Healthcare priority-setting institutions have good reason to want to demonstrate that their decisions are morally justified—and those who contribute to and use the health service have good reason to hope for the same. However, finding a moral basis on which to evaluate healthcare priority-setting is difficult. Substantive approaches are vulnerable to reasonable disagreement about the appropriate grounds for allocating resources, while procedural approaches may be indeterminate and insufficient to ensure a just distribution. In this paper, we set out a complementary, (...) coherence-based approach to the evaluation of healthcare priority-setting. Drawing on Rawls, we argue that an institutional priority-setter’s claim to moral justification can be assessed, in part, based on the extent to which its many normative commitments are mutually supportive and free from dissonance; that is, on the ability to establish narrow reflective equilibrium across the normative content of a priority-setter’s policy and practice. While we do not suggest that the establishment of such equilibrium is sufficient for moral justification, we argue that failure to do so might—like the proverbial canary in the coalmine—act as a generalised warning that something is awry. We offer a theoretical argument in support of this view and briefly outline a practical method for systematically examining coherence across priority-setting policy and practice. (shrink)

Some patients who have been diagnosed as “dead by neurologic criteria” continue to exhibit certain brain functions, most commonly, neuroendocrine functions. This preservation of neurologic function after the diagnosis of “brain death” or “brainstem death” is an ongoing source of controversy and concern in the medical, bioethics, and legal literatures. Most obviously, if some brain function persists, then it is not the case that all functions of the entire brain have ceased and hence, declaring such a patient to be “dead” (...) would be a false positive, in any nation with so-called “whole brain death” laws. Furthermore, and perhaps more concerning, the preservation of any brain function necessarily entails the preservation of some amount of brain perfusion, thereby raising the concern as to whether additional areas of neural tissue may remain viable, including areas in the brainstem. These and other considerations cast significant doubt on the reliability of diagnosing either “brain death” or “brainstem death.”. (shrink)

The COVID-19 pandemic crisis has necessitated widespread adaptation of revised treatment regimens for both urgent and routine medical problems in patients with and without COVID-19. Some of these alternative treatments maybe second-best. Treatments that are known to be superior might not be appropriate to deliver during a pandemic when consideration must be given to distributive justice and protection of patients and their medical teams as well the importance given to individual benefit and autonomy. What is required of the doctor discussing (...) these alternative, potentially inferior treatments and seeking consent to proceed? Should doctors share information about unavailable but standard treatment alternatives when seeking consent? There are arguments in defence of non-disclosure; information about unavailable treatments may not aid a patient to weigh up options that are available to them. There might be justified concern about distress for patients who are informed that they are receiving second-best therapies. However, we argue that doctors should tailor information according to the needs of the individual patient. For most patients that will include a nuanced discussion about treatments that would be considered in other times but currently unavailable. That will sometimes be a difficult conversation, and require clinicians to be frank about limited resources and necessary rationing. However, transparency and honesty will usually be the best policy. This work offers a new democratic case for federalism, understood as a form of governance in which multiple entities in a country possess final decision-making authority (viz., can make decisions free from others substituting their decisions, issuing fines, etc.) over at least one subject (e.g., immigration, defense). It argues that leading solutions to the democratic boundary problem provide overlapping arguments for federalism. The underlying logic and many details of the most commonly cited solutions focused on those relevantly affected by and (...) subject to decisions each support three distinct arguments (focused on voteshares, other forms of democratic influence, and persistent minorities) for multiple demoi possessing authority in a polity. Federalism is the best available method for recognizing the distinct demoi. This not only supports federal governance as opposed to unitary governance and subsidiarity. It also suggests that democracy and federalism are importantly related and have several implications for institutional design. (shrink)

A “universalist” policy on brain death holds that brain death is death, and neurologic criteria for death determination are rightly applied to all, without exemptions or opt outs. This essay argues that advocates of a universalist brain death policy defend the same sort of coercive control of end-of-life decision-making as “pro-life” advocates seek to achieve for reproductive decision-making, and both are grounded in an illiberal political philosophy. This article challenges conventional readings of Michel Foucault by examining his fascination with neoliberalism in the late 1970s. Foucault did not critique neoliberalism during this period; rather, he strategically endorsed it. The necessary cause for this approval lies in the broader rehabilitation of economic liberalism in France during the 1970s. The sufficient cause lies in Foucault's own intellectual development: drawing on his long-standing critique of the state as a model for conceptualizing power, Foucault concluded, during the 1970s, that economic liberalism, (...) rather than “discipline,” was modernity's paradigmatic power form. Moreover, this article seeks to clarify the relationship between Foucault's philosophical antihumanism and his assessment of liberalism. Rather than arguing that Foucault's antihumanism precluded a positive appraisal of liberalism, or that the apparent reorientation of his politics in a more liberal direction in the late 1970s entailed a partial retreat from antihumanism, this article contends that Foucault's brief, strategic, and contingent endorsement of liberalism was possible precisely because he saw no incompatibility between antihumanism and liberalism—but only liberalism of the economic variety. Economic liberalism alone, and not its political iteration, was compatible with the philosophical antihumanism that is the hallmark of Foucault's thought. (shrink)

This article critically examines the relations between epistemics in conversation analysis and linguistic and cognitivist conceptions of communicative interaction that emphasize information and information transfer. The epistemic program adheres to the focus on recorded instances of talk-in-interaction that is characteristic of CA, explicitly identifies its theoretical origins with ethnomethodology, and points to implications of its research for the social distribution of knowledge. However, despite such affiliations with CA and ethnomethodology, the EP is cognitivist in the way it emphasizes information exchange (...) as an underlying, extrasituational ‘driver’ in social interaction. To document how the EP draws upon cognitivist conceptions of information and knowledge, we review examples from the corpus of transcripts analyzed in key publications on epistemics. Our re-analysis casts doubt upon the way EP analysis invokes an underlying order that supposedly drives the evident sequential organization of those transcripts. (shrink)

This paper proposes a five-part empirical typology of interconnections of race and class. We describe the mechanisms whereby (1) race is a form of class relation; (2) race relations and class relations reciprocally affect each other; (3) race acts as a sorting mechanism into class locations; (4) race acts as a mediating linkage to class locations; and (5) race interacts with class in determining other outcomes. Rather than insisting on one or another mechanism as the overarching framework for conceptualising the (...) interconnections between race and class, we propose a theoretical integration of all five within a functionalist model. The model reconciles the empirical effects of race variables with a class-functionalist explanation of race. Our typology of interconnections is useful for situating concrete empirical phenomena, and our theoretical integration of those interconnections offers a coherent explanatory system that captures the recursive causality of race and class. Many contemporary metaphysicians believe that the existence of a contingent object such as Socrates metaphysically explains the existence of the corresponding set {Socrates}. This paper argues that this belief is mistaken. The argument proposed takes the form of a dilemma. The expression “{Socrates}” is a shorthand either for the expression “the set that contains all and only those objects that are identical to Socrates” or for the expression “the set that contains Socrates and nothing else”. However, Socrates' existence does not (...) explain the existence of the set that contains all and only those objects that are identical to Socrates, because there is such a set no matter whether or not Socrates exists. And although Socrates' existence does explain that of the set that contains Socrates and nothing else, this explanation is a conceptual rather than a metaphysical one. Both these claims rely on a deflationary account of the use of set theoretic vocabulary that is explained, though not properly justified, in the paper. (shrink)

Fossil fuel divestment movements have gained momentum since 2011, aimed at ending fossil fuel use and a move toward a cleaner, affordable, and sustainable energy system, for business and society. The present study investigates the direct impact of fossil fuel divestment announcements on stock prices of firms listed on the United States' stock exchanges. Using an event study and guided by the United Nation's sustainable development goals (SDGs), we test the effects of 116 divestments announcements between 2014 and 2019 on (...) 51 publicly traded fossil fuel companies. Our results suggest that there is a negative effect of these announcements on fossil fuel firm stock prices. Also, we find that the type of fossil fuel firm (coal or oil and gas), the type of divestment (partial, coal only, or full), the timing of the announcement, and the size of the divesting investor have some explanatory power in relation to the (cumulative) abnormal returns following the divestment announcements. While the negative impact on stock prices is not surprising, the reaction from the divested firms after such large divestitures is not consistent with what may be expected, given past reactions to divestitures seeking to achieve different social goals. Given the SDGs, it seems clear why investors are divesting themselves from fossil fuel firms, but why has the reaction to the 116 divestments led to very little change in the way these publicly traded fossil fuel firms do business given their direct and growing impacts on society? We conclude the study with some suggestions for future research. (shrink)

We develop Glowacki's intriguing proposition that in-group dynamics provide a route to peace by describing a prosocial motivational system, the caregiving system, that aligns individual interests and eliminates the need to use coercion to achieve mutually beneficial outcomes.

Over the last century and a half, manners and formalities in the West have become less status-ridden, stiff and rigid. Debates around Norbert Elias' theory of civilising processes gave rise to questions of a change in direction of these patterns. The concept of informalisation, which describes these transformations, was first used to analyse the tumultuous changes of the 1960s and 1970s. This increasing informality, leniency and flexibility, comes hand-in-hand with a growing demand on individuals to self-regulate their emotions. This book (...) will stimulate debate around the changes in the standards of manners and emotion regulation, and will generate new avenues of enquiry that focus on issues involving informalisation. The chapters shed light on a variety of such moral and political issues over the last 150 years, offering a new and broader scope on the present social condition of humanity. Civilisation and Informalisation will be an important addition for students and scholars of figurational process sociology, and of broader interest to academics across sociology, social psychology and social history. New brain-computer interface and neuroimaging techniques are making differentiation less ambiguous and more accurate between unresponsive wakefulness syndrome patients and patients with higher cognitive function and awareness. As research into these areas continues to progress, new ethical issues will face physicians of patients suffering from total locked-in syndrome, characterized by complete loss of voluntary muscle control, with retention of cognitive function and awareness detectable only with neuroimaging and brain-computer interfaces. Physicians, researchers, ethicists and hospital ethics committees should be aware of (...) and prepared to handle ethical issues unique to these totally locked-in patients. Several thought experiments are discussed, to highlight potential ethical dilemmas surrounding surrogate decision-making, autonomy, end-of-life care, and pediatric care, which will be unique to total LIS patients. These, along with other ethical problems especially relevant to total LIS patients, merit further discussion among physicians, researchers, ethicists and hospital ethics committees, to facilitate consensus regarding these issues, and improve patient care. ABSTRACT Academic freedom is typically understood as a means of protecting faculty rights against the violence—physical or intellectual—of the state or of the institution’s administration. This article argues that academic freedom may be seen as a form of violence, insofar as it is potentially threatening to the methodological and institutional stasis of colleges and universities.

Some passages throughout Spinoza’s body of works suggest that an attribute in its absolute nature provides a sufficient condition for all of its modes, including the finite ones. Other passages suggest that an attribute in its absolute nature fails to provide a sufficient condition for its finite modes. My aim is to dispel this apparent tension. I argue that all finite modes are ultimately entailed by the absolute nature of their attribute. Furthermore, I explain how the Spinozistic positions that appear (...) incompatible with this view are in fact compatible. As I see it, we should read those passages where Spinoza says that no finite mode ultimately follows from the absolute nature of its attribute as saying merely that no finite mode ultimately follows in one-by-one fashion, independent of an infinite series of other modes, from the absolute nature of its attribute. This book explores a hitherto unexamined possibility of justifiable disobedience opened up by John Rawls’ Law of Peoples. This is the possibility of disobedience justified by appeal to standards of decency that are shared by peoples who do not otherwise share commitments to the same principles of justice, and whose societies are organized according to very different basic social institutions. Justified by appeal to shared decency standards, disobedience by diverse state and non-state actors indeed challenge injustices in the international system (...) of states. The book considers three case studies: disobedience by the undocumented, disobedient challenges to global economic inequities, and the disobedient disclosure of government secrets. It proposes a substantial analytical redefinition of civil disobedience in a global perspective, identifying the creation of global solidarity relations as its goal. Michael Allen breaks new ground in our understanding of global justice. Traditional views, such as those of Rawls, see justice as a matter of recognizing the moral status of all free and equal person as citizens in a state. Allen argues that this fails to see things from the global perspective. From this perspective disobedience is not merely a matter of social cooperation. Rather, it is a matter of self determination that guarantees the invulnerability of different types of persons and peoples to domination. This makes the disobedience by the undocumented justified, based on the idea that all persons are moral equals, so that all sovereign peoples need to reject dominating forms of social organization for all persons, and not just their own citizens. In an age of mass movements of people, Allen gives us a strong reason to change our practices in treating the undocumented. Moreover, while protests such as these speak to a local political horizon, they also have a global footprint, catalyzing a transnational dialogue about global justice, political strategy and cosmopolitan solidarity. Speaking directly to such complexities, Allen makes a compelling case for a global perspective regarding civil disobedience. Anyone interested in how the dynamics of non-violent protest have shaped and reshaped the landscape for democratic engagement in a globalized world will find this book rewarding and insightful. Marcos Eberlin is a chemist and mass spectrometer who advances in a new book a refined Intelligent Design theory hinging on “foresight,” or the apparent teleology and purpose discernible in biological, chemical, and other complex life systems. Repurposing older ID arguments, such as those of “irreducible complexity,” and introducing new examples of phenomena pointed to by other ID theorists, Eberlin makes a strong argument for mindful creation by a “superintellect”. But is ID sufficient to answer Darwinism? Does “foresight” go far (...) enough in providing an alternative view of the origin of complex lifeforms? I argue that Eberlin, and other ID theorists, does not have a robust-enough definition of science to counter non-theistic theories of biology and biochemistry. An Aristotelian-Thomistic understanding of science allows us to go beyond the divide between ID and a-theistic theories and move the science-and-faith debate onto more solid ground. (shrink)

Michael Allen's latest work on the profoundly influential Florentine thinker of the fifteenth century, Marsilio Ficino, will be welcomed by philosophers, literary scholars, and historians of the Renaissance, as well as by classicists. Ficino was responsible for inaugurating, shaping, and disseminating the wide-ranging philosophico-cultural movement known as Renaissance Platonism, and his views on the _Sophist_, which he saw as Plato's preeminent ontological dialogue, are of signal interest. In an opinion piece penned at the Great War’s onset yet apparently unpublished until now, the historian of religion Hermann Gunkel outlined the opportunities he saw for the German people in anticipation of their triumph. He believed this war could consummate what the Napoleonic Wars and the Unification of Germany had not. Gunkel hoped for true German unity, more liberal domestic politics, and spiritual restoration. Further still, he referred to a resurgence of piety on account of the conflict. On the (...) It is shown (i) that causation exists, since we couldn't even ask whether causation existed unless it did; (ii) that any given case of causation is a case of persistence; and (iii) that spatiotemporal relations supervene on causal relations. (ii) is subject to the qualification that we tend not to become aware of instances of causation as such except when two different causal lines---i.e. two different cases of persistence---intersect, resulting in a breakdown of some other case of persistence, this being (...) why we tend to regard instances of causation as fundamentally disruptive, as opposed to preservative in nature. The meaning of (iii) is that spatiotemporal relations are causal relations considered in abstraction of the various specific differences holding between different kinds of causation. (shrink)

The Many-Interacting-Worlds (MIW) approach to a quantum theory without wave functions proposed in [8] leads naturally to numerical integrators of the Schrödinger equation on comoving grids. As yet, little is known about concrete MIW models for more than one spatial dimension and/or more than one particle. In honour of Detlef Dürr, we report on a further development of the MIW approach to treat arbitrary degrees of freedom and provide a numerical proof of concept for ground states in 2d. The latter (...) is part of a systematic numerical study [22] that includes also 1d ground and excited states. Video ethics in educational research involving children is a recent topic that has arisen since the increase in the use of visual mediums in research (such as photovoice and video) especially with the development of new and ubiquitous internet technologies and social media. This paper emerged as an expressed concerned by a group of scholars associated with the new Video Journal of Education and Pedagogy (Brill) that was established in 2016. The paper is the result of a collective writing process (...) over a period of a few months that discusses visual studies in education and visual ethics in relation to qualitative research in education, and as it applies to children. Essences have been assigned important but controversial explanatory roles in philosophical, scientific, and social theorizing. Is it possible for the same organism to be first a caterpillar and then a butterfly? Is it impossible for a human being to transform into an insect like Gregor Samsa does in Franz Kafka’s The Metamorphosis? Is it impossible for Lot’s wife to survive being turned into a pillar of salt? Traditionally, essences (or natures) have been thought to help answer such central questions about (...) existence, identity, persistence, and modality. These questions are not only of great philosophical interest, they also are of great interest to society at large. This Handbook surveys the state of the art on essence. All large-scale telescope facilities are constructed within a geographical, social, historical, and political context that includes nested layers at the global, national, and local levels. However, discussions about the geographic siting of astronomy facilities, for example, the communities in which they are embedded or the interactions between the facility and its locale, are uncommon in social science studies of astronomy, and no extant review focused on this gap in the literature. In this literature review and discourse analysis, we explore the (...) ways in which research about astronomy facilities and their local communities has emerged, and the extent to which it focuses on the Global South. We find that literature addressing the social and policy aspects of astronomy facilities has an emphasis on the Global North. However, literature addressing host communities has an emphasis on the Global South. Broadly, the discourses related to host communities in the Global South have emerged from reflections on the controversies related to large-scale telescopes in Hawai’i, Chile, and South Africa. One common theme linking these discourses is that a focus on benefits at the national and international levels obscures a range of problematic power dynamics and outcomes at the local level. The notion of the Global South as an ‘empty space’ in which astronomical observation does not constitute impactful action amongst local communities, is challenged by discourses that centre local contexts, and challenged by discourses that employ conceptual frameworks with a focus on revealing power dynamics. This casebook offers a window into important aspects of the ethical landscapes that researchers, communities, health professionals, policy makers – and ethicists – had to navigate during the first 15 months of the COVID-19 pandemic. The cases presented in this casebook are inevitably a selection informed by and constrained by the processes through which they were sought, and by the pandemic itself. Additional cases could valuably complement all the thematic chapters in this casebook. In addition, this casebook calls for a (...) broader approach to research ethics, both in terms of the issues to be considered, and the range of stakeholders having ethical responsibilities relating to the conduct of research. However a broad range of stakeholders have differing values, remits, authorities and capacities to exercise power in pandemic contexts, and in many situations, exercises of power, and their impact on research, are not direct and explicit. As such they are less amenable to clear representation in real-world cases, highlighting the importance of complementing discussions of the cases in this casebook with conceptual literature. Reflection on the research that has not been conducted is also critical. The COVID-19 pandemic has reemphasized that global health emergencies are never only about health. The wide-ranging impacts of the pandemic on economies, employment, education and a range of socially and culturally important activities, accentuates the importance of an equally comprehensive research agenda, which goes beyond a narrow conception of ‘health’, and addresses a broad range of pandemic impacts on populations. A further way in which we believe debate on pandemic research ethics both could and should be broadened is in relation to aspects of pandemic science beyond those relating to ‘response’. Inevitably, in the context of an emerging and continuing pandemic, scientific research attention has tended to focus on interventions that can enable more effective responses. However pandemic science can be thought of as divisible into four interdependent and overlapping domains: prevention, preparedness, response, and recovery. Research is essential to the development, evaluation, and deployment of interventions in each of these domains and effective, valuable, trustworthy and trusted research will require ethical questions to be identified and addressed. This chapter concludes by inviting the connection of additional cases and conceptual resources to this casebook, to enhance and expand the themes and topics covered. (shrink)
