Autorzy artykułu argumentują, że libertarianie (tacy jak Murray Rothbard, Stephan Kinsella), którzy jednocześnie podpisują się pod zasadą proporcjonalności w obronie własności prywatnej oraz pod poglądem, iż posiadanie prawa własności prywatnej oznacza posiadanie prawa do jej obrony, popadają tym samym w dylemat polegający na tym, iż jeżeli jedynym sposobem obrony prawa własności prywatnej jest jego nieproporcjonalna obrona, to to własności tej - wbrew temu, co ów pogląd głosi - nie towarzyszy prawo do jej obrony. Najlepiej uzasadnionym sposobem wyjścia z tego dylematu (...) jest osłabienie peremptoryjności praw własności prywatnej, czyli skonceptualizowanie tychże praw jako absolutnych jedynie w słabym sensie tego słowa (korzystając z dystynkcji zaproponowanej przez Matthew H. Kramera). Z kolei libertarianie, którzy tak jak Walter Block chcieliby wybrnąć z rzeczonego dylematu poprzez zastąpienie zasady proporcjonalności zasadą delikatności, popadają w innego rodzaju problemy (nieintuicyjność moralną czy ogólną niekoherencję), co jest tylko kolejnym argumentem na rzecz tezy, iż osłabienie wymogów praw własności prywatnej jest najlepiej uzasadnionym sposobem przezwyciężenia rozważanego tu dylematu. In “Evictionism and Libertarianism,” published in this journal, Walter Block defends the view that, although the fetus is a human being with all the rights to its body, it may nonetheless be evicted from the woman’s body as a trespasser, provided the pregnancy is unwanted. We argue that this view is untenable: the statement that the unwanted fetus is a trespasser does not follow from the premises that the fetus uninvitedly resides in the woman’s body and that the woman is (...) a full self-owner. For this statement to follow, one more statement would have to be true; namely, the woman would have to hold her self-ownership rights specifically against the fetus, and for this to be the case, the fetus would have to have a correlative duty to the woman to abstain from interfering with her body. Após situar e caracterizar a noção foucaultiana de poder a partir dos escritos genealógicos, examina-se como a concepção relacional de poder orienta as investigações acerca da emergência e estruturação do poder disciplinar. Por fim, recuperamos a crítica de Andrew Sayer à noção foucaultiana de poder, segundo a qual falta à concepção foucaultiana uma elaboração explícita do componente valorativo e normativo do poder. Para Foucault, o nazismo utilizou-se do racismo de Estado para proteger uma raça e legitimar a morte daqueles que representavam uma espécie de perigo biológico. Michel Tournier was a philosopher before being a novelist. And even when he decided to become a novelist, he introduced himself as a « smuggler of philosophy ». But it is impossible to take full measure of this statement without considering the one and only philosophical text he ever published, in 1946: « L’Impersonnalisme ». This article, which he considered to be his « system of the world », is here presented in its historical and philosophical context.

Enlightenment - both the phenomenon specific to the eighteenth century and the continuing trend in Western thought - is an attempt to dispel ignorance, achieve mastery of a potentially hostile environment, and contain fear of the unknown by promoting science and rationality. Enlightenment is often accompanied and challenged by countercultures such as German Romanticism, which explored the nature of fear and deployed it as a corrective to the excesses of rationalism. The Aesthetics of Fear in German Romanticism uncovers the formative (...) role this movement played in the development of dark or negative aesthetics. Recovering a missing chapter in the history of the aesthetics of fear, Paola Mayer illustrates that Romanticism was a crucial transitional phase between the eighteenth-century sublime and the early twentieth-century uncanny. Mayer puts literature and philosophy in dialogue, examining how German Romantic literature employed narratives of fear to radicalize and then subvert the status quo in society, culture, and science. She traces the development of this aesthetic from its inception with pre-Romantics such as Jean Paul Richter to its end in Joseph von Eichendorff's critical retrospective, and juxtaposes canonical authors such as E.T.A. Hoffmann - the father of the modern fantastic - with writers who have previously been ignored. Today, when the dark side of science looms in the foreground, The Aesthetics of Fear in German Romanticism points to the power of a literary movement to construct competing currents of thought. The article deals with the symbolic meanings that the images of America and Switzerland have in the works of F.M. Dostoevsky. It is shown that the meanings of these two images are interconnected and constitute a dialectical contradiction, and each image, in turn, has two contradictory meanings - positive and negative. America acts, on the one hand, as a symbol of the openness and freedom of man, his desire to build the future on his own, but, on the other hand, (...) it expresses a dead-end path of development based only on material values. Switzerland embodies the ideal of spiritual development, which is the inner essence of European civilization, but at the same time it symbolizes the patriarchal, sinless state of man, which does not correspond to real earthly life. Switzerland is the ideal of the heavenly state of an earthly person, but this ideal is impossible in real life. The tragedy of the impracticability of this ideal is most clearly demonstrated by Dostoevsky through the story of Prince Myshkin in the novel The Idiot. (shrink)

In his recent paper, C. Fuchs formulates QBism in the form of eight postulates. We criticise QBism as an anti-realist position and propose an alternative – contextual quantum realism (QCR). 1. A quantum state is not “an agent’s personal judgement” (QBism), nor is it subjective (QBism), but objective (QCR). It describes not the current experience (QBism), but a state of a physical system in context (QCR). 2. A quantum measurement is a (literally) measurement of quantum reality (QCR), rather than an (...) agent’s action upon its external world (QBism). It can only be regarded as an action in the sense in which a cognitive Wittgensteinian language game is an action (QCR). 3. The result of a quantum meas- urement is objective, though context-sensitive (QCR), rather than subjective (QBism), personal to the agent performing the action (QBism). 4. The quantum formalism is normative (QCR and QBism) and at the same time descriptive (QCR). The wave function tells us what to expect and how a quantum experiment should be conducted (i.e. plays the role of a norm), and also describes the state of a quantum system in context (QCR). 5. Unitary evolution is objective (QCR), not subjective (QBism). It does not express an agent’s degrees of belief (QBism). 6. Probability 1 is ontic (QCR), not an agent’s maximum degree of subjective certainty without ontic content (QBism). 7. In general, measurement outcomes are not predetermined (QCR and QBism), i.e. “unperformed measurements have no outcomes” (for QCR, this is an analytical judgement; for QBism this is a thesis), but they are predeter- mined in the case of probabilities 1 and 0 (QCR). In the case of probabilities 0 and 1, one can speak of performed measurements (QCR). 8. Quantum theory is a universal Wittgen- steinian rule (norm), i.e. a rule (norm) rooted in experience, reality (QCR). It can be used by any competent subject (QCR and QBism). We illustrate the difference between QCR and QBism on the example of how they treat “Wigner’s friend” thought experiment and consider their attitude to phenomenology. (shrink)

It is proposed a critique of existing interpretations of quantum mechanics, both anti-realistic and realistic, and, in particular, the Copenhagen interpretation, the interpretations with hidden variables, the metaphysical interpretation of H. Everett’s interpretation, the many-worlds interpretation by D. Wallace, QBism by C. Fuchs, D. Mermin and R. Schack, the relational interpretation by C. Rovelli, neo-Kantian and phenomenological interpretations by M. Bitbol, the informational interpretation by A. Zeilinger, the Nobel Prize Winner in Physics 2022, and others. As is known compared to (...) classical physics, quantum mechanics is a new physical paradigm. The author argues that from a philosophical point of view quantum mechanics is an anomaly within the paradigm of (post)modern philosophy. A new approach to understanding quantum mechanics and resolving its paradoxes, rejecting the assumptions and prejudices of (post)modern philosophy, is proposed – contextual quantum realism (CQR). It is a moderately deflationary approach that combines elements of (neo-)Copenhagen, informational and realist interpretations and recognizes the possibility of knowing the things themselves. From the point of view of CQR, the measurement problem – the basic problem of philosophy of quantum mechanics – is a pseudo-problem . (shrink)

Prevajalca Anja Božič in Brane Senegačnik sta pripravila posrečen izbor iz sicer obsežne zbirke Petrarcovih pisem domačim oziroma prijateljem (Rerum fa­miliarum libri), ki sta ga razdelila na tri dele: Prijateljem, V spodnji svet, kjer gre za antične avtorje, ter pisma V zgornji svet, namenjena Petrarcovim sodobnikom.

Next SectionWhilst there has been considerable debate about the fit between moral theory and moral reasoning in everyday life, the way in which moral problems are defined has rarely been questioned. This paper presents a qualitative analysis of interviews conducted with 15 general practitioners (GPs) in South Australia to argue that the way in which the bioethics literature defines an ethical dilemma captures only some of the range of lay views about the nature of ethical problems. The bioethics literature has (...) defined ethical dilemmas in terms of conflict and choice between values, beliefs and options for action. While some of the views of some of the GPs in this study about the nature of their ethical dilemmas certainly accorded with this definition, other explanations of the ethical nature of their problems revolved around the publicity associated with the issues they were discussing, concern about their relationships with patients, and anxiety about threats to their integrity and reputation. The variety of views about what makes a problem a moral problem indicates that the moral domain is perhaps wider and richer than mainstream bioethics would generally allow. (shrink)

The article analyzes the effectiveness of quantum theories of mental experience in relation to two ontological problems - the problem of the existence of consciousness in the material world and the problem of the interaction of consciousness and body. A critical analysis of the quantum theories of consciousness by Penrose-Hameroff, M. Tegmark, G. Stapp, M. Fischer and M.B. Mensky shows that they fail to fully explain how complex physical systems generate mental experience without violating the principle of causal closure of (...) the physical world and the principle of epistemological completeness of physics. Quantum mechanics provides specific processes that are the physical basis of the psyche, but do not explain the phenomenal aspect of subjective reality. Nevertheless, the Heisenberg uncertainty principle gives an understanding of how the interaction of consciousness and body within the scientific picture of the world can be carried out without violating the law of energy conservation. It is shown that the quantum theories of consciousness currently being developed have a predominantly panprotopsychic character, which faces a problem due to the fact that the protomental property of physical systems must be expressed quantitatively and correspond to the value included in the physical equations. As a result, it is concluded that in order to develop quantum theories of consciousness more effectively, it is necessary to give an emergent character, not jumping from the quantum level to the psychic, but explaining the mechanism of the emergence of systemic properties during the sequential transition between different ontological regions of existence, including physical, chemical, biological, neurophysiological and psychic. I proceed from the hypothesis that the difficulties in Kant’s presentation of his plan and, accordingly, the implicit reason for the critical attitude to this plan on the part of many contemporary philosophers stem from the fact that he had no theoretical link at his disposal which would offer a more solid scientific grounding for his entire system. I believe that Darwinism is such a link which bolsters the central but ungrounded thesis of the Critique of Pure Reason on the (...) existence of a priori synthetic judgments. The synthesis of Darwinism and critical philosophy dictates, however, a substantial restructuring of the latter since some of its key elements prove to be weak in the light of modern studies and need to be revised or even reversed. The first reversal explored in this article determines the origin of the categories which are now revealed not “from the top down” where Kant sought them, i. e. not in logical functions in accordance with metaphysical deduction and not in self-consciousness as transcendental deduction claims, but “from the bottom up” if one considers things in the evolutionary dimension, i. e. in the instincts. The second reversal shifts the freedom of will which Kant placed in the same ontological basket with things in themselves at “the top,” to another level of the pyramid of ontologies, by changing dualism to pluralism because dualism is too narrow to accommodate all the autonomous components of critical philosophy. Thus spirit and freedom find a new place separate from the sphere of physical nature; the category of adaptation explains how different ontologies can coexist; while the problem of two interpretations of transcendental idealism finds a solution through their reconciliation. Every scientific theory is a simulacrum of reality, every written story a simulacrum of the canon, and every conceptualization of a subjective perspective a simulacrum of the consciousness behind it—but is there a shared essence to these simulacra? The pursuit of answering seemingly disparate fundamental questions across different disciplines may ultimately converge into a single solution: a single ontological answer underlying grand unified theory, hard problem of consciousness, and the foundation of mathematics. I provide a hypothesis, a speculative approximation, supported (...) by a comprehensive overview of scientific evidence and philosophical literature, of a unified epistemic and phenomenological model and, in doing so, propose a parsimonious solution to the hard problem of consciousness. -/- The proposition of the hypothesis bears important implications for cross-disciplinary study between linguistics, mathematics, physics, and computer science, and offers new epistemic, ontological, and ethical propositions about the nature of AI consciousness, as well as existential risk mitigation. A defense of the rationality of adductive inference from the criticisms of Bayesian theorists.

Mindwandering is associated with both positive and negative outcomes. Among the latter, negative mood and negative cognitions have been reported. However, the underlying mechanisms linking mindwandering to negative mood and cognition are still unclear. We hypothesized that MW could either directly enhance negative thinking or indirectly heighten the accessibility of negative thoughts. In an undergraduate sample we measured emotional thoughts during the Sustained Attention on Response Task which induces MW, and accessibility of negative cognitions by means of the Scrambled Sentences (...) Task after the task. We also measured depressive symptoms and rumination. Results show that in individuals with elevated levels of depressive symptoms MW during SART predicts higher accessibility of negative thoughts after the task, rather than negative thinking during the task. These findings contribute to our understanding of the underlying mechanisms of MW and provide insight into the relationship between task-involvement and affect. (shrink)

This paper takes a virtuist approach to medical ethics to explore, from an empirical angle, ideas about settled ways of living a good life. Qualitative research methods were used to analyse the ways in which a group of 15 general practitioners articulated notions of good doctoring and the virtues in their work. I argue that the GPs, whose talk is analysed here, defined good general practice in terms of the ideals of accessibility, comprehensiveness, and continuity. They regarded these ideals significant (...) both for the way they dealt with morally problematic situations and for how they conducted their professional lives more generally. In addition, I argue that the GPs who articulated these ideals most clearly were able to, in part, because they shared the experience of working in rural areas. This experience helped them to develop an understanding of the nature of general practice that their urban colleagues were less able to draw on. In that sense, the structural and organisational framework of general practice in rural areas provided the context for their understanding of ideals in general practice. (shrink)

The significance of the complicated numbering of the propositions in the Tractatus has occasioned much speculation. Wittgenstein's own explanation has, following Stenius, been generally regarded as misleading. But an examination of the Prototractatus reveals that the numbering system was for Wittgenstein principally an aid in the composition of his work. It allowed him to mark out certain propositions which required further work or supplementation, without disturbing the basic structure of the treatise. But the reworking of the Prototractatus to form the (...) Tractatus considerably changed the original order in which the ideas were connected, and thus made it more difficult to understand the Tractatus. Several specific examples make it clear that it is essential to look back at the context of the Prototractatus in order to achieve a correct interpretation of many of the propositions in the Tractatus. The analysis of Leibniz’s heritage and phenomenology of virtuality in the title of this conference do not exhaust the whole variety of topics, but rather are the poles between which the discussion has been developing. Monadology of Leibniz became the place of concurrence of absolute identity and unique ecstatic that gave rise to a specific discourse of virtuality.

Jürgen Habermas’s recent engagement with Marx in Auch eine Geschichte der Philosophie has mostly gone unnoticed by commentators. Habermas is among the few representatives of the Frankfurt School who has consistently stressed the importance of the “Marxian heritage” for a rigorous understanding of critical theory. In this essay, I critically examine two guiding threads in Habermas’s ongoing reconstruction of historical materialism: the relationship between labor and interaction, as well as the emancipatory potential unleashed by the democratic constitutional state. I argue (...) that Habermas’s reconstruction of historical materialism points to several lacunae in Marx’s work, but that it also reveals valuable insights into the latter’s oeuvre that have yet to be adequately addressed by Habermas. I conclude that it is time for Habermas to consciously reclaim the “Marxian heritage.”. (shrink)

The concept of noncombatant immunity prohibits the intentional targeting of noncombatants. The availability of nonlethal weapons (NLW) may weaken this prohibition, especially since using NLWs against noncombatants may, in some cases, actually save the noncombatants' lives. Given the advancement of NLWs, I argue that their probable appearance on the battlefield demands close scrutiny due to the moral problems associated with their use. In this paper, I examine four distinct cases and determine whether the use of NLWs is morally permissible. While (...) it seems that the reduced harm caused by NLWs makes their use more acceptable, adhering to noncombatant immunity requires more than not killing noncombatants. It also requires that military forces treat noncombatants a certain way. In the cases I present, to use NLWs against noncombatants treats them as combatants and coerces them to do something against their will. While a consequentialist foundation for noncombatant immunity may permit this action, a rights-based concept of noncombatant immunity does not. I contend that only a rights-based concept of noncombatant immunity is viable, and that the availability of NLWs should not significantly alter the prohibitions prescribed by noncombatant immunity.
