Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. How do we come to like the things that we do? Each one of us starts from a relatively similar state at birth, yet we end up with vastly different sets of aesthetic preferences. These preferences go on to define us both as individuals and as members of our cultures. Therefore, it is important to understand how aesthetic preferences form over our lifetimes. This poses a challenging problem: to understand this process, one must account for the many factors at play (...) in the formation of aesthetic values and how these factors influence each other over time. A general framework based on basic neuroscientific principles that can also account for this process is needed. Here, we present such a framework and illustrate it through a model that accounts for the trajectories of aesthetic values over time. Our framework is inspired by meta-analytic data of neuroimaging studies of aesthetic appraisal. This framework incorporates effects of sensory inputs, rewards, and motivational states. Crucially, each one of these effects is probabilistic. We model their interactions under a reinforcement-learning circuitry. Simulations of this model and mathematical analysis of the framework lead to three main findings. First, different people may develop distinct weighing of aesthetic variables because of individual variability in motivation. Second, individuals from different cultures and environments may develop different aesthetic values because of unique sensory inputs and social rewards. Third, because learning is stochastic stemming from probabilistic sensory inputs, motivations, and rewards, aesthetic values vary in time. These three theoretical findings account for different lines of empirical research. Through our study, we hope to provide a general and unifying framework for understanding the various aspects involved in the formation of aesthetic values over time. (shrink)

Epistemicists claim that if it is vague whether p, it is unknowable whether p. Some contest this on epistemic grounds: vague intuitions about vague matters need not fully preclude knowledge, if those intuitions are response-dependent in some special sense of enabling vague knowledge. This paper defends the epistemicist principle that vagueness entails ignorance against such objections. I argue that not only is response-dependence an implausible characterization of actual vague matters, its mere possibility poses no threat to epistemicism and is properly (...) accounted for by the epistemicist’s own principles. This article analyzes the adoption of voluntary environmental management programs by firms operating in Mexico. Mexican firms can obtain national certification (Clean Industry) and/or international certification (ISO 14001). Based on institutional entrepreneurship theory, we posit that the role played by first movers as institutional entrepreneurs is crucial if these programs are to become established with sufficient strength and appeal. This understanding is especially important in an environment where more than one program can be adopted. We tested several hypotheses on the (...) behaviors of 1328 facilities operating in Mexico, half of which (664) had certified environmental management programs. Of the 664 certified facilities, 217 were classified as early adopters. Three variables predicted the likelihood of a facility being an early adopter: (1) connected to international market, (2) in the maquila sector, and (3) linked to an industry association that offers free resources. In this work, we propose a meaningful extension of description logics for non-monotonic reasoning. We introduce \, a logic allowing for the representation of and reasoning about both typical class-membership and typical instances of a relation. We propose a preferential semantics for \ in terms of partially-ordered DL interpretations which intuitively captures the notions of typicality we are interested in. We define a tableau-based algorithm for checking \ knowledge-base consistency that always terminates and we show that it is sound and (...) complete w.r.t. our preferential semantics. The general framework we here propose can serve as the foundation for further exploration of non-monotonic reasoning in description logics and similarly structured logics. (shrink)

U članku se propituje autorstvo i vrijeme nastanka Ātmabodhe, poznate filozofske pjesme koja na popularan, ali i pjesnički imaginativan način razlaže glavna učenja indijske filozofske škole Advaita Vedānte. Iako se Ātmabodha tradicionalno pripisuje velikom filozofu Śaṅkari (8. stoljeće), u članku se iznose argumenti koji govore u prilog tezi da je djelo nastalo nekoliko stoljeća nakon Śaṅkare. Osim suvremene stilometrijske metode General Imposters Framework, koja ju ne prepoznaje kao Śaṅkarino djelo, Ātmabodha također ne zadovoljava Hackerov kriterij kolofona. U članku se stavlja (...) poseban naglasak na doktrinarne i terminološke osobitosti u Ātmabodhi koje pripadaju vremenu nakon Śaṅkare. Osobit je primjer shvaćanje pojma neznanja, uz uvođenje kasnijih termina i koncepata. Dostupni dokazi upućuju na to da bi djelo moglo datirati iz vremena između 11. i ranog 14. stoljeća. (shrink)

The purpose of the study is to analyze various approaches to the processes of formation of the Russian civilizational identity in the context of modern Russian nation-building and modernization of education. The article substantiates the relevance of the growing civilizational paradigm of Russian education in accordance with the value orientations of the updated Constitution of the Russian Federation, the foundation of which is the course of positioning Russia as one of the civilizational poles of multipolar world development. An important condition (...) for the construction of the Russian civilizational identity is the dissemination of ideas about Russia as a state-civilization in the socio-pedagogical space. As a result of the analysis, the authors come to the conclusion that the modern model of national and civilizational identity should be built as a multi-level education, in which the Russian civilizational identity is complemented by the image of Russia as a Eurasian civilization. It is this image that can act as a certain supra-civilizational level, acceptable in other civilizational formations, which logically fits into the modern geopolitical vector of Russia, aimed at the formation of socio-economic, political and military institutions in the Eurasian space. Increasingly privatized auditory spaces resulting from the mutual engendering of auditory cultural practices and sound technologies that separated the sense of hearing and segmented acoustic spaces have had a muting effect on our experience of Others that has intensified since the advent of mobile listening devices. In Section 1 of the article, I outline features of the social realm of the nineteenth to twentieth centuries that made modern sound technologies possible and then features of the technological realm that have shaped (...) today’s social realm – all with an eye toward our experience of other people. Then, in Section 2, I reach for a few phenomenological tools from the work of Jean-Paul Sartre, Emmanuel Levinas, and Don Ihde to draw out the phenomenological vectors that have taken shape within the enmeshed sociotechnological context described in Section 1. Specifically, I show how technologically mediated auditory experience has been individualized and how the use of sound technologies on the go – whether wearing earphones or in a car – has had a muting effect on our experience of others. Why the social ontology uses the game as paradigmatic example of social object? Is social reality a game? In this short essay, shared characteristics and differences of ludic and social acts are explored to explode the myth of the normative structure of social reality. In order to explain and demonstrate their theories, major authors of our research sector as Searle and Smith appeal to ludic phenomenons as unmistakable evidences of regulated social activities. Nevertheless well valued theorists don’t recognize that there (...) are tens of different typologies of games, about which it should be appropriate to draw up a regional ontology, as much there are tons of rule types, not always prescriptive and not always descriptive. The instant article demonstrates that social reality is not explainable by appealing to regulated behaviors, opening in this way a research context that involves the Interactive Fiction of play. Therefore the ludic phenomenon rests the base of social reality, however disconnecting it from the concept of rule, which too much influenced the research on mind, language and culture. (shrink)

Recent anti-governmental social movements in countries of former Yugoslavia have awakened the spirit of contention which had been dormant for almost two decades. The overwhelming economic deprivation, accompanied by the massive violation of basic human rights of the citizens, urged the challengers to take the streets.This paper is focused on comparison of two movements, the “Citizens for Macedonia” movement in the Republic of Macedonia and the “Bosnian Spring” in Bosnia and Herzegovina, highlighting the role and influence of movements on the (...) occurrence of policy outputs which articulated claims put forward by social movement organizations as well as other movement actors in the two respective countries. The analysis will be conducted taking into consideration specific social movement related variables like forms/types of claims-making and repertoires of action, as well as wider political process factors such as repression by state actors, and the attitude of allies and opponents of the movements.Regarding the methodological approach, we will apply a mixed comparative research design, with variation both on side of the independent and the dependent variables. Since the outcomes of the movements are already tangible, we will also apply elements of process tracing methodology, reconstructing the events as much as possible. My primary data collection tools encompass in-depth interviews with four specific categories of interviewees as well as thorough document analysis referring to the policy outputs. (shrink)

This paper discusses the reliability of the criteria for determining Śaṅkara’s authorship established by Paul Hacker. His analysis of terminological peculiarities is based on only one of Śaṅkara’s works—the commentary on the Brahma-Sūtras. Therefore, doubt arises as to whether these criteria also apply to other works that we can claim to be authentic. First, it will be argued that the commentaries on the Bṛhadāraṇyaka- and Taittirīya-Upaniṣad are works that can be—with reasonable certainty—considered authentic. When applied to these two works, Hacker’s (...) criteria work remarkably well, and the commentaries on the Taittirīya- and Bṛhadāraṇyaka-Upaniṣad share the same terminological and conceptual features with the Brahma-Sūtra-Bhāṣya. Moreover, in most cases, it is possible to distinguish the usage of some terms and concepts from Sureśvara and Padmapāda. On the other hand, Sureśvara and Padmapāda use some of these terms in a quite similar way as Śaṅkara, but differently than the later Advaitins, indicating that a sharp line between Śaṅkara on the one hand and Sureśvara and Padmapāda on the other cannot be drawn in many cases. Also, the writings of these authors—especially Padmapāda—represent a transitional phase in the development of certain Advaita Vedānta concepts although the outlines of some peculiarities by which the later Advaita Vedānta differs from Śaṅkara can already be found sketched by Śaṅkara himself. Ovaj članak istražuje neke usporednice novoplatonističke tradicije filozofskih komentara uz Platōna i Aristotela. Uz to istražuje egzegetske metode usuglašivanja tih dvaju velikih antičkih mislilaca. Ako prihvatimo Sorabjijevu tvrdnju da je cilj novoplatonističkoga usuglašivanja obrana poganskih filozofa od kritike kršćanskih mislilaca možemo vidjeti jasnu usporednicu s vedāntom koja je branila koherenciju svetoga upanišadskog kanona od buddhističke kritike. Ovaj se članak usredotočuje na novoplatonističkoga komentatora Amonija koji je pokušao usuglasiti Aristotelov nauk o Nepokrenutom pokretaču s Platonovim naukom o Demijurgu i Ideji dobra. (...) S druge strane u Indiji možemo vidjeti sličan pokušaj usuglašivanja različitih upanišadskih učenja o najvišem biću.This article explores some parallels between neoplatonist tradition of philosophical commentaries on Plato and Aristotle and explores some exegetical techniques of harmonisation of these great ancient thinkers. If we accept Sorabji’s claim that the aim of this reconciliation is neoplatonist defence of pagan thinkers from the attack of Christian philosophers than we can see a clear parallel with Vedānta which was defending the coherence of upanishadic sacred canon against Buddhist attack. The paper is focusing on neoplatonist commentator Ammonius who is trying to reconcile Aristotle’s Unmoved mover with Plato’s Demiurge and the Idea of good. On the other side, in India we can see very similar project of harmonisation of the different upanishadic teachings of the highest being. (shrink)

The enigmatic thought of Charles S. Peirce, considered by many to be one of the great philosophers of all time, involves inquiry not only into virtually all branches and sources of modern semiotics, physics, cognitive sciences, and mathematics, but also logic, which he understood to be the only useful approach to the riddle of reality. This book represents an attempt to outline an analytical method based on Charles Peirce’s least explored branch of philosophy, which is his evolutionary cosmology, and his (...) notion that the universe is made of an ‘effete mind.’ The chief argument conceives of human discourse as a giant metaphor in regard to outside reality. The metaphors arise in our imagination as lightning-fast schemes for acting, speaking, or thinking. To illustrate this, each chapter will present a well-known metaphor and explain how it is unfolded and conceptualized according to the new method for revealing meaning.
