Hennepin County is the largest metropolitan area in Minnesota and includes the city of Minneapolis and surrounding suburbs. On Tuesday, March 24, 2020, the weekly local shelter count identified 1,494 individuals accessing homeless shelters within Minneapolis—205 children with adults, 112 adults with children, 56 youth without an adult, 971 individual adults, and 115 adults accessing emergency hotel placement in response to COVID-19 pandemic. Beyond the shelter system, a recent local point-in-time count logged 732 individuals sleeping on transit, in encampments, in (...) abandoned buildings, or otherwise outdoors. The training relationship between sport psychology professionals (SPPs) and their students is a critical aspect of graduate training. Maintaining ethical, appropriate boundaries within training relationships is imperative, as boundary crossings can have deleterious effects on students. SPPs (N = 152) and Sport Psychology graduate students (N = 165) completed The Survey of Applied Sport Psychologists to explore their experiences and perceptions of sexual attractions and boundary crossings within training relationships. Nearly 30% of SPPs acknowledged sexual attractions toward their students, yet (...) few students (8.5%) perceived such attractions. Compared to the SPPs, the students reported higher levels of anxiety regarding the SPP’s attraction toward them; both groups reported infrequent use of supervision for this attraction. Nine students and 13 SPPs reported engaging in sexual behaviors (e.g., kissing, dating, intercourse) with the other. Within the larger sample, the three most common nonsexual boundary crossings were becoming social friends, attending social gatherings, and the SPP initiating nonsexual touching. Both groups are advised to engage in ongoing monitor their behaviors, receive training specific to ethics within training relationships, and seek consultation/supervision to ensure appropriate boundaries remain intact. About 6,000 individuals participate in the U.S. transplant system as a living organ donor each year. Organ donation by living individuals is a unique procedure, where healthy patients undergo a major surgical operation without any direct functional benefit to themselves. In this article, the authors explore how the ideal of informed consent guides education and evaluation for living organ donation. The authors posit that informed consent for living organ donation is a process. Though the steps in this process are partially (...) standardized through national health policy, they can be improved through institutional structures at the local, transplant center-level. Effective structures and practices aimed at supporting and promoting comprehensive informed consent provide more opportunities for candidates to ask questions about the risks and benefits of living donation and to opt out voluntarily Additionally, these practices could enable new ways of measuring knowledge and improving the consent process. The Industrial Revolution caused an expansion of our ideas of property to include other forms of wealth, such as innovations and productive techniques. And the modern age has caused a further expansion of our ideas of property to include inchoate items, particularly information. The Framers of the U.S. Constitution presumed that government not only took an expansive view of the nature of property rights, they also believed that such rights should be protected. The existence of a meaningful distinction between economic rights and “other rights” has been a cornerstone of constitutional law for the past sixty years. During this period, the federal courts consistently have taken the position that Congress is free to abuse citizens’ economic liberties, but is not permitted to interfere with such other, noneconomic “rights” as freedom of expression, freedom of assembly, and freedom of religion.

In this essay, I identify the reasons that libertarian principles have failed to capture the popular imagination as an acceptable form of civil society. By the term “libertarian” I mean a belief in and commitment to a set of methods and policies that have as their common aim greater freedom under law for individuals. The term “freedom” in this context means not only a commitment to civil liberties, such as freedom of expression, but also to economic liberties, including a commitment (...) to a laissez-faire policy of free enterprise and free trade between countries. Libertarians, therefore, are committed to the absolute minimum state intervention in the economy as well as in people's private lives. In a world constrained by these libertarian principles, people should be permitted to do as they please, constrained only by rules that prevent them from encroaching on the liberty of others. This book argues that understandings and explanations of religion are always historically contingent.

Focusing on the supervisor–trainee relationship, this research set out to examine the impact of ethical leadership on two indicators of work-related well-being: work engagement and emotional exhaustion. Furthermore, this study sought to examine the mediating role of trust in supervisor in these relationships. Survey data were collected at two different points in time from 216 trainee accountants drawn from a variety of organisations. Structural equation modelling was used to test the research hypotheses. Results showed that, as hypothesised, trust in supervisor (...) fully mediated the effects of ethical leadership on work engagement and emotional exhaustion, respectively. We show that the fundamental legal structure of a well-written financial contract follows a state-transition logic that can be formalized mathematically as a finite-state machine (specifically, a deterministic finite automaton or DFA). The automaton defines the states that a financial relationship can be in, such as “default,” “delinquency,” “performing,” etc., and it defines an “alphabet” of events that can trigger state transitions, such as “payment arrives,” “due date passes,” etc. The core of a contract describes the rules by which different (...) sequences of events trigger particular sequences of state transitions in the relationship between the counterparties. By conceptualizing and representing the legal structure of a contract in this way, we expose it to a range of powerful tools and results from the theory of computation. These allow, for example, automated reasoning to determine whether a contract is internally coherent and whether it is complete relative to a particular event alphabet. We illustrate the process by representing a simple loan agreement as an automaton. (shrink)

In this paper, we propose a weak regularity principle which is similar to both weak König's lemma and Ramsey's theorem. We begin by studying the computational strength of this principle in the context of reverse mathematics. We then analyze different ways of generalizing this principle.

While previous methodological studies have suggested that coding is a useful technique for analyzing qualitative data, there is a stark lack of discussion about the incongruities that inevitably arise as researchers accomplish the actual work of coding. This article explores the complexities of the coding process, and how incongruities get resolved as researchers accomplish the practical work of coding. Three primary themes emerged from this study: <creating agreement>, <maintaining the integrity of the codes>, and <completing the work>. Since the last century, vaccination has been one of the most important tools we possess for the prevention and elimination of disease. Yet the tremendous gains from vaccination are now threatened by a growing hesitance to vaccinate based on a variety of concerns or objections. Geographic clustering of some families who choose not to vaccinate has led to a number of well-publicized outbreaks of vaccine-preventable diseases. Of note is that some of these outbreaks are centered within some Christian religious groups (...) that increasingly avoid vaccination due to moral concerns, fears about safety, or doubts about the necessity of vaccines. There is currently an evidentiary gap in the scholarship concerning medical tourism's impact on low- and middle-income destination countries (LMICs). This article reviews relevant evidence that exists and concludes that there are signs of correlation between medical tourism and the expansion of private, technology- intensive health care in LMICs, which has largely remained out of reach for the majority of the local patients. In light of this health care inequity between local residents and medical tourists in LMICs, we argue that (...) the presumption should not be in favor of medical tourism and that governments have a legitimate interest in seeking to regulate this industry to ensure that the net effects for their citizens is positive. Moreover, sending countries, particularly those in the developed world, have the responsibility to adopt public policies to diminish demand on the part of their citizens for medical tourism and to work with LMICs to ensure that the growth of medical tourism does not occur at the expense of the poorest of the poor. Travelling internationally to acquire medical treatments otherwise unavailable or inaccessible in one’s home country is not a novel concept. Conventionally, such medical travel largely entailed patients from developed countries or wealthy patients from the developing world seeking care in Western facilities like the Mayo Clinic in the U.S. and myriad private clinics along Harley Street in London, England. What is different about the topical phenomenon known as “medical tourism” is the growing trend of health services export in the opposite direction. (...) The number of patients travelling from the developed world to low- and middle-income countries for treatments has ballooned in recent years, primarily driven by difficulties with accessing affordable care at home. According to a liberal estimate by the Deloitte Center for Health Solutions, the number of Americans travelling abroad for care rose from 750,000 in 2007 to 1.6 million in 2012. On the flip side, Thailand reportedly treated a total of 1.3 million foreign nationals in 2007, which represented a 16% leap from 2001. (shrink)

This article examines the ambivalences in Foucault’s elaboration of the concept of biopower and biopolitics. From the beginning, he relates the idea of a power over life to struggle and war, and so to race. In the period of the formation of the nation-state, threats to the unity and strength of the population were thought to come from a contagion by an alien element. In this context, tropes of race became aligned with the ‘sciences and technologies of the social’ that (...) were emerging as part of biopolitics. They became part of the new rationality of the state, finding expression in projects such as public hygiene and eugenics, and, at the extreme, in Nazism. (shrink)

St. Thomas Aquinas treats penance as both a sacrament and a virtue. In either form, penance’s principal human act is contrition—a willed sorrow for one’s sins and an intention to avoid future sins. A look at Aquinas’s understanding of penitential contrition reveals a complex interplay of the different objects of love, the gift of fear, and finally friendship with God. This article offers an analysis of Aquinas’s accounts of penance and contrition with respect to these key elements. I argue that (...) contrition performs a fundamental role in countering, restoring, and safeguarding a proper ordering of love and attainment of the ultimate good of union with God. In short, contrition is the act that directly counters the interior disorder wrought by sin and provides an ongoing counter to the threat of additional disorder. Sin’s disorder is the aversion to God and conversion to self, while contrition involves the aversion to self and a conversion to God. (shrink)

This 2004 book is about the ascetic self in the scriptural religions of Christianity, Buddhism and Hinduism. The author claims that asceticism can be understood as the internalisation of tradition, the shaping of the narrative of a life in accordance with the narrative of tradition that might be seen as the performance of the memory of tradition. Such a performance contains an ambiguity or distance between the general intention to eradicate the will, or in some sense to erase the self, (...) and the affirmation of will in ascetic performance such as weakening the body through fasting. Asceticism must therefore be seen in the context of ritual. The book also offers a paradigm for comparative religion more generally, one that avoids the inadequate choices of either examining religions through overarching categories on the one hand and the abandoning of any comparative endeavour that focuses purely on area-specific study on the other. While there are overt philosophies of the person in both dualistic and non-dualistic Śaivism that developed their doctrines explicitly in relation to each other and to non-Śaiva traditions, especially Buddhism, many Śaiva texts exemplify what might be called a pre-philosophical discourse. Such works contain philosophical ideas but do not present systematic arguments and are often regarded as divine revelation. It is this layer of the articulation of concepts linked to practices that the paper exposes, which the arguments of the later (...) philosophers reflect upon and from which they develop. The claim here is that through an analysis of pre-philosophical literature, texts such as the Netra-tantra, we can build a picture of the conceptual universe of the early medieval period that forms the basis for the development of thinking by the later philosophers. One way of doing this is through the micro-study of particular textual passages and from that to build a larger picture of pre-philosophical discourse. (shrink)

Scholars are grateful to Cyril Lionel Robert James (1901-1989) and Herbert Aptheker (1915-2003) for their pioneering work in the field of slave revolts. What they've virtually never mentioned, however, let alone explored, was Aptheker’s practice of rendering James invisible. It is highly improbable that Aptheker did not know either of James or of his noteworthy study of the Haitian Revolution, given that the latter was related to the slave revolts that Aptheker did study. I argue that epistemic vices are bad on account of a lack of a good epistemic motive. Consequently, the source of the badness is specifically epistemic. I develop my argument through a consideration of Aquinas’s accounts of wonder and presumption, namely that what makes the latter bad is the lack of something thatthe former possesses. I then analyze (...) some representative epistemic virtues and vices in terms of the presence or privation of certain good epistemic motives. Finally, on the basis of the logic of the privation of something that should be present, I argue that a given vice’s lack of a good epistemic motive specifies the kind of badness present. It has become almost conventional to describe the early work of Frantz Fanon as an expression of individual political revolt, and his later work as testimony to his commitment to a collective revolution. This article contends that the early work, while individualistic, is a continued source of political embarrassment in that it is unclassifiable and raises difficult issues about the construction of race and racism, as well as challenging conventional views of Fanon as ‘revolutionary’ psychiatrist. Fanon’s representation of his native (...) Martinique, which he effectively disowned, is negative, but proves to be of surprising contemporary relevance, while his analysis of the mechanisms of racism is still pertinent: the situation in which racist stereotypes are invoked may have changed, but the stereotypical structures they employ remain remarkably constant, as do their profoundly dehumanizing effects. Fanon raises embarrassing questions for a French Republic that claims to be universal, demonstrating that its universal values are undermined by those it claims as its subjects. (shrink)
