Das Gendiagnostikgesetz verbietet seit 2010 die pränatale Diagnostik spätmanifestierender Erkrankungen GenDG). In seiner Begründung bezog sich der Gesetzgeber in Analogie zu internationalen Empfehlungen für den pädiatrischen Bereich vor allem auf das Recht des heranwachsenden Kindes bzw. des späteren Erwachsenen auf Nichtwissen. Mit diesem gesetzlichen Verbot hat Deutschland einen viel diskutierten Sonderweg in der Regulierung genetischer Pränataldiagnostik eingeschlagen. Seither jedoch hat sich nicht nur die Perspektive auf prädiktive Testungen im Kindesalter verändert. In zunehmendem Maße generieren auf das gesamte Genom abzielende Diagnostikangebote (...) auch andere vorgeburtlich genetische Informationen, die – in ähnlicher Weise wie diejenigen zu spätmanifestierenden Erkrankungen eine potenzielle Gefahr für das Recht auf Nichtwissen der späteren Person darstellen. Es soll daher im Rahmen dieses Beitrages überprüft werden, inwiefern das deutsche Diagnostikverbot und dessen Bezug auf das Recht auf Nichtwissen des späteren Kindes eine tragfähige Basis zur Regulierung gendiagnostischer Untersuchungen in der Pränatalmedizin insgesamt darstellt bzw. zukünftig darstellen kann.Untersucht wird der Argumentationsgang des Diagnostikverbotes im Hinblick auf spätmanifestierende Erkrankungen vor dem Hintergrund der Entwicklungen in der prädiktiven Diagnostik. Eine Analyse des normativen Begründungsrahmens zeigt, dass nach wie vor deutlicher Klärungsbedarf hinsichtlich der philosophisch-ethischen Fundierung wie auch hinsichtlich der Interpretation eines Rechts auf Nichtwissen eines Kindes im Kontext von genetischer Diagnostik besteht. Darüber hinaus müssen auch Interessen des Kindes an eventuell möglich werdender pränataler Behandlung oder Prävention von Erkrankungen in die Abwägung miteinbezogen werden.Um zukünftigen Herausforderungen genomischer Pränataldiagnostik und -therapie begegnen zu können, müsste dringend geklärt werden, inwiefern Rechte zukünftiger Personen tatsächlich in der speziellen Situation der Schwangerschaft relevant sein können und mit welchen Pflichten diese für den Gesetzgeber, aber insbesondere auch für zukünftige Eltern und Ärzte einhergehen. Der Menschenrechtsdiskurs könnte hierfür eine tragfähige Basis und hilfreiche Strategien liefern. (shrink)

Modern nursing evolved out of a war. Today’s nurses not only work in war zones but the profession as a whole needs to consider its responsibility in caring for victims of conflict and what its international duty is in preventing wars. This means that nurses must be informed of the devastation caused by conflict not only in countries where conflicts and war take place but also world-wide. Nurses’ responsibility is to prevent illness and alleviate suffering, which includes the long-term morbidity (...) caused by wars. They need to be more politically active in conflict resolution and prevention at local, community, national and international levels. The purpose of this article is to address these issues from an ethical perspective and to suggest implications for nursing education and practice. (shrink)

Cultural practices and artifacts, in their multiple and varied forms, are grounded on values, which are so deeply internalized by people that usually remain in the background, as taken-for-granted guides for interpretations and decisions in everyday life. Shaping individual moral horizons is at the core of socialization processes, through which older generations aim to disseminate their culturally established values to the new ones, making use of suggestions mainly implicit in daily experiences and interactions. Despite the strength of these processes of (...) cultural canalization, people find particular ways of positioning and interpreting social suggestions, drawing singular life trajectories and developing themselves as unique beings. This is truthful also in case of highly institutionalized settings like the military, in which people play in many forms an agentic role in their own development, being prepared to perform their professional duties in very complex and challenging activity contexts. This book is an invitation to dive deeper into human experiences lived in the military through qualitative and in-depth approaches, observing their affective qualities, the meanings they acquire and how they shape individuals' identities, fostering the development and try-out of specific ethical and moral values. The present work can contribute to research and professional practice in fields related to human development, social processes, education and people management in the military, as well as in other institutional contexts, especially by highlighting the affective, meaningful and moral-ethical dimensions of cultural experiences. This article traces the trajectory of Heidegger’s thinking about technology over the course of what is considered to be his early, middle, and late periods. Over the course of the years, Heidegger’s concerns moved from somewhat conventional concerns over the consumerism technology entails, and the damage it causes to the environment, to the more complex position that technicity distorts human nature with an accompanying loss of meaning. The real danger, he said, is not the destruction of nature or culture, nor (...) selfindulgent consumerism, but a new totalizing style of practices that would restrict our openness to people and things by driving out all other styles of practice that enable us to be receptive to realty. We discuss the no-go theorem of Frauchiger and Renner based on an "extended Wigner's friend" thought experiment which is supposed to show that any single-world interpretation of quantum mechanics leads to inconsistent predictions if it is applicable on all scales. We show that no such inconsistency occurs if one considers a complete description of the physical situation. We then discuss implications of the thought experiment that have not been clearly addressed in the original paper, including a tension between relativity and (...) nonlocal effects predicted by quantum mechanics. Our discussion applies in particular to Bohmian mechanics. (shrink)

The question of naturalness in logic is widely discussed in today’s research literature. On the one hand, naturalness in the systems of natural deduction is intensively discussed on the basis of Aristotelian syllogistics. On the other hand, research on “natural logic” is concerned with the implicitly existing logical laws of natural language, and is therefore also interested in the naturalness of syllogistics. In both research areas, the question arises what naturalness exactly means, in logic as well as in language. We (...) show, however, that this question is not entirely new: In his Berlin Lectures of the 1820s, Arthur Schopenhauer already discussed in depths what is natural and unnatural in logic. In particular, he anticipates two criteria for the naturalness of deduction that meet current trends in research: (1) Naturalness is what corresponds to the actual practice of argumentation in everyday language or scientific proof; (2) Naturalness of deduction is particularly evident in the form of Euler-type diagrams. This volume advances discussions between critics and defenders of the force-content distinction and opens new ways of thinking about force and speech acts in relation to the unity problem. -/- The force-content dichotomy has shaped the philosophy of language and mind since the time of Frege and Russell. Isn’t it obvious that, for example, the clauses of a conditional are not asserted and must therefore be propositions and propositions the forceless contents of forceful acts? But, others have recently asked in (...) response, how can a proposition be a truth value bearer if it is not unified through the forceful act of a subject that takes a position regarding how things are? Can we not instead think of propositions as being inherently forceful, but of force as being cancelled in certain contexts? In this four part exchange, Evan Selinger starts by stating that Collins’s empirical evidence in respect of linguistic socialization and its bearing on artificial intelligence and expertise is valuable; it advances philosophical and sociological understanding of the relationship between knowledge and language. Nevertheless, he argues that Collins mischaracterizes the data under review and thereby misrepresents how knowledge is acquired and understates the extent to which expert knowers are embodied. Selinger reconstructs the case for the importance of the body in the (...) initial acquisition of language and challenges Collins to show how a disembodied entity could become fluent in any language at all.Collins responds by accepting that his approach does not demonstrate quite as much about the irrelevance of the body as he thought it did but that even though he accepts all of Selinger’s claims, ‘the body’ as needed by the philosophical approach set out by Selinger is still a vestigial thing. Collins’s main point, however, is that the philosophical view of the body—the world is divided into embodied agents and unembodied entities—distracts attention from the more interesting empirically researchable question of how the ability to become socialized diminishes, if it does, as the body become more and more minimal. The right research question is not about whether a person can extrapolate from minimal sensory input but how much extrapolation is possible under different circumstances and how it is done.Dreyfus, having seen the whole of the exchange so far, agrees that both have a point but argues that Collins’s approach still misses the well established importance of bodily engagement for full understanding.Collins responds to this by trying to set out more clearly the position associated with the idea of interactional expertise.Keywords: Interactional expertise; Phenomenology; Turing test; Embodiment; Tacit knowledge; Socialization. Social network analysis (SNA) is an increasingly popular approach that provides researchers with highly developed tools to map and analyze complexes of social relations. Although a number of network scholars have explicated the assumptions that underpin SNA, the approach has yet to be discussed in relation to established philosophies of science. This article argues that there is a tension between applied and methods-oriented SNA studies, on the one hand, and those addressing the social-theoretical nature and implications of networks, on the (...) other. The former, in many cases, exhibits positivist tendencies, whereas the latter incorporate a number of assumptions that are directly compatible with core critical realist views on the nature of social reality and knowledge. This article suggests that SNA may be detached from positivist social science and come to constitute a valuable instrument in the critical realist toolbox. (shrink)

Anyone interested in philosophical argumentation should be prepared to study philosophical debates and controversies because it is an intensely dialogical, and even contentious, genre of argumentation. There is hardly any other way to do them justice. This is the reason why the present special issue addresses philosophical argumentation within philosophical debates. Of the six articles in this special issue, one deals with a technical aspect, the diagramming of arguments, another contrasts two moments in philosophical argumentation, Antiquity and the twentieth century, (...) focusing on the use of refutation, and the remaining four analyze particular philosophical controversies. The controversies analyzed differ significantly in their characteristics (time, extension, media, audience,…). Hopefully, this varied sample will illuminate some salient aspects of philosophical argumentation, its representation and variations throughout history. We are fully aware that, given the scarcity of previous studies of philosophical debates from the perspective of argumentation theory, the following specimens of analysis must have several shortcomings. But it is a well-known adage that the hardest part is the beginning. That is what we tried to achieve here, no more, but no less either. (shrink)

The study aims to investigate visual attention and perceived attractiveness to known versus unknown products above and beyond self-report applying physiological methods. A cross-cultural exploratory approach allows for comparing results gathered in the United States and China. We collected field data on physiological parameters accompanied by behavioral data. Mobile eye-tracking was employed to capture attention by measuring gaze parameters and electrodermal activity serves as indicator for arousal at an unconscious level. A traditional scale approach measuring perceived attractiveness of known versus (...) novel products provide insights at a conscious level. US-American and Chinese consumers in our sample indeed process novel products differently. This can be observed at an unconscious and conscious level. Different gaze movements and arousal levels are observed at an unconscious level. Regarding behavioral data, the level of vertical orientation shapes the perceived attractiveness of novel products at a conscious level. The study showcases how physiological methods complement behavioral ones when investigating visual attention to products. It underlines varying conscious as well as unconscious visual attention and attractiveness ratings comparing known versus novel products, driven by cultural differences. Data from a field setting further enrich the implications derived for new product development and applied marketing. (shrink)

The Generalized Poisson Distribution (GPD) adds an extra parameter to the usual Poisson distribution. This parameter induces a loss of homogeneity in the stochastic processes modeled by the distribution. Thus, the generalized distribution becomes an useful model for counting processes where the occurrence of events is not homogeneous. This model creates the need for an inferential procedure, to test for the value of this extra parameter. The FBST (Full Bayesian Significance Test) is a Bayesian hypotheses test procedure, capable of providing (...) an evidence measure on sharp hypotheses (where the dimension of the parametric space under the null hypotheses is smaller than that of the full parametric space). The goal of this work is study the empirical properties of the FBST for testing the nullity of extra parameter of the generalized Poisson distribution. Numerical experiments show a better performance of FBST with respect to the classical likelihood ratio test, and suggest that FBST is an efficient and robust tool for this application. (shrink)

This article sets out to assess the opportunities and risks for the advancement of gender equality in the European Union offered by the establishment of the European Institute for Gender Equality. It argues that the formal aims and objectives of the Institute mirror the wider political context today ; for the same reason, however, the Institute may be hard-pressed to fulfil those functions originally envisaged by a specific but broad range of actors in the field of equal opportunities. Whether or (...) not the Institute will be able to live up to the challenge will depend in large part on its ability to link with the gender studies research community and to forge critical political alliances with other strategic feminist actors. In English Perspectives Sisson presents half a century's reflection on politics. He pursues his early concerns through decades in which he developed an unusual combination of interests. Commitment to the continuance of the English tradition is an essential part of his work as a poet, translator and critic, as well as in such book as The Spirit of British Administration with some European Comparisons and The Case of Walter Bagehot, which addressed subjects overtly political. A review of The Spirit of (...) British Administration spoke of its 'agnosticism and empiricism', describing it as a 'brilliant attack on the theoreticians'. Sisson does not write on politics from the library or classroom but from years of work in Whitehall and first-hand acquaintance with government offices in a number of European countries. The centrality of this to the debate about Europe needs no special emphasis. Early essays collected here deal with matters surprisingly relevant to present controversies. One from 1940 wryly explores 'The Argument for Federal Union'. There are essays one the operation of government machinery abroad which throw more light on the subject than current public discussions on the EEC. Sisson stresses throughout those aspects of British practice which have importance beyond the immediate battles of the day. (shrink)

The evolving nature of armed conflict, characterized by a new emphasis on crisis management and peace support, is bringing morality to the forefront of military leadership. The challenges of today's military operations place a new imperative upon Professional Military Education (PME) to maximize the quality of instruction on ethics in terms of both content and effectiveness. This volume presents the refined proceedings of two conferences of the European Forum on Military Pedagogy dealing with ethical issues of teaching and learning in (...) PME. It explores the philosophical and scientific aspects of current ethical questions, as well as the historical, psychological, and technological dimensions of education in ethics. References to Popper’s concept of three worlds occupy a central position in ontological and human ecological questions in the recent literature on theoretical geography. This article demonstrates that Popper’s ideas and concepts have not been fully understood, causing problems for integrative research. Firstly, we critically review the discussion of Popper’s concept of three worlds in geography. We criticize its popular ontological interpretation, and furthermore we point out that Popper’s evolutionary basis has been consistently neglected. Subsequently we present an interpretation of (...) Popper’s concept of three worlds which seems most plausible. We thereby identify his intentions and emphasize the evolutionary foundation of our interpretation of his theory. Finally, perspectives for human ecological research in geography on the basis of theories of evolution and emergence will be outlined. (shrink)

Using the Job Demands-Resources model literature and the life-span theory as scholarly frameworks, we examined the effects of job demands and job resources as mediators in the relationship between bundles of used HRM practices and employee outcomes. In addition, we tested for age differences in our research model. Findings confirmed the hypothesized original 2-factor structure representing maintenance and development HRM practices. Structural Equation Modeling analyses showed that the maintenance HRM bundle related directly and negatively to employee outcomes, without moderating effects (...) of age. However, job resources appeared to mediate this relationship in a positive way as it also did for the development HRM bundle. Whereas this study showed the ‘driving power’ of the actual use of HRM bundles through job resources, regardless of the employee’s age, this study also suggests a ‘dark side’ of HRM. In particular, we found that development HRM bundles may also increase job demands, which, in turn, may result in lower levels of beneficial employee outcomes. These empirical outcomes demonstrate the strength of the driving power eliciting from job resources preceded by any HRM bundle. Moreover, this effect appears to apply to employees of all ages. Our moderated-mediation model appeared robust for several control variables. Overall, this study provides an extension of the well-known Job Demands-Resources model by including maintenance and development bundles of HRM practices used by employees that have a differential effect on job demands and job resources which in turn have an impact on employee outcomes.
