Diotima's Children is a re-examination of the rationalist tradition of aesthetics which prevailed in Germany in the late seventeenth and eighteenth century.

Few thinkers are more controversial in the history of philosophy than Hegel. He has been dismissed as a charlatan and obscurantist, but also praised as one of the greatest thinkers in modern philosophy. No one interested in philosophy can afford to ignore him. This volume considers all the major aspects of Hegel's work: epistemology, logic, ethics, political philosophy, aesthetics, philosophy of history, philosophy of religion. Norms are widely regarded as kinds of templates of performance, resident in agents. As such they are thought to determine unilaterally what kinds of thought or action accords with them. Under philosophical elaboration this view has led to multiple perplexities: among them the question of how there can be evaluation, justification, and rectification of such unilaterally determining entities. Sometimes one can appeal to other, supervening norms; but the need to terminate the regressive procedure typically leads to appeals to dubious "foundations," (...) to conventions, or to sheer prejudice. In a feat of surpassing acuity Wittgenstein exposed this view of norms to be inadequate in the apparently paradigm contexts to which traditionally it seemed best suited, these being those of mathematical rules and principles. An alternative general view of norms is one with important congruences with the view taken by the Critical-Pragmatic philosophy concerning the constitutive role played by norms in creating the texture of human life and thought. This view is that norms are intrinsically socio-psychological entities that interlock with each other and are rooted deeply in the practices of individuals and their communities. Embedded in these practices, norms are in principle open-textured: open to further definition and revision when serious anomalies in their extant forms are encountered. This article explores certain features of the alternative view, concentrating upon the illumination it sheds and the guidance it provides in the conduct of the fundamental philosophical activities of assessment, criticism, and revision of broad and deep personal and communal norms. Normen werden üblicherweise verstanden als eine Art Handlungsschablonen im Innern des jeweils Agierenden. Als solche wird von ihnen angenommen, daß sie einseitig festlegen, welche Arten von Gedanken oder Handlungen mit ihnen übereinstimmen. Bei philosophischer Überprüfung führt diese Sichtweise zu vielfältigen Schwierigkeiten: unter ihnen die Frage, wie solche einseitig bestimmenden Wesenheiten bewertet, gerechtfertigt und berichtigt werden können. Manchmal kann man sich auf andere, übergeordnete Normen berufen; aber angesichts der Notwendigkeit, überhaupt zu einem Ende zu kommen, führt das regressive Verfahren typischerweise zu einer Berufung auf zweifelhafte "Grundsätze", auf Konventionen oder auf ein bloßes Vorurteil. In einer Meisterleistung von außerordentlicher gedanklicher Schärfe hat Wittgenstein diese Sichtweise von Normen als inadäquat gerade für den scheinbar paradigmatischen Zusammenhang entlarvt, auf den sie nach traditioneller Anschauung am besten passen soll: den von mathematischen Regeln und Prinzipien. Eine demgegenüber alternative, allgemeine Sichtweise von Normen stimmt in wesentlichen Punkten mit der Perspektive überein, die von der kritisch-pragmatischen Philosophie im Hinblick auf die konstitutive Rolle eingenommen wird, die Normen bei der Schaffung der Strukturen menschlichen Lebens und Denkens spielen. Diese Sichtweise besteht darin, daß Normen eigentlich sozialpsychologische Entitäten sind, die ineinandergreifen und tief in der Praxis von Individuen und ihren Gemeinschaften wurzeln. Eingebettet in diese Praxis sind Normen prinzipiell offen strukturiert: offen für weitere Definition und für Revision, falls man auf ernstzunehmende Anomalien ihrer bestehenden Fassung stößt. Dieser Beitrag untersucht bestimmte Aspekte jener alternativen Sichtweise. Er konzentriert sich dabei auf die von ihr bewirkte Klärung und die Leitung, die sie bietet, wenn es um die Handhabung so fundamentaler philosophischer Aufgaben wie Bewertung, Kritik und Revision von weit und tief reichenden persönlichen und gesellschaftlichen Normen geht. This book shows the vital relationship between human life and the philosophical placement of value, emphasizing the now-occurring transition from the old mechanical world view to the postmodern alternative inspired by ecology.

There is a dilemma facing mainstream environmental ethicists. One of our leading spokesmen, Holmes Rolston, III, offers a rich ethical position, but one that lacks internal connections between principles relevant to the environment and principles relevant to human society. These principles are just different; thus no higher-order guidance is available to cope with cases of conflict between them. A second major spokesman, Baird Callicott, recommends a "land ethics" that is internally coherent but sadly inadequate for addressing many distinctly human ethical (...) concerns. To escape this dilemma I advocate an alternative worldview, "Personalistic Organicism." On this view, inspired by Alfred North Whitehead, a continuum of values, pervading the universe, can undergird a unified ethics in which human persons are recognized as especially valuable without rupturing the continuities that bind humanity to the rest of the living environment. Barnard argues that Western democracy, if it is to continue to exist as a legitimate political system, must maintain the integrity of its application of performative principles. Consequently, if both social and political democracy are legitimate goals, limitations designed to curb excessive political power may also be applicable in containing excessive economic power. If someone assaults you, should they get a milder penalty if they are rich than if they are poor? We wouldn't dream of passing a law that formalized such an arrangement. But the design of our legal systems in the US, UK, and elsewhere, which permits people with sufficient money to pay for better lawyers, means that wealth often does make a difference to legal outcomes. Justice, then, depends not only on the substance of the laws we pass, but on (...) the design of the system that administers and enforces them. Philosophers and legal theorists, however, have paid relatively little attention to what justice demands of the general design and structure of the legal system. Equal Justice argues among other things that market principles should not determine access to legal resources. If, for example, a large corporation sues a small startup, either the corporation has to use a law firm of the quality that the startup can afford or--which would be preferable, given the corporation's in-house lawyers--the startup would be given a subsidy to afford a top firm. The author builds on this core idea of equal access to resources to work out how the court system and the legal profession should be structured in order to ensure a generally just legal system. I defend pornography as an important aspect of freedom of expression, which is essential for autonomy, self-development, the growth of knowledge and human flourishing. I rebut the allegations that pornography depraves and corrupts, degrades women, is harmful to children, exposes third parties to risk of offence or assault, and violates women ’s civil rights and liberties. I contend that suppressing pornography would have a range of unintended evil consequences, including loss of beneficial technology, creeping censorship, black markets, corruption and extensive (...) social costs. IT HAS OFTEN BEEN STATED that Nietzsche's predominantly aphoristic style of writing militated against the construction of any system analogous to those of Spinoza and Hegel. The statement is doubtless true. But it is essential to add that Nietzsche had no wish to construct such a system. Spinoza was convinced that the order and connection of ideas is the same as the order and connection of things; and Hegel believed that the rational is the real and the real the rational. (...) Nietzsche, however, had no such conviction or belief. Hence it would be rather misleading to say that he "failed" to construct a system comparable to those of Spinoza or Hegel. (shrink)
