De même que Frédéric Nef, je suis séduit par les nombreuses vertus philosophiques de ces relations liantes. Ma contribution ne portera (...) pas sur une critique ou une défense de ces relations mais sur l'étude de leur nature, et en particulier, de leur possible nature méréologique. Combining elements from Heidegger’s philosophy of “being-in-the-world” and the tradition of Jewish theology, Levinas has evolved a new type of ethics based on a concept of “the Other” in two different but complementary aspects. He describes his encounters with those philosophers and literary authors (most of them his contemporaries) whose writings have most significantly contributed to the construction of his own philosophy of “Otherness”: Agnon, Buber, Celan, Delhomme, Derrida, Jabès, Kierkegaard, Lacroix, Laporte, Picard, Proust, Van Breda, Wahl, and, most notably, (...) Blanchot. At the same time, Levinas’s own texts are inscriptions and documents of those encounters with “Others” around which his philosophy is turning. This article addresses the problem of automatically extracting legal indices which express the important contents of legal documents. Legal indices are not limited to single-word keywords and compound-word keywords, they are also clause keywords. We approach index extraction using structural information of Japanese sentences, i.e. chunks and clauses. Based on the assumption that legal indices are composed of important tokens from the documents, extracting legal indices is treated as a problem of collecting chunks and clauses that contain as many important (...) tokens as possible. Each token is assigned a weight which is a statistical score, e.g. TF–IDF and Okapi BM25, to indicate its importance. The importance of a chunk or clause is determined based on the average weight of tokens included in that chunk or clause. Then, highly weighted chunks and clauses are recognized as the indices for legal documents. The experimental results on Japanese National Pension Act data show that our proposed method achieves better performance than TextRank, the most popular unsupervised method in extracting single-word and compound-word keywords. In addition, this approach is also applicable to extract clause keywords with high performance. (shrink)

The so-called Baldwin Effect generally says how learning, as a form of ontogenetic adaptation, can influence the process of phylogenetic adaptation, or evolution. This idea has also been taken into computation in which evolution and learning are used as computational metaphors, including evolving neural networks. This paper presents a technique called evolving self-taught neural networks – neural networks that can teach themselves without external supervision or reward. The self-taught neural network is intrinsically motivated. Moreover, the self-taught neural network is the (...) product of the interplay between evolution and learning. We simulate a multi-agent system in which neural networks are used to control autonomous agents. These agents have to forage for resources and compete for their own survival. Experimental results show that the interaction between evolution and the ability to teach oneself in self-taught neural networks outperform evolution and self-teaching alone. More specifically, the emergence of an intelligent foraging strategy is also demonstrated through that interaction. Indications for future work on evolving neural networks are also presented. Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. By exploring the cultural discrepancies in Chinese legal texts and their English versions and to what extent legal and cultural discrepancies influence and constrain legal translation, the study argues that it is useful to consider cultural discrepancies within a semiotic framework. Language is a phenomenon and factor that links different cultures; the use of language is crucial to any legal system. Law, as a cultural product, is attended by cultural discrepancies when switched into other languages for the purpose of achieving (...) equivalence. After a brief overview of cultural differences in translation, legal translation in particular, the study is set to examine the role of translation in crossing through different legal cultures and backgrounds and investigate barriers in the process of translation. Investigating cultural discrepancies in legal translation within a semiotic framework allows us to focus on certain interpretations by acknowledging that legal texts are composed with systems of systems and interacting with other cultural aspects in a wider context. In this article, I argue that Merleau-Ponty underpins an idea of differentiation without ultimate unification through intertwining. I trace this idea of intertwining to Phenomenology of Perception. I argue that what perception marks is already differentiation prior to any identification. For this purpose, firstly, I will introduce Merleau-Ponty’s depiction of intertwining; secondly, I will elaborate perception in Phenomenology of Perception; finally, I will discuss flesh as intertwining in The Visible and The Invisible.

Studies linking religion to CSR have produced conflicting findings due to a failure to draw distinctions among religious influences and different CSR practices, and to theorize their connection. Drawing on social identity theory and the theory of planned behavior, we first argue that religion will influence CSR when ethical values from a CEO’s religious social identification resonate with an aspect of CSR. Second, CEO attitudes congruent with those values and forms of CSR—interpersonal empathy and proactiveness—will strengthen that relationship. Third, the (...) relationship between religious social identification and CSR will be strengthened by a CEO’s ability to enact CSR policies, a function of personal and firm market power. Our research on 270 CEOs from 242 publicly traded US firms from 2007 to 2020 supports these relationships. (shrink)

Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. Ce commentaire privilegie incontestablement l'aspect logique et processuel du propos hegelien. Space tourism is an emerging field where few people have direct experience. However, considering the potential in the near future, it is beneficial to better understand how related information influences people’s attitudes about this new form of tourism. Employing information-processing-based Bayesian Mindsponge Framework (BMF) analytics on a dataset of 361 respondents consuming content related to space tourism on Chinese social media, we found that induced happiness and impression are positively associated with willingness to try space tourism. Information authenticity positively moderates (...) these two associations. Our findings emphasize three aspects of information during the processes of reception and filtering: meaning, intensity, and trust. Since promotional materials for space tourism rely heavily on mental simulations rather than objective feedback, creative uses of digital technology are advantageous. However, precautions must be taken to prevent exploitation, such as false advertising, exaggeration, and emotional manipulation. (shrink)

Le regain progressif d'intérêt dont a bénéficié depuis 1990 la pensée de Gilbert Simondon s'est encore renforcé, depuis 2006, par la publication de textes inédits du philosophe français, ainsi que par celle, enfin unifiée, du grand œuvre de Simondon, jusque-là publié en deux parties : sa thèse principale pour le doctorat d'État, intitulée L'individuation à la lumière des notions de forme et d'information. La présente étude se propose de revenir sur ce texte fondateur, origine de L'individu et sa genèse physico-biologique (...) comme ensuite de L'individuation psychique et collective, pour en dégager à la fois l'originalité et l'actualité, mais aussi pour mieux comprendre finalement le classique de l'auteur, sa thèse complémentaire : Du mode d'existence des objets techniques. On découvrira la portée du " nouvel encyclopédisme " dont Simondon se voulait l'initiateur. Il apparaîtra alors que dans le sillage de son directeur de thèse, Georges Canguilhem, avec d'autres modalités et insistances que lui, Simondon ne rejette le " facile humanisme " que par exigence d'un humanisme difficile qui sache d'une part faire dériver l'homme du vivant, d'autre part intégrer la technique à la culture.
