This paper’s aim is to promote greater interest in courtroom practices of minute-taking—the preparation of written documents that constitute a record of what was said and done in the courtroom during a case hearing, very often based on a judge’s dictation of rephrased questioned person’s statements to a clerk who records them. This aim is achieved through discussion ultimately focused on the distinguishable aspects of minute-taking, its possible underlying mechanisms, and further consequences, followed by some remarks concerning the judge–clerk relationship (...) outside the scope of minute-taking and more direct discussion of clerks themselves. The discussions and analyses presented here are empirically-grounded, forming a side result of a larger research project conducted in a Polish lower court that combined observations of case hearings with witness interviews. Despite their inadvertent origin, the investigations presented here demonstrate the complexity and multifaceted nature of minute-taking to a greater extent than previous relevant studies have revealed. While minute-taking has not been neglected entirely in legal research, there remain many questions to be addressed. This paper suggests some of these questions as well as potential directions for future research on minute-taking through discussion of how the identified aspects of minute-taking can be utilized and which theoretical frameworks may be applicable. Although the paper is a result of empirical research conducted in Poland, its aims are relevant outside the Polish context, particularly in other continental European countries where minutes are also taken from case hearings. This article is about the problem of non-disclosure of an assumed method and approach to international law. That makes some real and current issues of international more difficult to grasp – and how to debate about something if there is a misunderstanding of the basics? The problem is depicted with two examples: the attitude of international law toward the statehood of Taiwan along with the on-going development of the Responsibility to Protect doctrine. Both reveal the clash between so-called black-letterism and (...) a policy-approach to international law. Meanwhile the doctrinal method is fully functional and mostly accepted in domestic law, though often contested in international law. But after all, international law being sui generis law is not just an instance of the domestic-type law which is the effect of particular features of the international community. (shrink)

One of the greatest challenges of consciousness research is to understand the relationship between consciousness and its implementing substrate. Current research into the neural correlates of consciousness regards the biological brain as being this substrate, but largely fails to clarify the nature of the brain-consciousness connection. A popular approach within this research is to construe brain-consciousness correlations in causal terms: the neural correlates of consciousness are the causes of states of consciousness. After introducing the notion of the neural correlate of (...) consciousness, we argue (in section 2) that this causal strategy is misguided. It implicitly involves an undesirable dualism of matter and mind and should thus be avoided. A non-causal account of the brain-mind correlations is to be preferred. We favor the theory of the identity of mind and brain, according to which states of phenomenal consciousness are identical with their neural correlates. Research into the neural correlates of consciousness and the theory of identity (in the philosophy of mind) are two major research paradigms that hitherto have had very little mutual contact. We aim to demonstrate that they can enrich each other. This is the task of the third part of the paper in which we show that the identity theory must work with a suitably defined concept of type. Surprisingly, neither philosophers nor neuroscientists have taken much care in defining this central concept; more often than not, the term is used only implicitly and vaguely. We attempt to open a debate on this subject and remedy this unhappy state of affairs, proposing a tentative hierarchical classification of phenomenal and neurophysiological types, spanning multiple levels of varying degrees of generality. The fourth part of the paper compares the theory of identity with other prominent conceptions of the mind-body connection. We conclude by stressing that scientists working on consciousness should engage more with metaphysical issues concerning the relation of brain processes and states of consciousness. Without this, the ultimate goals of consciousness research can hardly be fulfilled. (shrink)

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. In this paper I will juxtapose the concept of the veil of ignorance – a fundamental premise of Rawlsian justice as fairness – and solidarity in the context of the organisation of a healthcare system. My hypothesis is that the veil of ignorance could be considered a rhetorical tool that supports compassion solidarity. In the concept of the veil of ignorance, I will find some crucial features of compassion solidarity within the Rawlsian concept of “reciprocity” – located between “impartiality” and (...) “mutual advantage”. I conclude that, even behind this “thick” veil, some essential, yet “particular” facts on health and wealth redistribution are available to decision makers. Lastly, I discover that by means of the assumption of self-interest in the original position the veil aims to convert egoism into empathy, thus invoking the solidarity of compassion that in turn could be translated into principles of the organisation of a healthcare system. Mental arithmetic is characterised by a tendency to overestimate addition and to underestimate subtraction results: the operational momentum effect. Here, motivated by contentious explanations of this effect, we developed and tested an arithmetic heuristics and biases model that predicts reverse OM due to cognitive anchoring effects. Participants produced bi-directional lines with lengths corresponding to the results of arithmetic problems. In two experiments, we found regular OM with zero problems but reverse OM with non-zero problems. In a third experiment, we tested (...) the prediction of our model. Our results suggest the presence of at least three competing biases in mental arithmetic: a more-or-less heuristic, a sign-space association and an anchoring bias. We conclude that mental arithmetic exhibits shortcuts for decision-making similar to traditional domains of reasoning and problem-solving. (shrink)

We generalize the notion of analytic/Borel equivalence relations, orbit equivalence relations, and Borel reductions between them to their continuous and quantitative counterparts: analytic/Borel pseudometrics, orbit pseudometrics, and Borel reductions between them. We motivate these concepts on examples and we set some basic general theory. We illustrate the new notion of reduction by showing that the Gromov–Hausdorff distance maintains the same complexity if it is defined on the class of all Polish metric spaces, spaces bounded from below, from above, and from (...) both below and above. Then we show that [Formula: see text] is not reducible to equivalences induced by orbit pseudometrics, generalizing the seminal result of Kechris and Louveau. We answer in negative a question of Ben Yaacov, Doucha, Nies, and Tsankov on whether balls in the Gromov–Hausdorff and Kadets distances are Borel. In appendix, we provide new methods using games showing that the distance-zero classes in certain pseudometrics are Borel, extending the results of Ben Yaacov, Doucha, Nies, and Tsankov. Stať se snaží analyzovat myšlenky málo známého rukopisu Sigmunda Freuda z roku 1895, v němž usiloval o nalezení biologických základů lidské psychiky. Tato práce je pozoruhodná ze dvou důvodů. Jednak představuje úvahy, které se výrazně od- lišují od toho, co je pro Freuda v oblasti psychologie tak typické. Freud se zde, až na výjimky, nezabývá psychoanalýzou či studiemi o hysterii, nýbrž popisuje, co by mohlo být základem těchto psychologických jevů na neurofyziologické úrovni. Druhým pozoruhodným faktem je, že tento manuskript byl (...) pozapome- nut až do poloviny 20. století, kdy byl vytištěn pod názvem Projekt vědecké psychologie. A jak je známo, neurofyziologická studia lidské mysli spojená s analýzou kognitivních funkcí se v ri- gorózní podobě objevují až na počátku 60. let. Stať se proto pokouší ukázat základní principy Projektu a naznačit, v čem byl Freud inspirativním průkopníkem moderních neurofyziologických přístupů k lidské mysli. (shrink)

In recent years part of the literature on probabilistic causality concerned notions stemming from Reichenbach’s idea of explaining correlations between not directly causally related events by referring to their common causes. A few related notions have been introduced, e.g. that of a “common cause system” (Hofer-Szabó and Rédei in Int J Theor Phys 43(7/8):1819–1826, 2004) and “causal (N-)closedness” of probability spaces (Gyenis and Rédei in Found Phys 34(9):1284–1303, 2004; Hofer-Szabó and Rédei in Found Phys 36(5):745–756, 2006). In this paper we (...) introduce a new and natural notion similar to causal closedness and prove a number of theorems which can be seen as extensions of earlier results from the literature. Most notably we prove that a finite probability space is causally closed in our sense iff its measure is uniform. We also present a generalisation of this result to a class of non-classical probability spaces. (shrink)

A class of quantum probabilities is reformulated in terms of non-Newtonian calculus and projective arithmetic. The model generalizes spin-1/2 singlet state probabilities discussed in Czachor (Acta Physica Polonica:139 70–83, 2021) to arbitrary spins _s_. For \(s\rightarrow \infty\) the formalism reduces to ordinary arithmetic and calculus. Accordingly, the limit “non-Newtonian to Newtonian” becomes analogous to the classical limit of a quantum theory.

Argumentace Tomáše Hříbka proti fenomenálnímu charakteru se opírá především o Dennettova stanoviska. Dennettem dlouhodobě preferovaná strategie při vypořádání se s tímto problémem je metodologický naturalismus. Tato strategie jistě přinesla své ovoce, zejména je-li řeč o otevření skutečně kritické diskuse na téma kválií. Problém vědomí je však v současnosti traktován spíše v rámci materialistické metafyziky, než z pohledu Dennettova metodologického naturalismu. Tato preference má své empirické, ale i filosofické důvody, o nichž jsme hovořili s Tomášem Marvanem v knize Vědomí a jeho (...) teorie. Protože Hříbkova monografie reaguje na některé názory z této knihy, komentuji Hříbkovy reakce a upřesňuji naše postoje. Zároveň se vyjadřuji k zařazení naší pozice v rámci materialistické metafyziky k materialismu typu B. V druhé části statě se zabývám problémem fenomenálního charakteru vědomé zkušenosti a snažím se argumentovat, že tento těžký problém nelze odstranit pouze tím, že se prokáže neudržitelnost tradičního chápání kválií. The essay examines Scholem's letter-confession on the Hebrew language addressed to Rosenzweig from two perspectives hitherto ignored in the ongoing interpretative consideration of this document: Scholem's repression of the literary space and his consequent exclusion of madness. The essay follows several threads in Derrida's own ‘internal’ reading of the letter, and leans on other Derridean writings such as The Monolingualism of the Other, Schibboleth: For Paul Celan and ‘Cogito and the History of Madness’ in order to suggest two distinct encounters (...) between Derrida and Scholem: In the first encounter, Scholem reads Derrida and proves to be deconstructing his own notions of secular and profane Hebrew, while fighting in vain for his sanity by clinging to liturgical practices against the grain of an ongoing ‘actualization’, politicization or else fictionalization of the sacred language. In the second encounter, it is Derrida who reads Scholem. By transforming the particular conditions of possibility of Hebrew into general conditions of possibility of every language contaminated by a theological-political tension, Derrida contributes some important insights for contemporary Hebrew speakers. Saying is experiencing: Affective consequences of complaining and affirmation In four experiments mood was measured before and after complaining or affirmation. Participants complained or affirmed either themselves or listened to such communications of another person. Mood decreased after complaining and increased after affirmation — a "saying is experiencing" effect. This effect was found also in the cognitive load condition suggesting that automatic mood contagion underlies the SIE effect rather than mechanisms based on self-perception or self-awareness. Appropriateness of a topic for (...) complaining appeared a boundary condition of the SIE effect: When a topic was considered by participants the most appropriate for complaining, the act of showing dissatisfaction with the topic led to mood improvement. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. It shows the Polish antimodernist perspective on modernistic thought. The neglect of Polish modernism was caused by the nationalistic character of the Polish theology and has resulted in absence of historical studies of Polish Catholic Modernism. Based on the results of archival and literature research the paper presents a variety of Polish Catholic Modernists and non-Catholic supporters of the modernist (...) thought. A unique place among Polish modernists belongs to Marian Zdziechowski (1861–1938) who was the only Polish participant of the international intellectual debate on the “modernisation” of Roman Catholicism. The paper analyses the development of Zdziechowski’s thought and shows that his main demand throughout the modernist debates was to create a new, more efficient apologetics, which would be grounded in the religious experience of the individual. This is the first volume in a new, definitive, seven-volume edition of the works of Michal Kalecki, one of the twentieth century's most distinguished economists. Kalecki was one of the three contemporary economists to arrive at the conclusions publicized by Keynes, although Kalecki arguably presented these views even earlier than Keynes. Volume I contains Kalecki's writings on the theory of the business cycle and full employment. His seminal Essay on the Business Cycle Theory is preceded by his earlier theoretical studies (...) and followed by publications which developed and defended its main concepts and ideas. This volume also contains the 1939 book Essays in the Theory of Economic Fluctuations, the work which established his reputation. The seventh volume of the Collected Works of Michal Kalecki, one of the twentieth century's preeminent economists, contains his empirical studies of the wartime and post-war economy in Britain and the USA, together with papers on the work of other economists and miscellanea.The first part of the book collects together his articles on the economic conditions of Britain during the Second World War, focusing on the rationing of consumption and war finance, and its post-war reconstructions. These articles are among Kalecki's (...) best known, and contributed significantly to his world renown as an economist. Part two contains studies of post-war America, comparing the economy with the situation before the War. Part three contains a group of articles under the title `Political economy and economists', and includes book reviews and essays on the study of economics. Part four collects essays on a variety of topics, including Polish economic planning, construction engineering, and the theory of numbers. As in previous volumes, editorial notes and annexes by Professor Osiaty'nski provide invaluable background information and explanatory glosses on the main text. Among other things, they reveal details of Kalecki's work for the United Nations.Since this is the final volume of the Collected Works, it concludes with a chronology of biographical information and a complete bibliography of Kalecki's writings from 1927 to 1987. Philosophy of religion has been the object of penetrating critiques concerning its continued near-complete blindness to all but a single religion. The need for philosophy of religion to open up so as to include more than merely occasional and tokenistic treatments of ‘Other’ religions is clearly evident from the slew of recently published titles concerned with diversifying the field. In this light, a book such as Victoria Harrison’s Eastern Philosophy of Religion should surely come as a welcome addition. And yet, (...) unfortunately, this book turns out to be a case study in how not to diversify philosophy of religion in the twenty-first century. (shrink)

Despite their ethical intentions, ethically minded consumers rarely purchase ethical products (Auger and Devinney: 2007, Journal of Business Ethics76, 361–383). This intentions–behaviour gap is important to researchers and industry, yet poorly understood (Belk et al.: 2005, Consumption, Markets and Culture8(3), 275–289). In order to push the understanding of ethical consumption forward, we draw on what is known about the intention–behaviour gap from the social psychology and consumer behaviour literatures and apply these insights to ethical consumerism. We bring together three separate (...) insights – implementation intentions (Gollwitzer: 1999, American Psychologist54(7), 493–503), actual behavioural control (ABC) (Ajzen and Madden: 1986, Journal of Experimental Social Psychology22, 453–474; Sheeran et al.: 2003, Journal of Social Psychology, 42, 393–410) and situational context (SC) (Belk: 1975, Journal of Consumer Research2, 157–164) – to construct an integrated, holistic conceptual model of the intention–behaviour gap of ethically minded consumers. This holistic conceptual model addresses significant limitations within the ethical consumerism literature, and moves the understanding of ethical consumer behaviour forward. Further, the operationalisation of this model offers insight and strategic direction for marketing managers attempting to bridge the intention–behaviour gap of the ethically minded consumer. This volume contains Kalecki's writings on the theory of growth of a socialist economy and the theory of economic efficiency of investment. These are supplemented by essays on some economic and social problems of People's Poland. Though quite theoretical in nature, both the Introduction to the Theory of Growth in a Socialist Economy and Kalecki's many studies in the theory of economic efficiency of investment projects are deeply rooted in his practical experience as an economic planner. It is only in (...) this light that the significance of his contributions to the theory of economic efficiency of investments can be assessed, and his ideas on socialist reproduction can be seen as a whole. The sixth volume of the Collected Works of Micha/l Kalecki, one of the twentieth-century's pre-eminent economists, contains his empirical studies of the capitalist economy, published primarily in pre-war Poland. The first part of the book collects together reviews of business conditions in commodity markets, studies of the structure and operations of large companies and cartels, and articles on international economic relations. These studies, written between 1928 and 1935, demonstrate Kalecki's keen insight into the international consequences of the Great Crisis of (...) 1929-33, and into the developments in Nazi Germany. The second part contains Kalecki's papers on the methodological problems of examining business fluctuations and on constructing indicators of economic trends. Part 3 comprises, Kalecki's estimates of the national income in Poland and of its structure. These studies, conducted between 1931 and 1935, were unique at the time in taking into account the distribution of aggregate income between the main social classes.
