We live in an age beset by religiously inspired violence. Terms such as "holy war" are the stock-in-trade of the evening news. But what is the relationship between holiness and violence? Can acts such as murder ever truly be described as holy? In Does Judaism Condone Violence?, Alan Mittleman offers a searching philosophical investigation of such questions in the Jewish tradition. Jewish texts feature episodes of divinely inspired violence, and the position of the Jews as God's chosen (...) people has been invoked to justify violent acts today. Are these justifications valid? Or does our understanding of the holy entail an ethic that argues against violence?Reconstructing the concept of the holy through a philosophical examination of biblical texts, Mittleman finds that the holy and the good are inextricably linked, and that our experience of holiness is authenticated through its moral consequences. Our understanding of the holy develops through reflection on God's creation of the natural world, and our values emerge through our relations with that world. It also tests the outer limits of the ethical deployment of power. I. Types of Wars The Jewish ethics of war focuses on two issues: its legitimation and its conduct. The Talmud classifies wars according to their source oflegitimation. Biblically (...) mandated wars are termed mandatory (milhemet mitzvah or milhemet hovah). Wars undertaken at the discretion of the Sanhédrin are termed discretionary (milhemet reshut). There are three types of mandatory wars: Joshua's war of conquest againstthe seven Canaanite nations, the war againstAmaleq, anddefensive wars against an already launched attack. Discretionary wars are usually expansionary efforts undertaken to enhance the political prestige of the government or to secure economic gain. The first type of mandatory war is only of historical interest as the Canaanite nations lost their national identity already in ancient times. This ruling, which appears repeatedly in rabbinic literature, is part ofa tendency to blunt the impact of the seven-nations policy. The Bible points out that these policies were not implemented even during the zenith of ancient Israel's power (Kings 9:20; 2 Chr 8:7-9; see also Judges 1:21-33, Ps 106:34). Indeed, an ancient Midrash explicitly excludes the possibility of transferring the seven-nations ruling to other non-Jewish residents of the Land ofIsrael. Maimonides is just as explicit in emphasizing that all trace 44Reuven Kimmelman of them has vanished. By limiting the jurisdiction of the seven-nations ruling to the conditions ofancient Canaan it was effectively removed from the postbiblical ethical agendaand vitiated as aprecedent forcontemporary practice. The second category ofmandatory war, against Amaleq, has also been rendered operationally defunct by comparing them with the Canaanites, or by postponing the battle to the immediate premessianic struggle, or by viewing them as a metaphor for genocidal evil. The two remaining categories, reactive defensive wars (which are classified as mandatory) and expansionary wars (which are classified as discretionary) remain intact. So, for example, King David's response to the Philistine attackaredesignated mandatory, whereashis wars "to expandthe border of Israel" are designated discretionary. Intermediate wars such as preventive, anticipatory, or preemptive defy so neat a classification. Not only are the classifications debated in the Talmud, but commentators disagree on the categorization of the differing positions in the Talmud. The major clash occurs between the eleventh century Franco-German scholar Rashi and the thirteenth century Franco-Provencal scholar Meiri. According to Rashi, the majority position considers preemptive action to be discretionary whereas the minority position expounded by Rabbi Judah considers it to be mandatory. According to Meiri, a preemptive strike, against an enemy who it is feared might attack or who is already known to be preparing for war is deemed mandatory by the majority ofthe rabbis, but discretionaryby Rabbi Judah. Accordingly, Rabbi Judah defines a counterattack as mandatory only in response to an already launched attack. A similar reading of Maimonides also limits the mandatory classification to a defensive war launched in response to an attack. With these distinctions between mandatory and discretionary wars in mind, we should be able to investigate the Jewish concerns with the problematics ofwarby focusing on preemptive strikes, declarations ofwar, ethics of warfare, and draftability. II. Preemptive Strikes as Self-Defense Not only Machiavellians view the security and survival ofthe state as nonnegotiable. National self-defense is as much amoral right as is personal self-preservation. Whereas it is clear that offensive war cannot be subsumed under the inalienable right of self-defense, the moral status of pre-emptive attacks is not as clear. Is the moral category of self-defense Working Warfare and Its Restrictions in the Jewish Tradition 45 limited to an already launched attack? The majority talmudic position, according to Rashi, and that of Rabbi Judah, according to Meiri, would answer in the affirmative. Their position is seconded by Article 51 of the United Nations Charter, which states: "Nothing in the present Charter shall impair the inherentright ofindividual ofcollective self-defense ifan armed attack occurs against a member." In Ancient Greece, the relation between war and peace used to have an ambiguous meaning. War was considered as a normal state and peace was seen only as an exception or a temporary truce during a long lasting conflict. But peace and political stability were also valued: the aim of war was never the total annihilation of the opponent. Besides this opposition, there was a balance between war and peace during these times and this conception, inherited from the heroic times, (...) lasted until the beginning of the Peloponnesian War. This event redefined the relation between war and peace. The meaning of conflict moved from polemos, as codified conflict between cities, to stasis, as civil war. War was less perceived as something positive and more people valued peace and stability. Plato’s political thought was developed in this context as a potential answer to this redefinition of conflict as well as the threat of an excessive and radical conception of war. However, Plato had to face an exigent challenge. No political regime was able to establish peace anymore, so Plato needed to create a brand new political system to solve the problems raised by the Peloponnesian War. The goal of this paper will be to present Plato’s response to these political challenges by showing that his response is deeply innovative for his time but also profoundly rooted in a traditional conception of conflict that was already obsolete when he wrote his masterpieces. In the twentieth century, an important transformation on this concept led to a deconstruction of its traditional meaning, originally focused on doctrines and dogmas, and further to the emergency of a new conception, which places the mystical experience in the very foundation of the Revelation’s concept. Since this renovation, the difficulties of a language to express the complexity of this paradoxical experience were highly problematized. All artistic creation, as long as it provokes a strong aesthetic experience, is matter of Revelation. The Art’s language, with its non-definable and evocative power, is certainly capable of expressing this divine experience without devaluate the holy or the human depreciation. This work consists on the reading of Cândido Portinari’s “War and Peace” panels, pointing out that, through art, it is possible to narrate artistically the Holy Mystery that dwells among us. Mittleman (Princeton, NJ: Princeton University Press, 2018), v + 227 pp.Alan Mittleman has written a profoundly thought-provoking book. A main question of the book is whether a higher (revealed) law may in some cases require (...) harm to be done to the neighbor—harm that otherwise would be unjust. Mittleman offers some fascinating examples of cases in which Jews have appealed to God's Law in order to justify oppression of Gentiles. He cites a contemporary halakhic text, Torat ha-Melekh (The King's Torah), as particularly egregious. While Torat ha-Melekh was widely condemned by rabbis and the general public in Israel, it had an audience among the ultra-Orthodox. According to the Torat ha-Melekh, Gentiles' souls are not intrinsically holy in the way that Jews' souls are. This means that killing Gentile children in wartime may be acceptable due to the threat that otherwise these children may grow up to kill Jews. The Torat ha-Melekh observes that many Gentiles do not practice and obey the seven Noachide commandments. Since this is so, the Gentiles who do not obey the Noachide commandments live "in an inhuman state, where the brutish nature of their souls has free rein and their lives have lost value" (186).Another example given by Mittleman is the status of the Holy Land and the Holy People. Insofar as the holiness of the land and people is thought to be intrinsic—an inseparable property—problems can arise. According to a midrash in Bereshit Rabbah, the land is so intrinsically holy that only the dead who are buried in the land—or whose dead bodies somehow travel to the land—will rise from the dead and enjoy everlasting resurrected life. Likewise, the land's air is presented as uniquely making its inhabitants wise, and the divine presence or shekinah comes only in the land. For the medieval Jewish philosopher Yehuda Halevi, in his Kuzari: The Book of Refutation and Proof on Behalf of the Most Despised Religion (ca. 1140), the land of Israel is the most temperate climate and the most conducive to producing the ideal human beings. In addition, Halevi thinks that only certain descendants of Adam are "true Adamites" (66). A true Adamite is a son of God, just as Adam was. Specifically, only Seth and some of his descendants are fully human in accord with the Adamic model. It is only in the family of Jacob that "God's influence [finally] becomes the property of an entire people" (67). The true Adamites are Adam's (and Jacob's) seed; other humans are comparatively speaking mere husks. Although people can convert to Judaism, therefore, converts cannot be equal to those born of the Jewish nation. This does not mean that all who descend from Jacob are holy, since [End Page 745] it is possible for a Jew to distort his or her purity of soul. Nevertheless, for Halevi the Jewish people are a holy seed that is intrinsically superior to all other humans, so that it is possible to say that "Israel is an angelomorphic, even theomorphic race" (69).Moses Maimonides responded to Halevi, rejecting his viewpoint completely—on the grounds that holiness is not an intrinsic or biological (let alone racial) property. Yet, Halevi's viewpoint influenced Jewish Kabbalah in a major way. For the Kabbalist text the Zohar, the people of Israel derive from the emanations of the divine, whereas all other nations derive from the impure powers. The Zohar holds, "The other nations count for nothing in God's sight. They are the products of Eve's illicit union with the serpent," rather than coming forth from the theomorphic being who was Adam (70). Similarly, Moses de Leon—thought to be an author of the Zohar—argues that Gentiles ontologically possess impure souls that will carry them to spiritual damnation and will ensure that they have no participation in the resurrection of the dead. Throughout the text of the _Han Feizi_, we see opposition to traditional (and often Confucian) perspectives on a wide range of state activities, both internally and externally. This antipathy towards the traditional morally-based criteria for justifying state actions extends to the questions of when, how, and if to wage war. In what we may today think of as reasoning akin to Western conceptions of political realism, Han Fei argues that considerations of morality have no place, either in questions of war (...) and peace or, indeed, in broader questions of politics more generally. This is not, though, to say that Han Fei is uninterested in broader questions of when ware and peace are justified. However, such justifications are based not to be justified by appeal to moral concerns. Rather, the fundamental question to be answered is how the strength, security, and flourishing of the state would be affected by warfare. By viewing questions of war and peace from the perspective of state consequentialism, Han Fei believes that we can ascertain the answers to questions not only about when and if to engage in warfare, but also to questions of what particular actions can be justified within the context of war. Theologians have repeatedly addressed the issues of the common and different in Islam and Christianity. With respect to the concepts of war and peace, despite some differences, there is a great deal in common in how they view conflict with violence and how they limit the harmful effects of such a conflict. Both religious traditions rate war as evil. Emphasis is placed on the need for peace as a basis for human existence. The commandment "do not kill" in one form (...) or another is given both in the Bible and in the Qur'an: "Jesus said to him, '... you know the commandments: do not kill...'; "Whoever killed even one soul - except for the punishment for killing or spreading disobedience on earth - is like killing all mankind." The use of military force is an inevitable evil and is only allowed as a last resort. Both traditions agree that there should be no forced conversion to religion, and that there should be restrictive conditions to limit the use of force, violence and war. These restrictions are traditionally divided into those relating to the initiation of war and war. (shrink)

The claim is widespread that the preservation, or reintroduction, of Western traditions of holy war in the post-Reformation period was due mostly to Protestantism, especially in its Calvinist variety. This paper makes a case for examining the thought of a much broader selection of minor intellectuals on just and holy war than is usually done, and to do so in other national contexts than exclusively the English Puritan one. To test the apparently widespread view that, historically, Calvinism has had a (...) particular proclivity for holy war, the article treats theological justifications of war in seventeenth- and eighteenth-century Dutch moral theology. Showing that a full-blown concept of "holy war" was largely absent from Dutch theological thought, it falsifies the assumption that historical Calvinism (or Protestantism in general) is inherently belligerent. The paper demonstrates that justifications of violence religionis causa and ideological motives for war have always been contingent, not on religions, but on the historical contexts in which those religions operate. This paper explores Pope Francis’ and the Holy See’s reaction to the war in Ukraine, and attempts to explain the logic behind it. After introducing the Holy See’s statements since the start of Russia’s aggression, the author reads them through the background of Catholic social teaching. In particular, he claims that the ambiguities of the Holy See’s position are due to the unresolved tension between the traditional just war approach and a tendency towards nonviolence. The latter has acquired prominence over (...) the last decades, in particular with Francis’ Fratelli Tutti. The author attempts to establish a set of four categories--causality, meaning, attainability and desirability--within the framework of which the philosophic dimensions of war and peace are considered. The bulk of the volume consists in the study of this question as developed in the thought of thirteen men representing both political idealism and political realism. Scholars have studied the concept of holy war in the Bible for well over a century. Both traditional Muslim and modern Western scholars have likewise studied the qur'?nic view of war, but little has been done to examine scriptural justification for holy war as a cross-cultural phenomenon. A comparison of biblical with qur'?nic war texts reveals that, despite historical, cultural, and geographical differences, scriptural justification for mass slaughter in war first appears for the purpose of defense but steadily evolves into (...) divinely encouraged and even divinely commanded offensive war. The differences in the evolving concept between the two scriptures and their exegesis can be explained by the different histories of two religious civilizations. (shrink)

The cities of refuge as detailed in the Deuteronomic witness in the Hebrew Bible have served as the inspiration and model for the practice of providing sanctuary for many throughout the centuries, namely with the most recent Sanctuary movements in the US and the UK in the twentieth and twenty-first centuries. And yet, its biblical witness as to its implementation and effectiveness is practically silent. Using methods of biblical studies via liberation hermeneutics and theological ethics from both the Jewish (...) and Christian traditions, the following questions will be explored: What were the cities of refuge? Purpose. The main purpose of this paper is to consider the methodological peculiarities in the formation and interpretation of war and peace, in the context of the spiritual rethinking by humanity and the nature of social phenomena, among which a special place is occupied by the political and legal phenomena of the modern world. This involves solving the following tasks: firstly, to reveal the meaning of modern approaches in understanding the features of religious fundamentalism, and, secondly, to reconstruct the dynamics (...) of transformations in representations of war and peace, in the context of the spiritual practices of the present. Theoretical basis. The author's analysis is based on the systematic reconstruction of modern theoretical models of understanding religious fundamentalism and its connection with the subject of modern anthropological research. The resulted fact that the taxonomy of different types of religious fundamentalism includes more political, legal and economic markers does not provide an answer to the question of what the qualitative influence of the fundamentalist ideas is on the spiritual component of a person's life. Appealing to the problem of religious fundamentalism, in the context of rethinking the phenomena of war and peace, is associated with the actualization of these phenomena in the communicational, media and ideological spheres. That is why, in the context of this analysis, we take into account the main modern approaches in the provisions of religious traditions. These articulate the problems of threat to the global world in the context of actualization and return of the religious factor into the everyday life of a person, including through politics. Originality. The author proves that when analyzing the religious aspect in the reinterpretation of ideas about war and peace, it is necessary to consider, as a doctrinal component, certain types of religious belief doctrines, as well as the individual psychological peculiarities of man. These peculiarities, which are manifested in different types of beliefs, can be verified by the clues in the analysis of religious practices, which represent the meaningful components of the religious doctrine. Conclusions. The reasons for forming ideas about war and peace in theistic religions are a number of provisions related to the nature of the world and of man. They are the result of the manifestation of the act of the Supernatural Essence. In the tradition of rethinking the vocation of man in the context of fundamentalist discourse, these ideas acquire the status of spiritually determined and politically achievable goals. These are conceived in connection with the establishment of the Divine Plan, and they overcome the gap between the material world and the ideal world order. (shrink)

We cannot think seriously on the importance of this subject without being horrified at some of its suggested implications. What makes it so baffling is the difficulty of discriminating between what is positive, negative and purely hypothetical in the current estimates. The idea of a nuclear war which, as we are told by men of the highest eminence in the natural sciences, would condemn the whole of mankind to extinction, dislocates our sense of reality. Man, it is true, is not (...) a necessary being; the mortality of his individual existence is an image of the human condition generally. The transmission of humanity as a historical fact is something we accept as not merely fortuitous but as imposed, at the biological level, in the evidence of cumulative experience. This by itself is not conclusive as regards the continuity of the human race. On the biological record the number of forms that have survived is infinitesimal as compared with those that have become extinct. (shrink)

The contributors to this special issue of _Tikkun_ seek to redefine the boundaries of political and ethical responsibility by crediting a worldview in which we are held to account for the well-being of everyone who has “passed through our city,” if only momentarily. Their conclusions challenge the ethos of materialism that _Tikkun_ believes is at the root of globalized capitalism and, alternatively, articulate a social justice ethos derived from the Jewish tradition of “accompaniment,” the call to take (...) care of those who enter our common space. Contributors from Christian, Muslim, and Jewish traditions bring an interfaith perspective to the foundations of social responsibility, laying the groundwork for a new global notion of justice. Drawing on a model from Rabbinic Judaism, one contributor discusses homelessness in Los Angeles, calling us to adopt a new, radical sense of obligation in relation to our neighbors. Childs Jr. Minneapolis: Fortress Press, (...) 2008. 149 pp. $19.00A comparison of Robert Benne’s Good and Bad Ways to Think about Religion and Politics and James Childs’s The Way of Peace illustrates the current divisions in political theology in the US Lutheran tradition. Benne’s book is a polemic aimed at the leadership of the mainline Protestant denominations and their mode of engagement with the American political process. In Benne’s account, these denominations draw too direct and exclusive a line between Christian faith and liberal political commitments; conversely, he sees greater agreement between core Christian norms and conservative political concerns. By contrast, Childs’s book provides an exegetical development of Christian norms of peace and peacemaking, followed by direct applications of Christian norms to public issues of economic justice and war that parallel the positions of secular liberals.Benne seeks to explore anew the issue of how Christians should interact with the political process. Unlike H. Richard Niebuhr, who undertook a similar project in Christ and Culture, Benne engages contemporary secular interpretations and critiques of religious engagement in politics. Benne rejects the strict separationist positions of the new atheists such as Richard Dawkins and the fusionist positions he attributes to Paul Tillich and the leadership of the contemporary mainline denominations in favor of a critical engagement model based on the Lutheran two kingdoms doctrine. Benne’s passion is not matched by the strength of his arguments. There is a straw man quality to his characterization of his antagonists. For example, Benne describes Tillich as seeing no difference between the demands of the Christian faith and democratic socialism. But Tillich explicitly recognizes the limitations of democratic [End Page 195] socialism in expressing Christian ideals and makes clear that his preference for this form of government is conditioned on a historical situation in which the alternatives are laissez-faire capitalism, fascism, and communism. Benne displays epistemological hubris when he questions mainstream scientific judgments. For example, he mocks the “alleged global warming consensus” (35) without offering any evidence that he possesses the necessary evidence or expertise to judge that consensus. He adds questionable historical claims, exaggerating Nazi persecution of Christians and minimizing the religious motivation of the European wars following the Reformation.Childs’s treatment of the question of how Christians are to engage in the US political process is even more problematic than Benne’s. His political prescriptions are written as if the problem did not exist, as if there existed a unified Christian polity fully faithful to its ideals that could express those ideals directly in the nation’s public policies. In this, there is a lack of the moral realism that Lutherans traditionally express through the doctrine that Christians are simul justus et peccator (at the same time justified and sinner). It is telling that the only sins that Childs acknowledges in the church are those that correspond to secular liberal norms: “racism, sexism, classism, and other forms of discrimination” (110). Childs’s representations of the church as holy, a community of peacemakers, and a sign of peace are normative not descriptive, effacing the traditional Lutheran distinction between the visible and invisible church. Childs also demonstrates a lack of political realism with respect to the influence of Christians in the American political process. In proposing that public policy be directed by Christian ideals, Childs either presupposes a significant conversion of our pluralistic society or he imagines that those not presently acting in the political process according to Christian moral principles can be persuaded to selflessness without conversion. The former position is not an empirical reality, and the latter contradicts the traditional Lutheran understanding of original sin, which holds that in the absence of faith human beings are curvatus in se, curved in upon themselves.Benne makes a... The issue of human nature is very complex and elusive, and mankind has been trying to unveil its elements since the beginnings of any philosophical reasoning. Whether they were questions of ontology, gnoseology, or ethics, it has been an uneasy task to uncover the complexity of the term. This article concentrates on finding ideas that support the existence of human nature and consequently searches for its possible ethical implications. I focused on the traditional issues of good vs evil, especially in (...) terms of dichotomy between committing violent acts and waging wars in contradiction to creation of conditions for peaceful and just societies. In the article, I compare various ideas on human nature and analyse their potential in unveiling its ethical implications. I also comment on the possibility of war and peace being consequences of human nature and its connection to our disposition of being moral subjects. (shrink)

This essay explores Kant's writings on war and peace, and concentrates on the thesis that Kant has a just war theory. It strives to explain what the substance of that theory is, and finds that it differs in several respects from that offered by the just war tradition. Many scholars suspect that Kant has no just war theory. Effort is made to overturn this conventional understanding: first by showing, negatively, that Kant does not subscribe to the two main rival (...) doctrines on the issue, namely, realism and pacifism; and second by demonstrating, positively, how the core propositions of just war theory are consistent with Kant's basic moral and political principles. Interpretive reconstruction then reveals the full substance of Kant's just war theory, which is divided into accounts of jus ad bellum, jus in bello and jus post bellum. Kant's jus post bellum reflections remain his most deep, original and relevant in this regard. (shrink)

Recent just war thought has tended to prioritize just cause among the moral criteria to be satisfied for resort to armed force, reducing the requirement of sovereign authority to a secondary, supporting role: such authority is to act in response to the establishment of just cause. By contrast, Aquinas and Luther, two benchmark figures in the development of Christian thought on just war, unambiguously gave priority to the requirement of sovereign authority as instituted by God to carry out the responsibilities (...) of ensuring a just and peaceful order in the world. On this conception it is the sovereign, in deciding whether to resort to armed force, who must make sure to satisfy the other moral requirements of the jus ad bellum. This paper examines Aquinas and Luther on sovereign authority for use of armed force. Recapturing the importance of this conception is important both for the proper understanding of just war tradition and for working out its implications for such contemporary issues as humanitarian intervention and "regime change.". Although the nascent church had no program for social reform, careful study of the Synoptic traditions about Jesus and of the letters of Paul do give us access to early and decisive developments in Christian attitudes to the world and therefore to such issues as war and peace.

The biblical, talmudic, midrashic, and mystical traditions, as well as contemporary Jewish feminist theologies, reveal a plethora of Shekhinah images. If tracked historically these readings, while diverse, reveal continuities even across traditions. These include Shekhinah’s ‘immanence’, ‘presence’, ‘exile’, and shared ‘suffering’. Another vital continuity is Shekhinah’s function as protective ‘shield’. Accordingly, in her gendered theology of the Shoah Raphael argues that Shekhinah was ‘present but concealed in Auschwitz because her female face was yet unknowable to women’. Raphael’s selectivist approach (...) appropriates and de-contextualizes texts from the biblical, rabbinic, Zoharic, Lurianic and Hasidic traditions. For Raphael this methodology is necessary given the tradition’s ‘androcentric and patriarchal’ underpinnings. This article’s reading of Shekhinah’s role in the Shoah, however, differs from Raphael’s theology. Indeed, while Raphael acknowledges the historical continuities of Shekhinah’s ‘immanence’, ‘presence’, ‘exile’, ‘suffering’ and protection, she justifiably claims that Auschwitz was not a ‘place of protection’. This is because Raphael understandably refuses associate Shekhinah with the ‘violent and abusive’ God of the ‘masculine Jewish tradition’. Yet a reading of the tradition, ‘warts and all’, reveals that Shekhinah’s presence but inability to protect the ‘victims’ is a break with precedent and requires explanation. This article therefore tracks Shekhinah’s protective role in Jewish tradition and history to suggest, using mystical texts, that the divine presence was sufficiently empowered to intervene in the Shoah and pleaded Israel’s cause, but was powerless because the Holy One, blessed be He refused to ‘consent’. In the process this article hopes to add another layer to Shekhinah’s story and to help ‘bring her out of exile’. (shrink)

The article surveys and analyzes the roles in Judaism of the value of imago Dei/human dignity, especially in bioethical contexts. Two main topics are discussed. The first is a comparative analysis of imago Dei as an anthropological and ethical concept in Jewish and Western thought (Christianity and secular European values). The Jewish tradition highlights the human body and especially its procreative function and external appearance as central to imago Dei. The second is the role of imago Dei (...) as a moral value relative to others. Amy Levad draws on Aristotle and the virtue ethics tradition to write about “moral imagination” and restorative justice. Darrin Belousek uses Thomas Kuhn’s language to write about a “paradigm shift” in our understanding of theological themes relevant to restorative justice. Both contrast the restorative imagination or paradigm with a retributive one, although Levad also contrasts restoration with rehabilitation. Levad limits her study to restorative justice as [End Page 214] practiced in the criminal justice system, while Belousek expands his work to consider the Bible, theology, and multiple issues in society and in the church.Levad begins her book by discussing Aristotle’s idea of justice as equity, which she points out requires more discernment from judicial decision makers than it requires the algorithmic application of laws. In order for them to enact justice as equity, she argues, decision makers need a “vivid and expansive” moral imagination. Toward this end, she brings together two traditions: Aristotelian virtue ethics and modern literature on moral imagination. At the heart of her work is an ethnographic study intended to determine whether there are practices of restorative justice that can foster such a vivid and expansive moral imagination. After observing and interviewing participants in restorative justice programs in Colorado, Levad examined the narratives, metaphors, and symbols they used in order to determine whether and how they demonstrated a distinctively restorative moral imagination. Because the scope of her study was limited, and because she had difficulty getting a wide spectrum of roles involved in restorative justice to participate in the study, Levad’s results are more suggestive than conclusive. She acknowledges that we cannot generalize from them; although she draws on research methods from sociology and criminology, her findings do not meet their standards of evidence. Thus, the book’s greatest value lies in the recommendations it makes for further study. Empirical studies of the effectiveness of restorative justice practices have tended to focus on either reducing recidivism or the satisfaction of participants with the process. Levad brings to the fore two questions that have so far not been explored in previous research. First, how do restorative justice practices affect the moral imagination? And second, what effect might those practices have on ethical discernment? Her book takes some hopeful initial steps in addressing those questions.Although Levad writes as a Christian ethicist, she did not explicitly incorporate theological reflection into her study of state-sponsored programs. Belousek, by contrast, takes on an explicitly theological project of evaluating how interpretations of the significance of the cross of Jesus interact with such things as support for capital punishment, just war, and market economics. Since Belousek’s book is wide-ranging, this review will concentrate on the task it has in common with Levad’s book: that of reconceptualizing justice.In a fashion parallel to Levad’s use of Aristotle’s notion of justice as equity, which sometimes departs from strict legal justice, Belousek cites Paul’s vision of God’s justice “irrespective of” or “apart from” the law (372). Belousek begins by linking penal-substitutionary atonement theory to capital punishment, just war, and exchange economy in a single “paradigm,” arguing that they are all under-girded by what he calls the “Retributive Principle” (28). How do we frame decisions to use-or not use-military force? Who should do the killing? Do we need new paradigms to guide the use of force? And what does "victory" mean in contemporary conflict? In many ways, these are timeless questions. But they should be asked again in light of changing circumstances in the twenty-first century. The post-Cold War, post-9/11 world is one of contested and fragmented sovereignty. Contested because the norm of territorial integrity has shed some of its absolute (...) nature. Fragmented because some states do not control all of their territory and cannot defeat violent groups operating within their borders. Humanitarian intervention, preventive war, and just war are all framing mechanisms aimed at convincing domestic and international audiences to go to war (or not), as well as to decide who is justified in legally and ethically killing. The international group of scholars assembled for this book critically examine these frameworks to ask if they are flawed, and if so, how they can be improved. ABSTRACTThe ‘City of David’ in Silwan is on the original site of Jerusalem. Located in Israeli-occupied East Jerusalem, it is both an illegal Israeli settlement in a Palestinian neighbourhood and a popular international tourist destination. This article examines how the site is narrated by tour operators and tourists through fieldwork, interviews and analysis of tourist comments on the TripAdvisor site. It argues that Israeli settlers have successfully harnessed tourist discourse in order to present their vision of a (...) Jewish Jerusalem in which Palestinian existence is ignored or treated as a threat. The site allows tourists to connect to and experience a mythical biblical past, something which answers to tourist desires to have an authentic encounter with the destination culture. In the site’s narratives, the presence of Palestinians in the area is elided over through spatial and linguistic separation and by denying their legitimate presence. This indicates how the congruence between Zionist and tourist discourses discursively legitimises Israeli colonisation of Silwan. (shrink)

Sion in Mamluk Jerusalem1Jon Paul Heyne (bio)In the spring of 1353, roughly half a century after the Latin world's loss of Acre, the Florentine lady Sofia degli Arcangeli purchased lands in Mamluk Jerusalem for the establishment of a pilgrim hospital run by a group of select companions.2 Thus began the (...) Latin hospice of St. Mary's of Mt. Sion. For twenty years under Sofia's direction, the foundation obtained numerous privileges from the popes until suddenly, in 1375, Gregory XI denounced Sofia, forbidding her continued association with the hospital. Shortly thereafter, care of St. Mary's fell into the hands of a community of Franciscan friars living in Jerusalem—members of the recently formed Franciscan Custody of the Holy Land—who in turn established various regulations for the workers at the hospital, identified simply as women (mulieres) of the hospice.3 By the fifteenth century, the community at St. Mary's was transformed into a female house of Third Order Franciscans directly under the authority of the Custody, which, [End Page 33] for its own part, had adopted the regular Observance sub vicariis of the Franciscan order.The story of Sofia's hospital and its associated house of workers raises important questions regarding the relationship of penitential lay communities to the papacy and to the mendicant orders in the late medieval period. At first glance, St. Mary's appears simply to have encountered the same fate of many quasi-religious groups in the fourteenth and fifteenth centuries; driven by papal, clerical, and Observant efforts to establish uniformity and avoid heresy among lay penitents, the hospice fell under the supervision of the Franciscans, and the women living and working there were made tertiary members of the friars' order. Was, however, this clerical interest in regulating penitential groups the primary driving force in the development and transformation of Sofia's hospital? How did the hospital's location in Jerusalem, a city under Islamic rule, influence the dynamics that formed between Sofia and the popes and between the community at St. Mary's and the nearby Franciscan monastery? I argue that both the popes' changing relationship with Sofia and the formation of closer ties between the hospice community in Jerusalem and the Franciscan Custody had as much or more to do with the opportunities and challenges presented by the hospital's position as a Latin establishment in the Mamluk Empire as it did with clerical preoccupations to promote uniformity in the late medieval Church. Thus, the history of St. Mary's expands upon recent scholarly understandings of the creation of the third orders, offering a view of these tertiary communities within the wider scope of Muslim-Christian relations in the Mediterranean.Before examining the history of St. Mary's, I offer a brief overview of recent scholarship on female tertiary communities.4 Traditional narratives on the Franciscan Third Order assert that the tertiaries officially began with St. Francis or at the very least with the creation of an "order of penitents" through the 1289 bull Supra montem.5 Several studies have challenged this older interpretation, describing the formation of the Third [End Page 34] Order Franciscans as a much messier and less coherent process spanning the thirteenth through sixteenth centuries.6 According to some of the most recent revisionist approaches, female penitential establishments first fell under increased clerical scrutiny and canonical regulation in the late thirteenth century and early fourteenth centuries.7 Nonetheless, despite such ecclesiastical efforts to conform penitential groups to more traditional forms of religious life—by requiring enclosure, a rule, and the direct association with an existing order—many lay communities remained merely quasi-religious and even those that adopted Supra montem as a "rule" were only superficially connected to the Franciscan friars. Indeed neither the lay communities nor the friars were typically interested in a more official or direct association, and the adoption of Supra montem was primarily a means by which female penitents put on the façade of a regulated monastic lifestyle so as to evade potential accusations that they were inappropriately... Women’s voices are widely expressed in current movements of rejuvenation of Jewish traditions. These moves raise tensions within the religious world and the civil legal realm. In focus here is a much-debated instance: the nearly thirty-year effort by Jewish women to pray in a group in song and read from the Bible at the holy site of the Western Wall in Jerusalem. The group is called the Women of the Wall (WoW). In addition to the women's rights (...) of speech, discussion here highlights the need to recognize duties of respect for the women’s voices. Moral analysis of the Jewish and democratic values which constitutionally define Israel founds the legal basis for this duty of respect. Both Jewish thought and Kantian analysis are seen to conceptualize the essence of freedom as obligation, from which arise duties of respect for the other. Duties of respect indeed are owed to WoW by the other worshippers at the Western Wall, as well as by the rabbinic authorities in control of forms of prayer at the site. That both Jewish and democratic values deem obligation as the essence of freedom lends support to seeing coherence between the two sets of values defining the State of Israel. (shrink)

The article is about the memory of the Kresy Wschodnie (Eastern Borderlands) in post-war Poland. As a result of the settlements of the peace conference in Yalta, Poland lost half its territory in the east. Censorship in PRL prohibited the talk about the history of eastern Polish provinces. Kresowianie couldn’t speak loudly where they came from, in the place of birth, communist wrote them to the USSR. Kresy Wschodnie were considered the cradle of patriotism and traditional values – traits associated (...) with resistance to communist rule. Kresowianie banished from the land inhabited for hundreds of years, they had to find a new reality. The article presents the issue of the memory of the Kresy through the prism of Lviv. Lviv was a particularly important town in the Eastern Borderlands. The city was a very important scientific, cultural and economic center. The city has evolved a unique atmosphere and a specific urban culture. The memory of Lviv in the PRL, was carried by his former inhabitants. (shrink)
