We propose a special look at new epistemological possibilities in constructing knowledge to fill the gap between theory development and its practical and societal applications. We turn our attention to the strategy field of studies, which is traditionally positivist, but that also accommodates some timid attempts to produce content from other onto-epistemological bases, such as strategy as practice. Then, we explore the possible interchange between strategy as practice and the Epistemologies of the South. Once strategy as practice is based on (...) practice rationality, which conceives social life as continuous production, it allows considering a wider diversity of social experiences surrounding strategic management. Likewise, the Epistemologies of the South represent a processual approach, which considers the social realities of developing countries and allows the inclusion of marginalized voices in social sciences' theorizing movements. We develop a conceptual-methodological guide for researchers to reflect on the possible ways to systematically rescue pieces of many social experiences forgotten by normal science, promoting cognitive and social justice in research, especially in the strategy field. Our proposal is a reflection about exploring what is not done, what is not practiced and make possible to expand the universe of social experiences considered for analysis in organizational and management studies. In doing so, we call the attention of scholars to start a paradigm shift from marginalization to the inclusion of multiple social realities toward cognitive and social democracy in research. Neste artigo, propomos realizar uma discussão sobre a problemática da técnica na contemporaneidade, especialmente a partir do século XX. A grande inspiração para essa abordagem reside na obra Aprender a Viver, do filósofo francês Luc Ferry. Iremos tratar sobre a negação da transcendência levada a cabo pela filosofia de Nietzsche, e como essa negação do que é transcendente influenciou nas questões técnicas ao longo do século XX e atualidade. Por outro lado, a problematização da técnica contemporânea não significará um abandono (...) da tecnologia ou do substrato científico que a possibilita, mas justamente o contrário. A visão científica de mundo pode ser incluída nesse contexto de transcendência. (shrink)

On the basis of arguments showing that none of the most influential analyses of Moore's paradox yields a successful resolution of the problem, a new analysis of it is offered. It is argued that, in attempting to render verdicts of either inconsistency or self-contradiction or self-refutation, those analyses have all failed to satisfactorily explain why a Moore-paradoxical proposition is such that it cannot be rationally believed. According to the proposed solution put forward here, a Moore-paradoxical proposition is one for which (...) the believer can have no non-overridden evidence. The arguments for this claim make use of some of Peter Klein's views on epistemic defeasibility. It is further suggested that this proposal may have important meta-epistemological implications. This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. The findings point to a number of important orientations for the future development of university curriculum. (shrink)

It is argued, on the basis of new counterexamples, that neither knowledge nor epistemic justification (or epistemic rationality ) can reasonably be thought to be closed under logical implication. The argument includes an attempt to reconcile the fundamental intuitions of the opposing parties in the debate.

This article explores the metaphor of Science as provider of sharp images of our environment, using the epistemological framework of Objective Cognitive Constructivism. These sharp images are conveyed by precise scientific hypotheses that, in turn, are encoded by mathematical equations. Furthermore, this article describes how such knowledge is pro-duced by a cyclic and recursive development, perfection and reinforcement process, leading to the emergence of eigen-solutions characterized by the four essential properties of precision, stability, separability and composability. Finally, this article discusses (...) the role played by ontology and metaphysics in the scientific production process, and in which sense the resulting knowledge can be considered objective. A história de O Clarim constitui-se em uma rica documentação de história da educação, pois revela um pouco das representações da cultura juvenil daquele tempo. Aqui interessam os significados da difusão dos discursos difundidos pelo periódico, nos processos de subjetivação provocados pelos textos e suas possíveis influências na construção das identidades daqueles jovens. A pesquisa identifica-se com os (...) pressupostos teóricos da História Cultural e se inscreve no campo das práticas de leitura e escrita e de memórias juvenis, tendo como referenciais as concepções de cultura escrita como uma produção discursiva de um determinado tempo e lugar. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

The full Bayesian signi/cance test (FBST) for precise hypotheses is presented, with some illustrative applications. In the FBST we compute the evidence against the precise hypothesis. We discuss some of the theoretical properties of the FBST, and provide an invariant formulation for coordinate transformations, provided a reference density has been established. This evidence is the probability of the highest relative surprise set, “tangential” to the sub-manifold (of the parameter space) that defines the null hypothesis.

Conceptual congruency effects are biases induced by an irrelevant conceptual dimension of a task (e.g., location in vertical space) on the processing of another, relevant dimension (e.g., judging words’ emotional evaluation). Such effects are a central empirical pillar for recent views about how the mind/brain represents concepts. In the present paper, we show how attentional cueing (both exogenous and endogenous) to each conceptual dimension succeeds in modifying both the manifestation and the symmetry of the effect. The theoretical implications of this (...) finding are discussed. (shrink)

Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

Recognizing that the presence of the Religious School Teaching discipline in public elementary schools in Brazil is a complex and controversial subject, it is of fundamental importance that alternatives be sought so that its offer takes place in such a way as to enable the emergence of conscious and participatory people in the process of transforming society. It was in pursuit of this objective that the authors of this article found in the category of conscientização, proposed by Paulo Freire, a (...) possible way for teachers of the Religious Education discipline of Brazilian public schools to contribute to the formation of autonomous citizens, with a critical conscience, capable of making their own choices, with full freedom. Methodologically, the article was organized using the See, Judge and Act method. This method of analysis allows us to look at the socioeconomic, political and cultural reality in which people are inserted, to confront a specific theoretical instrument, with the aim of proposing possible ways and alternatives for the promotion of a liberating education. Thus, in the first section analyzes two theoretical categories related to education, namely: banking education and liberating education. In the second section, an attempt was made to weave an approach around the category of conscientização, proposed by Paulo Freire. In the third section, the authors present possible paths of action for a liberating education based on the teaching of Religious Education. (shrink)

A pesar de lo anterior, la mayor parte de la investigación disponible se concentra en estudios de corte descriptivo y evaluativo, sin conectar sus desarrollos con las reflexiones de la teoría sociológica. El presente ensayo identifica las principales posibilidades teóricas y epistemológicas de la teoría de sistemas sociales para el análisis de la educación superior, examinando los rendimientos de la noción de diferenciación de (...) planos de formación sistémica (interacción, organización y sociedad) y la idea de diferenciación de sistemas parciales especializados. Abstract Higher education has become an object of growing interest in the specialized literature. Despite this, most of the available research concentrates on descriptive and evaluative studies, without connecting its developments with the reflections of general sociological theory. This essay identifies the main theoretical and epistemological possibilities of social systems theory for the analysis of higher education, examining the uses of the notion of differentiation of systemic formation planes (interaction, organization, and society) and the idea of differentiation of specialized partial systems. O objetivo deste trabalho é apresentar as diferentes posturas didático-pedagógicas dos professores pré-serviço de língua inglesa, quando tiveram que criar tarefas utilizando diferentes artefatos de ensino (tecnologias). A necessidade de se usar a tecnologia como recurso para o processo de ensino-aprendizagem de língua estrangeira, vem proporcionando a realização de trabalhos invest-igativos concernentes a observação de formas apropriadas para utilizá-la na educação. Warschauer e Healey (1998) e Nardi (1996) defendem que a inserção dos computadores e da internet no processo de ensino-aprendizagem (...) de línguas estrangeiras está proporcionando melhor condição de trabalho, bem como, uma formação adequada aos sujeitos envolvidos com a educação. Desta forma, pesquisar sobre a inserção do computador e da internet, como recurso de material didático (apoio) tendo como base os preceitos da Teoria da Atividade (Engestrom, 1987), nos permite compreender as alterações no sistema de atividade a partir dos diferentes artefatos utilizados. Tendo como contexto de pesquisa o curso de letras de uma universidade federal, os dados foram coletados por meio de observações das aulas de metodologia. A análise dos dados mostrou que na tentativa de se criar tarefas pedagógicas, utilizando diferentes artefatos de ensino, o professor pré-serviço desenvolveu práticas diferentes. (shrink)

La “muerte” de la metafísica de la causalidad, con Kant, propició la transferencia de este Absoluto a una obligación moral, cuya legisladora sería una buena voluntad subjetiva, introduciendo el relativismo en el pensamiento humano y generando, a lo largo del tiempo, una crisis ético antropológica y la pérdida (...) de la auténtica trascendencia. ¿Sería el rescate de la metafísica una respuesta transcendental a la crisis del hombre contemporáneo? This article has as its theme the democracy as fundamentalism, or the democratic fundamentalism. Its main objective is the recognition that the thinking about democracy can itself be fundamentalist, implying that not only religious fundamentalisms are a threat to contemporary democracy. Its method and object are the interpretation of texts by two contemporary philosophers who do not usually talk to each other, the Italian Gianni Vattimo and the French Jean-Luc Nancy. The essay's thesis is the affirmation of democratic thinking as (...) a form of fundamentalism, insofar as it fulfills certain conditions established by the two thinkers analyzed. These conditions are, in the language of the aforementioned philosophers, the framing of democracy under the so-called strong thought, or its subsumption to a metaphysical way of thought, so that it becomes incapable of self-criticism and its necessary reinvention. Thus, it is expected to contribute to the construction of a self-critical vision of democracy through dialogue with aspects of thought little known of important philosophers and also through the dialogue between philosophy and theology as emancipatory ways of knowing. This article provides a critical reading of the ‘Parecer CNE-CES 60, de 2014’, from the Ministry of education, Brazil, which defines the curriculum guidelines for courses of Baccalaureate in Theology. In its first section it discusses the theoretical background of the ‘Parecer’, questioning its illuminist orientation, as well as its pedagogical theory focused on contents and not on the students activities. It aims to show that are two opposed educational paradigms in the ‘Parecer’, the illuminist and the constructivist, although the (...) illuminist is the dominant one. It also question the view of the theologian present in the ‘Parecer’, marked by significant absences from the professional field of religious work. In the second section, the article presents a sample of particular interpretation of the ‘Parecer’, indicating the guidelines of a curriculum based on the constructivist paradigm. It dedicates special attention to the occult dimension of the curriculum and to an articulation of the student’s activities in relationship to the disciplines of the course. (shrink)

El déjà vu es problemático en el fin de siglo (XIX), no por la ensoñación poética que trae consigo, sino por la perturbación que le causa a la vida. De allí la preocupación de los “savants” por entenderlo, controlarlo y “curarlo”. El déjà vu irrumpe en la vida cotidiana del sujeto, lo perturba, lo desconcierta. De allí que Bodei lo relacione con el eterno retorno de Nietzsche. Más que un caso aislado o “patológico” ligado a individuos “pa(de)cientes” como los epilépticos, (...) o una “válvula de escape de la realidad”, el déjà vu sería para Bodei, la irrupción (la erupción) de una ilusión frente a la realidad “operante”. El déjà vu pone en crisis la supuesta identidad “absoluta” del sujeto, su dimensión del tiempo y su “confianza” en la continuidad de la personalidad. Para hablar de él es necesario, como sugiere Bodei, referirse al tema del “doble” en la literatura del siglo XIX. (Dostoievski más que Stevenson). (shrink)

Os acontecimentos políticos do século XX, tais como o totalitarismo, fizeram Arendt indagar sobre o sentido da política, originando, assim, a categoria de condição humana. Ao tomarmos como ponto de partida a vida ativa, vemos que a pluralidade, categoria que fundamenta a ação, manifesta-se em meio ao espaço público. O campo da política é o da pluralidade, sendo que nele é necessário a liberdade que é a própria condição da política e, assim sendo, o espaço público torna-se a esfera acolhedora (...) de ambas. Portanto, a política jamais pode ser vista e entendida no singular, mas no plural, pois é na pluralidade dos homens onde a mesma surge em meio ao espaço público. Assim, temos como objetivo demonstrar a importância do espaço público como lugar de aparência da política, buscando na obra “A condição humana” as ferramentas argumentativas que nos auxiliarão a alcançar o mote da presente pesquisa. Gilberto Freyre, autor de Casa-Grande & Senzala, pensador polêmico, mas singular no que se propõe - tradução da realidade brasileira à luz da miscigenação. Pode se dizer que nos textos desse recifense existem mais do que contradições, são, no sentido de determinados conceitos, debates dialéticos. Desse modo, o artigo aqui proposto intenta pensar o termo democracia racial por meio de um procedimento filosófico, a saber, dialética conceitual. Assim, não se pretende fazer uma defesa do autor em questão, mas para além (...) disso, observar o debate e contribuir para novos entendimentos em torno desse polissêmico conceito. Sendo assim, o texto encontra-se dividido em dois momentos, no primeiro momento, busca-se um diálogo com os estudiosos do pensamento de Gilberto Freyre para localização e compreensão histórica de seu expediente teórico e, no segundo momento, atina-se para uma observação filosófica do conceito de dialética. This article considers distinct ways of understanding the world, referred to in psychology as Functions of Consciousness or as Cognitive Modes, having as the scope of interest epistemology and natural sciences. Inspired by C.G. Jung's Simile of the Spectrum, we consider three basic cognitive modes associated to: (R) embodied instinct, experience, and action; (G) reality perception and learning; and (B) concept abstraction, rational thinking, and language. RGB stand for the primary colors: red, green, and blue. Accordingly, a conceptual map between (...) cognitive modes and primary and secondary colors is built based on the physics and physiology of color perception and epistemological characteristics of the aforementioned cognitive modes, leading to logical relations structured as an Hexagon of Opposition. Finally, this model of cognitive modes is applied to the analysis and interpretation of some important episodes in the historical development of physics and technology. (shrink)

The VIDAS data set presents data from 200 participants from different countries and language backgrounds. They completed an oral expression and interaction test in the context of a Spanish certification exam for adult migrants. The aim of the VIDAS data set is to provide researchers in psycholinguistics and second language acquisition with a Spanish spoken corpus of traditionally marginalized and underrepresented learners, providing a compelling data set of oral interactions by migrants and refugees. The corpus contains more than 29 h (...) of recordings of the oral interactions of the participants with trained interviewers, as well as background information about the participants. It furthermore contains the scores obtained by the participants in the oral expression and interaction exam. The VIDAS corpus allows for the development of studies on L2 spoken language comprehension and processing, as well as for comparative analyses of language acquisition between different L1 groups at different linguistic levels. Successful accounts of analogy in law have two burdens to discharge. First, they must reflect the fact that the conclusion of an argument by analogy is a normative claim about how to decide a certain case. Second, they must not fail to accord relevance to the fact that the source case was authoritatively decided in a certain way. We argue in the first half of this paper that the common view of the structure of analogical arguments in law cannot overcome (...) these hurdles. In the second half we develop an original account that aims to succeed where others failed. (shrink)

I propose and defend a proof-based account of legal exceptions. The basic thought is that the characteristic behaviour of exceptions is to be explained in terms of the distinction, relative to some given decision-type C in some decision-making context, between two classes of relevant facts: those that may, and those that may not, remain uncertain if a token decision C is to count as correctly made. The former is the class of exceptions. A fact F is an exception relative to (...) some decision-type C, I claim, if (i) the ascertainment of F is sufficient for a token decision C not to count as correctly made, and (ii) the ascertainment of the negation of F is not necessary for a token decision C to count as correctly made. I also recuperate, reconstruct and discuss some of HLA Hart’s early views on defeasible judicial decisions. These two projects are closely connected: the latter is a vehicle for the former. (shrink)

El texto reflexiona sobre el vaciamiento neoliberal de la política, despolitizando la vida y cuantificando la realidad. El neoliberalismo enaltece la libertad individual, llevando a un individualismo extremo que amenaza el tejido social. La destrucción creativa moldea cuerpos y subjetividades, promoviendo competencia y autosacrificio. La exterioridad neoliberal afecta a los individuos, enfocándolos en su propia libertad y bloqueando su capacidad de actuar con otros. La crítica se centra en recuperar la sensibilidad y el deseo para restaurar la vida colectiva, explorando (...) la relación entre el cuerpo entristecido y la lógica neoliberal de acumulación y autorresponsabilidad, sugiriendo que puede generar cuerpos tristes y descontentos -todo esto en atención a una ontología spinozista-. Se critica, así, el culto a la vida en la sociedad neoliberal y cómo se marginaliza a los cuerpos vulnerables, abogando por abrazar la vulnerabilidad y la interdependencia para superar la lógica destructiva y la obsesión por la acumulación. This paper has three main objectives: (a) Discuss the formal analogy between some important symmetry-invariance arguments used in physics, probability and statistics. Specifically, we will focus on Noether’s theorem in physics, the maximum entropy principle in probability theory, and de Finetti-type theorems in Bayesian statistics; (b) Discuss the epistemological and ontological implications of these theorems, as they are interpreted in physics and statistics. Specifically, we will focus on the positivist (in physics) or subjective (in statistics) interpretations vs. objective interpretations that (...) are suggested by symmetry and invariance arguments; (c) Introduce the cognitive constructivism epistemological framework as a solution that overcomes the realism-subjectivism dilemma and its pitfalls. The work of the physicist and philosopher Max Born will be particularly important in our discussion. (shrink)

Randomization is an integral part of well-designed statistical trials, and is also a required procedure in legal systems. Implementation of honest, unbiased, understandable, secure, traceable, auditable and collusion resistant randomization procedures is a mater of great legal, social and political importance. Given the juridical and social importance of randomization, it is important to develop procedures in full compliance with the following desiderata: (a) Statistical soundness and computational efficiency; (b) Procedural, cryptographical and computational security; (c) Complete auditability and traceability; (d) Any (...) attempt by participating parties or coalitions to spuriously influence the procedure should be either unsuccessful or be detected; (e) Open-source programming; (f) Multiple hardware platform and operating system implementation; (g) User friendliness and transparency; (h) Flexibility and adaptability for the needs and requirements of multiple application areas (like, for example, clinical trials, selection of jury or judges in legal proceedings, and draft lotteries). This paper presents a simple and easy to implement randomization protocol that assures, in a formal mathematical setting, full compliance to the aforementioned desiderata for randomization procedures. Although logical consistency is desirable in scientific research, standard statistical hypothesis tests are typically logically inconsistent. To address this issue, previous work introduced agnostic hypothesis tests and proved that they can be logically consistent while retaining statistical optimality properties. This article characterizes the credal modalities in agnostic hypothesis tests and uses the hexagon of oppositions to explain the logical relations between these modalities. Geometric solids that are composed of hexagons of oppositions illustrate the conditions for these modalities to be logically (...) consistent. Prisms composed of hexagons of oppositions show how the credal modalities obtained from two agnostic tests vary according to their threshold values. Nested hexagons of oppositions summarize logical relations between the credal modalities in these tests and prove new relations. (shrink)
