involvement on the global stage, and one that maintains that its mythic goals are fulfilled most effectively by developing itself as the world's model for freedom and democracy. The tension created between these perspectives creates a dynamic and durable quality that fuels the power of the foundation myth even after a seemingly destructive event such as the Vietnam War. If, as some physicians of the national malaise claim, the American dream is dead and our history as a nation has reached its end, it seems fitting to reopen the question of what America is - or should be, or what was once thought she ought to be. Although we can hardly expect this to be persuaded any longer by the historic dreams of the new Adam, a review of that century-old challenge to debate, founded in the possibility (...) of an achieved human perfection, can provide u with humane instruction in understanding the present and the future. The author here gives us that review through the eyes of a major nineteenth-century commentator. Orestes Brownson's work is a significant part of American history, especially of its intellectual history. Arthur Schlesinger, Jr., wrote of Brownson: "...one feels the pathos of modernity in this stormy pilgrim...His life still touches contemporary nerves - from the antagonisms of capital and labor to the place of the Catholics in American society, from the nature of American culture to the death of God..." To expect solutions from - to expect agreement with - Brownson is to ask for more than this book intends. Much of his mastery was in the isolation and sharply etched presentation of the question. Clarity and depth of thought are everywhere reflected in his work. Whither that thought leads is clearly the work of ultimate judgment by the reader. By allowing Brownson to speak for himself, and confining critical comments chiefly to footnotes, the author presents him as still vigorously alive and, it is hoped, as a formative influence in America's future.'. Conceived in Liberty is a cultural, sociological and geopolitical review of the uniquely American notion that the country and its people are "exceptional." While all nations have their own patriotic commitments, no other people have outwardly declared their power as vigorously as have Americans, especially since World War II. John J. Tierney, Jr. advances the idea that liberty is the singular source of the power of the American worldview and all other elements of this society--equality, patience, charity, justice, (...) etc.--are derived from liberty. He argues that this worldview comes from this one source and is responsible for the many movements that may engage the public's interest, such as women's rights, civil rights, and voting rights. Such movements are all positive, but they could not exist in a society devoid of liberty. The characteristic of religions and cultural identities of Ho Chi (...) Minh City is in the process of transformation, receipt and selection of the cultural and religion elements of those cultures. B a c k g r o u n d. According to the genre characteristics, the article is a form of publicizing analytical conclusions from the experience of research in the field of the philosophical Chinese studies at the National Academy of Sciences of Ukraine from 1991 to the present day. The material for understanding was supplied from the environment of scientific professional activity of prominent figures of Ukrainian philosophical Sinology from the H. Skovoroda Institute of Philosophy of the (...) NAS of Ukraine and the A. Krymskyi Institute of Oriental Studies of the NAS of Ukraine. The scientific achievements of academic Sinologists, who are leading researchers of Chinese philosophical education, science and culture from the archaic to modern times, are highlighted. They are, namely: V. Kiktenko, V. Pyrohiv, V. Hamianin, S. Kapranov, Y. Hobova and A. Usyk. M e t h o d s. The article uses an analytical approach based on the study of historical and philosophical sources. The methodological basis of the research is the main methods of historical and philosophical science: problem-categorical analysis, socio-cultural analysis and biographical analysis. At the same time, the methods of situational and contextual analysis of scientific texts are applied. R e s u l t s. Four conditional thematic vectors of the progress of academic philosophical Sinology in modern Ukraine are classified, namely the study of: 1. the history of ancient Chinese philosophy, especially Confucianism; 2. the history of Chinese philosophy in the 19th – early 21st centuries; 3) the history of Ukrainian Sinology in the 18th – early 21st centuries; 4. the history of modern foreign Sinology. The director of the A. Krymskyi Institute of Oriental Studies of the NAS of Ukraine and the head of the Ukrainian Association of Sinologists V. Kiktenko very effectively studies all these vectors, especially the last three of them. His colleagues at the institute V. Pyrohiv, V. Hamianin and Y. Hobova mainly research the first of these vectors, and primarily the history of Confucianism. Employees of the H. Skovoroda Institute of Philosophy of the NAS of Ukraine S. Kapranov and A. Usyk are also focused scientific attention on the history of Confucianism, in particular, the second of them studies social ethics and anthropology of Confucius. C o n c l u s i o n s. As a result it was established that modern domestic philosophical academic Sinology is a qualitatively new and innovative direction of Oriental studies in independent Ukraine. This discipline was formed as a result of the two-century progress of Ukrainian Chinese studies from the era of Hetmanshina until now. V. Kiktenko and his colleagues have made a significant and already internationally recognized contribution to the study of both the classical philosophical schools of Ancient China and their ideological heirs, in particular, the leaders of the PRC and the CCP from Deng Xiaoping to Xi Jinping during these thirty years. V. Kiktenko also laid the foundations for the study both of the history of Ukrainian Chinese studies and of modern foreign, primarily Western European and North American, Sinology. (shrink)

Considering the lack of substantive scientific or theoretical studies about ethics in small and medium sized enterprises (SMEs) in Latin America, this paper examines the context of an existent paradox, based upon the perspective of experts and academicians of Latin America and the Caribbean. These countries live different realities, due to their respective European cultural influences, as well as to racial and economic issues. Such facts impact the size and characteristics of their industries. On the other hand, the SMEs face (...) more similarities in the region, so they will be treated as a group in the discussion of ethics and corporate social responsibility (CSR) in Latin American SMEs. As this topic has not been sufficiently investigated in this geographic area, the objective of this exploratory study is to offer a contribution for future research. It raises the main dilemmas and intends to explain how legislation and common practices enable and perhaps lead SMEs to choose unethical strategies to survive and compete in the market. These enterprises are growing in number and in job creation, but do not participate in the Gross National Product in the same proportion. Informality, tax evasion and corruption are gradually caused or erode morality in business, but can contribute to corporate social responsibility in the region. The paper tries to show positive and negative aspects of apparently unethical practices and discusses challenging ways to solve complex problems that are common in most Latin America. (shrink)

This paper documents the types and amounts of aid exchanged between adults and their non-coresidential parents. Data for the study are drawn from a representative national sample survey of Americans age 19 and older conducted in 1987–1988. Exchanges of monetary and material resources, childcare, household assistance, and companionship and advice are considered.Patterns of intergenerational exchange are found to differ by gender, family structure, age, ethnicity, and socioeconomic situation. Differences in exchange between males and females and between whites and Mexican-Americans (...) are related to other life-course characteristics, and to the availability and proximity of kin. Blacks and persons living in poverty are shown to be less involved than other groups in intergenerational exchanges. Finally, patterns of prior assistance and the available needs and resources of the respondents and their parents are found to influence current patterns of exchange. (shrink)

The consideration of racial differences in the biology of disease and treatment options is a hallmark of modern medicine. However, this time-honored medical tradition has no scientific basis, and the premise itself, that is, the existence of biological differences between the commonly known races, is false inasmuch as races are only sociocultural constructions. It is time to rid medical research of the highly damaging exercise of searching for supposed racial differences in the biological manifestations of disease. The practice not only (...) condoned but required by the National Institutes of Health of utilizing racial identification as a demographic characteristic with assumed biological implications is at best badly flawed, and at worst unintentionally contributes to perpetuating the fallacy of natural differences between persons of different skin color, which has been used in the past to advance the cause of racial discrimination. In the article on material of seventeen texts, the problem of world outlook strategy in the American novel of the 21th century is studied. The most influential author’s models are considered: neodecadence, post-apocalyptic humanity, personal versions of social and psychological realism and existentialist consciousness. The main attention is paid to the description and interpretation of the general for modern American novels of a national picture of the world. The family history remains the stable level of a narration. (...) At other level, there is a depressive or protest word about a condition of life, about the absolute beginnings dooming the person to suffering. In the narrative center, there is a hero, who has to solve personal problems in the context of the opened emptiness capable to get metaphysical meanings or to replace them. Reducing dynamics of a plot and formation of character, the novel becomes a form of the image of a steady state. For this state, the complex combination of two literary archetypes is characteristic: Job and Hamlet. The love to the world is not provided, the problem of finding of arguments for continuation of life is perceived by writers as main. If the classical American novel has positioned itself between dream and the tragedy, the modern novel settles down between everyday life and emptiness. The key paradox of the studied art texts is connected with it: two forms of fatigue - not only from the Absolute responsible for weight of existence, but also from its absence connect in one complex. The hero does not know with whom he does not agree: God or with essentially subjectless life depriving any God of will, power and sense. Search of new moral rituals is represented in this situation quite natural. (shrink)

The Low Countries (Belgium and the Netherlands) have their own traditions when it comes down to sports. Sports such as football, cycling (Belgium) or skating (the Netherlands) take center stage with the sports-minded public, and are a central element in popular culture, somewhat similar to the way cricket is part of the British culture. Since many years now, social scientists and philosophers in this countries have started to think about the impact of sports on everyday society and the different aspects (...) involved in it. At first, in the eighties, topics like physicality, game, fair play and the definition of sport were discussed; later on, and especially from the beginning of the 20th century the debate on doping, enhancement in general and the relationship of sports and technology became more prominent; today, also themes like sports and nationality or sports and the value of sports are at the centre of the debates. In this article, we present an overview of the development of the philosophy of sports in the Low Countries in the last two decades. We sketch the main strains of interest, and focus on the most relevant topics. In particular we concentrate on the characteristic features and issues of philosophy of sports in the Low Countries: what are these features and issues? How can they be explained and appreciated, and how do they contribute to the international, largely Anglo-American and analytical debate in philosophy of sports. (shrink)

The objective of this research is to identify relationships between social context dimensions and hardiness in elite weightlifting athletes. Methods: The design: non-experimental, cross-sectional and correlational, the participants were 20 athletes who belong to the elite as the national team of Mexico, they are between 19 and 28 years of age, M = 22.05 SD = 2.91, 8 men (40%) and 12 women (60%). 2 instruments were used, the first is the Perception of Factors Related to Excellence in Sport (...) (PFED), (Simón, 2009) consisting of 54 items 6 variables, coach, environment and resources, athlete, family, nature of training and characteristics of the training and the second the questionnaire of hardiness in Central American and Caribbean Athletes (PRDCC) (Ponce, 2017; Ponce-Carbajal et al. 2015) of 18 items and three variables, commitment control and challenge. In the procedure, a file was created in google forms and coaches who are in charge of athletes from the Mexican national weightlifting team were contacted. The statistical analyzes used were frequencies, descriptive, reliability, and Spearman's bivariate correlations. Results: Adequate internal consistency in almost all the variables, between.40 and.92 in the 2 questionnaires. In the correlations between variables of the social context and those of the hardiness, relationships were evidenced between the total resistant personality and the nature of the training with an r =.767** and the challenge variable correlated with two, the first is the nature of the training r =.834** and with the characteristics of training r =.671**. Conclusion, the relationships between the variables of the social context and the resistant personality are confirmed. (shrink)

Background: Patient autonomy has been promoted as the most important principle to guide difficult clinical decisions. To examine whether practising physicians indeed value patient autonomy above other considerations, physicians were asked to weight patient autonomy against three other criteria that often influence doctors’ decisions. Associations between physicians’ religious characteristics and their weighting of the criteria were also examined. Methods: Mailed survey in 2007 of a stratified random sample of 1000 US primary care physicians, selected from the American Medical Association (...) masterfile. Physicians were asked how much weight should be given to the following: (1) the patient’s expressed wishes and values, (2) the physician’s own judgment about what is in the patient’s best interest, (3) standards and recommendations from professional medical bodies and (4) moral guidelines from religious traditions. Results: Response rate 51% (446/879). Half of physicians (55%) gave the patient’s expressed wishes and values “the highest possible weight”. In comparative analysis, 40% gave patient wishes more weight than the other three factors, and 13% ranked patient wishes behind some other factor. Religious doctors tended to give less weight to the patient’s expressed wishes. For example, 47% of doctors with high intrinsic religious motivation gave patient wishes the “highest possible weight”, versus 67% of those with low (OR 0.5; 95% CI 0.3 to 0.8). Conclusions: Doctors believe patient wishes and values are important, but other considerations are often equally or more important. This suggests that patient autonomy does not guide physicians’ decisions as much as is often recommended in the ethics literature. (shrink)

El análisis propuesto contrasta las bases mencionadas con algunos casos llevados ante la jurisdicción del Sistema Interamericano de Derechos Humanos, cuya última fase descansa en las sentencias de la Corte IDH.ABSTRACT: The present paper proposes an analysis of the Fundamental Rights of the indigenous peoples in the light of the international principles of Free Determination and Prior Consultation, as foundations and budgets of the other Indigenous Rights. Charles Darwin argued that human beings are what happen whenphysical laws act upon a planet with the characteristics that earthhad five billion years ago. Similarly, I have argued that theprimacy of individual will is what eventually happens when asociety allocates and limits coercion based upon rights. From timeto time particular visions of the good or the right dominate publicbehavior, but they are eventually enframed by rights — the authoritative claim of each person to respect.I have argued that the propositional structure (...) of American law—the laws themselves — can be seen to be a logically consistentsystem of propositions stemming from the axiom that the will ofeach person is worthy of respect. This is an explanatory, not anormative, proposition. The axiom was not put there by anyoneand the law derived from it, any more than the human brian wasput there and the theory of relativity derived from it. The axiomcame to be embodied in k because of a fact — the single universalcharacteristic of human beings that is relevant to the question ofarranging coercion is individual will — and a process — the right ofeach person to demand a justification for coercion used upon him.Since will is universal to human beings, this would suggest thatany rights-based legal system would evince a general structuresimilar to our own. Particularities of national culture, naturalresources, population density, and so on would produce a verydifferent liberty frontier from the one facing this country andhence, different laws. But the general structure of law — the relationship between principle and policy decision, the role of thebasic rights, and so on — should be similar. This similarity shouldprovide a common basis for cooperation between states, transcending particularities of economic structure, political structure and ideology. We have seen that a very broad range ofeconomic and political institutions may be justified. The essential difference between states lies not in the different ways that theyarrange institutions but in the different ways that they justifythem. Those that justify them to people as persons are similar.Those that justify them by conformity to a design are different.The theory set out here is not a design. It is an explanation. Onevirtue of explanations is that they draw forth other explanations.More importantly, they offer perspective — they tell us what weare “up to.” As the social relations which law must rationalizebecome ever more complex, perspective becomes ever more necessary. The simple laws have already been written. The connectionbetween the doctrine of consideration and the first principle isobvious. The connection between the “hard look” doctrine ofreviewing administrative agencies and the second principle isnowhere near so obvious (though it is a lovely example of thejudicial process enframing the realm of uncertainty). The morecomplex and artificial the institution, the poorer the guidance ofintuition and the more necessary are conscious guides to decision.Justification comes easy to printers. Most of them don't knowwhy a page of print that has straight margines left and right is“justified.” They don't need to know, for the idea has immediateintuitive appeal; it is easy to accept and to remember, and, onceremembered, it is an effective guide to behavior. It is easy to seethat this line of print is not justified and to do somethingabout it. It is not so easy to tell whether the “hard look” doctrine orthe enforcement of a surrogate motherhood contract sits fairly on itspage. Justification of law requires an understanding of thecriterion against which it is being done. There is an intuitive core— a “sense” — to any act of judgment, but that core can be illuminated and developed by an understanding of the framework withinwhich it operates. (shrink)

This study analyzed the national data on life-sustaining treatment decisions from 2018 to 2020 to find out the characteristics of South Korea’s end-of-life procedure according to the decision-making approach and process. We collected the data of 84,422 patients registered with the National Agency for Management of Life-sustaining Treatment. We divided the patients into four groups (G1, G2, G3, and G4) according to the decision-making approach. A descriptive analysis of each group was conducted using indicators such as the patient’s (...) age, status, diagnosis, and content of forgoing life-sustaining treatment. Additionally, logistic regression analysis was performed by dividing the patients into self-determining (G1, G2) and non-self-determining patients (G3, G4). Cancer was the most common diagnosis for each group. The period from life-sustaining treatment decision to implementation was 10.76, 1.01, 0.86, and 1.19 days for G1, G2, G3, and G4, respectively. In the logistic regression analysis, the self-determination ratio was higher for 40–49 years old and lower for cardiovascular disease and gastrointestinal disease. Age was has a major impact on life-sustaining treatment decisions (LSTD), and with increase in age, the family, and not the patient, made the LSTD. The LSTD method also differed depending on the disease. The self-determination rates of patients with circulatory or digestive diseases were somewhat lower than that of those with neoplastic diseases. The period from decision-making to implementation is short for end-of-life care. (shrink)
