È possibile rendere compiutamente conto di ciò che gli artefatti e le tecnologie fanno, senza per questo sminuire il ruolo dell’agentività umana, ossia la capacità dell’essere umano di essere all’origine dell’azione e del senso?Per quanto determinismo tecnologico e sociocostruzionismo siano ormai approcci sufficientemente integrati, sembra quasi impossibile poter riconoscere l’uno senza pagare nulla di più che un piccolo contributo all’altro.Gli autori sottolineano quanto questa cesura che apparentemente riguarda un fenomeno circoscritto e settoriale come il ruolo degli artefatti nella costruzione del (...) mondo sociale, rispecchia in qualche modo l’antica distinzione proposta da Dilthey tra scienze della natura e scienze dello spirito. Il fatto é che tale divisione del lavoro scientifico sembra il risultato più che il punto di partenza di un lavoro deliberato di purificazione dei due domini . Per quanto utile da un punto di vista epistemologico, essa corre costantemente il rischio di proclamare a priori l’incapacità di alcune metodologie di indagare oggetti che si situerebbero al di là della loro giurisdizione . Inoltre, gli autori ritengono che questa distinzione sia alquanto problematica quando si tratta di questioni ontologiche. In linea con il pensiero di filosofi come Whithead , Delueze e Guatatri e Tarde , sostengono che tanto l’approccio sociocostruzionista quanto l’approccio tecno-determinista soffrano di un simile riduzionismo ontologico: ridurre l’oggetto di indagine a quanto la prospettiva inscritta in ciascuna metodologia consente di vedere e di analizzare.Prendendo le distanze da tale riduzionismo, questo articolo intende dimostrare che la materialità, la tecnologia e persino la natura intrudono costantemente nel mondo del significato, della comunicazione, del discorso. Allo stesso tempo, cultura e significato conferiscono senso e persino forma al mondo naturale . A fronte della propensione diffusa a pensare l’interazione come qualcosa che riguarda soltanto gli essere umani, gli autori mostrano che altre cose si autoconvocano costantemente nelle nostre conversazioni e che é legittimo ipotizzare che tali cose facciano «cose con le parole», per usare la famosa espressione che John Langshaw Austin coniò per indicare ciò che le persone fanno attraverso i loro atti linguistici.Attraverso un esempio tratto dalle osservazioni sul campo in un presidio medico d’urgenza operato da Medici senza Frontiere, gli autori mostrano che il sottolineare quanto e come le cose siano partecipanti attivi in una conversazione non significa evacuare il contributo umano all’attività di parola. Se le cose fanno cose con le parole é perché portano prospettivamente le persone a dire quel che dicono e, retrospettivamente, a far dire loro quel che hanno detto. Piuttosto che postulare che i soli partecipanti umani siano all’origine di quanto vien detto durante una conversazione, diventa possibile ritracciare altre origini o elementi che influenzano e condizionano ciò che le persone fanno mentre parlano tra loro.Il fatto che gli oggetti siano spesso trasformati dalla loro stessa incursione sulla scena interattiva viene vista come una prova della « realtà » del loro contributo alla conversazione. Utilizzando la metafora del ventriloquismo, gli autori mostrano che se i partecipanti umani fanno sì che le cose facciano cose con le parole, ciò é anche dovuto al fatto che le cose stesse fanno far loro cose con le parole, in quella sorta di oscillazione ventriloqua già sottolineata da David Goldbaltt . Individuare le tracce sia dell’agentività umana sia dell’agentività tecnologica, porta a riconoscere il grado di passività o passione inerente a qualunque attività o azione. Tale riconoscimento é cruciale dal momento che tale passività fa parte dei modi con cui le persone rendono razionale/giustificabile/legittimabile/ sanzionabile ciò che esse fanno e dicono nel corso di una interazione.Invece di ridurre l’interazione ad un fenomeno che riguarda esseri umani tra loro, appare più costruttivo riconoscere tutte le figure che popolano la scena interattiva, siano esse tecnologie, regolamenti, principi, emozioni o artefatti. La proposta avanzata dagli autori può dunque essere vista come un tentativo di riabilitare metaforicamente l’analisi del parlare prendendo seriamente in considerazione ciò che le figure letteralmente hanno da dire su come noi, gli umani, comunichiamo e lavoriamo.Se poiesis significa fabbricazione, allora forse poesia può diventare un modo innovativo di comprendere come funzionano le tecnologie e come noi interagiamo con esse.While we tend to think of interaction as involving human beings only, this paper proposes to show that other things – technologies, in particular – are continuously inviting themselves in our conversations and that these things can even be said to “do things with words.” Using the metaphor of ventriloquism, we show that if human participants make things do things with words, it is also because things animate them, a form of ventriloqual vacillation or oscillation already noticed by David Goldblatt . Acknowledging both human and technological agencies therefore leads us to recognize the degree of passivity or passion that is inherent in any activity or action, a recognition that is especially important given that its marks the accountable / reasonable / intelligible / justifiable / sanctionable character of what people do and say in interaction. Merleau-Ponty spent the summer of 1960 in the small French village of Le Tholonet writing Eye and Mind. His choice of location was no accident. Le Tholonet was the physical and emotional epicenter of Paul Cezanne’s late painting, the ultimate proving ground of his relentless quest to reveal the truth of landscape in art.It makes perfect sense that Merleau-Ponty wrote Eye and Mind in Le Tholonet. The essay is a philosophical meditation on vision and painting. But it also is a (...) meditation on place, in the deeply saturated sense that encompasses the landscape, its natural and human history, and the history of the painter who brought this part of Provence to universal visibility in his art. Le Tholonet is the terroir of Eye and Mind, the site and soil of this final, extraordinary expression of Merleau-Ponty’s thinking. Merleau-Ponty passa l’été 1960 dans le petit village français de Le Tholonet en écrivant L’OEil et l’Esprit. Le choix de ce lieu n’est pas accidentel. Le Tholonet était l’épicentre physique et émotionnel de la dernière peinture de Paul Cézanne, le terrain d’essai final de sa quête incessante pour arriver à révéler la vérité du paysage dans l’art. C’est tout à fait sensé que Merleau-Ponty ait écrit L’OEil et l’Esprit à Le Tholonet. L’essai est une méditation philosophique sur la vision et sur la peinture. Mais c’est aussi une méditation sur le lieu, sur le sens profondément saturé qui entoure le paysage, sur son histoire naturelle et humaine, et sur l’histoire du peintre qui porta, par son art, ce coin de la Provence à la visibilité universelle. È del tutto coerente che Merleau-Ponty abbia scritto L’occhio e lo spirito a Le Tholonet. Il saggio costituisce una riflessione filosofica sulla visione e sulla pittura, ma rappresenta anche una meditazione sul senso di un luogo, secondo un’accezione densa che comprende il paesaggio, la sua storia naturale e umana, e la storia del pittore che attraverso la sua arte ha portato questa parte della Provenza a una visibilità universale. Computer simulation and thought experiments seem to produce knowledge about the world without intervening in the world. This has called for a comparison between the two methods. However, Chandrasekharan et al. argue that the nature of contemporary science is too complex for using TEs. They suggest CS as the tool for contemporary sciences and conclude that it will replace TEs. In this paper, by discussing a few TEs from the history of science, I show that the replacement thesis about TE (...) is a failure. The paper is divided into three sections. The first section discusses the arguments of Chandrasekharan et al. and demonstrates the three distinct aspects of the replacement thesis. The second section examines the argument against TE and shows that they are inadequate to prove the withering of TE from science. The third section discusses Albert Einstein’s Magnet and Conductor TE and demonstrates that replacing such TE with CS yield no advantage. (shrink)

This article represents the author’s reflections on the book by Karl Sigmund “Exact Thinking in Demented Times. The Vienna Circle and the Epic Quest for the Foundations of Science” and the fate of the Vienna Circle. Sigmund paints a vivid portrait of the Vienna Circle against the background of the difficult historical period in which its members lived and worked. The Vienna Circle established the tradition of liberating consciousness and science from metaphysics. But the participants of the Vienna Circle and (...) their entourage did not manage to get rid of the humanistic issues, despite the declaration of strict scientific character. The author of the article draws attention to the internal contradiction between strict scientific topics and the existential-humanistic perception of this topic by the Vienna Circle’s authors and their likeminded people, and by Sigmund himself. The author concludes that it was thanks to this contradiction the Vienna Circle became not only a stage in the development of philosophical science, but also had a broad cultural influence on art, politics, architecture, museums, etc. The historical and philosophical tradition connects the activities of the Vienna Circle with the beginning of the divergence between the philosophical scientific and humanistic traditions in the understanding of philosophy, and the controversy between R. Carnap and M. Heidegger is an important point in this process. But Sigmund’s book gives the impression that this is not the divergence strictly scientific and humanistic traditions, but the difference between two humanistic traditions, one of them tends to express its thoughts strictly analytically. Background : researchers and sponsors increasingly confront the issue of whether participants in a clinical trial should have post-trial access (PTA) to the trial drug. Legislation and guidelines are inconsistent, ambiguous or silent about many aspects of PTA. Recent research highlights the potential importance of systematic reviews (SRs) of reason-based literatures in informing decision-making in medicine, medical research and health policy. Purpose: to systematically review reasons why drug trial participants should, or need not be ensured PTA to the trial drug (...) and the uses of such reasons. Data sources: databases in science/medicine, law and ethics, thesis databases, bibliographies, research ethics books and included publications’ notes/bibliographies. Publication selection: a publication was included if it included a reason as above. See article for detailed inclusion conditions. Data extraction and analysis: two reviewers extracted and analyzed data on publications and reasons. Results: of 2060 publications identified, 75 were included. These mentioned reasons based on morality, legality, interests/incentives, or practicality, comprising 36 broad (235 narrow) types of reason. None of the included publications, which included informal reviews and reports by official bodies, mentioned more than 22 broad (59 narrow) types. For many reasons, publications differed about the reason’s interpretation, implications and/or persuasiveness. Publications differed also regarding costs, feasibility and legality of PTA. Limitations: reason types could be applied differently. The quality of reasons was not measured. Conclusion: this review captured a greater variety of reasons and of their uses than any included publication. Decisions based on informal reviews or sub-sets of literature are likely to be biased. Research is needed on PTA ethics, costs, feasibility and legality and on assessing the quality of reason-based literature. (shrink)

Zakat is a monetary form of religious worship that establishes a bridge between a rich and a poor, helps those who are in need and contributes to peace and tranquillity within a society. When zakat is collected properly under a government control and transmitted to those who deserve, it helped to decrease the gap between the poor and the rich, supported activities of social solidarity and revived the economy as well. Malaysia after its independence in 1957 has developed an interest (...) in Islamic practices by drawing attention to a distinctive practice with the public zakat system. Even though a national- central system of zakat could not be established due to the federal structure of the country, the collection and distribution of zakat has been centralized on a state level. Parts of the practice are being criticized, reviewed and new regulations are introduced. Unlike Malaysia, the zakat practice in Turkey is out of state control, thus it hinders zakat from achieving its real purpose. There is a need to make use of the well-functioning zakat systems around the world and establish a public zakat system in our country so that we can make the most of the benefits that zakat has for individuals and societies. This article aims to be a step in that direction. -/- SUMMARY Zakat is one of the main forms of worship and is at the same time one of the main sources for the state budget in Islam. It aims at making sure that the rich –those with higher wealth and income– protects the poor and the powerless and through this it contributes to the peace in the society. In the Islamic creed wealth in reality belongs to Allah; therefore, those who live an affluent life should not attribute their wealth to themselves alone and help those who, for whatever reason, are unable to meet their needs. Because there is a social dimension to this form of worship, it is the duty of the head of state to collect the zakat and distribute it to the right people. Historically this duty has taken different forms and today, many Muslim countries sustain this collection and redistribution under state supervision. Malaysia is a country where zakat is collected and distributed officially at the state level. In each state, there is an Islamic council responsible for taking care of activities related to Islam and is semi-independent from the government that organizes the zakat process. Some of these do the collection and distribution together, some do it separately. In some states, the process has been totally privatized. Constitutionally, each state is dependent on its own sultan in religious affairs, thus each has its own mufti and partially different zakat practices and eac collect and distributes its zakat within that state. Because religious affairs have been codified as the privilege of the sultans of each state in the constitution during Malaysia’s foundation, there is no attempt at centralizing religious affairs and a centralization of zakat practices; the establishment of an institution to achieve this is not possible. Moreover, the secular character of the federation does not seem yet compatible with making zakat obligatory. However, due to the dominant Shafi‘i tradition and the convention in the country, people see it as imperative to hand over the charity and tithe to state institutions. Furthermore, there are local fatwas – which are considered as legal regulations in Malaysia – that require people with an income over a certain amount to pay zakat. Those who have the most are expected to give it voluntarily. In the 19th century, when wealth sources such as palm oil, cacao, rubber, tin were discovered, Malaysian officials were not able to extend the tithe to these; however, in the last twenty-five years, based on fatwas that income should be taxable under zakat has led to a boom in zakat. In all states, the largest portion of zakat is collected through income, usually automatically deducted from payroll. An influential factor in this outcome is that individually paid zakat can be deducted from income tax. From 2005 on, there have been other regulations to make it possible for legal personalities to deduct zakat from taxes. To increase zakat payment, especially publications have been produced to inform and encourage people, and modern opportunities to make payment easy have been developed. The most often used method is direct deduction from payroll. The second most common method is payment through zakat machines in different parts of the city by cash, check, Islamic credit card and, debit card. In addition to these, online, internet banking, telephone banking, ATM machines, post offices, kiosk machines, sms-zakat options are all available. The distribution of zakat differs from year to year and state to state. In general, there is an observable effort to pay all groups from zakat, but because there are no slaves in some states no payment is done under this category. There are both direct transfers and indirect transfers, such as through the construction of houses for poor people. There have been cases where poor people who had projects were supported with funds and those later returned in zakat. There is support for students in terms of scholarships through fuqarā’, fī sabīl allāh and ibn al-sabīl classes. For the muallafa al-qulūb class, there is a foundation to encourage local people to convert to Islam and help them for food, shelter, clothes and education. For Muslims who suffer as minorities in other countries help is provided through the riqāb, muallafa al-qulūb, fī sabīl allāh and ibn al-sabīl classes. In the ghārimīn class, especially victims of natural disasters such as flood and earthquake are supported. For those who have a right to receive zakat be able to receive it, the state has to side with the powerless and help zakat fulfill its social and individual functions. The way zakat is spent requires state policy and will. For this reason, zakat should be institutionalized and all activities should be organized by a single institution with state power behind it. Determining the recipients and the zakat-payers, and using the funds efficiently is easier with the coordination of state institutions. Extensive zakat councils that include state institutions should consider the ijtihāds in the area of zakat anew and make decisions to create a just and consistent zakat system. For these decisions to be applicable, the question of what kind of a system could be founded in our country should be on the agenda in these councils. Once an institution – official or autonomous but with state power behind it- is created, solutions can be found as they arise in the way. (shrink)

ABSTRACT:We combine prior research on ethical decision-making in organizations with a rational choice theory of corporate crime from criminology to develop a model of corporate offending that is tested with a sample of U.S. managers. Despite demands for increased sanctioning of corporate offenders, we find that the threat of legal action does not directly affect the likelihood of misconduct. Managers’ evaluations of the ethics of the act, measured using a multidimensional ethics scale, have a significant effect, as do outcome expectancies (...) that result from being associated with the misconduct but not facing formal sanctions. The threat of formal sanctions appears to operate indirectly, influencing ethical evaluations and outcome expectancies. Obedience to authority also affects illegal intentions, with managers reporting higher prospective offending when they are ordered to engage in misconduct by a supervisor. (shrink)

The II. constitutional period is a period of renewal in many areas. Political, social and educational changes also had influences in the field of religious education. One of the examples of these changes is the ʻAmelī I҆lmiḥal textbook written by Halim Sabit (DOD. 1946) in five volumes for both teachers and student. This study particularly aims to assess this textbook in terms of religious education. Accordingly, the following questions are addressed: “What are the topics covered in the ilmihal books written (...) for students and teachers? Is the content of the subjects taught appropriate for the religious education? Which methods, techniques, and essential matters are discussed in the ilmihal books for teachers? As having first grade elementary school textbooks for both teachers and students, the research is made just based on these books. Data were collected through the examination of the document, and the texts in Ottoman Turkish were transcribed into Turkish. Content analysis method was used in the analysis of the data. By examining both books, this study shows that belief, worship, and social issues were taught, and prayers and sūras were addressed as need to be memorized knowledge in the book. The books included inappropriate contents for first grade children regarding the belief issues such as fear of Allah, hell, and the hereafter. Summary: Education I҅lmiḥal, occupies an important place in the history of Islamic religious education. According to the religion of both adults and children to learn the principles of faith and worship, it is aimed to shape the daily life. In this context, for example, during the Ottoman period, In the period of II. Mahmut, boys were required to attend the primary school. Thus, it was ensured that children could learn I҅lmiḥal and Islamic sharia properly. Children are taught alif ba for Qurʾān readings in primary schools, as simple as required by religious duties, writing skills have been acquired and the four processing rules are memorized. The II. constitutional period is a period of renewal in many areas. Extreme innovative thinking is also reflected in education. Especially after the Balkan wars, the idea that the collapsing state would be saved through education was dominant. For the first time, a higher education institution for girls and a kindergarten for young children were opened. By recognizing the importance of pedagogy knowledge in teaching, the students have switched to a system where they can search for observation and experiment. Innovations in educational methods have started to be seen. It was seriously opposed to memorization, and the question and answer was seen as old methods. Instead, it was proposed to use sightseeing observation and discovery. Political, social and educational changes are also reflected in the field of religious education. As a reflection of the newly introduced methods, there have been changes in the ʻAmelī I҆lmiḥal books prepared for children. One of the examples of this is the ʻAmelī ʻIlmiḥal textbook, which was written by Halim Sabit in five volumes. This ʻAmelī I҆lmiḥal was prepared in 5 volumes for teachers and students.The main purpose of this study is to evaluate ʻAmelī I҆lmiḥal textbook in terms of religious education This study particularly aims to assess this textbook in terms of reigious education. Accordingly, the following questions are addressed: “What are the topics covered in the ilmihal books written for students and teachers? Is the content of the subjects taught appropriate for the religious education? Which methods, techniques, and essential matters are discussed in the ilmihal books for teachers? As having first grade elementary school textbooks for both teachers and students, the research is made just based on these books. Data were collected through the examination of the document, and the texts in Ottoman Turkish were transcribed into Turkish. The textbook prepared for the students of the first year consists of 21 boards/sheets. The sentences are quite self and short. The contents of the board/sheet are well suited to be discussed and explained. There are no headlines on the boards/sheets. The language of text is Ottoman. It is possible to express the topics covered in the book under the following themes:Prayer and Sūras: Basmala, Kalima Tawḥīd, Kalima Shahāda, Fātiḥa, Subḥana Rabbiyal Aʿala, Subhana rabbiyal ʿAẓim, As-salāmu ʿalaykum va Raḥmatullah, Taḥiyyat, Salawat Sharif, Iḥlas, Kawthar, Subḥanaka Prayer, Qunut Prayers.Faith Issues: Allāh, the fear of Allāh, thanks to Allāh, the Qurʾān, Prophets, Prophet Muḥammad, The Hereafter, Heaven Hell, Angels.ʿIbādat Issues: Zakāt, Ablution, Prayer, Adhān, worship in General (Salāt, Ṣawm, Zakāt, Ḥajj)Social Issues: Friendship, affection for minors, affection for parents, Muslims are Brother, human love, respect for the elderly, respect for scholars.The textbook prepared for the teachers of the first year; consists of 21 pages, 69 pages and Ottoman. As the students do not include the topics in the textbook, it is appropriate to mention the names of the subjects in the textbook of the teacher:1. Subject: Fear of Allāh.Halim Sabit also gave information about the methods and techniques to be used in the course and emphasized that the teacher told his / her not by looking at the book. He thought it would be only influence the student in this way. It is recommended to use the appropriate language for the child, to make an introduction in the subjects that will be learned in the new subjects and to draw attention to the subject and to teach the subject gradually. An important advice is the knowledge that the teacher wants him / her to do in the long-term memory in the present sense. The teacher must repeat a subject several times while teaching a subject, and should not immediately remind a student of forgotten subjects, talk to a student and has finded to him. A subject should not be passed without being thoroughly understood, and the classroom needs to be opened by the teacher in order not to forget the learned subjects. The first fifteen minutes of each course should be reserved for the repetition of previously learned subjects. Content analysis method was used in the analysis of the data. By examining both books, this study shows that belief, worship, and social issues were taught, and prayers and sūras were addressed as need to be memorized knowledge in the book.
