This paper offers an account of Susan Haack’s philosophy of law and points out several aspects within the legal pragmatist tradition that deserve further discussion. Firstly, a systematic presentation of legal pragmatism as it is defended by Haack, who follows Justice Oliver W. Holmes here, is given. Secondly, the limits of an evolutionary perspective of law recommended by legal pragmatism are considered. Finally, the paper discusses whether legal pragmatism is able to handle different legal traditions, thereby focusing on Anglo-American common (...) law and European civil law. (shrink)

BackgroundAlthough the number of reporting guidelines has grown rapidly, few have gone through an updating process. The STARD statement (Standards for Reporting Diagnostic Accuracy), published in 2003 to help improve the transparency and completeness of reporting of diagnostic accuracy studies, was recently updated in a systematic way. Here, we describe the steps taken and a justification for the changes made.ResultsA 4-member Project Team coordinated the updating process; a 14-member Steering Committee was regularly solicited by the Project Team when making critical (...) decisions. First, a review of the literature was performed to identify topics and items potentially relevant to the STARD updating process. After this, the 85 members of the STARD Group were invited to participate in two online surveys to identify items that needed to be modified, removed from, or added to the STARD checklist. Based on the results of the literature review process, 33 items were presented to the STARD Group in the online survey: 25 original items and 8 new items; 73 STARD Group members (86 %) completed the first survey, and 79 STARD Group members (93 %) completed the second survey.Then, an in-person consensus meeting was organized among the members of the Project Team and Steering Committee to develop a consensual draft version of STARD 2015. This version was piloted in three rounds among a total of 32 expert and non-expert users. Piloting mostly led to rewording of items. After this, the update was finalized. The updated STARD 2015 list now consists of 30 items. Compared to the previous version of STARD, three original items were each converted into two new items, four original items were incorporated into other items, and seven new items were added.ConclusionsAfter a systematic updating process, STARD 2015 provides an updated list of 30 essential items for reporting diagnostic accuracy studies. Nationalistische Ideen haben in der gegenwärtigen Politik Konjunktur. Dabei ist auch die Wiederkehr einer völkisch-traditionalistischen Ideologie zu beobachten. Der völkische Nationalismus ist in rechtsextremen Gruppen weit verbreitet. Mittlerweile wirken völkische Ideen jedoch weit in die bürgerliche Mitte hinein, nicht zuletzt aufgrund der erfolgreichen Strategien der sogenannten „Neuen Rechten“. Die Identitäre Bewegung (IB) spielt in dieser Szene eine wesentliche Rolle und wird zumeist als eine „neurechte Jugendbewegung“ (Bruns et al 2017) definiert. Diese Einschätzung möchte ich im Folgenden näher betrachten. Meine (...) Auseinandersetzung mit der Ideologie der IB umfasst drei Schritte: Im ersten Schritt wird mit dem Konzept des Ethnopluralismus, das Grundmotiv der identitären Ideologie, analysiert. Im zweiten Schritt entfalte ich eine genealogische Perspektive. Deshalb wird hier eine bestimmte Variante völkischen Denkens der 20er und 30er Jahre thematisiert. Ausgehend von einer kulturkritischen Zeitdiagnose entwickelten Philosophen wie Alfred Baeumler (1887–1968), Ernst Krieck (1882–1947) oder Erich Rothacker (1888–1965) eine identitätspolitische Antwort auf die Moderne und sahen diese im Nationalsozialismus (NS) verwirklicht. Der völkische Partikularismus war das Grundmotiv dieser politischen Anthropologie. Meine genealogische Analyse wird zeigen, dass die IB keine „neurechte Jugendbewegung“ (Bruns et al 2017; Hervorhebung J.S.) in einem inhaltlichen Sinne ist. Denn die identitäre Ideologie ist keine Erneuerung, sondern eine simple Wiederkehr völkischen Denkens, das bereits vor 1945 weit verbreitet war. The paper provides a systematic overview of recent debates in epistemology and philosophy of science on the nature of understanding. We explain why philosophers have turned their attention to understanding and discuss conditions for “explanatory” understanding of why something is the case and for “objectual” understanding of a whole subject matter. The most debated conditions for these types of understanding roughly resemble the three traditional conditions for knowledge: truth, justification and belief. Die in diesem Sammelband vereinigten Überlegungen stehen unter der zweiteiligen übergreifenden Überschrift "Deliberative Kritik – Kritik der Deliberation", die in einem Zug den kritischen Sinn der Deliberation und die Notwendigkeit einer reflexiven Kritik am Konzept der Deliberation selbst deutlich macht. Es spricht einiges dafür, daß sich die Zukunftsfähigkeit auch westlicher Gesellschaften an ihrer Fähigkeit zur demokratischen Selbsttransformation, z.B. durch eine Ausweitung der Mitwirkungsrechte der Bürgerinnen und Bürger, erweisen wird.Vor diesem Hintergrund wird hier der Versuch unternommen, die Bedingungen und Chancen einer partizipatorischen Reform parlamentarischer Demokratien zu sondieren. Dabei führt der Verfasser zunächst im Durchgang durch die neuere staats- und demokratietheoretische Diskussion die Idee einer deliberativen Politik ein, die er dann in ein Modell reflexiver Demokratie übersetzt und so eine Perspektive auf (...) die grundlegende Reform politischer Institutionen eröffnet. In science and philosophy, a relatively demanding notion of understanding is of central interest: an epistemic subject understands a subject matter by means of a theory. This notion can be explicated in a way which resembles JTB analyses of knowledge. The explication requires that the theory answers to the facts, that the subject grasps the theory, that she is committed to the theory and that the theory is justified for her. SummaryIn a theory of representational or intentional states content is generally supposed to play various roles. It has to be the bearer of a truth‐value, it has to determine the way a representation is about something , and finally it has to 6e used in order to give intra‐ and interpersonal psychological explanations. It has been argued that no unique kind of content can play all these roles. What criterion should one adopt in order to draw the dividing line? We (...) suggest that the divide be based on ontological considerations related to the way content depends on external factors. There is a fundamental difference, we submit, between object‐dependent and property‐dependent contents. The requirements concerning modes of presentation as well as cognitive significance can be met by one kind of content. This content, it will appear, is property‐dependent, but never object‐dependent. Most philosophers have largely downplayed any relevance of multiple meanings of the folk concept of truth in the empirical domain. However, confusions about what truth is have surged in political and everyday discourse. In order to resolve these confusions, we argue that we need a more accurate picture of how the term ‘true’ is in fact used. Our experimental studies reveal that the use of ‘true’ shows substantial variance within the empirical domain, indicating that ‘true’ is ambiguous between a correspondence (...) and a coherence reading. We then explore the consequences of these results for the project of re-engineering truth. (shrink)

Taking Carnap’s classic exposition as a starting point, this paper develops a pragmatic account of the method of explication, defends it against a range of challenges and proposes a detailed recipe for the practice of explicating. It is then argued that confusions are involved in characterizing explications as definitions, and in advocating precising definitions as an alternative to explications. Explication is better characterized as conceptual re-engineering for theoretical purposes, in contrast to conceptual re-engineering for other purposes and improving exactness for (...) purely practical reasons. The Irish language represents a material link ensuring continuity between the past and present of the Irish experience, but as that link has gradually been obscured, the language has become a form of alterity, indicated in the notion of Gaelic Ireland going ‘underground’. The choice between maintaining the continuity of the Irish literary tradition and abandoning it was characterized by Franciscan theologian and philosopher Froinsias Ó Maolmhuaidh (Francis O’Molloy) as the choice between keeping one’s reason and embracing folly. Thus, his (...) envoi to the first printed Irish grammar in 1677 exhorts the people of Ireland to engage in a revival of literacy in the Irish language so as to transform their future by keeping faith with the past. Yet the desire to revive past knowledge or values is problematic. Is it possible, as the Irish revivalist Douglas Hyde desired, to ‘render the present a rational continuation of the past’? Or is it the case that revivals are attempts at a renewal of tradition, involving a dialectical transition similar to Hegel’s notion of Aufhebung? This inaugural lecture considers this question and the wider implications of revival by situating the Irish tradition of Revivalism within the broader history of ideas. (shrink)

Carnap and Goodman developed methods of conceptual re-engineering known respectively as explication and reflective equilibrium. These methods aim at advancing theories by developing concepts that are simultaneously guided by pre-existing concepts and intended to replace these concepts. This paper shows that Carnap’s and Goodman’s methods are historically closely related, analyses their structural interconnections, and argues that there is great systematic potential in interpreting them as aspects of one method, which ultimately must be conceived as a component of theory development. The (...) main results are: an adequate method of conceptual re-engineering must focus not on individual concepts but on systems of concepts and theories; the linear structure of Carnapian explication must be replaced by a process of mutual adjustments as described by Goodman; Carnap’s condition of similarity can be analysed into two components, one securing a relation to the specific extensions of the pre-existing concepts, one regulating the transition to the new system of concepts; these two criteria of adequacy can be built into Goodman’s account of reflective equilibrium to ensure that the resulting concepts promote theoretical virtues while being sufficiently similar to the concepts we started out with. Wrongdoing is inescapable. We all do wrong and are wronged; and in response we often blame one another. But if blame is a defining feature of our social lives, so is ceasing to blame. We might excuse, justify, or forgive an offender; or simply let the offence go. Each mode of ceasing to blame is a social practice and each has characteristic norms that influence when and how we do it, as well as how it’s received. We argue that how (...) we relinquish blame, and how effective we are, depends on many circumstances only partially within our control. Like any norm-governed practice, one can do it well or poorly, appropriately or inappropriately, successfully or unsuccessfully. To successfully participate in a practice, one’s action must be done for the right reasons and secure uptake. We argue that social and material circumstances can compromise one’s ability to effectively cease to blame in the manner one prefers. But if one can fail, then one can lack access to particular ceasing to blame practices if one is regularly prevented from effectively relinquishing blame. However, uncooperative social and material circumstances do not only arise by chance. Our central argument is that circumstances of oppression can systematically compromise one’s ability and opportunities to effectively perform a variety of ceasing to blame practices. This deprivation is an insidious facet of oppression that is neglected both in theories of oppression and of forgiveness but which has significant implications for how we understand the power and purpose of forgiveness. The goal of this paper is to re-assess reflective equilibrium (“RE”). We ask whether there is a conception of RE that can be defended against the various objections that have been raised against RE in the literature. To answer this question, we provide a systematic overview of the main objections, and for each objection, we investigate why it looks plausible, on what standard or expectation it is based, how it can be answered and which features RE must have to meet (...) the objection. We find that there is a conception of RE that promises to withstand all objections. However, this conception has some features that may be unexpected: it aims at a justification that is tailored to understanding and it is neither tied to intuitions nor does it imply coherentism. We conclude by pointing out a cluster of questions we think RE theorists should pay more attention to. (shrink)

Healthcare professionals who feel psychologically safe believe it is safe to take interpersonal risks such as voicing concerns, asking questions and giving feedback. Psychological safety is a complex phenomenon which is influenced by organizational, team and individual level factors. However, it has primarily been assessed as a team-level phenomenon. This study focused on understanding healthcare professionals' individual experiences of psychological safety. We aim to gain a fuller understanding of the influence team leaders, interpersonal relationships and individual characteristics have on individuals' (...) psychological safety and their decisions to engage in voice or silence behavior. Thirty-four interviews were conducted with healthcare professionals from across five teams working within an acute, suburban hospital. Hybrid inductive-deductive thematic analysis focused on identifying themes which captured the complexities of individuals' varied experiences of psychological safety. The themes identified were: “Personal Characteristics,” “Past Experiences,” “Individual Perceptions of Being Valued,” and “Judged Appropriateness of Issues/Concerns.” These themes are explored within the context of motivating and inhibiting factors associated with the influence of leadership, interpersonal relationships and individual characteristics on experiences of psychological safety and voice behavior. These results extend existing theoretical frameworks guiding our understanding of psychological safety by accounting for the variation in individuals' experiences and studying these significant influences on voice behavior. Important considerations for the development of interventions to enhance psychological safety are discussed. (shrink)

Asexuality is overlooked in the philosophical literature and in wider society. Such neglect produces incomplete or inaccurate accounts of romantic life and harms asexual people. We develop an account of asexuality to redress this neglect and enrich discussion of romantic life. Asexual experiences are diverse. Some asexual people have sex; some have romantic relationships in the absence of sex. We accept the common definition of asexuality as the absence of sexual attraction and explain how sexual attraction and sexual desire differ (...) by giving an affordance‐like account of sexual attraction. Armed with that distinction, we show that asexuality is clearly different from celibacy or disorders of desire and that some existing philosophical theories of sexual desire struggle to accommodate asexual sexuality. We then build on asexual testimony about the diversity of non‐sexual attractions to answer two common objections levelled at asexual romance: that romantic relationships require sexual attraction or that sex in the absence of sexual attraction is insufficiently focused on someone as an individual. Finally, we describe some of the ways asexuality has been erased or denigrated in society, and the specific injustices and harms that result. (shrink)

Concept formation has recently become a widely discussed topic in philosophy under the headings of “conceptual engineering”, “conceptual ethics”, and “ameliorative analysis”. Much of this work has been inspired either by the method of explication or by ameliorative projects. In the former case, concept formation is usually seen as a tool of the sciences, of formal disciplines, and of philosophy. In the latter case, concept formation is seen as a tool in the service of social progress. While recent philosophical discussions (...) on concept formation have addressed natural sciences such as physics as well as various life sciences, so far there is only little direct engagement with the social sciences. To address this shortcoming is important because many debates about socially relevant concepts such as power, gender, democracy, risk, justice, or rationality, may best be understood as engaging in conceptual engineering. This topical collection addresses the nature and structure of concept formation in the natural, the life, and the social sciences alike, both as a process taking place within science and as an activity that aims at a broader impact in society. This helps to understand how concept formation proceeds not only in the natural sciences but also in disciplines such as psychology, cognitive science, political science, sociology and economics. Reflective equilibrium (RE) is often regarded as a powerful method in ethics, logic, and even philosophy in general. Despite this popularity, characterizations of the method have been fairly vague and unspecific so far. It thus may be doubted whether RE is more than a jumble of appealing but ultimately sketchy ideas that cannot be spelled out consistently. In this paper, we dispel such doubts by devising a formal model of RE. The model contains as components the agent’s commitments and a (...) theory that tries to systematize the commitments. It yields a precise picture of how the commitments and the theory are adjusted to each other. The model differentiates between equilibrium as a target state and the dynamic equilibration process. First solutions to the model, obtained by computer simulation, show that the method allows for consistent specification and that the model’s implications are plausible in view of expectations on RE. In particular, the mutual adjustment of commitments and theory can improve one’s commitments, as proponents of RE have suggested. We argue that our model is fruitful not only because it points to issues that need to be dealt with for a better understanding of RE, but also because it provides the means to address these issues.
