My paper will explore boundaries and rights, the public and the private, as to the enforcement of religious legal rules in societies self-consciously founded on Islamic law. I employ as my case-study legal and social controversies aroused by the Saudi Hay’at al-amr bi-al-ma`ruf wa-al-nahy `an al-munkar, the government agency charged with “ordering the good and forbidding the evil.” The paper will first lay out some of the laws fixing the powers of the Hay’at, including various statutes issued by (...) the king but, of equal or greater importance, the received medieval fiqh rules governing the muhtasib . Focus shall be on an issue much debated in the classical law and also a long-time bone of contention in Saudi society, namely the legal limits on the powers of the Hay’at to investigate and punish immoral acts occurring in private. Limits on such powers stem from two sources, both in the law and in social understandings of that law. One source, the more prominent in public debate, concerns revelatory and fiqh and related social norms against spying or prying into people’s behavior and against undue attempts to expose people’s sins. Notably, however, this restriction affects only enforcement. The pervasiveness of laws considered to arise from the relationship of the individual to God still stands. A solitary immoral act performed in privacy can still be a sin and a crime, and punishable if it is somehow legitimately known and proved . The second source of restrictions is more far-reaching, going beyond issues of investigation and proof. As held by the majority of scholars, the Hay’at may not compel or forbid any actions for which the religious-legal ruling is under classical law a matter of legitimate difference of scholarly opinion; or inversely, the Hay’at may compel or forbid only those actions as to which there is a divine command known to a certainty either from a revealed text or from the consensus of scholars. A commonly noted abuse by the Hay’at in Saudi Arabia has been to attempt to enforce rules lacking requisite certainty, such as requiring veiling of the face. Rules known to a certainty have a pervasive role in Islamic constitutional theory. In principle, such rules must be enforced, regardless of whether they concern matters other societies may consider individual or private, such as changing one’s religion. Rules lacking that high degree of certainty cannot – without separate justification on grounds other than religious text – define sins or crimes or be enforced as general rules by the state. Though seemingly scholastic and philosophical, this restriction is potentially crucial in defining a realm of individual autonomy in religious matters and shaping the boundary between public and private in societies self-consciously founded in Islamic law. This essay argues that the inherent value of Indigenous African Religions, which ensures that the belief in different gods does not eclipse the fact of common humanity might be of importance to contemporary Africa plagued by ceaseless conflicts. The IAR ideology contrasts, for example, with that of Christianity which views the Christian God as the one true God and regards those who worship a different God as pagans and gentiles. It also contrasts with the ideology of Islam, which views Allah (...) as the one true God and regards those who worship different God as infidels. The essay claims that social orientation in contemporary Africa is mostly influenced by the divisive ideologies of these two foreign religions that have come to dominate. These divisive ideologies are to a large extent, indirectly responsible for some of the violent conflicts on the continent. This divisive religious orientation bifurcates humanity into in and out-groups that are extended to the social sphere where people from different religious, ethnic and linguistic groups are treated as outsiders and are made targets for attacks like in South Africa and Nigeria today. Further, if we interpret such violent conflicts as evil and consider its source in light of the perennial problem of evil, what would be our response? Using the conversational method, the essay argues that both good and evil are part of the universe, and that if we want more good, then a change from a divisive to a complementary orientation based on the relational values of the IARs is imperative. The basic resources of the Islamic Society are generally the Qur'an, the Sunnah, the mind, science and culture. The Islamic society that emerged with the migration of Muhammad from Mecca to Medina in 622 was the beginning of a new civilization. This civilization has created a society based on the unity of belief, which goes beyond the principles of language, color, race, geography, blood ties and nationality. According to the French-born Muslim philosopher Roger Garaudy, this society had a very different, (...) universal and transcendent character than the previous ones. Because the principles of the Arab society from which the prophet came, on the contrary, were based on the principles of tribe, cognate and nationality. While this society was based on the rich-poor, male-female, slave-master and black-white distinctions, the Islamic society abolished all these distinctions and was based on the principles of equality, justice, right, law and piety. The purpose of this society, which is the dual aspect of the Islamic society, which is based on the material and spiritual aspects of the Islamic religion, which is based on happiness in both the world and the hereafter, is to order goodness and prevent evil. Thus, the civilization in question both strengthened its own social structure and contributed to world peace. Garaudy opposes those who say that the Islamic civilization is not original but a product of collection and imitation, and says that this civilization is original and noble and its source is based on revelation. It is a region where great civilizations that left their mark on history such as Sassanid, Byzantine, Mesopotamian, African, Indian and Chinese civilizations were influential in the geography where Islamic civilization spread. While Garaudy attributes the reasons for the collapse of this great civilization, which dominated three continents, to the loss of its lively and dynamic character, he also lists some other reasons. He stated that the most important of these are sectarian bigotry and Muslims' distancing from understanding the Qur'an. According to him, the Qur'an is not a book that addresses only the seventh century. He says that the Qur'an addresses every age on its own terms. For example, during the Andalusian Umayyads, Islamic civilization rose to the position of the most developed country in the world. In the 7th century, when Islam emerged, the Arabian peninsula was under the influence of the Sassanid empire, one of the two great world powers, culturally as well as economically/politically. Like the Sasanian/Zoroastrian belief system, the Arabs of the Ignorance period had a dualist cosmology in essence. In the world of the Arabs of Ignorance, who think of man as a being between "good" and "evil" forces, it is believed that evil forces such as "jinn and devils" (...) can have an effect on people, as well as Allah. In the period of ignorance, which is generally accepted to be understood through "idol worship", idols actually function as a form for the embodiment of these metaphysical powers. Therefore, idols themselves are not gods; Just like the manifestation of the human spirit in the body, they are worshiped because they enable metaphysical entities to "take on flesh and bones", that is, to occupy a place in the visible realm. However, in accordance with the dualist belief, the polytheists place idols around the Kaaba in the center of the city so that the angels can be incarnated, they also place idols in the wild and desolate places and build temples and altars for demonic forces. According to Ibn al-Kalbī, for example, the idol of al-ʻUzzā is a female devil and its altar is located in the Batn al-Nahle valley, 45 km northeast of Mecca. As a result, the main characteristic feature of the cosmology of the Age of Ignorance is the belief that evil metaphysical beings can affect human life as well as benevolent forces. What happens to human beings caught between these two metaphysical powers is also explained by the concept of "Dahr", which means time, which occurs as a result of the synthesis of the conflict between the two. Islam flatly denies the ability of a power other than Allah to have such an effect on existence in the universe. Polytheism, which Islam qualifies and condemns as "shirk", is essentially this dualism. In the Qurʾān, this is emphasized as " Take not (for worship) two gods: for He is just One Allah." (an-Naḥl, 16/51.). By making only the will of Allah valid in the universe, Islam also unifies the order in the physical world and the mind. Thus, an important step has been taken towards rational thinking in the universe where the rule of a single mind is valid. Even in the Qurʾān, it is emphasized that the Prophet was a "human" like other people, did not have any supernatural abilities, and did not know the "unseen", that is, events beyond what time or material means allowed. As a matter of fact, since the Prophet did not have any superhuman claims, the polytheists accuse him of "ordinariness" and claim that what he tells is only the "word of man". However, Islam does not stay here either, it declares the end of prophethood with Muhammad. According to this, it will not be possible for Allah to address another person after Muhammad as the carrier of a divine message that must be socially obeyed. From now on, human beings will walk the rest of the way on their own in a world where a single rational, consistent mind is valid. Of course, in this journey, the light of the Qur'an, the last revelation, and all the acquis of humanity up to that time will be benefited, but the guidance of a living prophet will no longer be in question. This situation, which is described as the "sealing of the prophethood" in the classical literature, represents a new stage for human beings in terms of the history of thought. However, all this rationalization fails when the parties to the conflict in the history of Islam after the death of the Prophet tend to justify their political positions with occultist arguments. Especially in the Umayyad period, political legitimacy is based on metaphysical claims rather than being taken from the society itself. According to classical sources, the expression "the shadow of God on earth" is used for the first time for Muʿāwiya. With the same method, it is possible to provide theological explanations for tragic events such as the events in Karbala. This situation leads to the reproduction of the dialectical relationship between good and evil forces, which were known in the Ignorance period and revealed the concept of Dahr, this time by attributing "evil" (shar) to Allah. The existence of the evils within our ken poses a threat to the rationality of central tenets of theism; the presence of overwhelming evils within our lives can threaten the viabil· ity of our religious attitudes and practices. On the other hand, religions typically offer strategies for coping with evil. They propose explanations of its origins that may aid us in understanding it, and they con· tain salvific practices that are meant to lead to redemption from sin or the cessation of suffering. So religious responses to evil are bound to be complex, and this complexity will inevitably be reflected in the treatment of evil in academic discourses. In addition, the present academic division of labor results in religion being studied in many disciplines. Each of them has its own traditions and agendas, and this often leads to a diversity of approaches that gives interdisciplinary dis· cussion of religious responses to evil something of the air of conversa· tion after Babel. The three books under review here, which represent the disciplines of philosophy, religious studies, and theology, illustrate nicely both the complexity and the diversity. Jane Mary Trau, who is Associate Professor of Philosophy at Barry University, has written a short essay in analytic philosophy of religion proposing a solution to the logical problem of evil. The problem arises from the fact that there are arguments purporting to show that the proposition that God is omniscient, omnipotent, and omnibenevolent is inconsistent with the proposition that evil exists. One way to solve the problem would be to find a possibly true proposition such that it is consistent with the proposition ·that God is omniscient, omnipotent, and omnibenevolent and together with that proposition entails that evil exists. Alvin Plantinga's celebrated free-will defense offers a solution of this sort. Trau's alternative solution is a version of the familiar greater-goods defense. Trau's main claim is that it is possible that evil has positive value. An evil has positive value if it is logically necessary for some greater 525 526 BOOK REVIEWS good, and it certainly seems to he possible that some evils have positive value. Thus, for example, suppose God creates nothing other than two angels, A and B. Nothing interrupts the felicity of either hut a mild pang of sorrow felt by A, to which B responds with compassion. A's sorrow is logically necessary for the greater good of B's compassionate response to A's sorrow. Hence A's sorrow is an evil that has positive value. Moreover, the proposition that evils with positive value exist is consistent with the proposition that God is omniscient, omnipotent, and omnihenevolent. So the existence of evil is consistent with the existence of an omniscient, omnipotent, and omnihenevolent deity. In other words, Trau's version of the greater-goods defense does seem to provide a solution to the logical problem of evil. But that is not to say that all the evils there actually are or even all those we know about do or could have positive value. Thus it does not follow, without further assumptions, that the existence of all the evils there actually are is consistent with the existence of an omniscient, omnipotent, and omnihenevolent deity. In a discussion of natural evil near the end of her hook, Trau acknowledges the need for such additional assumptions. She says: "Four assumptions underlie the claim that natural evils have positive value: (1) The material universe has positive value. (2) The material universe must function in a way that requires the occurrence of natural evils as secondary effects. (3) The material universe is either the best or the only possible universe. The subject of human acts has been one of the controversial topics of kalām since the first centuries of Islam. A lot of concerning human acts –from divine attributes to divine decree and destiny, from the issue of good and evil (ḥusn and Qubḥ) to the boundaries of the reasoning, from the accountability with impossible things to the rational accountability, from the topics of substance and accident to causality- has been said and written in the history of Islamic (...) tought. In this study, the subject was discussed especially within the scope of man’s on his own action in connection with the divine knowledge, will, and power. On this issue, the Muʻtazila argues that human beings are independent in doing their good and evil acts with the power that God has given to them because of His will and wisdom, and that the evil actions that they have done cannot be associated with the divine attributes in any way. Sunnī theologians assert that God creates human actions through man’s orginated power. They also arguethat evil acts are not independent of the Divine Creation although human beings are the reason of evil in terms of thier acquisition (kasb) and will (irāda). Nevertheless, the representetives of the Sunnī kalām (Asharites and Māturīdis) differ on their account of acquisition, which expresses man’s agency in his acts. In contrary to the Mātūrīdiya, the Ashʻariya holds that acquisition is a created act of God. On the other hand, the Mashshai (peripatetic) philosophers, who are opposed by teologians on some issues such as divine attributes and the working of activity/acts in nature, consider human’s actions part of the eternal chain of cause-effect that emanate (al fayḍ) from the First Principle. However, according to them, every link of this chain is formed by the divine providence (al-ināyah). They also attribute morally evil acts not to the First Principle which is complete (tām) and full good (hayr), but to agents in the cause-effect chain. In summary, according to both teologians and philosophers, the ultimate source of human acts is the divine will and power. The acts that are morally or religiously evil, are not independent of man’s will. Thus, human beings are accountable for their actions. Philosophers and teologians, who agree on these issues, have explained their views and build their opinions on different concepts and principles. They have shown a very different attitude in their discourse and secondary principles, while all of them basically try to express the same idea. This difference has revealed within the frame of the following questions: Is man’s accountability for his actions because of his created power or will? Can evil actions, which are willed by human beings and therefore created by God, attributed to Him? Does the fact that the world emanates from God, the First Principle, due to His knowledge and essence, necessitate Him to be a willless and ineffective agent, and therefore to be a cause cause that has no effect on man's actions?Although teologians and philosophers have put forward different views in the context of the answers to these questions, they agree on the issues we have mentioned above. As this study shows, there is actually a common purpose in this subject, man’s actions, which causes deep divisions between theologians and philosophers in Islamic history. Primary sources of the study are the basic texts of the schools mentioned above. Additionally, the study were limited to the subject the effect of human on acts. It consists of two parts: the main part and the conclusion part. In the main section, the approaches of schools were examined from two aspects, in in terms of divine attribute and human effectiveness, and in the conclusion section, the common purposes behind the discussions were determined. The problem of evil is the problem of reconciling the world's afflictions with the fundamental attributes and justice of God. Throughout their lives people encounter painful events originating from nature and other individuals. Furthermore, it is believed that God created everything, particularly in divine religions. Scholars and thinkers have debated for centuries why an omniscient, omnipotent, just, and compassionate God would create evil. The problem of evil is sometimes employed by atheists as evidence against religion, and at (...) times as philosophical proof for the absence of God. Nowadays, it exerts a profound impact on people's beliefs within social media platforms. This article aims to address doubts and objections surrounding the problem of evil. Numerous studies have been conducted on this current issue. The subject, which is basically examined as natural and moral evil in the philosophy of religion, has been examined under the titles such as justice and cruelty, goodness and evil, will and power in classical theology. In this study, the subject is examined in terms of the relationship between the subject of evil and its object, and attention is drawn to the role of man in the formation of evil. In this context, a general overview of the problem of evil is presented in the introduction. The second section delves into how the problem of evil is approached in philosophical and theological traditions, specifically examining the viewpoints of classical kalam schools. In the later parts of the study, the subject has been tried to be reinterpreted under different titles. Within this framework, it is suggested that some doubts and questions about the problem of evil arise from a lack of understanding of religion, while others stem from interpretations perceived as religious within the tradition. To propose a solution to the problem, the concept of God, known for its power and authority in classical times, should be reevaluated. In the context of Islam, God should be considered as an entity possessing complete knowledge, absolute will and power, and creating the universe for goodness, possesses justice and mercy and bestows numerous blessings upon humanity. This perspective finds ample support in the verses of the Qur'an. The problem of evil sometimes emerges from misconceiving the relationship between God and nature as equivalent to a God-human relationship. However, God designed the universe's order to support the emergence of life in nature and make it conducive to the lives of all living beings, particularly humans. Natural phenomena and events unfold by the laws set by Allah. Evils such as diseases, fires, earthquakes, floods, storms, volcanic eruptions, rain, and lightning are not events directly orchestrated by God to harm humans. The harm they cause is primarily a result of humans' negative interactions with nature. Precautions can mitigate these harms. Yet, humans who pollute air, water, and forests and build poorly located structures hastily attribute the resulting evils to God. A careful examination of the numerous blessings in nature underscores that the universe was created by God as a benevolent order. God created humanity to undergo tests within such a world, aiming for human happiness in both this world and the hereafter. Thus, the entirety of God's will be goodness. Evil, conversely, arises from humanity's exercise of free will and the potential to commit malevolent acts. Consequently, evil stems from human interactions with nature and fellow beings. Destiny is another frequently misconstrued aspect. It refers to the natural and moral laws established by Almighty Allah to govern the order of nature and human existence. Destiny presents a realm of possibilities and does not coerce anyone's actions. To address the problem of evil, the portrayal of God, whose sole intent is good, must be reconstructed. Additionally, concepts like testing, fate, death, and sustenance need to be reinterpreted in alignment with this conception. Furthermore, methods that facilitate the acquisition of accurate religious information through social media should be developed to suit contemporary requirements. (shrink)

pThis article seeks to demonstrate how a dialogue between literary theorist and psychoanalyst François Flahault and Kyoto School philosopher Nishida Kitarō can be mutually beneficial in the service of building an account of good and evil that contributes to discourses in ethics. Although Flahault and Nishida share a similar commitment to disrupt the dichotomy between good and evil in the effort to liberate subjectivity, they diverge in terms of how their accounts relate subjectivity to the processes (...) of social history. As this article will discuss, the significance of their divergence, however, elucidates the strengths and limits of their approaches to the victim-victimizer duality that is implied within the problem of good and evil. Such a divergence also points to a potential space of synthesis and mutual enrichment as well: namely, on the side of championing Nishida’s contradictory logic and Flahault’s emphasis on the contextual demands and problems of social history. That is to say, within the dialogical encounter between Flahault and Nishida, as the present article suggests, is the potentiality to develop a universal conception of the common good that is contradictorily linked to the subjective interior where such provides a critical resource for a deeper engagement with the victim-victimizer duality./p. Talk about evil resonates in ways that are culturally inherited. Historical and religious dimensions of “evil” often seem to be front and center. Nevertheless, we argue that it would be too quick to dismiss the study of evil within secular ethics. We defend an outlook that is inspired by ancient ethics—also called virtue ethics—which accepts the so-called Guise of the Good account of motivation. For an agent to be motivated to perform an action, something about the (...) action must look good to her. We argue that evil actions do not constitute exceptions to the Guise of the Good. To preserve this framework, we entertain a privative account of evil, according to which evil is the absence of the good, and yet appears in a positive light to the agent who performs an evil action. We reject the view that evil is quantitatively extreme badness. An account of evil should permit that some instances of evil are from a third person perspective not extremely bad. On this picture, evil is agent-relative; something can be evil relative to one person without being evil relative to another person. Accordingly, several qualities—rather than only one distinctive quality—can make an action evil. (shrink)

This paper develops a critical account of evil. By referring to Kant’s moral philosophy, I argue that evil actions have reasons and cannot be explained in terms of a lack of reason. However, these reasons of evil are not obvious but rather forms of rational self-deception. I therefore argue that the phenomenon of evil is complex and involves three dimensions: activity, reasons, and deception.

Recent developments in Europe and the United States (US) attest to an increasing fascination with and nostalgia for the strong leaders of the past – especially those that emerged in the aftermath of the creation of nation states and during the period between the First World War and the end of the Cold War era. Considerations of the “strongman syndrome” have a long lineage in premodern European and Islamic political thought. The famous Italian humanist Leonardo Bruni (ca. 1370–1444), for example, (...) provides in his History of the Florentine People a narrative of the events that led to the ascension, ten-month rule and downfall of Walter VI of Brienne in 1342 in Florence. Writing one hundred years earlier, the historian and political writer Żiyā' al-Dīn Baranī (ca. 1285–1357) in his History of Fīrūz Shāh analyzes the failed leadership of the sultan of Delhi, Muḥammad b. Tughluq (r. 1324–1351). This article presents an exploration of specific variants of autocratic leadership in Renaissance Florence and the Delhi Sultanate – as recorded in Bruni’s and Baranī’s writings, respectively – which demonstrates that both authors seek to offer reflections on the emergence and gradual degeneration of strongman rule that are embedded in a broader discussion of the didactic value of the study of history and its relevance to good government. Both Bruni and Baranī highlight the transience of political authority and the dangers that can arise when a leader is out of touch with the overall social climate, alienates his constituency and operates without popular consent. A detailed examination of premodern modes of envisioning strongman rule can yield fresh insights into the circumstances that incubate the strongman syndrome and the ascent of strong leaders that are still timely today.
