We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. After (...) all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

Movement is crucial to Merleau-Ponty’s effort to comprehend sense, meaning as generated within being. This requires a new concept of movement, not as a dislocation within an already determinate space- or time- frame, but as a deeper, more fundamental change that first engenders space and time as determinate contexts in which movement can follow a sensible course. This poses a novel challenge: conceptualizing determinate space and time as contingently arising from a deeper sort of change, which I call templacement. I (...) address this challenge by turning to the Mexica/Aztecs because the most basic term of their ontology is motion-change, and it is obvious to them that motion-change does not occur in an abstract space-time container. Instead, time-place is woven out of ‘prior’ motion-change. This study leads to a deeper lesson for phenomenology, regarding ‘obvious’ presuppositions about what time and philosophy obviously are – and how these presuppositions go hand in hand.La question du mouvement est cruciale dans l’effort de Merleau-Ponty pour comprendre le sens, la signification telle qu’elle se produit dans l’être. Cela requiert un nouveau concept du mouvement, qui n’est pas compris comme un déplacement dans un cadre spatial – ou temporel – prédéterminé, mais plutôt comme un changement plus profond et fondamental, qui, avant tout, produit l’espace et le temps comme des contextes déterminés dans lesquels le mouvement peut suivre un cours sensible. Cela pose un nouveau défi : conceptualiser un espace et un temps déterminés qui résulteraient, de manière contingente, d’un type de changement plus profond, que j’appellerai templacement. The Oxford World History of Empire. 2 vols. Oxford: Oxford University Press, 2021; xxviii + 552 pp.; xxxiv + 1,318 pp.The volumes under review are an impressive if unequal diptych. The first, the slimmer of the two, entitled "The Imperial Experience," comprises a series of analytical studies on the creation, management, and (...) ideologies of empires, and forms of resistance to them. The second, "The History of Empires," is a forbidding tome of forty-four specific studies of individual empires and imperial ventures, from Ur III and Middle Kingdom Egypt to the Mongols and the British, ending, naturally, with America's "global imperium." In the analytics, the usual suspects, including Michael Doyle, Frederick Cooper and Jane Burbank, are on display; and the conceptual approaches of Michael Mann and Ernest Gellner are favorite points d'appui. For premodern empires, the ideas of the Maghribi thinker Ibn Khaldūn provide a different focus, so it is heartening to see Bang and others applying them more consistently (e.g., 1:13, 40, 326–9; 2:162, 246–8, 253). Especially for premodern empires, these volumes can be seen as an extension of earlier handbooks devoted to the state, one devoted to the ancient Near Eastern and Mediterranean state and another on ancient empires.1 As an aspect of world history, the endeavor is the culmination of a decades-long project on the history of empires fronted by Peter Bang.2 He has usefully produced detailed historical introductions not only to both volumes, but also to the subsections in each of them. Perhaps not surprisingly, empire turns out to be a virile enterprise. As Ian Morris notes, "the story of empire... is so strongly gendered that it [End Page 505] seems reasonable to call rulers and commanders 'he' throughout" (1:162 n. 14). The muscular subject is mirrored by its principal actors and by its students. All the editors are men. Reflecting the same balance, out of the forty-five authors of individual studies in the large history of empires volume, there are five (lonely) female voices. In both volumes, women as subjects of empire are, for all intents and purposes, absent.3From the perspective of an historian who has actually worked on the history of an empire, it must be plainly stated that almost all of the theories, adequately reviewed by Bang (1:20–48), are worth about as much as the paper or pixilated screens on which they have been written. Obvious and serious exceptions to every one of the definitions and hypotheticals abound. In fact, a fair number of the exemplary histories in the second volume do not obey the strictures of most of the theories advanced in the first. So it is with a sense of relief that one turns from theory to the hard quantities offered by Walter Scheidel (1:chap. 2). To a considerable degree, his analysis depends on the well-known measurements made by Rein Taagepera. Rather alarmingly, Taagepera counted as an empire "any large sovereign political entity whose components are not sovereign," say, like the well-known empires of Algeria, Finland, or Canada.4 What an analysis of these global entities confirms is that size or orders of magnitude mattered, and that the first entities to count as empires emerged in the 7th to 5th centuries bce in southwestern Asia (1:53; 2:161, 245). The neo-Assyrian empire was the first super-large territorial state and its successor, the Achaemenid empire, was the first "hyper-power without rival" (1:172; 2:83, 111, 161). Subsequent premodern empires were able to reach higher levels of millions of square kilometers of territory and larger populations of dozens of millions of subjects nominally under their aegis. The magnitudes reached by a given generation of super-states set base-lines above which a successor might be able to reach greater sophistication of rule, numbers of subjects, and extent of territory. Donation after circulatory determination of death (DCDD) is an accepted practice in the United States, but heart procurement under these circumstances has been debated. Although the practice is experiencing a resurgence due to the recently completed trials using ex vivo perfusion systems, interest in thoracoabdominal normothermic regional perfusion (TA-NRP), wherein the organs are reanimated in situ prior to procurement, has raised many ethical questions. We outline practical, ethical, and equity considerations to ensure transplant programs make well-informed decisions about TA-NRP. We (...) present a multidisciplinary analysis of the relevant ethical issues arising from DCDD-NRP heart procurement, including application of the Dead Donor Rule and the Uniform Definition of Death Act, and provide recommendations to facilitate ethical analysis and input from all interested parties. Background : researchers and sponsors increasingly confront the issue of whether participants in a clinical trial should have post-trial access (PTA) to the trial drug. Legislation and guidelines are inconsistent, ambiguous or silent about many aspects of PTA. Recent research highlights the potential importance of systematic reviews (SRs) of reason-based literatures in informing decision-making in medicine, medical research and health policy. Purpose: to systematically review reasons why drug trial participants should, or need not be ensured PTA to the trial drug (...) and the uses of such reasons. Data sources: databases in science/medicine, law and ethics, thesis databases, bibliographies, research ethics books and included publications’ notes/bibliographies. Publication selection: a publication was included if it included a reason as above. See article for detailed inclusion conditions. Data extraction and analysis: two reviewers extracted and analyzed data on publications and reasons. Results: of 2060 publications identified, 75 were included. These mentioned reasons based on morality, legality, interests/incentives, or practicality, comprising 36 broad (235 narrow) types of reason. None of the included publications, which included informal reviews and reports by official bodies, mentioned more than 22 broad (59 narrow) types. For many reasons, publications differed about the reason’s interpretation, implications and/or persuasiveness. Publications differed also regarding costs, feasibility and legality of PTA. Limitations: reason types could be applied differently. The quality of reasons was not measured. Conclusion: this review captured a greater variety of reasons and of their uses than any included publication. Decisions based on informal reviews or sub-sets of literature are likely to be biased. Research is needed on PTA ethics, costs, feasibility and legality and on assessing the quality of reason-based literature. (shrink)

Today, this widespread interpretation must be regarded as being outdated, since it gives but a very partial and limited picture of Husserl's thinking. The continuing publication of Husserl's research manuscripts has disclosed analyses which have made it necessary to revise and modify a number of standard readings. Health professionals faced with refusal of life-saving treatment may wish to override a person's wishes, especially if that person suffers from a mental disorder. Mental illness does not automatically mean a patient is incapable of making decisions of this nature. It is not always clear whether an individual is legally competent to decide whether to undergo treatment or not. Makalede İlâhî vahyin insanın ontolojik gerçekliğini göz ardı etmediğini, ontolojik gerçekliği üzerinden insanlara mesaj verdiği konusu ele alınmıştır. Bu durum, rüya ve şeriatlerin farklılığıyla ispat edilmeye, bu fikre temayül gösteren ancak Kur’ân hakkında olumsuz bir argüman olarak kullanan Montgomery Watt gibi müsteşriklere de cevap verilmeye çalışılmıştır. Bu yapılırken ilk önce bilinçaltının anlaşılması hususunda bazı örnekler verilmiş sonra rüya sembollerinde baskın olan kültürel unsurlara temas edilmiştir. Rüyalardaki sembollerin şekillenmesinde mantıksal bağı irdeleyen İslam ulemasının açıklamalarına ve rüya tevillerine de yer verilmiştir. Bu (...) yorum ve tevillerden anlaşıldığı kadarıyla insanlarda ortak görülen sembollerin Jung’un arketip, İslam ulemasının ise zihinsel kalıp ve manaların elbisesi dediği bir nevi kültürün kodlarından oluşan bilinçaltı alfabesi tarafından formlaştığı anlaşılmaktadır. Daha sonra şeriat-ontolojik gerçeklik ilişkisi irdelenmiş, dinde bütün insanların ortak fıtratının esas alındığı ve bundan dolayı dinin bütün insanlar için değişmeyen bir olgu, şeriatlerin ise kültürün baskın olduğu ve dolayısıyla bir yönüyle ilişki içinde olduğu toplumsal bilinçaltı olduğu vurgulanmıştır. Kur’ân’da, dinin temel prensipleri ve resullerin üzerine birleştikleri kapsamlı şeriat kanunları dile getirilmiştir. Genel hatlarıyla din, Allah’ın varlıkları üzerine yarattığı (insanın tabiatının kolektif değişmezliğine dayalı) ve bütün mahlûkata sevimli geleni, marufu emretmeyi, münkerden nehyi, temiz şeyleri helal eden, zararlı olan şeyleri haramı eden emirleri içermektedir. İslam ulemasına göre bütün semavi dinlerde esas olan Allah’a, meleklerine, resullerine, kitaplarına ve ahiret gününe iman etmek, insanın yaptığı takdirde Müslüman olacağı fiilleri işlemektir. Bu iman da doğal olarak dünyadan yüz çevirmeyi, ahirete yönelmeyi, güzel ahlakı edinmeyi ve kötü ahlaktan da kaçınmayı gerektirir. Ancak şeriatlar ise birbirinden farklılık gösterebilir. Çünkü şeriatlar dinin indiği toplumun hallerini ve maslahatlarını esas aldığından değişiklik arz eder. Şeriatların farklılaşmasında toplumsal bilinçaltının göz ardı edilmediğini göstermek bağlamında Kur’ân’dan örnekler verilmek suretiyle savunulan tez ispat edilmeye çalışılmıştır. Bunlardan birisi, Kur’ân’da Arapların ortak duygularının esas alınması, kültürel bazı unsurların kullanılması, bir diğeri de yabancı isimlerin Arapların ifade ettiği şekliyle, ümmi anlayışa uygun kullanılmasıdır. Ayrıca bu konuda bazı helal yiyeceklerin Yahudilere haram kılınması ve diğer şeriatlerde yer alan bazı farklılıklar üzerinde durulmuştur. Helal yiyeceklerin haram kılınması konusunda Hz. Yakub’un yakalandığı ağır hastalıktan iyileştiği takdirde sevdiği yiyecekleri yememeyi nezretmesi, buna bağlı olarak iyileşince deve eti ve sütünü yiyip içmemesi, daha sonra çocukları ve ümmetinin de bu yiyeceklerden uzak durması sonucunda Tevrat’ta bunların haram kılınması örneği üzerinde durulmuştur. Bu örnek, şeriatlerin farklılaşmasının nedeninin bir şeye karşı tavrın toplumsal bir alışkanlık halini almasının sonucu olduğu ifade edilmiştir. Nitekim teravih namazının Müslümanlarca toplu kılınması ve buna devam edilmesi durumunda farz kılınır endişesiyle evlerinde kılmalarını tavsiye eden Allah Resulünün endişesinin de bunu pekiştirdiği dile getirilmiştir. Diğer şeriatlerde bazı farklılıklar konusunda ise orucun öncekilere farz kılınmasına rağmen keyfiyetinin farklı olması üzerinde durulmuştur. Aynı şekilde namaz, zekât ve haccın semavî dinlerinin hepsinde olmasına rağmen keyfiyetinin değiştiği örneklerle izah edilmiştir. Bu doğrultuda milletlerin yaşam tarzlarının ve kültürünün dolayısıyla toplumsal bilinçaltı şeriatlerin farklılığında gözönüne alındığı ifade edilmiştir. Nitekim İsâ peygambere tabi olanların kendilerine emredilmemekle birlikte Allah’ın rızasını elde etmek için ruhbanlığı kendilerine farz kılmaları ve buna devam etmeleri karşısında Allah’ın buna itibar ederek, ruhbanlıkta bulunanlara ücretlerini verdiğini ifade etmesi de bu durumu pekiştirmektedir. Sonuç olarak din ve dine taalluk eden her şeyin insanlığın ortak fıtratını esas aldığını, şeriatten şeriate değişiklik gösteren unsurların da kültürel ve bir yönüyle toplumsal bilinçaltıyla ilgili olan hususlar olduğu ortaya konulmaya çalışılmıştır. Purpose The purpose of this paper is to understand the dark side of blockchain technology (BCT) adoption in small and mid-size enterprises. The focus of the authors is to decode the intricate relationship among the selected variables missing in the existing literature. Design/methodology/approach A focused group approach is initiated by the authors to identify the barriers. Total interpretive structural modeling, Matrice d'impacts croisés multiplication appliquée á un classment, that is, matrix multiplication applied to classification and decision-making trial and evaluation laboratory (...) are used to analyze the complex relationships among identified barriers. Findings This study finds that implementation of BCT reduces maintenance cost by withdrawing manual effort, as BCT has better capability to quantify the internal status of the system (observability characteristic). The observability characteristic of BCT provides high compatibility to the system. This study also finds that the compatibility of BCT with the organization reduces implementation cost and facilitates project management. The findings of this study recommend analyzing maintenance cost and compatibility of BCT before implementing it. Small and mid-size enterprises can select complex BCT depending on the sophistication level of IT usage and IT project management capabilities. Research limitations/implications This study comes with various limitations, where the model developed by the authors may not be conclusive, as it is based exclusively on expert opinion. The samples collected may not help in validating the model statistically. Though the model has its limitations, it can still be considered as a nascent initiative for further investigation using structural equation modeling. Originality/value The outcomes of the theoretical and managerial contributions of the study can be categorized into three levels. This study can be used both by the industrialists and researchers to understand the barriers and the recovery methods thereafter. Suggestions that serve as future directives are also discussed by the authors. (shrink)
