A draft of a will takes us back to the fifteenth century Cyprus introducing a strange case : a nun as an owner of a slave woman of foreign origin. While attempting to reconstruct the identities and circumstances of the two women, the primary sources offer a glimpse of the late medieval eastern Mediterranean with its quickly changing boundaries, multicultural context and complex interpersonal relationships.

The relation between Kant’s conception of modalities in the Postulates of Empirical Thought and Hegel’s conception in the Logic of Essence has not been addressed in the current scholarship. I argue that there is in fact a close connection that becomes visible if the desideratum which is implied by Kant’s conceptions is understood. Thus, after an analysis of the Kantian modal postulates, the article shows that they are sufficient to characterize the necessity of Kant’s Grundsätze and, hence, a specific form (...) of synthetic propositions a priori. However, I will prove that they are insufficient to characterize Kant’s synthetic propositions a priori about transcendental philosophy. This insufficiency in the characterization of transcendental philosophy itself brings into the arena Hegel, who supplements the Kantian modalities with a self-reflexive form of transcendental modality. Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. In this work, first published in two volumes in 1890 and 1894, Erwin Rohde, the German classical scholar and friend of Nietzsche, describes the ancient Greek cult of souls and establishes the sources of the belief in the immortality of the soul, exploring its relation to life both before and after death. This belief in the survival of the soul already existed in the earliest Greek writings, but when and from where did it originate? In Volume 1 Rohde examines (...) belief in the soul as it appears in Homeric poetry and within local cults, and finds that the idea of an afterlife is already represented in different forms in the works of Hesiod and Aeschylus. He also discusses burial rites and the Eleusinian Mysteries. Psyche, reissued here in the 1898 edition, remains a standard reference work on this topic. (shrink)

_Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. In a thought-provoking article – or how she herself named it, ‘a thought experiment’ – the philosopher-medical ethicist Anna Smajdor analyzed in this journal the idea of whole-body gestational donation (WBGD) in brain-dead female patients, as an alternative means of gestation for prospective women who cannot or prefer not to become pregnant themselves. We have serious legal, economical, medical and ethical concerns about this proposal. First, consent for eight months of ICU treatment can never be assumed to be derived from (...) consent for post-mortem organ donation; these two are of an incomparable and entirely different medical and ethical order. Moreover, the brain-dead woman is very likely to be medically unfit for high-tech surrogacy and the brain-dead state poses a high risk for deficient embryo/fetal development. Second, from a scarcity perspective, occupying an ICU bed for eight months appears to be unjust. The costs for eight months of ICU treatment are far too high compared to the costs of surrogacy for a living, selected, and healthy woman. Neither insurance companies nor prospective parents will want to pay these exceptionally high costs for a dead woman if a living surrogate mother can be hired for a considerably lower amount. Third, there is an increased risk for harm of the child to be in WBGD. And finally, WBGD risks violating the brain-dead woman’s dignity and harming the interests of her loved ones. In short, there is simply no need for brain-dead women as surrogates. (shrink)

The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

In his Encyclopedia, the late Hegel makes the highest demands on truth and justification from the first paragraph onward. With this, Hegel takes up the skeptical challenge and believes that he can overcome this problem. However, it is not easy to see how Hegel tries to meet this challenge in the Science of Logic, which plays a fundamental role in Hegel’s encyclopedic project. The present article argues that the question of the justification of the claim to truth is a fruitful (...) perspective for the interpretation of the Science of Logic. For this purpose Hegel’s answer to the Agrippan Trilemma is examined, which P. Franks analyzed as a basic problem for Classical German Philosophy. One possible interpretation of Hegel sees him solving the skeptical trilemma at the beginning of the Logic. The article argues against this possibility that the Logic of the Concept contains Hegel’s actual solution. This solution consists in that the concept represents the principle of logic and that the concept itself must be presented in the form of an apagogical argument. Finally, the article gives a reason why Hegel sees an analogy to the ontological argument in this attempt of an ultimate justification. (shrink)

In 2020, M. Summa developed a promising approach to understanding the concept of illness. This approach combines a theory of organisms with Responsive Phenomenology to gain a concept of illness. Following on from this, the present article shows that the normative presuppositions can be further explicated and justified by drawing on the theoretical resources of Aristotelian naturalism as propounded by Michael Thompson. Aristotelian naturalism does provide a theoretical option to grasp the normative foundations of human life. However, this article argues (...) that Aristotelian naturalism requires another criterion besides human nature to make the concept of illness intelligible. Following John McDowell’s critique of Aristotelian naturalism, it will be shown that this criterion consists in the capacity for autonomy. From this a concept of illness is developed which describes an impairment of the self-regulated and autonomous realisation of the human form of life. (shrink)

Ancient philosophy has been a source of inspiration for contemporary philosophy in recent decades. An outstanding example is the renaissance of hylomorphism in the field of philosophy of biology. For the philosophy of mind, hylomorphism has been little discussed so far. Therefore, ancient models in the philosophy of mind are still of interest. This article argues that Plato’s Phaedo can act as a source for contemporary debates. As a starting point, Simmias’s objections to the immortality of the soul are analyzed. (...) Plato does not simply reject these objections, but introduces conditions for a hylomorphistic understanding of the soul in Socrates’ reply. These conditions are the following: (A) the mind supervenes on the body; (B) this supervenience must allow the strong emergence of the mind; (C) the mind comprises causal powers; (D) teleological explanations are a necessary ingredient of a suitable model for the mind-body problem. With these conditions, Plato already introduces central components that are present in contemporary philosophical debates, but have not yet been unified into a hylomorphistic concept in the philosophy of mind. Is reality the basis of everything or has reality itself an other basis? What makes reality – not the real things – to be active, to exist? The question of what is real seems to be an easy question, because in our daily lives we are and must be naive realists. We ourselves, the things around us, the world, the facts, all that is real. there must be several concepts of reality if we want to say that not only physical (...) or material things of everyday life are real, e. g. numbers, π, Dr. Faustus, thoughts, emotions and other things. On the other hand, given the difference of classical physics and modern physics, we see that even that form of knowledge, which seems to be most responsible for reality, natural science, cannot give the desired uniqueness in terms of what itself wants or needs to understand as real. Alternatively, when we see that nothing can be and nothing can be real without being in a world, and when we understand the world as the order of things, which I call worldI , then this leads us to the speculative answer that it is exactly the “unreal” worldI which is the reason why the everyday reality, worldI I , is real. The worldI is the basis for the reality of our empirical worldI I . The considerations presented here have nothing to do with the idealistic conception of possibility, founded in the power of the subject, nor with the existential concept of potentiality, founded in the Entwurf des Daseins. BackgroundEnd-of-life decisions remain a hotly debated issue in many European countries and the acceptance in the general population can act as an important anchor point in these discussions. Previous studies on determinants of the acceptance of end-of-life interventions in the general population have not systematically assessed whether determinants differ between withdrawal of life-prolonging treatment and euthanasia.MethodsA large, representative survey of the Austrian adult population conducted in 2014 included items on WLPT and EUT. We constructed the following categorical outcome: rejection of (...) both WLPT and EUT, approval of WLPT but rejection of EUT, and approval of both WLPT and EUT. The influence of socio-demographics, personal experiences, and religious and socio-cultural orientations on the three levels of approval were assessed via multinomial logistic regression analysis.ResultsHigher education and stronger socio-cultural liberal orientations increased the likelihood of approving both WLPT and EUT; personal experience with end-of-life care increased only the likelihood of approval of WLPT; and religiosity decreased approval of EUT only.ConclusionThis study found evidence for both shared and different determinants for the acceptance of WLPT and EUT. This is an English translation of “‘Das Problem des Stills in der bildenden Kunst’” (1915). It is Erwin Panofsky’s first published essay and provides a critique of the famous theory of pictorial style by Panofsky’s distinguished predecessor, Heinrich Wölfflin.

Objections arise to the concept of artistic intention based upon the psychology of a period. Here too we experience trends or volitions which can only be explained by precisely those artistic creations which in their own turn demand an explanation on the basis of these trends and volitions. Thus "Gothic" man or the "primitive" from whose alleged existence we wish to explain a particular artistic product is in truth the hypostatized impression which has been culled from the works of art (...) themselves. Or it is a question of intentions and evaluations which have become conscious as they find their formulation in the contemporary theory of art or in contemporary art criticism. Thus these formulations, just like the individual theoretical statements of the artists themselves, can once more only be phenomena parallel to the artistic products of the epoch; they cannot already contain their interpretation. Here again this parallel phenomenon would, in its entirety, represent an extraordinarily interesting object of humanistic investigation, but it would be incapable of defining in detail a methodologically comprehensible volition. So, too, the view of art which accompanies a period's artistic output can express the artistic volition of the period in itself but cannot put a name to it for us. This view can be of eminent significance when we are seeking a logical explanation for the perception of tendencies dominating at a given time and thus also for the judgment of artistic volition at that time, which must also be interpreted.Erwin Panofsky, the renowned art historian, was professor at the Institute for Advanced Study, Princeton University, until his death in 1968. It is customary to draw a distinction between statements unconfirmable in practice and statements unconfirmable in principle. It may be impossible, for example, to confirm the statement “The star most distant from us in the universe has recently doubled in size,” but this impossibility is not of a logical kind. We could conceive of tests which would either confirm or disconfirm the statement, even if in fact we cannot carry them out. In contrast, the statement ‘Everything has recently doubled in (...) size’ cannot be confirmed for logical reasons, or so some philosophers have claimed. If everything were to double in size, including the very measuring rods used to detect expansions, it would be logically impossible, so the argument runs, to either confirm or disconfirm the above statement. Despite medicine's achievements, medical errors and the difficulty of reproducing research prove medicine is far from perfect. This book provides a critical and historical analysis of medical reasoning that recognizes the constant need for certainty despite the enormous variety of disease, illness, symptoms, and behavior in patients. According to Erwin Montgomery, Jr., medicine depends on logic, balancing utility with certainty, and anticipating errors in judgment.
