This article presents the new German law on advance directives from 1 September 2009. The history of the parliamentary process of this law is described, the present regulations are explained, their relevance for medical practice discussed and shortcomings are identified. Finally, the new law is compared with other regulations in the international context. Previously established legal practice in Germany has now become largely confirmed by the new law: An advanced directive must be respected in any decision concerning medical treatment, regardless (...) of the stage of the illness. It can be informally revoked at any time, even with limited decision-making capacity. Nobody may be obliged to issue a directive in any way. Advance directives do not need notarisation or routine updating after certain time intervals. Provided that the patient, who is no longer mentally competent, has issued a lasting power of attorney, or provided that the patient has been appointed a healthcare proxy by the courts, this authorised surrogate must assert the patient's will. The role of the guardianship court is clarified: it only needs to be involved in cases of disagreement as to the patient's will. The new German law thus combines more legal certainty with a liberal emphasis on patient autonomy and flexible, adaptable regulations. (shrink)

Trust is of great significance to the economic and social development of a country. In the case of China, the trust of rural women has undergone tremendous changes along with the development of rural areas. It is seen that the trust of rural women has changed from localized to generalized trust, and it is stated that the major factor leading to this transformation is education. To explore the phenomenon empirically, the current study uses the survey data of rural women sourced (...) from China Family Panel Studies over the year 2018. Through the ordered probit model, the study reveals that education plays a significant role in influencing rural women’s generalized trust and localized trust. Through mediation analysis, the study further reveals that reliance on Internet information, access to public resources, and income are the factors mediating the relationship between education and generalized trust. Besides, the outcomes further unveil that the impact of education on localized trust is stronger when the level of mobility is low. For robustness check, the current study additionally employs a regression discontinuity model. The overall findings elucidate that education is the major factor triggering the trust of rural women in China. The findings propose that policymakers in China should imply education-oriented strategies as individuals with higher levels of education are more inclined to trust others. (shrink)

This paper introduces the Generalized Argumentation Theory which takes argumentation as a locally rational socio-cultural interaction governed by social norms and carried out through discourse between the members of a socio-cultural community in order to reason things out. Then we bring in the basic structure of generalized argumentation and the localized procedure of Generalized Argumentation Theory for studying the argumentative rules. On the basis of above introduction, we use the localized procedure to analyze a case of political argumentation by reciting (...) poems in ancient China. By doing so, it’s indicated that political argumentation by reciting poems, in essence, takes cultural principle of Li of the Spring and Autumn Period as argumentative rules and uses poems to express ideas, in virtue of which arguments are accepted as locally rational by the politicians at that time. At last, the Little Red Book quotation fight, a similar political activity, is discussed briefly to show the significance that ancient Chinese political argumentation has on contemporary argumentation. 何定生是顧頡剛在廣州中山大學任教時的學生，早年即已有文章收錄於《古史辨》中，而享有古史辨學者的光環。一九四九年隨國民政府來臺，任教於臺大中文系。生前出版有《詩經今論》一書，收錄三篇《詩經》研究論文，為 臺灣學界所仰重。一九七○去世後，其弟子何寄澎、曾志雄整理遺稿，出版《定生論學集──詩經與孔學研究》，收錄四篇論著。《何定生著作集》即在此二書的基礎上，復廣泛蒐求其論著、書信與相關資料，編為二冊。第一冊 為《何定生著作集一：詩經、孔學及其他》，第二冊為《何定生著作集二：尚書與文法》，雖尚未能將何氏著作網羅殆盡，但已足將何氏學術的主要面向及研究精華充分展現出來。 何定生深受五四以來新文化運動的影響，繼承顧頡剛及古史辨的學風，將此學風在戰後的臺灣學界持續發皇。何定生的學問主要表現在《詩經》，強調復古解放的精神，他呼籲今日的《詩經》研究，應從清學的漢學壁壘中出來， 以復於原始的樂歌地位。他認為惟有站在《儀禮》的樂歌地位來讀《詩經》，從人性的同類意識來接觸人性，才有碰到詩人靈感的可能。.

Kant’s Dreams of a Spirit Seer has puzzled most of its readers since its publication in 1766. Herder complained in general terms about the lack of unity and coherence of the book as well as Kant’s dialectical method of presenting both sides of a problem without offering his own solution. Mendelssohn was in doubt about whether Kant wanted to ridicule metaphysics or make a case for Swedenborg’s visions. Another exegetical puzzle has not been noted yet: Dreams discusses not one, but (...) three different versions of a ‘metaphysics of spirits’. All of them are mutually incompatible. In other words, the two versions of a metaphysics of spirits that Kant criticises in the first part of the book are both of them different from Swedenborg’s own claims, as they are discussed in the second part. And the two versions discussed within the first part are not homogeneous, either: the metaphysics discussed in the first chapter of the first part (the ‘tangled knot’) and those that seem to form the foundation for the second chapter of the first part (the ‘fragment of occult philosophy’) are again incompatible. And neither of them fits with what Kant analyses as Swedenborg’s metaphysical position in the second part: The position of the ‘tangled knot’ can tentatively be labelled as ‘crypto-materialist’. Swedenborg’s own position is characterised in the text as ‘idealist’. The ‘fragment of occult philosophy’ in contrast is probably best described as ‘dualist’. If this diagnosis is correct, it reinforces Herder’s complaints about the lack of coherence of Dreams as well as Mendelssohn’s worry about its targets. And it adds the additional challenge to explain how there can be a ‘crypto-materialist’ metaphysics of spirit-seeing. I propose to weaken the impact of these problems by identifying a second target of Kant’s scorn in Dreams – a metaphysical position Kant could be sympathetic with as far as its fundamental intentions are concerned, but that draws his ire because of an equally comprehensive failure in the realisation of these intentions. In this work, we investigated a covert communication method in wireless networks, which is realized by multiantenna full-duplex single relay. In the first stage, the source node sends covert messages to the relay, and the relay uses a single antenna to send interference signals to the adversary node to protect the covert information being transmitted. In the second stage, the relay decodes and forwards the covert information received in the first stage; at the same time, the relay uses zero-forcing beamforming (...) to send interference signals to the warden to ensure covert transmission. The detection error rate, transmission outage probability, maximum effective covert rate, and other performance indicators are derived in two stages, and the total performance of the system is derived and analyzed. Then, the performance indicators are verified and analyzed by simulation. Our analysis shows that the maximum effective covert rate of using the characteristics of multiantenna to interfere with Willie in the second stage is taken as the total covert performance of the system, and the transmission interruption probability is significantly less than that of the first stage, so the corresponding maximum effective concealment efficiency will be greater. The pattern, process, and mechanism of residential heterogeneity vary significantly with different geographical scales. However, most traditional methods ignore the checkboard and modifiable areal unit problem, which may cover up the complexity and hierarchy of social space. Taking Hangzhou city as an example, a multiscalar method was proposed based on the information entropy theory to estimate residential heterogeneity and its scale sensitivity. Based on the sixth population census of Hangzhou and the housing price database of 6,536 residential districts from 2008 (...) to 2018, we explore the scale effect and dynamic characteristics of residential heterogeneity. The results of spatial simulation and geostatistical analysis based on Python Spatial Analysis Library module show that the multiscalar algorithm better presents the real segregation pattern than traditional method, which is one of the new models and technologies in urban geography complex system. Exploring residential heterogeneity through multiscalar lens provides an important basis for the gradual and refined urban renewal. (shrink)

BackgroundBilateral cerebral palsy is the most common type of CP in children and is often accompanied by different degrees of communication impairment. Several studies have attempted to identify children at high risk for communication impairment. However, most prediction factors are qualitative and subjective and may be influenced by rater bias. Individualized objective diagnostic and/or prediction methods are still lacking, and an effective method is urgently needed to guide clinical diagnosis and treatment. The aim of this study is to develop and (...) validate an objective, individual-based model for the prediction of communication impairment in children with BCP by the time they enter school.MethodsA multicenter prospective cohort study will be conducted in four Chinese hospitals. A total of 178 children with BCP will undergo advanced brain magnetic resonance imaging at baseline. At school entry, communication performance will be assessed by a communication function classification system. Three-quarters of children with BCP will be allocated as a training cohort, whereas the remaining children will be allocated as a test cohort. Multivariate lesion- and connectome-based approaches, which have shown good predictive ability of language performance in stroke patients, will be applied to extract features from MR images for each child with BCP. Multiple machine learning models using extracted features to predict communication impairment for each child with BCP will be constructed using data from the training cohort and externally validated using data from the test cohort. Prediction accuracy across models in the test cohort will be statistically compared.DiscussionThe findings of the study may lead to the development of several translational tools that can individually predict communication impairment in children newly diagnosed with BCP to ensure that these children receive early, targeted therapeutic intervention before they begin school.Trial registrationThe study has been registered with the Chinese Clinical Trial Registry. With increasing market competition and rapid development of service economy, more and more enterprises are shifting from providing products or services to providing product-service systems that integrate products and services, in order to improve competitiveness and profitability. Meanwhile, consumers have strategic delayed purchasing behavior when purchasing the PSS and high requirements for service quality. This paper investigates the two-period pricing and service quality decisions of product-service supply chain considering consumers’ strategic behavior under decentralized and centralized scenarios. The equilibrium results are (...) compared in two scenarios. In order to eliminate performance loss under the decentralized scenario, we design two-period dynamic contracts to coordinate the PSSC. Furthermore, numerical simulation is provided to verify the feasibility of the contracts. The following conclusions can be drawn: the higher the service input-efficiency, the more beneficial for alleviating consumers’ strategic purchase behavior under two scenarios, but this mitigation effect is more obvious under the centralized scenario. Compared with the centralized scenario, the service quality is lower, the two-period PSS sales prices are higher, and the two-period profit is lower under the decentralized scenario. The proportion of service valuation will promote the widening of the service quality gap under two scenarios, but in some cases, the service input-efficiency will weaken the promotion effect of the proportion of service valuation. The design of the two-period combined contracts depends on the proportion of service valuation. When the proportion of service valuation is high, the “two-period revenue sharing + service-cost sharing” combined dynamic contract can achieve PSSC perfect coordination. However, when the proportion of service valuation is low, it is necessary to design complexity combined dynamic contract which can achieve PSSC perfect coordination. (shrink)

BackgroundThe cognitive level of post-stroke aphasia patients is generally lower than non-aphasia patients, and cognitive impairment affects the outcome of stroke. However, for different types of PSA, what kind of cognitive assessment methods to choose is not completely clear. We investigated the Montreal Cognitive Assessment, the Mini-Mental State Examination, and the Non-language-based Cognitive Assessment to observe the evaluation effect of CI in patients with fluent aphasia and non-fluent aphasia.Methods92 stroke patients were included in this study. Demographic and clinical data of (...) the stroke group were documented. The language and cognition were evaluated by Western Aphasia Battery, MoCA, MMSE, and NLCA. PSA were divided into FA and NFA according to the Chinese aphasia fluency characteristic scale. Pearson’s product–moment correlation coefficient test and multiple linear regression analysis were performed to explore the relationship between the sub-items of WAB and cognitive scores. The classification rate of CI was tested by Pearson’s Chi-square test or Fisher’s exact test.ResultsThe scores of aphasia quotient, MoCA, MMSE, and NLCA in NFA were lower than FA. AQ was positively correlated with MoCA, MMSE, and NLCA scores. Stepwise multiple linear regression analysis suggested that naming explained 70.7% of variance of MoCA and 79.9% of variance of MMSE; comprehension explained 46.7% of variance of NLCA. In the same type of PSA, there was no significant difference in the classification rate. The classification rate of CI in NFA by MoCA and MMSE was higher than that in FA. There was no significant difference in the classification rate of CI between FA and NFA by NLCA.ConclusionMoCA, MMSE, and NLCA can be applied in FA. NLCA is recommended for NFA. (shrink)

Working speed as a latent variable reflects a respondent’s efficiency to apply a specific skill, or a piece of knowledge to solve a problem. In this study, the common assumption of many response time models is relaxed in which respondents work with a constant speed across all test items. It is more likely that respondents work with different speed levels across items, in specific when these items measure different dimensions of ability in a multidimensional test. Multiple speed factors are used (...) to model the speed process by allowing speed to vary across different domains of ability. A joint model for multidimensional abilities and multifactor speed is proposed. Real response time data are analyzed with an exploratory factor analysis as an example to uncover the complex structure of working speed. The feasibility of the proposed model is examined using simulation data. An empirical example with responses and response times is presented to illustrate the proposed model’s applicability and rationality. (shrink)

Als Einheit des Subjekts, das erkennt, und des Objekts, das erkannt wird, umfasst die Vernunft für Hegel alles, was es gibt und geben (...) kann. Jene Definition bedeutet eben: Es gibt nichts außerhalb dessen, was das Subjekt erkennt und erkennen kann. Mit dieser These verneint Hegel selbstverständlich nicht, dass es Sachen gibt, die das Subjekt noch nicht kennt bzw. von deren Existenz es noch nicht weiß, und auch nicht, dass es keine Sachen gibt, die das Subjekt noch nicht verstanden und begriffen hat, sondern eigentlich nur, dass es keine Sachen gibt, die prinzipiell nicht erkannt und begriffen werden können. Dass etwas existiert, impliziert für Hegel, dass es eventuell erkannt und fernerhin begriffen werden kann. Sein, Erkennbarsein und Begreifbarsein sind für Hegel ein und dasselbe. (shrink)

This study explored the relationship between the integrity of the supervisor and the manager and the creativity of employees who are below the supervisor. Drawing on social learning theory, we proposed a moderated mediation model for the trickle-down effects of perceived supervisor integrity. Using a sample of 716 employees and their supervisors, we found positive associations between both managers’ and supervisors’ integrity and employee creativity. Supervisors’ integrity partially mediates the relationship between managers’ integrity and employee creativity. In addition, supervisors’ perceptions (...) of professional ethical standards moderate the indirect effects of the managers’ integrity on employee creativity. DNA replication stress threatens ordinary DNA synthesis. The evolutionarily conserved DNA replication stress response pathway involves sensor kinase Mec1/ATR, adaptor protein Mrc1/Claspin, and effector kinase Rad53/Chk1, which spurs a host of changes to stabilize replication forks and maintain genome integrity. DNA replication forks consist of largely distinct sets of proteins at leading and lagging strands that function autonomously in DNA synthesis in vitro. In this article, we discuss eSPAN and BrdU‐IP‐ssSeq, strand‐specific sequencing technologies that permit analysis of protein localization and (...) DNA synthesis at individual strands in budding yeast. Using these approaches, we show that under replication stress Rad53 stalls DNA synthesis on both leading and lagging strands. On lagging strands, it stimulates PCNA unloading, and on leading strands, it attenuates the replication function of Mrc1‐Tof1. We propose that in doing so, Rad53 couples leading and lagging strand DNA synthesis during replication stress, thereby preventing the emergence of harmful ssDNA. (shrink)

Methods: An electronic search of PubMed, Embase, and the Cochrane library database was performed to identify the papers between January 1980 and June (...) 2013 that reported on laparoscopic/robotic kidney transplantation. The terms "laparoscopic kidney/renal transplant" and "robotic kidney/renal transplant " were used. Cross-referencing was also used to find the further publications. Only English language reports were selected and accepted for descriptive analysis. Results: A total of 17 papers and abstracts were retrieved. There were two case-control studies of small volume. High-level evidence comparing the safety and efficacy of laparoscopic/robotic kidney transplant with conventional open kidney transplant was not available at the time of this review. Conclusion: The limited published data have suggested that laparoscopic/robotic kidney transplant may offer the advantages of less pain, better cosmesis, possible shorter hospital stay, and fewer wound complications, without compromising graft function. Accordingly, some immunosuppressive agents, such as sirolimus, might be able to be commenced earlier, after laparoscopic/robotic kidney transplant. The techniques are various at this early stage. A uniformed operative technique may be established in the near future. With refinement of laparoscopic devices, this technique may be widely employed. Further studies will be needed to demonstrate the advantages of laparoscopic/robotic kidney transplant over the conventional open kidney transplant. Keywords: laparoscopic surgery, robotic surgery. Motivation has an effect on the rate and success of second language (L2) learning. However, little is known about its role in students’ levels of L2 pragmatic awareness. This study investigated whether and to what extent students’ L2 motivation influences their pragmatic awareness. A total of 498 Chinese university students completed a two-part web-based survey (an appropriateness judgement task and a motivation questionnaire), of whom 12 were subsequently interviewed. The quantitative results show that pragmatic awareness correlates positively with attitudes towards (...) the L2 community and the intended learning efforts. Moreover, a model combining the intended learning efforts, attitudes towards the L2 community and attitudes towards learning English can significantly predict pragmatic awareness. The analysis of semi-structured interviews reveals a mismatch between students’ immediate needs when learning English and outcomes of pragmatic acquisition, which may contribute to the absent correlation between overall levels of L2 motivation and pragmatic awareness.
