Analytic social ontology has been dominated by approaches where institutions tend to come out paradigmatically as being relatively harmonious and mutually beneficial. This can however raise worries about such models potentially playing an ideological role in conceptualizing certain politically charged features of our societies as marginal phenomena or not even being institutional matters at all. This article seeks to develop a nonideal theory of institutions, which neither assumes that institutions are beneficial or oppressive, and where ideology is understood as a (...) structuring and stabilizing phenomenon that helps maintain specific distributions of rights and duties by conferring perceived legitimacy onto them. A significant part of contemporary social ontology has been focused on understanding forms of collective intentionality. It is suggested in this paper that the contested nature of some institutional matters makes this kind of approach problematic, and instead an alternative approach is developed, one that is oriented towards a micro-level analysis of the institutional constraints that we face in everyday life and which can make sense of how there can be institutional facts that are deeply contested and yet still real. (...) The model is applied to two main examples, sexism and racism, and it is argued that on this approach it can make sense to understand both of them as institutions in our societies. (shrink)

Human rights have increasingly been put forward as an important framework for bioethics. In this paper, it is argued that human rights offer a potentially fruitful approach to understanding the notion of Respect for Persons in bioethics. The idea that we are owed a certain kind of respect as persons is relatively common, but also quite often understood in terms of respecting people’s autonomous choices. Such accounts do however risk being too narrow, reducing some human beings to a second-class moral (...) status. This paper puts forward a political approach to our standing as persons and a strongly pluralistic account of human rights that lays the ground for a more broadly applicable conception of Respect for Persons. It is further argued that this model also provides an example of a more general approach to philosophical ethics, an approach which is here called taxonomical pluralism. Many normative theorists want to contribute to making the world a better place. In recent years, it has been suggested that to realise this ambition one must start with an adequate description of real-life practices. To determine what should be done, however, one must also fundamentally criticise existing moral beliefs. The method of reflective equilibrium offers a way of doing both. Yet, its practical usefulness has been doubted and it has been largely ignored in the recent practical turn of normative (...) theorising. This paper offers a complementary methodology to the method of reflective equilibrium, referred to as Rawlsian constructivism, which brings forth its practical merits. With the support of Rawlsian constructivism, the method of reflective equilibrium becomes a tool for public reasoning about practical problems which aims to facilitate shared solutions. The process of reflective scrutiny is used, not in the search of moral truth, but rather to highlight what stands in the way of solutions to problems agents face in different domains of social life. The practical value lies in scrutinising reasons for action that are taken for granted, explicating new rationales for action and highlighting neglected points of agreement. The paper exemplifies this approach with a process of justifying individual obligations to combat climate change. Normative theorists who share the practical agenda have correctly noted the importance of bottom-up investigations of subject domains. This paper argues that the next step should be to utilise this version of the method of reflective equilibrium to explore the potential for morally progressive solutions to these problems. (shrink)

Abstract In contemporary moral philosophy, the standard way of understanding the constituents of the human good is in terms of a fairly limited number of features that contribute to our happiness independently of how they are situated in our lives. Even when this approach is supplemented by Moorean ideas about organic wholes, it still cannot do justice to the deep importance of how things are situated and even when meaning is seen as an important factor, it still tends to be (...) treated as simply another item on the list of constituents. It is argued here that we should abandon this approach in favor of one that recognizes that our lives are best understood in terms of their narrative structure and that treats narrative meaning as a pervasive phenomenon that strongly influences the importance that different features have in making our lives go more or less well. The article explores the limits of buck-passing analysis in evaluating value or goodness. It talks about the inability of back-passers to account for two important types of value or goodness, which include excellence and means. The use of delimiting strategy in buck-passing analysis in order to be in possession of goodness is discussed.

Jonathan Dancy works within almost all fields of philosophy but is best known as the leading proponent of moral particularism. Particularism challenges “traditional” moral theories, such as Contractualism, Kantianism and Utilitarianism, in that it denies that moral thought and judgement relies upon, or is made possible by, a set of more or less well-defined, hierarchical principles. During the summer of 2006, the Philosophy Departments of Lund University (Sweden) and the University of Reading (England) began a series of exchanges to take (...) place every other year, alternating between the departments. Andreas Lind and Johan Brännmark arranged to meet Dancy during the first meeting in Lund to talk about questions regarding particularism, moral theory and the shape of the analytical tradition. Autonomy and consent have been central values in Western moral and political thought for centuries. One way of understanding the bioethical models that started to develop, especially in the 1970s, is that they were about the fusion of a long-standing professional ethics with the core values underpinning modern political institutions. That there was a need for this kind of fusion is difficult to dispute, especially since the provision of health care has in most developed countries become an ever more important (...) concern of our political institutions, with governments playing a significant role in regulating and facilitating the provision of health care and in many countries even largely organizing it. There is, nevertheless, still room for dispute about how best to achieve this fusion and how to best think about autonomy and consent in a biomedical context. The simplest model we can have is probably about how being a person is largely about having the capacity of autonomous choice and that the main mode through which we exercise autonomy is by providing informed consent. Yet, liberal democracy's core idea that human beings have a high and equal value is also found in other accounts of the person. The human-rights framework provides an alternative model for thinking about personhood and about patient care. The human-rights approach is grounded, not in an account of autonomy, but in an account of the moral and political personhood that people possess merely by being human beings. In this approach, values like dignity and integrity, both highly relevant in a bioethical context, are identified as distinct values rather than being derived from and therefore reduced to respect for autonomous choice. The human-rights approach can supplement the problematic notion of autonomy that has been central to bioethics by placing this notion in a broader, strongly pluralistic framework. (shrink)

In recent years, several political theorists have argued that reasonable principles of justice are practice-dependent. In this paper it is suggested that we can distinguish between at least two main models for doing practice-dependent theorizing about justice, interpretivism and constructivism, and that they can be understood as based in two different conceptions of practices. It is then argued that the reliance on the notion of participants that characterizes interpretivism disables this approach from adequately addressing certain matters of justice and that (...) a better way of developing the idea of practice-dependence can be found in a constructivism that starts from the Rawlsian idea of overlapping consensus, but which shifts the focus of that approach from societies to a more open-ended category of domains, and which understands the parties to a possible overlapping consensus as stakeholders in a certain set of interconnected practices. This paper discusses the relation between medical ethics and general moral theory, the argument being that medical ethics is best seen as independent from general moral theory. According to this independence thesis, here explicated in terms of what is called a disunitarian stance, the very idea of applied ethics, which is often seen as underlying medical ethics, is misguided. We should instead think of medical ethics as a domain-specific ethical inquiry among other domain-specific ethical inquiries. On this alternative kind of (...) picture, such ethical inquiries should start with looking at the particularities of the domain under consideration and then proceed from there. Some possible consequences of this idea for medical ethics are then identified and discussed. (shrink)

In considering patriarchy as potentially institutional and as a characteristic also of contemporary Western societies, a fundamental issue concerns how to make sense of largely informal institutions to begin with. Traditional accounts of institutions have often focused on formalized ones. It is argued here, however, that the principal idea behind one commonly accepted conception of institutions can be developed in a way that better facilitates an explication of informal institutions. When applied to the phenomenon of patriarchy, such an approach can (...) then also allow us to ontologically make sense of gray areas and hierarchies of authority, as well as the intersectionality of social positions. Some contemporary paternalists argue in favor of government interventions based on how experimental psychologists and behavioral economists have found that our behavior often diverges from what would be predicted by rational-choice models. In this article it is argued that these findings can, more specifically, be used to identify decisional trouble spots where paternalist interventions may be legitimate. It is further argued that since the epistemic legitimacy of government paternalism ultimately rests on centralized decision-making having a comparative advantage, it also depends (...) on the possibility of such interventions being governed by an ideal of evidence-based policy-making. The article asks how stringently this requirement should be understood, and to what extent government can legitimately engage in what might be called experimental policy-making of a paternalistic character. In her work on virtue ethics Rosalind Hursthouse has formulated an Aristotelian criterion of rightness that understands rightness in terms of what the virtuous person would do. It is argued here that this kind of criterion does not allow enough room for the category of the supererogatory and that right and wrong should rather be understood in terms of the characteristic behavior of decent persons. Furthermore, it is suggested that this kind of approach has the added advantage of allowing one (...) to make sense of the centrality of negative precepts in commonsense morality. (shrink)

This work seeks to develop a Kantian ethical theory in terms of a general ontology of values and norms together with a metaphysics of the person that makes sense of this ontology. It takes as its starting point Kant’s assertion that a good will is the only thing that has an unconditioned value and his accompanying view that the highest good consists in virtue and happiness in proportion to virtue. The soundness of Kant’s position on the value of the good (...) will is defended against criticisms directed against it by G. E. Moore and it is argued that there is an ambiguity in Moore’s notion of ‘intrinsic value’ that makes him unable to fully understand and appreciate the Kantian view. It is also argued that the special value of moral goodness has been unduly neglected in modern moral philosophy, even by those working in the Kantian tradition, and it is suggested that the possibility of a Kantian ethical theory centred on the notion of the highest good remains to be explored. In order to lay the ground for such a theory a Kantian approach to reasons for action and the metaphysics of the person is developed and defended, albeit in a way that, in contrast to Kant himself, emphasizes the social dimension inherent in being a person and acting on reasons. It is also argued that there exists what Henry Sidgwick has called a dualism of practical reason, which means that there are two systematic modes, the self-interested and the moral, of approaching action. These two modes correspond to the two components of the highest good as understood by Kant and it is argued that the highest good represents a reasonable way of unifying them. These two parts of the highest good are then considered, each in turn, and Kantian models for understanding them are elaborated and defended against main rivals. On the matter of happiness, it is argued that standard philosophical theories fail to properly account for the way in which a subject’s own opinions about what constitutes her happiness are important in determining where her happiness actually lies. On the matter of morality, Kantianism is contrasted with consequentialism, the other leading theory that understands morality in terms of an ideal of impartiality and it is argued that the Kantian ideal, which can be called ‘impartiality as universalizability’ is superior to the consequentialist one, which can be called ‘impartiality as impersonality’. A version of Kantian ethics that places its emphasis on the Formula of Universal Law is then elaborated and it is argued that it is reasonable to understand maxims, or at least those maxims eligible for the universalizability test, as having to do with the basic general principles according to which we live. This kind of interpretation creates a large room for the exercise of judgment on the part of the agent and it is suggested that the standards according to which such judgment is exercised are largely determined through our actual moral practices and discourses. Following John Rawls, writers like Bernard Williams and Christine Korsgaard have suggested that a transparency condition should be put on ethical theories. The exact nature of such a condition and its implications is however not anything on which there is any consensus. It is argued here that the ultimate rationale of transparency conditions is epistemic rather than substantively moral, but also that it clearly connects to substantive concerns about moral psychology. Finally, it is argued that once a satisfactory form of (...) the transparency condition is formulated, then, at least among the main contenders within ethical theory, it speaks in favor of a broadly Aristotelian approach to ethical theorizing. Social ontologists commonly think that our ideas about social entities, and about other people also inhabiting the social realm, play an important role in making those entities into what they are. At the same time, we know that our ideas are often indeterminate in character, which presumably would mean that this indeterminacy should carry over to the social realm. And yet social indeterminacy is a neglected topic in social ontology. It is argued that this neglect can be traced to how (...) a particular approach that favors ahistorical reconstructions in making sense of social entities has come to dominate social ontology. If we think beyond the parameters set by this approach, however, we can see that recognizing indeterminacy as a pervasive phenomenon in the social realm might open up new interpretative possibilities in relation to different social categories. This argument is at least partly in line with recent calls for a move towards nonideal social ontology. (shrink)

Contemporary value theory has been characterized by a renewed interest in the analysis of concepts like "good" or "valuable", the most prominent pattern of analysis in recent years being the socalled buck-passing or fitting-attitude analysis which reduces goodness to a matter of having properties that provide reasons for pro-attitudes. Here I argue that such analyses are best understood as metaphysical rather than linguistic and that while the buck-passing analysis has some virtues, it still fails to provide a suitably wide-ranging pattern (...) of analysis for conceptualizing evaluative properties. Instead, a better alternative can be found in a metaphysical version of the Geachean view that goodness is always attributive and never predicative, namely that goodness is always a matter of relative placement in certain kinds of comparison classes. It is then suggested that the good and the valuable need to be separated from each other and that the latter is a species of the former. (shrink)

Some recent arguments for paternalist government interventions have been based in empirical results in psychology and behavioral economics that would seem to show that adult human beings are far removed from the ideals of rationality presupposed by much of philosophical and economic theory. In this paper it is argued that we need to move to a different conception of human decision-making competence than the one that lies behind that common line of philosophical and economic thinking, and which actually still lies (...) in the background of some of these recent approaches to paternalist interventions. An alternative picture of human decision-making competence is outlined and four criteria for identifying areas where paternalist interventions have a basic moral and political legitimacy are then identified on the basis of this picture. Normative ethics usually presupposes background accounts of human agency, and although different ethical theorists might have different pictures of human agency in mind, there is still something like a standard account that most of mainstream normative ethics can be understood to rest on. Ethical theorists tend to have Rational Man, or at least some close relative to him, in mind when constructing normative theories. It will be argued here that empirical findings raise doubts about the accuracy of this kind of (...) account; human beings fall too far short of ideals of rationality for it to be meaningful to devise normative ideals within such a framework. Instead, it is suggested, normative ethics could be conducted more profitably if the idea of unifying all ethical concerns into one theoretical account is abandoned. This disunity of ethical theorizing would then match the disunited and heuristic-oriented nature of our agency. (shrink)

Liberal political theory is often understood as being underpinned by an individualistic social ontology, and it is sometimes objected that this type of ontology makes it difficult to address injust...

Since G. E. Moore introduced his concept of organic unity there has been some discussion of how one should best understand this notion and whether there actually are any organic unities in the Moorean sense. Such discussions do however often put general questions about part-whole relations to the side and tend to focus on interpreting our intuitive responses to possible cases of organic unity. In this paper the focus lies on the part-whole relation in valuable wholes and it is suggested (...) that we should distinguish between two kinds of wholes, collections and complex unities, where the latter can involve values that do not pass on their value to the greater whole in which they are included. Given this distinction we are then able to distinguish between two kinds of organic unity phenomena, the first involving a form of goodness that emerges on the level of the whole, the second involving a form of goodness that is embedded on the level of parts. In order to properly understand the latter form of goodness, there is also a need to distinguish final value from inherent value. (shrink)

We all want things. And although we might disagree on just how significant our wants, desires, or preferences are for the matter of how well we fare in life, we would probably all agree on some of them having some significance. So any reasonable theory about the human good should in some way acknowledge this. The theory that most clearly meets this demand is of course preferentialism, but even pluralist theories can do so. However, then they will at the same (...) time bring aboard a classical problem for preferentialism, namely that of discriminating among preferences. Not all preferences would seem to make contributions to our well-being and there should be some set of criteria which at least makes it intelligible why there is such a difference and that perhaps can even be used in order to evaluate hard cases. Many contemporary defenders of paternalist interventions favor a version of paternalism focused on how people often choose the wrong means given their own ends. This idea is typically justified by empirical results in psychology and behavioral economics. To the extent that paternalist interventions can then target the promotion of goals that can be said to be our own, such interventions are prima facie less problematic. One version of this argument starts from the idea that it is meaningful to ascribe to (...) us preferences that we would have if were fully rational, informed and in control over our actions. It is argued here, however, that the very body of empirical results that means paternalists typically rely on also undermines this idea as a robust enough notion. A more modest approach to paternalist interventions, on which such policies are understood as enmeshed with welfare-state policies promoting certain primary goods, is then proposed instead. (shrink)

Over the last decades the traditional emphasis on moral rules, or principles, has been attacked by particularists like Jonathan Dancy. I argue that particularists are correct in rejecting traditional attempts at moral codification, but that it is still possible to have a rule-oriented approach to morality if we distinguish between different ways in which features can be morally relevant. I suggest that there are first a limited number of features that can serve as basic moral reasons for action, and then (...) a class of relational features that can change the relevance of these features. I then argue that while particularists do well in drawing attention to the fact that sometimes our basic moral duties are put out of play by other relevant features, they fail to make sense of the exceptional nature of such situations. Only a rule-oriented understanding of morality can do this. (shrink)
