Presented here are the cases of two secondary social studies teachers who were participants in a larger research endeavor designed to examine the enduring effects of a preservice teacher preparation program rooted in problem-based historical inquiry (PBHI) on their in-service beliefs and practices. The study was designed to revisit graduates of this teacher preparation program after they completed their induction into the profession. The two teachers selected for closer examination in this piece had relatively similar preservice teacher experiences and taught (...) in the same city school system. Findings indicate that the preservice program continued to impact both to some extent. However, their current beliefs about social studies teaching and their typical classroom practices differed greatly. Evidence suggests that these differences may be attributed to their personal dispositions and their conceptions of the role of the teacher. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. The Bermuda Principles for DNA sequence data sharing are an enduring legacy of the Human Genome Project. They were adopted by the HGP at a strategy meeting in Bermuda in February of 1996 and implemented in formal policies by early 1998, mandating daily release of HGP-funded DNA sequences into the public domain. The idea of daily sharing, we argue, emanated directly from strategies for large, goal-directed molecular biology projects first tested within the “community” of C. elegans researchers, and were introduced (...) and defended for the HGP by the nematode biologists John Sulston and Robert Waterston. In the C. elegans community, and subsequently in the HGP, daily sharing served the pragmatic goals of quality control and project coordination. Yet in the HGP human genome, we also argue, the Bermuda Principles addressed concerns about gene patents impeding scientific advancement, and were aspirational and flexible in implementation and justification. They endured as an archetype for how rapid data sharing could be realized and rationalized, and permitted adaptation to the needs of various scientific communities. Yet in addition to the support of Sulston and Waterston, their adoption also depended on the clout of administrators at the US National Institutes of Health and the UK nonprofit charity the Wellcome Trust, which together funded 90% of the HGP human sequencing effort. The other nations wishing to remain in the HGP consortium had to accommodate to the Bermuda Principles, requiring exceptions from incompatible existing or pending data access policies for publicly funded research in Germany, Japan, and France. We begin this story in 1963, with the biologist Sydney Brenner’s proposal for a nematode research program at the Laboratory of Molecular Biology at the University of Cambridge. We continue through 2003, with the completion of the HGP human reference genome, and conclude with observations about policy and the historiography of molecular biology. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This is the first book to offer the best essays, articles, and speeches on ethics and intelligence that demonstrate the complex moral dilemmas in intelligence collection, analysis, and operations. Some are recently declassified and never before published, and all are written by authors whose backgrounds are as varied as their insights, including Robert M. The theme of the third annual Spring workshop of the HUPO-PSI was proteomics and beyond and its underlying goal was to reach beyond the boundaries of the proteomics community to interact with groups working on the similar issues of developing interchange standards and minimal reporting requirements. Significant developments in many of the HUPO-PSI XML interchange formats, minimal reporting requirements and accompanying controlled vocabularies were reported, with many of these now feeding into the broader efforts of the Functional Genomics Experiment data (...) model and Functional Genomics Ontology ontologies. The current consensus in Locke scholarship is that Robert Boyle anticipated Locke's thesis that classification into species is the arbitrary work of the understanding. In fact, according to Michael Ayers, inter alia, not only did Boyle and Locke both think that classification is the workmanship of the understanding but that this thesis follows directly from the mechanical hypothesis itself. In this paper I argue that this reading of Boyle is mistaken: Locke's thesis on classification was not anticipated by Boyle. (...) I will do this by showing that Boyle's account of classification is not Locke's, but is a more realist view of natural species employing a mechanically respectable account of natural forms. (shrink)

SummaryRecently discovered documents have revealed the background to a letter published in The Darwin Correspondence, dated 21 February 1838 and sent to Charles Darwin and six others from John George Children of the British Museum. It concerned a complaint made by Edward Blyth about George Robert Gray, assistant in charge of birds at the museum. A response by Darwin, and 14 other referees, supported Gray's defence of his character, and the complaint was dismissed. It is concluded that Children (...) investigated this complaint so vigorously because of recent criticism of the natural history collections by witnesses to the Select Committee of the House of Commons on the British Museum (1836–37), who sought to increase the involvement and influence of career scientists in the overseeing of the collections. Children may have also been sensitive to criticism because he was a controversial appointee. (shrink)

John Earman's A Primer on Determinism treats the doctrine of Laplacian determinism by a careful look at a considerable variety of physical theories. This paper enriches Earman's discussion of chaos theory by considering in some detail the analysis of dripping faucets due to Robert Shaw. Shaw's analysis exhibits in a nice way some of the techniques used in chaos theory and gives a feel for research in this area. The paper concentrates on the tension between the determinism inherent (...) in any description involving differential equations and the in-practice unpredictability resulting from the extreme sensitivity to initial conditions of the non-linear differential equations characteristic of chaos theory. Much of the literature on "ceteris paribus" laws is based on a misguided egalitarianism about the sciences. For example, it is commonly held that the special sciences are riddled with ceteris paribus laws; from this many commentators conclude that if the special sciences are not to be accorded a second class status, it must be ceteris paribus all the way down to fundamental physics. We argue that the (purported) laws of fundamental physics are not hedged by ceteris paribus clauses and (...) provisos. Furthermore, we show that not only is there no persuasive analysis of the truth conditions for ceteris paribus laws, there is not even an acceptable account of how they are to be saved from triviality or how they are to be melded with standard scientific methodology. Our way out of this unsatisfactory situation to reject the widespread notion that the achievements and the scientific status of the special sciences must be understood in terms of ceteris paribus laws. Many have claimed that ceteris paribus (CP) laws are a quite legitimate feature of scientific theories, some even going so far as to claim that laws of all scientific theories currently on offer are merely CP. We argue here that one of the common props of such a thesis, that there are numerous examples of CP laws in physics, is false. Moreover, besides the absence of genuine examples from physics, we suggest that otherwise unproblematic claims are rendered untestable by the (...) mere addition of the CP operator. Thus, “CP all Fs are Gs” when read as a straightforward statement of fact, cannot be the stuff of scientific theory. Rather, we suggest that when ``ceteris paribus'' appears in scientific works it plays a pragmatic role of pointing to more respectable claims. (shrink)

First published in 1994, this scholarly edition of a major Renaissance text is edited and introduced by John Henry Jones, a leading expert on the Faust legend. The English translation of the best-selling German Faust Book of 1587 has long been known as Marlowe's principal source for Dr Faustus. The earliest surviving edition of this translation, published in 1592, is here presented complete, in modern spelling and with a line register for reference, together with full details of all alterations (...) and omissions from the German source. Textual comparisons with Doctor Faustus and with later editions of the English Faust Book provide crucial information in the development of the Faust theme in England and Germany. In an introduction making full use of hitherto unpublished research, Dr Jones offers new arguments both on the dating of Marlowe's play, and on the personal history and probable identity of the original translator of the German Faust Book, known only as 'P. This is the first part of a two-part article in which we defend the thesis of Humean Supervenience about Laws of Nature (HS). According to this thesis, two possible worlds cannot differ on what is a law of nature unless they also differ on the Humean base. The Humean base is easy to characterize intuitively, but there is no consensus on how, precisely, it should be defined. Here in Part I, we present and motivate a characterization of the Humean base (...) that, we argue, enables HS to capture what is really stake in the debate, without taking on extraneous commitments. Our contention is that one can combine a modest realism about laws of nature with a proper recognition of the importance of empirical testability in the epistemology of science only if one accepts HS.

This article provides critical analysis of Aquinas’s designation of poverty as unqualifiedly evil. This paper provides an analysis of two different meanings of poverty: (a) in relation to things or to the external conditions in which people live and (b) in relation to an action in which people engage or are thwarted. Next, the paper discusses the sense in which poverty is an evil—and particularly, an unqualified evil—in relation to both of these meanings of poverty. Since Aquinas claims that poverty (...) is an unqualified evil so far as it prevents people from attaining the ends of sustaining themselves and assisting others, the final section of the paper discusses possible interpretations of these ends, suggesting that each end can be taken in a narrow, minimalist or subsistence sense and a broader, more holistic or contextualized sense.
