In this study we replicated the explanatory effect of a label which had been found by Giffin et al.. In their experiments, they used vignettes describing an odd behavior of a person based on culturally specific disorders that were unfamiliar to respondents. It turned out that explanations which explain an odd behavior through a person’s tendency to behave that way seemed more persuasive if the disorder was given a label that was used in the explanation. We replicated these results in (...) Experiment 1, and in a follow-up Experiment 2 we examined the familiarity with category information and the evaluation of that category over time. We realized that the label effect persists even when people make judgments based on their recollections about a category. Furthermore, according to a content analysis of the recollections, participants in the label condition remembered more information from the vignettes but tended to forget an artificial label; however, they used other words from the disorder domain instead. This allowed us to suggest a new interpretation of this effect: we suppose that in the Giffin et al. experiments the label did not bring any new features to a category itself, but pointed to a relevant domain instead, so the effect appeared from the activation of areas of knowledge in semantic memory and the application of relevant schema for learning a new phenomenon. I distinguish between two forms of consequentialism: reductionist and anti-reductionist. Reductionist consequentialism holds that the deontic properties of rightness and wrongness are identical with the axiological properties of optimality and suboptimality, respectively. Anti-reductionist consequentialism denies this identification, hence accepting what I call the autonomy of the deontic. In this article I ignore reductionist consequentialism. Instead I argue that anti-reductionist consequentialism is deeply problematic or even incoherent. Simply put, the main point is that the criterion of rightness of any ethical theory (...) that respects the autonomy of the deontic must entail that an object that meets that criterion is an action, and anti-reductionist consequentialism does not meet that requirement (while certain competing theories arguably do). The "theory of mind" framework has been the fastest growing body of empirical research in contemporary psychology. It has given rise to a range of positions on what it takes to relate to others as intentional beings. This book brings together disparate strands of ToM research, lays out historical roots of the idea, and indicates better alternatives.

The paper addresses an understudied but highly relevant group of people within corporate organizations and society in general—the marginalized—as well as their narration, and criticism, of personal lived experiences of marginalization in business. They are conventionally perceived to lack traditional forms of power such as public influence, formal authority, education, money, and political positions; however, they still possess the resources to impact their situations, their circumstances, and the structures that determine their situations. Business ethics researchers seldom consider marginalized people’s voices (...) and experiences as resources to understand their lives, as demonstrated through a review of 7500 articles published in the Journal of Business Ethics and Business Ethics Quarterly (2000–2019). Only 78 studies included aspects of marginalized groups. 69 of those studies discussed the topic of marginalized groups of people, but without integrating their explicit voices into the text. Only 9 of the 78 articles featured marginalized people’s explicit voices about their marginalization experiences incorporated into the text as a source for exploration. None of the identified studies discussed the potential for theorizing based on such voices. This paper contributes to business ethics theory by developing four theoretical possibilities vis-à-vis the critical voices of marginalized people’s experiences in business: (a) marginalized theory on critical agency and freedom of speech; (b) the gatekeeping role of academia; (c) primary sources; and (d) a participative perspective. Discussing the theoretical potential of quoting the above voices can enrich business ethics research in terms of the theoretical understanding of marginalized groups in business. (shrink)

O utopianismo científico de Neurath é a proposta para que as ciências sociais se envolvam na elaboração, desenvolvimento e comparação de cenários contrafactuais, as ‘utopias’. Tais cenários podem ser entendidos como peças centrais de experimentos de pensamento científicos, isto é, em exercícios da imaginação que não apenas promovem a revisão conceitual, mas também estimulam a criatividade para lidar com problemas vivenciados, já que utopias são esforços para imaginar como o futuro poderia ser. Ademais, experimentos de pensamento utópicos podem oferecer conhecimento (...) científico para informar debates e decisões políticas, contribuindo para formatar a sociedade. Este ensaio reconstrói um evento histórico como um exemplo da metodologia utopianista de Neurath. No final dos anos 1970 e início dos anos 1980, uma comissão científica e política designada pelo parlamento da Alemanha Ocidental inventou e comparou quatro cenários para políticas energético-econômicas futuras. Conclusões da comissão informaram decisões políticas que puseram a Alemanha Ocidental (e depois reunificada) em um caminho para se tornar uma potência industrial verde. Uma parte fundamental do trabalho da comissão envolveu um apelo à imaginação, permitindo a caracterização sob a metodologia de Neurath. (shrink)

In this article we argue that puzzle of tax compliance can be explained, at least in part, by recognizing the typically neglected role of ethics in individual behavior; that is, individuals do not always behave as the selfish, rational, self-interested individuals portrayed in the standard neoclassical paradigm, but rather are often motivated by many other factors that have as their main foundation some aspects of “ethics.” We argue that it is not possible to understand fully an individual’s compliance decisions without (...) considering in some form these ethical dimensions. Specifically, we argue here that there is much direct and indirect evidence that ethics differ across individuals and that these differences matter in significant ways for their compliance decisions. We then put this in the larger context of the inability of the standard neoclassical paradigm to explain compliance of at least some individuals, and we suggest several possible avenues by which theory can be expanded to incorporate ethics. We conclude by arguing that a full house of compliance strategies is needed to combat tax evasion, strategies that include the traditional “enforcement” paradigm suggested by and consistent with neoclassical theory, a less traditional “service” paradigm that recognizes the important role of a “kinder and gentler” tax administration in encouraging compliance, and, importantly, a new “trust” paradigm that is built on the foundation of ethics, in which the tax administration must recognize that it can erode the ethics of taxpayers by its own decisions. The intentions to simulate human cognition are permanently increasing. Nonetheless, our knowledge about human cognition is based on fragments of different points of view. Hence, it is necessary to examine which demands these points of view make on technologies aiming at simulating human cognition. In this paper it is argued that no technology can function beyond the cognitive abilities of its constructor. It seems that the cognitive limits and constrains of the constructor will also be implanted in the technologies. It (...) is perhaps the right time to think about what kind of future we are going to create by means of an artificial cognition built upon fragmentary, and many times confusing, premises. (shrink)

In this paper I take another look at the view, defended by C. Nino, that we may punish criminals because, by knowingly breaking a law, they have consented to becoming liable to the prescribed punishment. I will first rebut the criticisms usually aimed at this view in the literature, aiming to show that they are inconclusive. They are all efforts to show that criminal offenders in fact do not consent to becoming liable to punishment simply by committing crimes. I then (...) turn to a different line of criticism, which I find more promising. I argue that the moral power of effecting normative changes by consenting reflects the power holder’s value as a person, and show how this idea makes sense of how refusal to recognize that power wrongs a person. I then argue that the “power” of consenting to punishability does not fit that model, and is better explained as reflecting the value of other people, whom the offender has wronged. Hence the power of consenting is not involved in typical cases of wrongdoing. (shrink)

In the research we focus on the construction of the sexual lifestyles of young people—undergraduates—in Slovakia and ask “which cultural sources are used?” and “which cultural demands exert pressures on these constructions?” The analysis was based on the answers respondents provided to a questionnaire relating to the preferences of values, aspirations regarding partner and sexual life as well as the socio-economic background of respondents. On the basis of the factor analysis and other steps, we obtained five groups of respondents with (...) different lifestyles: 1. Liberal—free, 2. Partner—monogamous, 3. Natural—instinctive, 4. Hedonistic—free, 5. Submissive—partner. The research proves that while constructing their sexual lifestyles, young people experience confusion as to their personal interests, preferences, internal orientation of partner relationships, and culturally prescribed norms of monogamous relationships. Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. The bulk of this volume consists of a somewhat revised version of the Axel Hägerström Lectures given in Uppsala, Sweden in 1991. It also contains previously published papers on the relevance of philosophy of language to ethics and the interpretation of Kant’s moral philosophy. The latter, in particular, deserves comment, but space considerations force me to devote my attention to the Hägerström Lectures, entitled “A Taxonomy of Ethical Theories.”.

Atomism is defined as the view that the moral value of any object is ultimately determined by simple features whose contribution to the value of an object is always the same, independently of context. A morally fundamental feature, in a given context, is defined as one whose contribution in that context is determined by no other value fact. Three theses are defended, which together entail atomism: (1) All objects have their moral value ultimately in virtue of morally fundamental features; (2) (...) If a feature is morally fundamental, then its contribution is always the same; (3) Morally fundamental features are simple. (shrink)

Recent theological anthropology emphasizes a dynamic and integral understanding of the human being, which is also related to Karl Rahner's idea of active self-transcendence and to the imago Dei doctrine. The recent neuroscientific discovery of the “visual word form area” for reading, regarded in light of the concept of cultural neural reuse, will produce fresh implications for the interrelation of brain biology and human culture. The theological and neuroscientific parts are shown in their mutual connections thus articulating the notion that (...) human beings shape and transcend themselves both at the biological and at the cultural level. This will have relevant implications for the timely topic of human uniqueness in science and theology, and in proposing a new research perspective in which theology may consider culture along with its biological import, but not necessarily in strictly evolutionary terms alone. El mar, los atardeceres, la llama de (...) una hoguera, por ejemplo, son la inminencia de una revelación que nunca se produce, son el hecho estético. La obra de Wittgenstein es estrictamente filosófica y al mismo tiempo literaria. Esa proposición parece verdadera también para el caso de la obra de Borges. (shrink)

The oldest preserved commentary on the Br̥hadāraṇyaka-Upaniṣad was composed by Śaṅkara. Sureśvara composed a sub-commentary on this commentary, while Ānandagiri composed commentaries both on Śaṅkara’s commentary and on Sureśvara’s sub-commentary. All these four books contain a number of passages from earlier works which are not preserved. Sureśvara and Ānandagiri attributed some of these passages to a commentator named Bhartr̥prapañca. The aim of this article is to present a philological method which will establish which of the passages might be paraphrases and (...) which might be quotations from Bhartr̥prapañca’s lost commentary composed in the scope of the bhedābheda theory. This article will argue that Śaṅkara paraphrases Bhartr̥prapañca’s text, while Ānandagiri quotes most probably Bhartr̥prapañca’s text literally. This text was metrically adjusted by Sureśvara who paraphrases Bhartr̥prapañca by shortening and adjusting the original text in order to fit into the pattern of the śloka meter. If this is true, it is possible to establish a methodology which may help us to reconstruct portions of the oldest known commentary on the Br̥hadāraṇyaka-Upaniṣad. (shrink)

This paper discusses the reliability of the criteria for determining Śaṅkara’s authorship established by Paul Hacker. His analysis of terminological peculiarities is based on only one of Śaṅkara’s works—the commentary on the Brahma-Sūtras. Therefore, doubt arises as to whether these criteria also apply to other works that we can claim to be authentic. First, it will be argued that the commentaries on the Bṛhadāraṇyaka- and Taittirīya-Upaniṣad are works that can be—with reasonable certainty—considered authentic. When applied to these two works, Hacker’s (...) criteria work remarkably well, and the commentaries on the Taittirīya- and Bṛhadāraṇyaka-Upaniṣad share the same terminological and conceptual features with the Brahma-Sūtra-Bhāṣya. Moreover, in most cases, it is possible to distinguish the usage of some terms and concepts from Sureśvara and Padmapāda. On the other hand, Sureśvara and Padmapāda use some of these terms in a quite similar way as Śaṅkara, but differently than the later Advaitins, indicating that a sharp line between Śaṅkara on the one hand and Sureśvara and Padmapāda on the other cannot be drawn in many cases. Also, the writings of these authors—especially Padmapāda—represent a transitional phase in the development of certain Advaita Vedānta concepts although the outlines of some peculiarities by which the later Advaita Vedānta differs from Śaṅkara can already be found sketched by Śaṅkara himself. Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

In this article I will describe the main elements of the Norwegian press’s moral confrontation with the Government Pension Fund’s ethical investment management when it was in an introductory phase in early 2005, with special emphasis on one newspaper, Stavanger Aftenblad. The press criticized the fund’s fresh investment profile and intended exclusionary practice before it had really started in earnest. Then I will focus on how the press’s unilateral criticism of the fund’s investment practice at the time overshadowed a discussion (...) of any defects in the ethical principles for investment. And I will focus on the press’s lack of distinguishing between information and sensation. In conclusion I point out that in 2006 the press has abandoned its critical stance from 2005 and has now a tendency to idealize the fund’s exclusionary practice and the underlying principles. According to what we could call the "liberal" theory of distributive justice, people do not deserve the money they are able to make in the market for contributing to the economy. Yet the standard arguments for that view, which center on the fact that persons have very limited control over the size of their contributions, would also seem to imply that persons cannot deserve admiration, appreciation, esteem, praise and so on for these and other contributions. The control asymmetry is this: (...) the first conclusion of these arguments is acceptable but the second not. This paper is an effort to defend that claim, but without appeal to the notion of control. (shrink)

In this paper I criticize the standard argument for deontological egalitarianism, understood as the thesis that there is a moral claim to have an equal share of well-being or whatever other good counts. That argument is based on the idea that equals should be treated equally. I connect the debate over egalitarianism with that over comparative justice. A common theme is a general skepticism against comparative claims. I argue (i) that there can be no claim to equality based simply on (...) the fact of equal worth as that fact itself does not have any value for the supposed claim holder; and (ii) intuitions that suggest otherwise can be explained away without appealing to comparative claims. Moral Rights and Their Grounds offers a novel theory of rights based on two distinct views. The first--the value view of rights--argues that for a person to have a right is to be valuable in a certain way, or to have a value property. This special type of value is in turn identified by the reasons that others have for treating the right holder in certain ways, and that correlate with the value in question. David Alm then argues that the (...) familiar agency view of rights should be replaced with a different version according to which persons' rights, and thus at least in part their value, are based on their actions rather than their mere agency. This view, which Alm calls exercise-based rights, retains some of the most valuable features of the agency view while also defending it against common objections concerning right loss. This book presents a unique conception of exercise-based rights that will be of keen interest to ethicists, legal philosophers, and political philosophers interested in rights theory. (shrink)

Orthomodular posets form an algebraic formalization of the logic of quantum mechanics. A central question is how to introduce implication in such a logic. We give a positive answer whenever the orthomodular poset in question is of finite height. The crucial advantage of our solution is that the corresponding algebra, called implication orthomodular poset, i.e. a poset equipped with a binary operator of implication, corresponds to the original orthomodular poset and that its implication operator is everywhere defined. We present here (...) a complete list of axioms for implication orthomodular posets. This enables us to derive an axiomatization in Gentzen style for the algebraizable logic of orthomodular posets of finite height. (shrink)

In this paper I defend the view that persons have a claim to deserved treatment, including many forms of punishment, against an objection resting on the principle that it is not possible to have a claim to harmful treatment. I do not challenge this principle, but argue, rather, that the harms wrongdoers typically deserve either (a) are not genuine harms at all (for reasons relevant to their being deserved) or (b) are not relevant to the content of these wrongdoers' claims.

The acid rain issue came into prominence because scientists kept telling the world of acid rain's potential devastating effects. Yet, the acid rain debate was marked by mistrust between American and Canadian scientists. The signing of the Air Quality Accord in 1991 appears to have quelled this divisiveness and promises to bring about a new era of scientific cooperation. Using surveys of acid rain scientists in the United States and Canada across three time periods, this study finds both similarities and (...) differences between how Canadian and American scientists view many of the issues surrounding the acid rain debate. Stuttering is one of the most well-known speech disorders, but the underlying neurological mechanisms are debated. In addition to genetic factors there are also major non-genetic contributions. It is here proposed that infection with group A beta-hemolytic streptococcus (GAS) was a major underlying cause of stuttering until the mid 1900s, when penicillin was introduced for the treatment of streptococcal infections about 1946. The main mechanism proposed is an autoimmune reaction from tonsillitis, targeting specific molecules, for example within the basal ganglia. (...) It is here also proposed that GAS infections may have continued to cause stuttering to some extent, to the present date, though more rarely. If so, early diagnosis of such cases would be of importance. Childhood cases with sudden onset of stuttering after throat infection may be particularly important to assess for possible GAS infection. The support for this hypothesis primarily comes from three lines of argument. First, medical record data from the 1930s strongly indicates that there was one type of medical event in particular that preceded the onset of childhood stuttering with unexpected frequency: diseases related to GAS throat infections. In particular, this included tonsillitis and scarlet fever, but also rheumatic fever. Rheumatic fever is a childhood autoimmune sequela of GAS infection, which was a relatively widespread medical problem until the early 1960s. Secondly, available reports of changes of the childhood prevalence of stuttering indicates striking parallels between stuttering and the incidence of rheumatic fever, with (1) decline from the early 1900s, (2) marked decline from the introduction of penicillin about 1946, and (3) reaching a more stable level in the 1960s. The correlations between the data for stuttering and for rheumatic fever after introduction of penicillin are very high, at about 0.95. Thirdly, there are established biological mechanisms linking GAS tonsillitis to immunological effects on the brain. In addition, a small number of more recent case reports have provided further support for the hypothesis linking stuttering to GAS infection. Overall, it is proposed that the available data provides strong evidence for the hypothesis that GAS infection was a major cause of stuttering until the mid 1900s. (shrink)

Certain cognitive and philosophical aspects of the concept of conceivability with intended or established diversion from reality are discussed. The “coherence gap problem” arises when certain fragments of the real world are replaced with imaginary situations while most details are ignored. Another issue, “the spectator problem”, concerns the participation of the conceiver himself in the world conceived. Three different examples of conceivability are used to illustrate our points, namely thought experiments in physics, a hypothetical world devoid of consciousness , and (...) virtual reality. Two generally recognized moral duties are to reciprocate benefits one has received from others and to compensate harms one has done to others. In this paper I want to show that it is not possible to give an adequate account of either duty – or at least one that corresponds to our actual practices – within a contractualist moral theory of the type developed by T. M. Scanlon (1982, 1998). This fact is interesting in its own right, as contractualism is (...) a leading contemporary contender among deontological moral theories, and the two duties I have mentioned are fairly standard ingredients of such theories. But it also serves to highlight a general problem with contractualism, at least in Scanlon’s version – namely its one-dimensional view of the keystone of any plausible deontological theory: the idea of respect for persons. In his political philosophy, John Rawls has a normative notion of reasonable behaviour expected of citizens in a pluralist society. We interpret the various strands of this idea and introduce them to the discourse on stakeholder dialogue in order to address two shortcomings in the latter. The first shortcoming is an unnoticed, artificial separation of words from actions which neglects the communicative power of action. Second, in its proposed new role of the firm, the discourse of political CSR appeared to (...) offer a promising synthesis of deliberation and action. However, the discourse has been criticized for its shortcoming in failing to provide a regulatory environment for corporation—stakeholder dialogue. Through our interpretation of Rawls’ notion of reasonableness in citizens, the article makes two important theoretical contributions to the debate on stakeholder dialogue. First, we transfer Rawls’ injunction in insisting that dialogues between business corporations and their weaker stakeholders must be understood as consisting of both verbal exchanges and actions. Second, we propose that the coercive power of government ought to provide a necessary context for stakeholder dialogue, and that by doing so, it can provide a way forward for the discourse of political CSR. We illustrate the usefulness of this contribution from Rawls in an analysis of BP’s behaviour towards thousands of victims following the Deepwater Horizon blowout in 2010. (shrink)

Stuttering is a disorder characterized by intermittent loss of volitional control of speech movements. This hypothesis and theory article focuses on the proposal that stuttering may be related to an impairment of the energy supply to neurons. Findings from electroencephalography, brain imaging, genetics, and biochemistry are reviewed: Analyses of the EEG spectra at rest have repeatedly reported reduced power in the beta band, which is compatible with indications of reduced metabolism. Studies of the absolute level of regional cerebral blood flow (...) show conflicting findings, with two studies reporting reduced rCBF in the frontal lobe, and two studies, based on a different method, reporting no group differences. This contradiction has not yet been resolved. The pattern of reduction in the studies reporting reduced rCBF corresponds to the regional pattern of the glycolytic index. High regional GI indicates high reliance on non-oxidative metabolism, i.e., glycolysis. Variants of the gene ARNT2 have been associated with stuttering. This gene is primarily expressed in the brain, with a pattern roughly corresponding to the pattern of regional GI. A central function of the ARNT2 protein is to act as one part of a sensor system indicating low levels of oxygen in brain tissue and to activate appropriate responses, including activation of glycolysis. It has been established that genes related to the functions of the lysosomes are implicated in some cases of stuttering. It is possible that these gene variants result in a reduced peak rate of energy supply to neurons. Lastly, there are indications of interactions between the metabolic system and the dopamine system: for example, it is known that acute hypoxia results in an elevated tonic level of dopamine in the synapses. Will mild chronic limitations of energy supply also result in elevated levels of dopamine? The indications of such interaction effects suggest that the metabolic theory of stuttering should be explored in parallel with the exploration of the dopaminergic theory. (shrink)

The thesis of this paper is that it is possible to explain why a culpable aggressor forfeits his right not to suffer the harm necessary to prevent his aggression if a killer forfeits his right to life. I argue that this strategy accounts also for the necessity restriction on self-defense. I respond to several objections, including the worry that it makes no sense to attempt a derivation of the relatively uncontroversial from the highly controversial.

An overview on archaeological evidence, provided by Colagè and d’Errico, reveals that the timing, location, and pace of cultural innovations are more consistent with scenarios that take culture, rather than genetic evolutionary processes, as the key driving force for human cognition. The authors elaborate on those mechanisms by which cultural evolution operates, with a specific focus on cultural exaptation and cultural neural reuse.

In this paper, I consider the question of whether crime victims can be said to have a moral right to see their victimizers punished that could explain why they often feel wronged or cheated when the state fails to punish offenders. In the first part, I explain what I mean by a “right to punishment” and what it is for such a right to “explain” the frustrated crime victim’s reaction. In the second part, I distinguish such a right from a (...) Lockean-style right to punish, which is also shown incapable of providing the needed explanation. In the third part I argue that it is difficult to identify any benefit such that the right to punishment could plausibly be understood as a right to that benefit. I discuss two main candidates here: the vaguely Hegelian idea that punishment is itself some sort of restitution for the wrong done to the victim; and the idea, due to Victor Tadros, that punishment is a form of compensation for wrongdoing by contributing indirectly to protecting victims from future harm. In the final section, I suggest instead that the frustrated crime victim’s reaction, when justified, is best explained, not by the violation of any right to punishment, but rather by the state’s failure to treat the victim as an equal.
