In this essay, I argue for a historical-critical perspective on rationality. In our global age, we in the West need to come to terms with the fact that non-Western traditions have developed complex forms of practical rationality. I will first give an overview of what I call the “Confucian standards of reasoning.” Secondly, I will explain how the Neo-Confucian thinker Zhu Xi 朱熹 has rearticulated the earlier understanding of practical reasoning. Thirdly, I will demonstrate why a comparative perspective may enrich (...) our reasoned engagement with individuals in the Chinese-speaking world. Charles Sanders Peirce is generally regarded as the founder of pragmatism, and one of the greatest ever American philosophers. Peirce is also widely known for his work on truth, his foundational work in mathematical logic, and an influential theory of signs, or semiotics. Albert Atkin introduces the full spectrum of Peirce’s thought for those coming to his work for the first time. This paper challenges the traditional assumption that descriptive and prescriptive sciences are essentially distinct by presenting a study on the implicit normativity of the production and presentation of biomedical scientific facts within evidence-based medicine. This interdisciplinary study serves as an illustration of the potential worth of the concept of implicit normativity for bioethics in general and for integrated empirical ethics research in particular. It demonstrates how both the production and presentation of scientific information in an evidence-based decision-support contain implicit presuppositions (...) and values, which pre-structure the moral environment of the clinical process of decision-making. As a consequence, the evidence-based decision support did not only support the clinical decision-making process; it also transformed it in a morally significant way. This phenomenon undermines the assumption within much of the literature on patient autonomy that information disclosure is a conditional requirement before patient autonomy even starts; patient autonomy is already influenced during the production and presentation of information. These results imply an increased responsibility of those who produce and present evidence-based facts(i.e. scientists in general and physicians in particular). The insights of this study not only involve a different focus on both theory and practice of patient autonomy and informed consent, but they also call for a broader scope of morality than does traditional empirical research in bioethics. The concept of implicit normativity within integrated empirical ethics research calls for a strong cooperation between bioethicists and descriptive scientists, i.e., a cooperation that goes beyond the discipline-specific epistemic values and that takes place during all phases of the research process. There are two discourses that are used in connection with the provision of good healthcare: a rights discourse and a beneficial design discourse. Although the logical force of these two discourses overlaps, they have distinct and incompatible implications for practical reasoning about health policy. The language of rights can be interpreted as the ground of a well-designed healthcare system stressing the values of equality and inclusion, but it has less application when dealing with questions of cost-effectiveness. This difference reflects the (...) distinction between the deontological status of rights claims and a teleological approach presupposed in the language of beneficial design. However, the value of the separateness of persons contained in the discourse of rights can impose constraints on the adoption of a simple maximizing principle when thinking about the allocation of healthcare resources within a social contract for health. Modern Social Contract Theory provides an exposition and evaluation of major work in social contract theory from 1950 to the present. It locates the central themes of that theory in the intellectual legacy of utilitarianism, particularly the problems of defining principles of justice and of showing the grounds of moral obligation. It demonstrates how theorists responded in a novel way to the dilemmas articulated in utilitarianism, developing in their different approaches a constructivist method in ethics, a method that aimed to (...) vindicate a liberal, democratic and just political order. A distinctive feature of the book is its comparative approach. By placing the works of Barry, Buchanan and Tullock, Harsanyi, Gauthier, Grice, Rawls, and Scanlon alongside one another, similarities and differences are brought out, most notably in the way in which principles are derived by each author from the contractual construction as well as the extent to which the obligation to adopt those principles can be rationally grounded. Each theory is placed in its particular intellectual context. Special attention is paid to the contrasting theories of rationality adopted by the different authors, whether that be utility theory or a deliberative conception of rationality, with the intention of assessing how far the principles advanced can be justified by reference to the hypothetical choices of rational contracting agents. The book concludes with a discussion of some principal objections to the enterprise of contract theory, and offers its own programme for the future of that theory taking the form of the empirical method. Hans Albert is the leading critical rationalist in the German-speaking world and the main critic of the hermeneutic tradition. He is well-known for applying the idea of critical reason to various kinds of human practice, including economics, politics, and law. But he has also improved on Popper's methodology by introducing the idea of rational heuristics. This collection of essays presents the core of his work on epistemology, philosophy of the social sciences, philosophy of religion, and philosophy of law. In this article, I draw on research carried out in Europe, primarily in Germany, on patients’ and scientists’ perspectives on mitochondrial replacement techniques in order to explore some of the complexities related to collective representation in health governance, which includes the translation of emerging technologies into clinical use. Focusing on observations, document analyses, and interviews with eight mitochondrial disease patient organization leaders, this contribution extends our understanding of the logic and meanings behind the ways in which patient participation and collective (...) representation in health governance initiatives take shape. My findings highlight the ways in which a commitment to a global mitochondrial disease patient community and a sense of patient solidarity influence expressions of support with regard to legalizing mitochondrial replacement techniques. My analyses illustrate how normative practices and expectations of participatory governance potentially foreclose opportunities for sustained collective patient engagement with the complex ethical, social, and political dimensions of emerging technologies and may silence diverse and potentially dissenting embodied and lived responses to the prospects of particular technological developments. Using H. Whitney's algebra of physical quantities and his definition of a similarity transformation, a family of similar systems (R. L. Causey [3] and [4]) is any maximal collection of subsets of a Cartesian product of dimensions for which every pair of subsets is related by a similarity transformation. We show that such families are characterized by dimensionally invariant laws (in Whitney's sense, [10], not Causey's). Dimensional constants play a crucial role in the formulation of such laws. They are represented (...) as a function g, known as a system measure, from the family into a certain Cartesian product of dimensions and having the property gφ =φ g for every similarity φ . The dimensions involved in g are related to the family by means of certain stability groups of similarities. A one-to-one system measure is a proportional representing function, which plays an analogous role in Causey's theory, but not conversely. The present results simplify and clarify those of Causey. Representing the kinetic state of a patient (posture, motion, and activity) during vital sign measurement is an important part of continuous monitoring applications, especially remote monitoring applications. In contextualized vital sign representation, the measurement result is presented in conjunction with salient measurement context metadata. We present an automated annotation system for vital sign measurements that uses ontologies from the Open Biomedical Ontology Foundry (OBO Foundry) to represent the patient’s kinetic state at the time of measurement. The annotation system is applied (...) to data generated by a wearable personal status monitoring (PSM) device. We demonstrate how annotated PSM data can be queried for contextualized vital signs as well as sensor algorithm configuration parameters. (shrink)

Empirical evidence from both utility and psychophysical experiments suggests that people respond quite differently—perhaps discontinuously—to stimulus pairs when one consequence or signal is set to `zero.' Such stimuli are called unitary. The author's earlier theories assumed otherwise. In particular, the key property of segregation relating gambles and joint receipts (or presentations) involves unitary stimuli. Also, the representation of unitary stimuli was assumed to be separable (i.e., multiplicative). The theories developed here do not invoke separability. Four general cases based on two (...) distinctions are explored. The first distinction is between commutative joint receipts, which are relevant to utility, and the non-commutative ones, which are relevant to psychophysics. The second distinction concerns how stimuli of the form (x, C; y) and the operation of joint receipt are linked: by segregation, which mixes stimuli and unitary ones, and by distributivity, which does not involve any unitary stimuli. A class of representations more general than rank-dependent utility (RDU) is found in which monotonic functions of increments U(x)-U(y), where U is an order preseving representation of gambles, and joint receipt play a role. This form and its natural generalization to gambles with n > 2 consequences, which is also axiomatized, appear to encompass models of configural weights and decision affect. When joint receipts are not commutative, somewhat similar representations of stimuli arise, and joint receipts are shown to have a conjoint additive representation and in some cases a constant bias independent of signal intensity is predicted. An edition of two manuscript essays found in the family archives of the descendants of the painter and writer Eugène Fromentin. These unpublished essays were submitted in 1840 by their author, Albert Aubert, to Fromentin and his friend Paul Bataillard, for comment and in part response to a question which they had posed, concerning the importance of ambition as a prerequisite for happiness. Les deux essais, publiés ici pour la première fois, datent de mars 1840. Leur auteur, Albert (...) Aubert, y répond, au moins partiellement, à une question que ses amis, Eugène Fromentin et Paul Bataillard, lui avaient posée : pour être heureux, l'homme doit-il avoir de l'ambition? Aubert passe en revue l'évolution de l'humanité, du spiritualisme métaphysique au spiritualisme laïc, et nous donne un témoignage sur l'histoire des mentalités sous la monarchie de Juillet : à l'individualisme et au libéralisme de 1789 a succédé la réhabilitation de l'intervention de l'État, afin de développer la solidarité au sein de la société. Ce débat évoque des questions qui sont d'une brûlante actualité, à une époque où nous éprouvons les limites du modèle démocratique, la crise de l'État-providence, l'essoufflement du modèle social-démocrate et la baisse d'efficacité des thérapeutiques keynésiennes. On peut y voir aussi les prémices de Dominique, le roman de 1862 quasi autobiographique de Fromentin, où la retraite souhaitée par le héros éponyme, qui se donne pour un premier venu, comporte néanmoins une vie intérieure active et intense.
