The modern philosophy of science has not succeeded in defining conclusively what the scientific method consists in. On the contrary, scientific practice seems to consist in a methodological pluralism, a definition that connects with essential fragments of John Dewey's Logic, the Theory of Inquiry. For Dewey, even the forms of logic emerge from the problems defined in indeterminate situations. A historical example was the introduction of the notion of complementarity in physics, which allowed the interpretation of two confusingly paradoxical experiments (...) in a coherent way. Dewey's thought demonstrates its relevance by helping us to define the pattern of inquiry. Methodological pluralism and the dependence of logic on research problems is not something that will happen, it is something that has happened and does happen in scientific practices. (shrink)

In this article I explore some topics of the philosophy of law of Julius Binder. More specifically, I explore the relation and compatibility of his ideas with national-socialism. In the first part of the article I analyze the neo- Kantian approach underlying to his philosophy. Subsequently I analyze his turn towards neo- Hegelianism. In the last sections I address the philosophical concept of nation that this author defended and I search for its links with both national- socialism and Hegelian philosophy. (...) We study the theories I∇n, L∇n and overspill principles for ∇n formulas. We show that IEn ⇒ L∇n ⇒ I∇n, but we do not know if I∇n L∇n. We introduce a new scheme, the growth scheme Crγ, and we prove that L∇n ⇒ Cr∇n⇒ I∇n. Also, we analyse the utility of bounded collection axioms for the study of the above theories.

This article has a twofold purpose: first, it explores how Leonardo Polo's personalist anthropology enriches and enhances neo-Aristotelian virtue ethics and second, it highlights how this specific personalist approach brings new perspectives to servant leadership. The recently revived neo-Aristotelian virtue ethics tradition finds that MacIntyre's scholarship significantly contributes to virtue ethics in business—particularly his conception of practices, institutions, and internal/external goods. However, we argue that some of his latest insights about the virtues of acknowledged dependence and human vulnerability remain underdeveloped (...) because of the underlying anthropology that neo-Aristotelian virtue ethics relies on. To overcome this limitation, we introduce Polo's transcendental anthropology as a possible foundation of a personalist approach that enriches virtue ethics. To do so, we address how transcendental anthropology can enrich two central aspects of virtue ethics, namely (1) the understanding of human beings and their flourishing and (2) the relationship of virtue to praxis and human work. Finally, to address the practical implications for business leadership and work that can derive from assuming transcendental anthropology, we address how servant leadership acquires a new perspective in light of this personalism and its logic of gift, highlighting interpersonal self-giving as a way of service. The analysis of the confession in Foucault's work based on the comparison between Les anormaux, Mal faire, dire vrai and Les aveux de la chair shows one of the most relevant displacements in Foucault's work, which constitutes a good part of the essence of what has been called the last Foucault: the relation of the subject and the truth. An attempt will be made to account for this turn, analyzing the look at primitive Christianity of the last Foucault and the (...) relationship of such reflection in the analysis of the hermeneutics of the self. The last reflections on the confession in Les aveux de la chair will show the meaning of the ethical inquiry of the last Foucault that reproduces the double critical and ontological character of anarcheology. Este texto analiza el cambio en la noción de enfermedad que se produjo en el siglo V a.c. a través de la comparación entre _nosos, insania y peste_ en las tragedias de Sófocles con el nuevo proceso diagnóstico que se pone en marcha con el establecimiento del corpus hipocrático. Analizando las causas, la cura y el ser de la enfermedad en el Filoctetes, el Ayax y Edipo Rey, podremos observar las distancias con respecto a la concepción técnica y racional del (...) diagnóstico hipocrático y delimitar así los procesos de desarrollo técnico, democratización del saber y de pérdida de autoridad divina que posibilitarán una medicina liberada, en tanto saber, de sus ancestrales raíces religiosas. Este texto analiza la formación del concepto de genealogía en _Teoría e Instituciones Penales_, donde aparece la primera aplicación práctica del método genealógico. La pregunta por el estatuto de la formación de la genealogía nos permitirá plantearnos, a su vez, los límites y los problemas implicados en su emergencia que poseen una relevancia específica para la actualidad del método. Por último, se planteará la actualidad de la genealogía a través de los desarrollos de la obra foucaultiana y las características posibilitadoras (...) y antirrepresentativas de la misma. Todo ello nos permitirá actualizar un método que posee profundas virtudes epistémicas y críticas para pensar nuestro presente. (shrink)

En el presente artículo se pretende analizar el posicionamiento de Levi Strauss, reciente Premi Internacional Catalunya 2005, en el seno del debate entre humanismo y antihumanismo. El estructuralismo de Levi Strauss supuso un desenmascaramiento de algunos presupuestos sobre los que se levantaba el humanismo. Al mismo tiempo, el estructuralismo respondía a un síntoma de nuevos tiempos, en dónde se intentaba pensar y actuar de otro modo. Los patrones clásicos y humanistas parecían estar agotados y la euforia estructuralista auguraba un nuevo (...) modo de filosofía. Contraponiendo los análisis de ‘Antropología estructural’ y ‘El pensamiento salvaje’ al humanismo ejemplificado por el Sartre de ‘Crítica a la Razón Dialéctica’, en este artículo se pretenden marcar los principales frentes de la batalla entre humanismo y antihumanismo. Este texto plantea el tratamiento de la noción de enfermedad en la obra de Michel Foucault desde su alejamiento del naturalismo y el constructivismo social. La herencia de Canguilhem y de su normativismo vital ofrecen las herramientas teóricas que permitirán un tratamiento de la medicina cuyo análisis provoca la explicitación de la pregunta por la ontología de la obra foucaltuiana, la relación entre normativismo social y vital y la posibilidad de una democratización del saber médico.

Recommending the identity of bidders in public procurement auctions has a significant impact in many areas of public procurement, but it has not yet been studied in depth. A bidders recommender would be a very beneficial tool because a supplier can search appropriate tenders and, vice versa, a public procurement agency can discover automatically unknown companies which are suitable for its tender. This paper develops a pioneering algorithm to recommend potential bidders using a machine learning method, particularly a random forest (...) classifier. The bidders recommender is described theoretically, so it can be implemented or adapted to any particular situation. It has been successfully validated with a case study: an actual Spanish tender dataset which has 102,087 tenders from 2014 to 2020 and a company dataset which has 1,353,213 Spanish companies. Quantitative, graphical, and statistical descriptions of both datasets are presented. The results of the case study were satisfactory: the winning bidding company is within the recommended companies group, from 24% to 38% of the tenders, according to different test conditions and scenarios. Mediante el análisis de su novela Noches tristes y día alegre, rastrearemos la influencia de la novela ilustrada europea, así como los ecos de la obra Noches lúgubres de José Cadalso. Bataille's immanent mysticism knows that in the sovereignty of excess the limitlessness of expenditure allows us to descend into the sacred spaces (...) of the curse. The present work wants to delve into such a physiological inner experience to see whether the Nietzschean affirmation can be consummated in this way. Como sabemos Nietzsche quiso afirmar la vida en su totalidad sin prescindir ni de la alegría misma de la afirmación, ni de la energía trágica de lo más terrible que ello implica. Sin embargo, una tarea de esa magnitud requiere la afinidad de otros espíritus que sean capaces de recorrer otras vías distintas a las del ascenso. El misticismo inmanente de Bataille sabe bien que en la soberanía del exceso la ilimitación del gasto nos permite descender a los espacios sagrados de la maldición. In the wake of corporate ethical scandals that have harmed millions of employees and investors, there has been an increase in the number of works written in the last decade, which aim to answer one apparently simple question: what causes unethical behavior, and what can we do, if anything, to prevent similar transgressions in the future? The extensive research around this question is the best proof of its real complexity as the challenge of disentangling the background of ethical behavior has (...) obvious academic and practical interest. This study aims to take a further step toward that goal. Much research has noted the impact of multiple aspects of organizational contexts on individuals’ ethical behavior. However, studies that analyze the impact of organizational learning capability (OLC) on employees’ ethical behavior are few and far between. This was the first aim of this study. The second centered on gaining a deeper understanding of the relationship between OLC and ethical behavior by analyzing the mediating role of employability and organizational commitment. We tested our hypotheses through a structural equation methodology applied to a sample of 641 workers from 166 Spanish consultancy firms and found a positive, direct relationship between OLC and employability, OLC and organizational commitment, employability and organizational commitment, and organizational commitment and ethical behavior. Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

Resumen: Este artículo consiste en un comentario del ensayo Ser justo con Freud: La historia de la locura en la era del psicoanálisis de Derrida con el objeto de rastrear lo que no puede ser reapropiado por la presuposición del marco del debate entre Derrida y Foucault. Al analizar la pregunta “¿quién anuncia el no-recurso?”, exploraré la forma en que la escritura de Derrida es afectada por la necesidad e imposibilidad de no reprimir la sinrazón. Argumentaré que Derrida compulsivamente escribe (...) los efectos de dicha resistencia a no reprimir la sinrazón a través de la repetición de la búsqueda Foucaultiana de un más allá de la razón. Esta “compulsión de repetición’ no solamente reabre una y otra vez el debate, sino que desencadena el retorno de la sinrazón en la forma de un desarreglo de los principios de identidad y tiempo lineal, desestabilizando todo forma de autoría sobre la historia de la locura en general y cada una de sus críticas. Este artículo se aproxima a los intercambios entre Derrida y Foucault deconstruyendo la premisa de la posibilidad de un debate sobre la historia de la locura. (shrink)

Pueden identificarse cuatro estrategias principales de tratar la cuestión ambiental de acuerdo al marco rawlsiano. Extender la posición original o el principio de igualdad de oportunidades afecta a la concepción de la justicia. Reconocer límites naturales o ambientales a nivel de esencia constitucional o abrir la fase legislativa a la justicia ambiental afectan al liberalismo político. En cualquiera de ellas, el esquema sólo permitiría ir más lejos cuestionando la visión nacional-estatal de sociedad cooperativa.

Previously, the author tried to show that some arguments in one of the two versions of Nicholas of Autrecourt’s Quaestio de intensione visionis are taken almost verbatim from the anonymous Tractatus de sex inconvenientibus. This paper concentrates on the arguments themselves in order to consider two main issues: the ‘translatability’ of limit decision problems, manifest in Autrecourt’s juxtaposition of questions de maximo et minimo, de primo et ultimo instanti, and the intension and remission of forms; the importance of Parisian discussions (...) of limit decision problems prior to the adoption of the new analytical languages developed at Oxford. Thus, the paper is divided in two sections, the first concerning some arguments of Autrecourt’s question, the second focusing on the link between one of Autrecourt’s arguments and the medieval tradition of commentaries on Aristotle’s De caelo, in which it is possible to find some antecedents of the analytical approach that later Parisian scholars would apply to these problems. Kant is not typically considered a major figure in the just war tradition's canon, although his work has informed recent discussions about international justice and just war theory. More specifically, philosophers have suggested that Kant's work may provide a coherent, normatively practical just war theory, basing this claim, in the main, on his views on the goal of peace and its purpose of establishing a cosmopolitan civil society.1 Such discussions are mostly concerned with jus ad bellum and jus in bello (...) constraints on nations and how Kant's writings can guide deliberation and, perhaps, the considered policy and practices of governments. Yet, the fact remains that it is embodied men and women and not the metaphysical ?nation? who actually conduct war. Hence, this paper seeks to determine the extent to which Kant's thought might contribute to the moral deliberation of those individuals who a fortiori will be bound to jus in bello constraints. To this end, the idea of moral learning will be explored, emphasizing the Kantian idea of autonomy. The ultimate goal of this paper is to demonstrate how some aspects of Kant's thought would contribute to ethics education in a military academy. (shrink)
