When it has become uncertain who or what determines what actually happens, when the world oppresses us physically and emotionally and the only certainty in the future is our death, when our needs and the limits of their fulfilment have become unclear to us, then nothing helps more than reflection - reflection on our nature and its place in the world, thinking about the hierarchy of our needs, about how we can harmonise the success of our lives with reason and justice. _Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

This article aims to contribute to literature on the conceptualisation of ‘vulnerability’ and its use by neo-liberal welfare regimes to demean, stigmatize and responsibilize welfare recipients. Several conceptions of ‘vulnerability’ will be explored and utilised in the context of welfare reforms that purport to regulate social security recipients as highly risky ‘vulnerable’ subjects. However, as this article will make clear, ‘vulnerability’ is a somewhat slippery concept and one susceptible to abuse by powerful interests intent on increasing coercive surveillance, discipline and (...) disentitlement for those designated as ‘vulnerable’. Legislation enacted ostensibly to address the ‘vulnerability’ of welfare recipients can foster intensive regulation and it must be asked who benefits most from such arrangements and the rhetoric that supports them. ABSTRACT An ontological analysis of time and of serial order is offered within the framework of a comprehensive ontology wherein the category of facts plays a crucial role. It is applied to distinguish them while various ways and contexts in which both have been mixed up in past and in present philosophy are discussed. The good reasons for that mix-up and the astonishing difficulty of keeping them apart are considered. The focus is more on the ontology of order than on (...) the ontology of time. The latter is too wide a subject. It turns out that order has not really been grounded even in set theory. The ontology of serial order expounded is new. It is also needed for the adequate ontological analysis of relational facts. (shrink)

Today, there are many natural sciences, one of which is physics, but there is no science in the sense of a Theory of Nature. In our everyday life, the opinion is rightly held that there is only one nature, but whether this opinion stands up to reflection is questionable. When we apply the speculation that Aristotle developed in Metaphysics Λ to his Physics, we will see, that Aristotle has developed a Theory of Nature that consists in posing the question of (...) the being of the natural being (Frage nach dem Sein des Naturseienden). The standardinterpretation wants us to believe that Aristotle founded a substance metaphysics with a corresponding theology, and that he practised natural science. But, our hermeneutical situation could lead us to an "Aristotle today" and free us from old beliefs so that we, like Thomas Aquinas and others, could learn from a contemporary Aristotle as an immediate interlocutor. One of the learning points, for example, would be that questions are more crucial than new assertions, even if they are sophisticated, and that unassertive thinking (unbehauptendes Denken) in a topical attitude can lead us to insight into the multiplicity of worlds. This insight would have immediate consequences for our behaviour towards our co-inhabitants of our planet and towards our environment. (shrink)

Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. Edward Erwin's clear analysis addresses some of the fundamental questions on behavior therapy that remained in 1978, when this book was first published.

In this work, first published in two volumes in 1890 and 1894, Erwin Rohde, the German classical scholar and friend of Nietzsche, describes the ancient Greek cult of souls and establishes the sources of the belief in the immortality of the soul, exploring its relation to life both before and after death. This belief in the survival of the soul already existed in the earliest Greek writings, but when and from where did it originate? In Volume 1 Rohde examines (...) belief in the soul as it appears in Homeric poetry and within local cults, and finds that the idea of an afterlife is already represented in different forms in the works of Hesiod and Aeschylus. He also discusses burial rites and the Eleusinian Mysteries. Psyche, reissued here in the 1898 edition, remains a standard reference work on this topic. (shrink)

With overwhelming conviction the standard-interpretation of the Aristotelian philosophy translates the Greek ousia with the Latin substantia. There are many reasons, that this translation and equation is false, in a short overview I name six of them.

The sociography of the Belgian post-war minister is characterized by an upper middle-class or middle-class origin, a French-speaking and male preponderance and a university-education. The most frequent professional occupations are lawyer, professor and executive.The political career which led to a ministerial post, went in the first place through the legislative body and in the second place through thepolitical parties. After their ministerial career 39 % of the ministers played a promine part in the parliament; 35 %, however, prosecuted an extra-parliamentary (...) and prestigious « after-function ».The Belgian ministerial career pattern bears some resemblances to the Dutch, German and French career pattern, but also many differences. The most outstanding difference is the importance of the bureaucratic component in the structure of the ministerial elite in those three countries, where in Belgium this is not very important. It is customary to draw a distinction between statements unconfirmable in practice and statements unconfirmable in principle. It may be impossible, for example, to confirm the statement “The star most distant from us in the universe has recently doubled in size,” but this impossibility is not of a logical kind. We could conceive of tests which would either confirm or disconfirm the statement, even if in fact we cannot carry them out. In contrast, the statement ‘Everything has recently doubled in (...) size’ cannot be confirmed for logical reasons, or so some philosophers have claimed. If everything were to double in size, including the very measuring rods used to detect expansions, it would be logically impossible, so the argument runs, to either confirm or disconfirm the above statement. BackgroundEnd-of-life decisions remain a hotly debated issue in many European countries and the acceptance in the general population can act as an important anchor point in these discussions. Previous studies on determinants of the acceptance of end-of-life interventions in the general population have not systematically assessed whether determinants differ between withdrawal of life-prolonging treatment and euthanasia.MethodsA large, representative survey of the Austrian adult population conducted in 2014 included items on WLPT and EUT. We constructed the following categorical outcome: rejection of (...) both WLPT and EUT, approval of WLPT but rejection of EUT, and approval of both WLPT and EUT. The influence of socio-demographics, personal experiences, and religious and socio-cultural orientations on the three levels of approval were assessed via multinomial logistic regression analysis.ResultsHigher education and stronger socio-cultural liberal orientations increased the likelihood of approving both WLPT and EUT; personal experience with end-of-life care increased only the likelihood of approval of WLPT; and religiosity decreased approval of EUT only.ConclusionThis study found evidence for both shared and different determinants for the acceptance of WLPT and EUT.
