Franz Rosenzweig's philosophical writings from his years of study (1906-1914) are now published for the first time. The publication of his historical and art-historical works is planned. This article explores hamartiological questions at the interface of evolutionary biology and theology. Such questions include the problem of evil, the possibility of a historical fall, and the meaning of human sinfulness in light of biology. First, I examine some of the leading accounts of animal theodicy, including John Schneider's aesthetic theodicy, Christopher Southgate's compound theodicy, and Joshua Moritz's free creatures’ defense. Second, I review several non‐lapsarian accounts of how sin originated within the human story (e.g., Robert Russell's concept of (...) entropy as the physical origin of sin). Then third, I discuss noteworthy attempts to revise the doctrine of original sin in light of evolutionary psychology. Although the quest for a post‐Darwinian doctrine of sin has prompted fascinating areas of research, I conclude that an evolutionary hamartiology remains a remarkably difficult project. (shrink)

The paper interprets Wittgenstein’s famous call to silence at the end of his Tractatus – that “whereof one cannot speak, thereof one must be silent” – as a critique of philosophy itself. Wittgenstein was concerned throughout his philosophical life with finding a way to delineate the limits of language. These limits, once we have them clearly in view, rob our attempts to put forth philosophical theories of their legitimacy. In order to give a critical assessment of this Wittgensteinian critique of (...) philosophy, the paper primarily focuses on the roots of that critique in Wittgenstein’s earliest writings – his notebooks, his 1913 “Notes on Logic,” the 1914 set of notes dictated to G. E. Moore, and the Tractatus itself. Wittgenstein’s influence by Fritz Mauthner and, mediated through Mauthner, by Kant receive special attention. The conclusion is that, far from Mauthner’s radical anti-philosophical bias, we can come to see a deep appreciation of the power, the draw, and the significance of philosophical problems in Wittgenstein’s writings. A framework for the mind-matter problem in a holistic universe which has no parts is outlined. The conceptual structure of modern quantum theory suggests to use complementary Boolean descriptions as elements for a more comprehensive non-Boolean description of a world without an a priori mind-matter distinction. Such a description in terms of a locally Boolean but globally non-Boolean structure makes allowance for the fact that Boolean descriptions play a privileged role in science. If we accept the insight that there are (...) no ultimate building blocks, the existence of holistic correlations between contextually chosen parts is a natural consequence. The main problem of a genuinely non-Boolean description is to find an appropriate partition of the universe of discourse. If we adopt the idea that all fundamental laws of physics are invariant under time translations, then we can consider a partition of the world into a tenseless and a tensed domain.In the sense of a regulative principle, the material domain is defined as the tenseless domain with its homogeneous time. The tensed domain contains the mental domain with a tensed time characterized by a privileged position, the Now. Since this partition refers to two complementary descriptions which are not given a priori we have to expect correlations between these two domains. In physics it corresponds to Newton 's separation of universal laws of nature and contingent initial conditions Both descriptions have a non-Boolean structure and can be encompassed into a single non-Boolean description. Tensed and tenseless time can be synchronized by holistic correlations. (shrink)

The recent discussions about alternative sources of human embryonic stem cells , while stirring new interest in the developmental potential of the various abnormal embryos or constructs proposed as such sources, also raise questions about the potential of the derived embryonic stem cells. The data on the developmental potential of embryonic stem cells that seem relevant for ethical considerations and aspects of patentability are discussed. Particular attention is paid to the meaning of “totipotency, omnipotency and pluripotency” as illustrated by a (...) comparison of the developmental potential of three-dimensional clusters of blastomeres , embryonic stem cells, somatic or stem cells or other somatic cells. This paper focuses on embryoid bodies and on direct cloning by tetraploid complementation. Usage and patenting of these cells cannot be considered to be ethically sound as long as totipotency and tetraploid complementability of embryonic stem cells are not excluded for the specific cell line in question. Testing this poses an ethical problem in itself and needs to be discussed in the future. (shrink)

Thus far, the philosophical study of patenting has primarily focused on sociopolitical, legal, and ethical issues, such as the moral justifiability of patenting living organisms or the nature of (intellectual) property. In addition, however, the theory and practice of patenting entails many important problems that can be fruitfully studied from the perspective of the philosophy of science and technology. The principal aim of this article is to substantiate the latter claim. For this purpose, I first provide a concise review of (...) the main features of the theory and practice of the patenting of scientific and technological inventions. Second, I discuss several philosophical issues implied by these features and explore the possible contributions of the philosophy of science and technology to the clarification, or resolution, of these issues. The seven features discussed are: patents as commercial monopolies on scientific and technological inventions, the contrast between natural and non-natural subject matter, the distinction between inventions and discoveries, the reproducibility of inventions, the question of the sameness of two inventions, the distinction between the invented and the protected object, and the contrast between material objects versus concepts and theories. The article concludes with some observations on the problems and prospects of the philosophical study of the theory and practice of patenting scientific and technological inventions. (shrink)

This article investigates the scope and effects of enhanced consumer choice in health insurance that is presented as a cornerstone of the new health insurance legislation in the Netherlands that will come into effect in 2006. The choice for choice marks the current libertarian trend in Dutch health care policymaking. One of our conclusions is that the scope of enhanced choice should not be overstated due to many legal and non-legal restrictions to it. The consumer choice advocates have great expectations (...) of the impact of enhanced choice. A critical analysis of its impact demonstrates that these expectations may not become true and that enhanced consumer choice should not be perceived as the ‘magic bullet’ for many problems in health care. This volume answers the question: Why do we believe what we believe? It examines current research on the concept of beliefs, and the development in our understanding of the process of believing. It takes into account empirical findings in the field of neuroscience regarding the processes that underlie beliefs, and discusses the notion that beyond the interactive exploratory analysis of sensory information from the complex outside world, humans engage in an evaluative analysis by which they attribute personal meaning and relevance (...) to the probabilistic representations of objects and events. Beliefs exert a strong influence on behaviour, decision-making, and identifying and solving problems. Despite their importance, beliefs have until recently not been at the centre of scientific interest. In fact, "belief" is an ill-defined phenomenon. From a transdisciplinary perspective the actual approaches to understanding belief seem incompatible as they attempt to highlight such different topics as "belief - religion", "belief - spirituality", "belief - faith", "belief - knowledge", "belief - attitude", "belief - disbelief", "belief - illusion", and "believing - brain function". This situation contradicts the idea that belief is close to pathological phenomena and that it should be eliminated from scientific discussions. Rather, believing is fundamental for understanding the many problems of every-day life. In fact, the book shows that beliefs are relevant for politics, international affairs, economy, law, or religions also in modern societies. This book presents the increasing scientific interest in beliefs and believing, and reflects the change in focus from the content aspect of belief towards the fluid nature of believing. (shrink)
