This article employs the notions of exclusivism and inclusivism to categorise the responses of prospective Islamic religion teachers towards various Islamic religious sects. Despite the prevalent criticism surrounding the perceived oversimplification and a lack of insight provided by the two typologies, we have found them to be valuable tools for elucidating the phenomena under investigation. Quantitative data were collected from 154 respondents using questionnaires containing multiple-choice questions. Data frequency, cross-tabulation and gamma values are statistical techniques employed to (...) analyse and characterise data and ascertain the nature of their associations or dependencies. This study provides evidence indicating that a significant proportion of prospective Islamic religious teachers had a worldview characterised by exclusivity. Their exclusivist stance is seen in their acknowledgment of sects that deviate from their own, such as Wahhabism, Shia, and those engaging in non-scriptural forms of worship. Some individuals agree with the designation of heretical being attributed to those who adhere to distinct religious worship customs. Moreover, these individuals perceive contentious theological assertions, such as those made by Sheikh Panji Gumilang, as warped, misguided and beyond redemption.Contribution: This study implies the need to review and reconstruct higher education curricula to prepare prospective Islamic religion teachers who are moderate, tolerant, inclusive, and uphold human rights. With the start of teaching the sect-based Islamic religion lesson in public schools within the scope of a pilot project in Germany, the development and efforts are continuing to ensure that the course can be given both as a lesson in accordance with the constitution and in accordance with the wishes and expecta-tions of Muslims. Since the Islamic religion lesson is still in the process of formation, one of the most curious points is what the expectations of Muslim (...) families from the lessom are. For this reason, in this study, the state of Baden-Württemberg, one of the states of Germany, in the 2018/2019 academic year, 1-4th grades in public schools. It is aimed to determine the opinions and expectations of the parents of Tur-kish Muslim students who take this lesson from the Islamic religion lesson, which is given as a pilot pro-ject at grade levels, on the issues related to the operation and application of the lesson in the light of cur-rent practices. The study is important in terms of revealing the current status of the lesson and shed light on the future development of the lesson in accordance with the wishes and expectations of Muslim fami-lies. Qualitative research method was used in the research. Research data were collected by semi-structured interview technique consisting of open-ended questions. The research sample consists of 11 Turkish students' parents. In the research, the views and expectations of the parents were expressed with the help of the analysis categories in the form of lower and upper categories. Thus, evaluations were made about at which points the Islamic religion lesson is suitable for the expectations of the parents and at which points it should be made appropriate. (shrink)

The scholars of Ahl as-Sunnah, who are united in the view that sin will not nullify faith and other good deeds, dissented from opinion on the status of the deeds of the person who converted to Islam after his apostasy, in the first Muslim period. In general, Ḥanafī/Māturīdīs argued that those deeds would be in vain with direct apostasy, while Shāfiʽī/Ash'arīs also stipulated death for this purpose, and claimed that a person's previous deeds would not be lost with apostasy alone. (...) Comprehensive interpretations on this issue have found a place for itself mostly in tafsir rather than disciplines such as kalam, fiqh and usûl. Here, while Ḥanafī/Māturīdīs grounds on verse 5/5 of the Surah al-Ma’idah, which only mentions that deeds will be in vain through apostasy; Shāfiʽī/Ash'arīs is based on verse 2/217 of Surah al-Baqarah, which connects this futility to death as apostasy. The parties made different inferences against each other over the relevant verses and gave various answers. The most fundamental point of disagreement among these was the question of whether the first verse, which is muṭlaq in terms of usūl, should be attributed to the second verse, which is in the position of muqayyad. While Ḥanafī/Māturīdīs objected to this process with the thought that the conditions for attributing muṭlaq to the muqayyad were not met in the relevant verses, Shāfiʽī/Ash'arīs, which took a more flexible stance on this issue, approved this attributing process within the framework of the conditions and accordingly reached their relevant views. When the parties evaluated the relevant verses, they made their explanations mostly in the explanation of the 2/217 verse of the Surah Baqarah, which is prior to the arrangement and is in the position of a muqayyad. Since Shāfiʽī/Ash'arī scholars are already based on the relevant verse, it is quite understandable that the place where they examine the subject is the interpretation of this divine word. Ḥanafī/Māturīdīs, on the other hand, examined the issue here in order to respond to the meaning attributed to the verse by Shāfiʽī/Ash'arīs. Shafi'i/Ash'aris based their judgments on one of the two verses, Surah Baqara, 2/217, as a requirement of attributing mutlaq to the muqayyad, and in fact, accepted a single verse as a criterion. On the other hand, Ḥanafī/Māturīdīs, made separate judgments from both of them, claiming that the conditions for attributing muṭlaq to the muqayyad, were not fulfilled in the two related verses. In this context, they concluded from the first verse that death as apostasy necessitates eternal disappointment, and from the second verse, apostasy absolutely wastes deeds. Here, the most typical result of the separation between the two sects emerges as to whether a person will repeat the pilgrimage, for example, he performed while he was a Muslim when he returns to Islam after apostasy. While the Shāfiʽī/Ash'arīs, who thought that deeds will be wasted only by death due to apostasy, did not consider it necessary to go on pilgrimage again, while Ḥanafī/Māturīdīs, who thought that deeds will be lost directly with apostasy even if death does not occur, held the person responsible for pilgrimage. In this study, it will be tried to explain the basic intellectual framework of the view advocated by the parties and the background of what kind of criticism they brought to their opponents. Carrying out analyses performed on the provisions of “Pre-Islamic Divine Laws”, which is described as the religious provisions introduced by the prophets before Prophet Muhammad is one of the questions of debate in Shafiī Sect. The reason laying out of this controversy is based on the question, whether the provisions enunciated via the prophets before the Prophet Muhammad are recognized within the legal aspect, or not. On the other hand, there is no controversy between the procedural, on non-binding for (...) Muslims, about of the previous divine communiqués, which are not mentioned in the Qur’ānor the sunnah, and previous divine messages with evidence that they were abolished despite their presence in these two sources. In the same way, there is no debate about the fact that the provisions of the previous divine religions that were in force for Muslims, such as fasting, also remained in force for Muslims. In this case, with taking part in the Qur’ān or the sunnah, the provisions that there is no evidence about whether they abolished or not, it is debated that they are for Muslims binding or not.In this study, our objective is to carry out analyses and researches on the methodological conceptions of Imam Shafiī and Shafiī lawmen with regards to Pre-Islamic Divine Laws, which have no evidence for being retained in force or being abolished for Muslims despite being mentioned in the Qur’ān or the sunnah, as well as on the level of theoretical conceptions of these scribes being put into practice within the scope of fiqh examples.SummaryIt is a must to identify the scope of Pre-Islamic Divine Laws (Sharia Man Qablanā) [shariah of those before us], which is discussed in terms of being recognized as a shariah evidence by the Shafiī lawmen before analzying the opinions of Shafiī Sect followers. Yet, setting forth the opinions in a healthy manner is based on the identification of the question of debate. Within this context, it is a must to draw up the lines and borders in what the Shafiī lawmen / lawyer and canonists / judiciary mean by the term “Pre-Islamic Divine Laws (Sharia Man Qablanā)” in order to designate the practical results of methodological discussions on Pre-Islamic Divine Laws.Sharia Man Qablanā, of which lexical meaning is “shariah of those before us” is defined in fiqh as follows: “These are the religious provisions acquainted by the prophets before Prophet Muhammad”. In fact, this definition can be categorized as “general” in terms of the evidential value of Sharia Man Qablanā. In that, since it is not possible to carry out an analysis on the reliability of the informational value in the previous divine notices, which cannot be conferred neither in the Holy Qur’ān and the sunnah, each and every lawmen and canonists, including those recognizing Sharia Man Qablanā as hujjat (proof), have come to an agreement that the early divine notices that are not mentioned in the Holy Qur’ān and sunnah will not be recognized in terms of its informational value for Muslims, thus being besides the mark to discuss its validity and bindingness. In this case, the outlines of Sharia Man Qablanā, as controversial in terms of its hujjat value, must be specified. Belonging the earlier divine religions as per the works of lawmen, Sharia Man Qablanā is subjected to a categorization of four part with regard to provisions mentioned in the Holy Qur’ān or the sunnah, whether they are recognized as hujjat by Muslims. 1. The provisions that are not mentioned in the Holy Qur’ān or the sunnah, yet being mentioned only in the earlier monotheistic revelations. The fiqh lawmen have come to an agreement that these provisions are not binding for Muslims, and even that it is not permissible to act in accordance with these provisions. Because, there is no certain information on whether these provisions are reliable.2. The earlier divine notices, which have been proven to be nullified for Muslims, despite being mentioned in the Holy Qur’ān or the sunnah. Since these divine notices have lost their validity, there is a consensus among Muslims that they are not recognized as hujjat. The following hadith is shown as an example as of from the sunnah for this part “Pillage was not halal to those before me, but not it is halal to me” (Muslim, “Masājid”, 56). In that, this hadith indicates that prohibition with regards to the pillage, which was not permissible to the earlier ummahs (nations), is not recognized by Muslims. Thus, rendering pillage as not halal cannot be attributed to Muslims. 3. The provisions of earlier divine religions, which remained in force about Muslims. The canonists exemplify this matter with “fasting”. It can be understood from the verse “O ye who believe! Fasting is prescribed to you as it was prescribed to those before you, that ye may (learn) self-restraint.” (al-Baqara 2/183) that the fasting was a provision as prescribed for the earlier ummahs, which remained in force for Muslims as well. There is no controversy on the matter that fasting is prescribed for Muslims too, as it can be clearly seen from the verse. The hadith of the Prophet Muhammad “It (sacrificing an animal for God) is the sunnah from your Ancestor Ibrahim” (Ibn Majah, “Adāhi”, 3) can be shown as an example that sacrificing an animal for god is applicable to Muslims as well. As a matter of fact, this hadith attests that sacrificing an animal for god is applicable to Muslims, as it is in the religion of the Prophet Ibrahim. 4. The provisions from earlier divine religions, which have no evidence whether they were revoked or remaimed in force for Muslims. The canonists cannot find any evidence for the provisions with regards to the alternative utilization of something between the partners to be recognized as applicable for Muslims within the scope of the following verses: “Here is a she-camel: she has a right of watering, and ye have a right of watering, (severally) on a day appointed” (al-Shu‘ara 26/155) and “And tell them that the water is to be divided between them: Each one's right to drink being brought forward (by suitable turns)” (al-Qamar 54/28). Similarly, there is no evidence that the provisions concerning the retailation, as prescribed in Torah, whether they remained in force or were revoked, as it can be seen in the verse “We ordained therein for them: "Life for life, eye for eye, nose or nose, ear for ear, tooth for tooth, and wounds equal for equal” (al-Ma’ida 5/45). Islam Nusantara is just an approach in practicing Islamic teachings, namely cultural approaches. This Islam has the most prominent character which is called as wasathiyah that is reflected in some attitude such as, inclusive, tolerant, friendly, respect other parties, friendly with diverse cultures and religions, tasamuh, tawazun, and i’tidal. Islam Nusantara sees local (...) cultures as “oxygen”; filters and then respect good culture and tradition so it can have a dialogue with the environment around it positively. This cultural approach has been successfully used by the Walisongo in preaching using tembang, Wayang Kulit, socializing key terms, and so on. In the faith, Islam Nusantara is manifested in some rituals, tahlilan, istighasah, haul akbar, and selametan. Furthermore, in fiqh it’s such as imsak, zakat, halal-bihalal, marriage registration, marriage book, and the reading of ta’liq talaq. Islam Nusantara successfully consolidate Islam with nationalism so both of them are harmonious, and bring the tradition together with modernization through slogan a l-muhafadzah ‘ala al-qadîm al-salih wa al-akhdz bi al-jadîdal-aslah [keep the old good tradition and take a new and better tradition]. Among the Muslims the most common sect is Ḥanafī. It is mentioned in the Ḥanafī sect that there are a line of students who transfer the principles of the sect from generation to generation. In order for the Islamic conquests that started simultaneously in the Eastern and Western lands to be permanent, people were sent to teach Islamic morality, worship and fiqh that encompass daily life. From the 2nd century (A.H.) the sectarianization process that started in the centers (...) such as Kufa, Medina and Damascus has naturally spread to the geography of the West. Many jurists who were educated in the madrasas in the East transferred this education to the newly conquered lands in the West, thus contributing to the fact that sectarianization began in the East and West at the same time. During this period, the views of many mujtahids, including Abū Ḥanīfa and his students, began to enter this geography again through his students. In this article, the most important person who introduced the Ḥanafī sect in the Andalusian region and transferred Abu Ḥanifa's ijtihads, ʿAbdallāh Ibn Farrūkh's life, his scientific personality, his contributions to the spread of the sect and the reasons for the Ḥanafī sect to find supporters in the region will be followed by a short course and the history of the sect will be tried to uncover in the history of Andalusia.Summary: Among the Muslims the most common sect is Ḥanafī. It is not a coincidence that the Ḥanafī sect spread more than other sects and found supporters. Abū Ḥanīfa (d. 150/767) is the most senior among the imams of four leading sects. He experienced about commercial and everyday life, had loyal students. This is because he discussed with his students before deciding on a ruling.Islamic conquests in the east and west started at the same time. Experts teaching Islamic morality were sent to conquered places. In this way, both morality and Islamic law, which encompasses worship and daily life, were also taught. Since the implementation of justice was considered as the main duty of the state, legal affairs were dynamic and systematically organized. For this purpose, both in the Medina and the newly conquered lands, various issues such as, management, use, distribution, non-muslim marriage, trade and so on emerged. These issues were carried out with the "kadi" establishment, which is like today's ministry of justice.In the Hijri 2nd century, Fiqh schools produced practical solutions to matters of process and worship in centers such as, Iraq, Medina and Damascus. These schools completed the sectarianization process after a century. Many Islamic jurists who took madrasah education in the east taught these training in the west. They pioneered the development of this sectarianization process both in the east and the west at the same time.The Islamic jurisprudence solved the problems that emerged with the conquest process that began in Andalusia, primarily through the independent jurisprudence, kadi and muftis in the region. After 710 A.C., the Ḥanafī sect reached Andalusia. After the death of Abū Ḥanīfa, Abu Yusuf became the chief justice. Later, the views of Abū Ḥanīfa gained importance. Abu Yusuf appointed the judges who knew the Ḥanafī sect. Abū Ḥanīfa's students, like a gold mine, embraced the views of their teachers. These jurisprudences were adopted by the supporters. Imam Muhammad was the first to write the case law of Abū Ḥanīfa. The views and thoughts of Abū Ḥanīfa, which were published by Imam Muhammad, spread throughout Iraq, Damascus, Iran and Khorasan. Later these thoughts reached North Africa that was under the control of Aghlabid (A.C. 800-909).In the same era, ʿAbdallāh b. Farrūkh passed to the way 6500 km to learn western sciences. The purpose of Farrūkh is to write the views of his teacher, Abū Ḥanīfa. In this way, he returned to Andalusia by writing ten thousand subjects. Beginning from 767 A.C., Ḥanafī sect gradually began to form in this region. He served as a judge voluntarily, although he did not serve as the official judge. Therefore, it contributed greatly to the spread of this sect in the west. The Mālikī sect, which due to from the animosity of Umayyad (A.C. 661-750) and Abbasids (A.C. 750-1258), came to the forefront. Abdullah b. Ferrûh was not as famous as the other disciples of Abū Ḥanīfa.Although Ḥanafīism spread in the west, it was in the foreground in the eastern geographies. Scholars such as Qadi Ayyad (d. 544/1149), Ibn Farḥūn (d. 799/1397), Muhammad Abū Zahra (d. 1974) and Hintātī state that this sect was effective for a short time in the west. On the other hand, Maqdisī (d. 380/999) states that Ḥanafī existed in Andalusia until the second half of the third century A.C. and was at least as widespread as Mālikīism. Orientalist Lévi Provençal (d. 1956) says that Ḥanafī sect did not reach to Andalusia. However, it can be understood from the above statements that this view is not real. In addition, according to the student hierarchy described in the article, it is understood that the Ḥanafī sect maintained its existence in this region for a while. In Andalusia, the views of the sect from the 8th to the 13th centuries known, recognized and followed by experts and the public. Because this sect was not official, its books were not in demand. For this reason, the basic works belonging to the sect were not reproduced.It is not true that the Ḥanafī sect never came to Andalusia or did not stay for a long time. ʿAbdallāh b. Farrūkh, who studied at Abū Ḥanīfa for 5 years, introduced Ḥanafī sect in Andalusia. Then his students continued this teaching. In this study, the life, mastery and students of ʿAbdallāh b. Farrūkh, who made important contributions for the first time in teaching Ḥanafīsm's to Andalusia, have been brought together. This information is summarized in terms of Ḥanafīsm's entry into Andalusia, the reasons for acceptance in social life and the duration of the sect in the region. (shrink)

Gathering information about theological Islamic dissidents/sects and classifying and listing them in various ways as a literary genre in Islamic literature has been of interest to Muslim scholars as a result of scholarly curiosity or in the aim of criticizing and refuting their ideas from a certain ideological and theological point of view. After especially taking the ḥadīth saying that the Muslim community will divide into 73 sects as a main reference, heresiological classifications or lists became (...) more systematic and schematic. These heresiological classifications or lists are in fact mostly different attempts in terms of material, method and style. This enables to determine and offer possible traditions of classifying and listing sects based on the similarities, differences and connections among them. This dissertation that examines heresiological classifications and lists that emerged in particularly seven centuries after the hijra and appeared in books of various literary genres tries to identify their characteristics and historical development, and categories them according to their methods, scopes, styles and contents in order to reach a holistic understanding. Also it offers possible traditions for heresiological classifications or lists after analysing and comparing the available ones. (shrink)

This paper employs Critical Discourse Analysis to examine resistance discourses as created by the Ahmadiyya followers – a self-defined sect of Islam – to argue against negative discourses undermining them in Indonesia. In some legal proclamations and statements delivered by state officials and the representatives of majority Muslims in the country, the followers of the sect, especially those affiliated to the JAI (Jemaat Ahmadiyya Indonesia) are excluded from Islamic community. By using Van Dijk’s ideological square, this study aims at (...) identifying resistance discourses created by the JAI followers as the defence strategies to oppose negative discourses presenting them as the non-believers of Islam. The resistance discourses are apparent in both written and spoken texts, such as books, articles, speeches, and public debates created by the sect. The finding reveals that the JAI followers create discourses of victim, defender of Islam, imperialism, illegitimacy, and discourse of public deception using various discourse strategies namely victimization, scare tactics, positive attribution, quotation, power delegitimising and negative portraits of misbehaving. Speaking of relations between logic and religion in Islamic world may refer to logic in two respects: logic in religious texts, from doctrinal sacred texts such as Qur’ān and sayings of the Prophet to the Qur’ānic commentaries and the texts related to the principles and fundamentals of jurisprudence, all of which make use of some reasoning to persuade the audiences or to infer the rules and prescripts for religious behavior of the members of religious community; and logic as a (...) discipline that is studied and applied both independently and as a tool for reasoning in schools of Islamic theology, systems of Islamic philosophy, and other types of knowledge in medieval Islamic world, all being strongly influenced by religious doctrines of Islam. Accordingly, this paper speaks of the different manifestations of using logical reasoning, particularly analogy, in Qur’ānic arguments, e.g. for the existence of God and resurrection after death; some contradictions or paradoxes reported by different opponents in the verses of Qur’ān; the place of logic in the classification of disciplines and the courses taught at the schools and seminaries; the influence of the attitudes of different religious sects on logic; the instrumental role of logic for both religious and secular reasonings; the relation between reason and dogmatic religious doctrines, and, finally, the reflection of this relation on progress or recession of logic in medieval Islamic world. As a fiqh (Islamic jurisprudence) term, the concept of “ignorance” ex-presses uncertainties in legal transactions and, in Islamic law, is accepted as a situation that negatively impacts the legitimacy of contracts. If the sale is deferred, clarification of the delivery time of the price to be paid for the goods sold, the number of installments, etc. during the contract is considered essential for the validity of the transactions in order not to damage the principle of mutual consent in (...) purchase and sale transactions and to avoid conflicts between the parties. However, not every uncertainty is considered an obstacle to the validity of the contract, and minor uncertainties that do not lead to disputes are tolerated. The fiqh sources of four Islamic sects contain many examples of these uncertainties. This study firstly examines the effect of ignorance on the validity of purchasing contracts in Islamic law using the issues in classical fiqh sources and then analyses the housing sales contract of TOKI’s (housing development administration of Turkey) “my first house social housing project” in this context from a fiqh perspective. In addition, the study addresses the related housing sales contract in terms of the juristic preference method by considering the aspect of meeting an important need of society and realizing the purpose of this project. Then, while evaluating the issue from a juris-prudential point of view, the study discusses that the absolute and strict interpretation of the rule of “ignorance renders the contract void,” which is adopted by ignoring the public interest, does not produce favorable results. This collection shows Islam to be a diverse (...) set of variable practices and beliefs shaped by region, nation, ethnicity, sect, and class, as well as by responses to many cultural and economic processes. In examining women's participation in religious and nationalist projects, these critics debate controversial issues: Does Islamic feminism provide an alternative, revolutionary paradigm to Eurocentric liberal humanism and western feminism? Is Islam more oppressive to women than the modern secular state? How are the lives and texts of Arab and Muslim women constructed for local or western consumption? These essays expose the shortcomings of the secularist assumptions of many recent feminist analyses, which continue to treat religion in general and fundamentalism in particular as a tool of oppression used against women, rather than as a viable form of feminist agency producing contradictory effects for its participants. The Ismaili is one of the sub-sects of Shiite sect which in addition to being involved in some specific events in the history of different regions in the world of Islam from India to Iran and North Africa has been able to form governments. The record of Ismaili’s presence in Azerbaijan goes back to the third century A.H and the ruling period of Mosafer and Sajian in the fourth century A.H that continued to Seljuqs and Ilkhanids periods. Upon Mongol (...) attacks the center of Immamat moved to Azerbaijan, during 8 and 9th century A.H and this coincided with the Nezari Ismaili’s internal evaluations in Iran. The level of Ismaili sect’s presence in and its contribution to Azerbaijan between 4th and 10th century A.H is assessed here through a descriptive-analytic method and library studies. (shrink)

Many different meanings are attributed to the term Sufi. From the philosophical standpoint the sufi sect leans towards the mystic tradition, while taken etymologically the word implies anything which is extracted from wool. Sufi was the term applied to those individuals who went through life wearing a woolen gown, spending their life in mediation and prayer. Other scholars are of the opinion that the terms sufi is derived from the root “Suffa” which is applicable to the platform built by Mohammad (...) in the mosque at Madina. Hence the term sufi applied to those benevolent and pure but homeless people who spent their time sitting on this platform and meditating upon this life and the hereafter. According to Gazzzali , the term sufi implies a man’s remaining at peace with the world, in mediation upon God. We can say that the Sufis are example of pure spiritual discipline which require a sense of dedication and humanity to get the ultimate goal of life i.e. self-realisation. (shrink)

_In 1497, Syed Muhammad Jaunpuri of India claimed to be a reformer with the mission to purify Islam by justifying his claim according to the teachings and sayings of the Prophet of Islam. He started by curbing the innovations, focusing on belief in Allah, offering prayers, search for God and the truth, and also challenging the religious scholars of his time. Thus, he was criticized by religious scholars by refuting Jaunpuri’s claim of being a reformer, interestingly, academicians have also ignored (...) Jaunpuri’s role as a reformer, but this paper discusses the life of Jaunpuri by focusing on his role as a reformer in India, moreover, this paper limits its scope with the life of Jaunpuri as a reformer. The research used a descriptive cum analytical approach which was aimed at making the research a qualitative one and for that various libraries of Pakistan and personal collections of followers of Jaunpuri were accessed, and at the same time, various websites were also surveyed. So, the research resolved that Jaunpuri was a reformer of the 15 th century India who did his best to reform the people and society of his time by bringing them closer to their Creator._. (shrink)

In this paper I will discuss the main approaches of moral epistemology in the major sects of Islamic theology; the Mu’tazilah and Shi‘ite, who formulated rationalistic ethical system between the eighth and tenth centuries, and the Ash‘arites, who developed a voluntaristic system of morality. At first the answer of Mu’tazila and Shi‘ite to the main question of moral epistemology namely the justification of moral beliefs will be discussed and compared with the intuitionism of Western ethics. Islamic law has an advanced legal theory, apart from the four basic decision-making methods, many judgment-gaining theories based on interpretation and reasoning have been derived which have been developed by Islamic jurists in the process. Islamic jurists have used some of their knowledge and techniques to correct the problematic results that arise from both the incorrect use of methods of obtaining judgments and the expansion of the scope of these methods. With these interdisciplinary studies, it was aimed (...) to interpret the criticisms directed against the analogy process and the causes accurately. One of the methods used at the point of revealing whether these criticisms and objections are based on a justified reason and evidence is the debating method. The method of debating, which has become an independent discipline along with fiqh and kalām in the Islamic scientific tradition, began to form during the periods when sects were formed (II century Hijri). The discipline of debate, which has found a practical field in the methodology of Islamic jurisprudence (fiqh), has been particularly effective in interpreting analogy (qiyas), which constitutes an important part of fiqh, and is even assumed to be among the methods of inference (istidlāl). Many Fasād al-waḍʻ (invalidity of an argument of syllogism) is one of the methods of debating has been used in uṣūl al-fiqh. Fasād al-waḍ‘ has been described as the binding of a provision to a cause (ʻillat) that is the opposite of what that cause requires. This is a situation that completely invalidates the cause. In Fasād al-wad‘, the objector proves that the analogy is erroneous by directing objections to the person who brings the evidence. Since Fasād al-wad‘ is a type of objection directed to the basis of the fiction of analogy, it has been accepted by Islamic jurists as one of the strong objections directed to the cause/analogy. However, the issue of which cause this type of objection can be directed against has been discussed among Islamic jurists. Hanafīs accept Fasād al-wad‘ as a sound objection method, but they think that it is not possible to object to the effective causes (al-ʻillat al-muaththirah) with it. Because, according to Hanafīs, the correctness of the effective quality has been revealed by the Qur’ān, the Sunnah and the consensus (ijmā’). Because these proofs do not produce false qualifications. According to Shafeis, all causes and provision can be objected with Fasād al-wad’. In fact, some Shāfi'ī jurists consider this method as a general type of objection, not aunique one to the analogy. Due to these different interpretations that Islāmic law schools attribute to the conditions of analogy and the nature of Fasād al-wad‘, different results may arise in furû issues. In this study, Fasād al-wad‘as a type of objection to the analogy process in Islamic legal procedure has been examined and the nature of Fasād al-wad‘ has been tried to be revealed by determining the comparative furû. Thus, it is aimed to identify and analyse the diversity of legal reasoning methods, which have an important place in the logic of law in Islam and can be gathered under the name of analogy. (shrink)

The one of goals that religious provisions aim to achieve is the preservation of the generation. For this reason, Islam recommends marriage and prohibits all illegitimate relationships outside of marriage. He also ordered the parties to respect each other's rights and fulfill their responsibilities in order to maintain the marriage union. He requested that all attitudes and behaviors that would disrupt the marriage union be avoided. How ever, from time to time, a word said or a behavior exhibited by one (...) or both spouses shakes the marriage union and even leads to its end. Situations that can be described as severe disagreements that occur between spouses and make the continuation of the marital union almost impossible are expressed with the concept of “shiqàq” in fiqh. Failure of the parties to observe marriage law in domestic relations is one of the main reasons that lead to “shiqàq”. Although the reasons for the “shiqàq” that leads the spouses to discord are not explained in the relevant verse, it is recommended that in case of “shiqàq”, the institution of arbitration should be applied and the arbitrators should first reconcile the relationship between the spouses and prevent the breakdown of the marital union. On the other hand, it is controversial among the sects whether arbitrators have the authority to terminate a marriage union that they do not find beneficial to continue. While the fuqaha, who argue that arbitrators are in the position of attorneys, say that referees cannot separate the spouses without the consent of the spouses, those who say that arbitrators are in the power of judges are of the opinion that arbitrators have the authority to separate husband and wife regardless of the consent of the spouses. In addition, in case of “shiqàq”, the man can directly divorce his wife, and the woman can request the judicial authorities to separate from her husband. In this study, which deals with the issue of “shiqàq” in the context of family law, first of all, the meaning of “shiqàq”, the issues that cause this situation and the legal consequences attached to this concept will be revealed. The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

This paper constructs the theological polemic among Near Eastern Christian sects and the encounter with the new religio-political regional power: Islam. Focusing on the period from around the first Muslim conquests in the mid-seventh century until the ninth centure C. E., a list of East Syriac Church Fathers and their writings are selected as representative voices in the continuing Christological debates. In particular, the paper is concerned with how theological arguments were first used and reinterpreted to address conversion to (...) Islam and later used to emphasize, in an ironic twist, the proximity between Nestorianism and Islam contra other Christian “heresies”. This historical development is important to understand how Nestorian literature was later used by Muslim theologians well after the ninth century, such as Ibn Abī Ţālib al-Dimašqī in the fourteenth century, to defend Islam and debunk Christianity. For Nestorian apologetics the immediacy of addressing the issue of Christian conversion to Islam was clear. Letters from Nestorian clergy, such as Katholikos Īšō’yahb III. and Katholikos Georg, recount the old debates among Nestorians, Miaphysites, and Melkites concerning the nature of Christ. In order to explicate best the erroneous attraction of Islam, these two men contextualized Islamic theology as similar to a Christian heretical sect. Yet over time, appealing to Islamic overlordship became necessary. With the rise of the Abbasid caliphate and the establishment of its capital in the historical heartland of the Nestorian Church, the polemic was reversed. Hereafter, Nestorian dyophysite doctrine was used as an appeal to the Islamic conception of Christ’s divinity. For example, Katholikos Timotheos I. and the theologian Theodor Bar Koni underlined the blasphemy of the Miaphysite and Chalcedonian Christology. This very tactic, however, was easy for Muslim scholars to appropriate in Islamic apologetics. Well before al-Dimašqi, the words of the Abbasid Caliph al-Mahdi to Timotheos are distinct: the Nestorians understood correctly that God could not have suffered and died, but that they all were still wrong that Jesus is the Son of God. The main framework of this study will take into account the Thanawīya/dualism belief within Islamic sources and the criticism of the Māturīdiya tradition to such doctrines. Firstly, an overview of the Thanawīya belief and its sects have been taken into account with a general perspective from kalām and history of religion works. Thereafter certain early, middle and late period works of the Māturidī tradition regarding the Thanawīya transformation has been analysed throughout the study. Abū Manṣūr al-Māturidīs Kitāb al-Tawhīd (...) and Abū Shakūr al-Sālimīs Tamhīds examples are among such works chosen from the mutaqaddimīn (early) period. In terms of the muteakhkhirīn (late) period which is accepted to be 6/12. Century, works considered to be of the middle period such as Abū-l’Mu‘īn al-Nasafīs Tabṣirat al-‘Adillah and Abū’l-Thanā al-Lāmishīs al-Tamhīd li Qawa‘id al-Tawhīd are also taken into account. Nūr al-Dīn al-Ṣabūnīs al-Kifayah has also been included due to it being an important and influential work. With regards to the latter period, Shams al-Dīn al-Samarqandīs al-Ṣaḥāif al-ilāhiyyah work has been given as an example. Additionally, a brief information from works of the New Science of Kalām era has been mentioned. Upon researching the entire mentioned works regarding the Thanawīya or one of its sects, related sections from these works will be mentioned briefly by comparing with each other. The extent of criticism to the Thanawīya belief in such cases will be analysed. (shrink)

The reviewer presents the main theses of Martha Nussbaum's latest book and enters into discussion with it. Although the reviewer does not object to Nussbaum's thesis on the important role of religion in the individual's life, she nevertheless believes that what may arouse controversy is Nussbaum's failure to distinguish between a religious community and sects that may be dangerous to their members. Next, since Nussbaum defends Islam by saying that it is compatible with women's rights, the reviewer challenges this (...) statement by pointing out that Nussbaum's charge against European governments may also be levelled against Muslims themselves. The reviewer also charges Nussbaum with not following, on numerous occasions, the very principles she introduces. (shrink)

The principles of medical ethics, common as they are in the world at the present time, have been formed in the context of Western secular communities; consequently, secular principles and values are inevitably manifested in all corners of medical ethics. Medical ethics is at its infancy in Iran. In order to incorporate medical ethics into the country's health system, either the same thoughts, principles, rules, and codes of Western communities should be translated and taught across the country, or else, if (...) the principles and values and consequently the prominent moral rules and codes of Western medical ethics are not consistent with the culture, customs, and religion of our country, then new principles and values should be formulated that are more in harmony with our society. According to the available literature in Iran, the four principles proposed by Beauchamp and Childress do not contradict the Islamic-Iranian culture and can thus be generally applied in the mentioned context. However, the application of these four principles and their derivatives requires careful examination and adaptation to Islamic ethics. A comparison of the ontological, anthropological and epistemological foundations of secular and Islamic attitudes shows the differences between these two attitudes to be deep-rooted. “Rationalism,” “scientism,” and “humanism” are the main foundations of secularism, whereas “Godcentrism,” “pure human servitude to God,” the belief in “returning of humans to God,” “resurrection day,” and also human's accountability to God are all fundamental beliefs and principles of religion for Muslims of all cults and sects. It can thus be concluded that the principles of secularist thought are different from and to some extent inconsistent with the principles of Islam. Instructions derived from secular thought can therefore not be implemented in an Islamic community; rather, these communities should adopt Islamic foundations as the source for the norms and standards of their medical ethics. The capacities of religious thought make possible the formation of an ethical system consistent with Islamic Ummah. (shrink)

Imam Malik, the founder of one of the four major sects of fiqh, named his work Muwatta, which compiled authentic narrations. It is also the first fiqh formulation that survive to the present day. The Muvatta, as a work that conveys the practices of the Medina society in the period of the Companions, allows to see the religious life of the Prophet and the Companions. This work, which constitutes one of the first written sources of fiqh and hadith, is (...) a response to the western criticism, especially regarding the authenticity of hadiths. Conveying the Muvatta in the same way, the narrators in different geographies of the world revealed that authentic hadiths had also been the tradition of the Muslim community since the time of the Prophet. This article relies entirely on the most significant primary sources and uses a phenomenological method of enquiry. It describes the stages that novices journey through in spiritual practice to ‘see God’ and to engage in what they describe as reports/testimonies and/or revelatory speech. Recognizing the location of the sect within the Mahdist/millenarian movements in Islam, the author points readers in the direction of possible parallels with other charismatic phenomena which could be further explored for intra- and inter-religious dialogue. Recent events in the United States and beyond have brought debates over the practice of female genital cutting back into public, academic, and policy discourses.1 In April 2017, Jumana Nagarwala, a Michigan-based emergency medicine physician from a small Shia sect known as the Dawoodi Bohra, was charged with performing female genital mutilation. The procedure is prohibited by federal law and defined as the circumcision, excision, or infibulation of the whole or any part of the female genitalia under the age of (...) 18. Ash’arism, which emerged in the first quarter of the fourth century of Hijra, is a theological sect that has been accepted by the majority of hadith scholars throughout Islamic history. This fact, which has important consequences for the history of hadith, raises the question of the extent to which the hadith scholars belonging to the Ash’arite sect were interested in theology. This is because theology, which is considered an heretical innovation according to the traditional understanding of Ahl al-hadīth, was (...) severely criticised by hadith scholars representing Salafī thought and positioned as the opposite pole of hadith. Accordingly, Ash’arism could not escape from being the target of the anti-theological Ahl al-hadīth. However, this did not prevent the adoption of the Ash’arite sect by hadith scholars and the emergence of a group of Ash’arite hadith scholars who engaged in theology. Thus, from the fourth century of Hijra, Ash’arite theology, like other Islamic sciences, became a natural part of education and teaching activities. Andalusia and the Maghrib, one of the regions where the Ash’arite sect was widespread, provide a favourable ground for determining the place of theology in the scholarly life of the hadith scholars. The famous hadith scholars who lived in this region in the fifth and sixth centuries of Hijra are analysed in this study in terms of their affiliation with Ash’arism and their interest in the science of kalām. By analysing the education and training lives of the hadith scholars subject to the research, the details that highlight their Ash’arite identities were determined. Issues such as how the Ash’arite tradition was inherited by hadith scholars in the Western Islamic region, what roles hadith scholars played in the spread of the Ash’arite sect in this region, which books were most widely used by hadith scholars in the study of kalām, and which methods were used to read and transmit theological texts are clarified within the framework of available data. As a result, it was revealed that in the Western Islamic world of the fifth and sixth centuries of Hijra, the science of kalām was in great demand among the Ash’arite hadith scholars and that important texts of Ash’arite theology remained in circulation among hadith scholars through reading and transmission. This paper aims at helping trainees to overcome the difficulties they face when dealing with Arduino platform by describing the design of a desktop based intelligent tutoring system. The main idea of this system is a systematic introduction into the concept of Arduino platform. The system shows the circuit boards of Arduino that can be purchased at low cost or assembled from freely-available plans; and an open-source development environment and library for writing code to control the board topic of Arduino (...) platform. The system is adaptive with the trainee’s individual progress. The system functions as a special tutor who deals with trainees according to their levels and skills. Evaluation of the system has been applied on professional and unprofessional trainees in this field and the results were good. (shrink)

Arguing that psychology and business ethics are best brought together through a multi-level, broad-based agenda, this essay articulates a vision of psychology and business ethics to frame a future research agenda. The essay draws upon work published in JBE, but also identifies gaps where published research is needed, to build upon psychological conceptions of business ethics. Psychological concepts, notably, are not restricted to phenomena “in the head”, but are discussed at the intra-psychic, relational, and contextual levels of analysis. On the (...) basis of this presentation, I discuss future directions for development in psychology and business ethics, including but not limited to studies of personality, emotion, decision making, motivation, and the biological bases of psychology and business ethics. An inclusive approach to these and related areas, it is argued, will both bring about depth of understanding on the psychological bases of business ethics, and allow dialogue across disciplinary areas within JBE. This paper argues that contemporary medicalization is one of the reasons why death and dying should be considered as ethical issues. First, two distinct features regarding death and dying can be analysed by comparing ‘tamed death’ and ‘death untamed’. The distinction between death in Ars Moriendi and death as deprivationism has been compared before deducing a conclusion that biomedical ethics is an indispensable tool today to deal with the morality of death and dying. We provide evidence of the relationship between corporate social responsibility (CSR) and corporate financial performance (CFP) in Palestine, a highly unstable political context. Annual reports of all firms listed on the Palestine Exchange (PEX) for the period 2016-2019 were manually content analysed. A checklist of reported CSR items is summarised into four areas: environmental information, human resources, community involvement, and product and customer service quality. Results indicate a robust positive connection between each of the four dimensions and the composite CSR (...) index with three performance indicators: ROA, ROE, and Tobins Q. Results also find better performing companies with a higher degree of community involvement being greatly appealing, while the environmental dimension was the least resilient. We discuss the significance of community engagement for an unstable context like Palestine from a community cohesion standpoint. (shrink)

The Kurdish question and the PKK have been among the topics that have gained massive importance for almost a century in politics, daily life, and among academics. The declaration of the PKK, the last ideological rebellion against the Turkish state, has translated the Kurdish problem into the problem of assimilation, nationalization, and standardization of the decades-long armed conflict between the Turkish army and the PKK. This article aims to present a discourse and content analysis of the master’s and doctoral dissertations (...) that were submitted to the Turkish Higher Education Institution (YÖK) between 1999–2020 in Turkey. The paper focuses on how and in which context these researchers analyzed and formulated their findings on the PKK and the Kurdish conflict. The two basic theoretical concepts on which the study is based are the “embedded journalist” used in media studies and Antonio Gramsci’s “organic intellectual.” The main argument of this study is that the theses have become an affirmation apparatus that reproduces the official ideology of the state with slight differences and feeds it to the masses, and at the same time, due to their narrative that is built with the eyes of the state, they tend to be examples of embedded journalism rather than scientific studies. Social practices of quantification, or the production and communication of numbers, have been recognized as important foundations of organizational knowledge, as well as sources of power. With the advent of increasingly sophisticated digital tools to capture and extract numerical data from social life, however, there is a pressing need to understand the ethical stakes of quantification. The current study examines quantification from an ethical lens, to frame and promote a research agenda around the ethics of quantification. After a brief overview (...) of quantification research and its uses in state and market organization, I discuss quantification in terms of three core subprocesses—capture, specification, and appropriation, illustrating and identifying ethical concerns around each process. Linking these processes to the performative effects of measures, I present a working model of quantification from which the discussion builds ideas for developing a research agenda around quantification.
