Controversy often follows when patents are obtained in a pioneering area of technology. Patent filing activity in the field of regenerative medicine and in relation to stem cells in particular has not escaped opprobrium, although it is instructive to compare the nature of the debates that are taking place over the patenting of stem cells in the US and Europe. In the US, debate over the early patent applications made by the Wisconsin Alumni Research Foundation has been intense2, but at (...) least it appears to have been grounded firmly in patent law principles. In Europe, the debate has skewed away from the basic patent law tenets of novelty, inventiveness and industrial utility and has entered something of a twilight zone, with the European Patent Office serving as a diffident forum for difficult moral and ethical arguments about the destruction of human embryos and the commercial exploitation of human life. Variant Creutzfeldt–Jakob disease is a fatal, transmissible, neurodegenerative disorder for which there is currently no effective treatment. vCJD arose from the zoonotic spread of bovine spongiform encephalopathy. There is now compelling evidence for human to human transmission through blood transfusions from presymptomatic carriers and experts are warning that the real epidemic may be yet to come. Imperatives exist for the development of reliable, non-invasive presymptomatic diagnostic tests. Research into such tests is well advanced. In this article the ethical implications of (...) the availability of these tests are elaborated and comparisons drawn with predictive genetic testing for Huntington’s disease and screening for HIV. Paramount to considerations is the issue of whom to test, weighing up respect for personal autonomy against obligations to benefit and protect society. A paradigm is proposed similar to that used for HIV screening but with unique features: compulsory testing of all blood/organ donors and individuals undergoing surgery or invasive procedures who have a significant risk of disease transmission. As I walk into a restaurant to meet up with a friend, I look around and see all sorts of things in my immediate environment—tables, chairs, people, colors, shapes, etc. As a result, I know of these things. But what is the nature of this knowledge? Nowadays, the standard practice among philosophers is to treat all knowledge, aside maybe from “know-how”, as propositional. But in this paper I will argue that this is a mistake. I’ll argue that some knowledge is (...) constituted, not by beliefs toward propositions, but by awareness of properties and objects. Seeing isn’t believing, but it is knowing. After further characterizing this type of knowledge, I will make the case for it. Then I will consider a variety of objections. Finally, I will indicate how our recognition of this knowledge may answer other questions, and solve other problems, in philosophy. (shrink)

I can be aware of myself, and thereby come to know things about myself, in a variety of different ways. But is there some special way in which I—and only I—can learn about myself? Can I become aware of myself by introspecting? Do I somehow show up in my own conscious experiences? David Hume and most contemporary philosophers say no. They deny that the self shows up in experience. However, in this paper I appeal to research on schizophrenia—on thought insertion, (...) in particular—to argue that Hume and his follows are wrong: The self does, in fact, show up in experience. It is widely thought that grounding is a hyperintensional phenomenon. Unfortunately, the term ‘hyperintensionality’ has been doing double-duty, picking out two distinct phenomena. This paper clears up this conceptual confusion. We call the two resulting notions hyperintensionalityGRND and hyperintensionalityTRAD. While it is clear that grounding is hyperintensionalGRND, the interesting question is whether it is hyperintensionalTRAD. We argue that given well-accepted constraints on the logical form of grounding, to wit, that grounding is irreflexive and asymmetric, grounding is hyperintensionalTRAD only if one (...) endorses a sentential operator view of grounding. We argue that proponents of the sentential operator view will need to distinguish two importantly different kinds of hyperintensionalityTRAD—weak and strong—and we offer them a way to do so. A conspicuous oversight in recent debates about the vexed problem of the value of knowledge has been the value of knowledge-how. This would not be surprising if knowledge-how were, as Gilbert Ryle [1945, 1949] famously thought, fundamentally different from knowledge-that. However, reductive intellectualists [e.g. Stanley and Williamson 2001; Brogaard 2008, 2009, 2011; Stanley 2011a, 2011b] maintain that knowledge-how just is a kind of knowledge-that. Accordingly, reductive intellectualists must predict that the value problems facing propositional knowledge will equally apply to knowledge-how. (...) We show, however, that this is not the case. Accordingly, we highlight a value-driven argument for thinking that knowledge-how and knowledge-that come apart. (shrink)

Many people believe that the mind is an epistemic refuge of sorts. The idea is that when it comes to certain core mental states, one’s being in such a state automatically puts one in a position to know that one is in that state. This idea has come under attack in recent years. One particularly influential attack comes from Timothy Williamson (2000), who argues that there is no central core of states or conditions—mental or otherwise—to which we are guaranteed epistemic (...) access. In Williamson’s words, we are cognitively homeless. In this paper I will argue that Williamson’s argument for the conclusion that we are cognitively homeless fails. Then I will show that there is a class of phenomenal states that constitutes a substantial cognitive refuge. When all is said and done, I will have both defended and shed light on our cognitive home. We recognize a paradox of power and promise in the context of legislative and organizational changes in nurse regulation which poses constraints on nursing's capacity to bring voice and influence to pressing matters of healthcare and public policy. The profession is at an important crossroads wherein leaders must be well informed in political, economic and legislative trends to harness the profession's power while also navigating forces that may put at risk its central mission to serve society. We present a critical (...) policy analysis of the impact of recent regulatory trends on what the International Council of Nurses considers nursing's three ‘pillars’ – the profession of nursing, socioeconomic welfare of nurses and nurse regulation. Themes surfacing from this analysis include regulatory discontinuity, a tightening of regulatory control, and an increasingly managerial governance culture. These themes illuminate insights and strategies required to renew and revitalize the social mandate of our profession amidst a climate of urgency in the questioning of nurse scholars with respect to the future of the profession. At this historic juncture, nurses must clearly understand the implications of legislative and organizational regulatory changes to ensure the profession contributes to full capacity in achieving health and health equity globally. The only constant in theological education is change, despite brave attempts to hold the tide back in some quarters. Yet, Western-based theological education remains the norm globally. The Faculty of Theology at the University of Pretoria exemplifies this norm despite its commitment to Africanisation. This article will consider transformation through the lens of the leadership of Prof. Johan Buitendag, who has led the transformation initiative from his own shared leadership perspective as dean since 2010. Change in the faculty will be (...) analysed through analysis of the faculty plans, with particular reference to teaching, learning and research. Consideration will be given to a more radical proposal for future transformation under the initiative of Africanisation. (shrink)

Este artículo es una aproximación al carácter político de las mafias que protegen el tráfico de drogas desde una perspectiva mencionada pero poco tratada dentro del concepto mismo de mafia: la articulación de intereses de amplios grupos sociales dentro de su oferta de protección. Tanto las mafias de la droga que gozan de dominación social como las que no tienen mayor interacción social toman decisiones dirigidas a la imposición de sus intereses. La gran diferencia está en que las decisiones de (...) las primeras tienden a involucrar la estructura social que ha sido transformada por el narcotráfico. Cualquier intento por reprimir a las mafias involucra ahora un ataque a los intereses estructurales de amplios sectores sociales. Un caso concreto servirá para ilustrar esta lectura política del narcotráfico: la guerra de Pablo Escobar contra el estado. (shrink)

Hobbes repeatedly expressed concerns about moral and political language, e.g., about the bad consequences of various uses and misuses of language. He did not simply focus on the consequences though. He also attempted to understand the problems, using the central semantic notion in his philosophy of language, signification. Hobbes, in both the Elements of Law and Leviathan, argues that a wide variety of terms – including ‘good’, ‘bad’, and the names of virtues and vices – have a double and inconstant (...) signification. This paper explores and explains that theory of Hobbes's. (In the course of the discussion, two other interpretations of Hobbes's claims are discussed: Pettit’s discussion in terms of indexicals, and Alexandra’s in terms of sense and reference.) This phenomenon is, Hobbes thinks, pervasive in our use of moral and political language. Indeed he says his analysis applies to all “names of such things as affect us, that is, which please, and displease us” (Leviathan 4.24), which seems a very broad category indeed. This inconstancy of signification has considerable potential to cause confusion and conflict. Given those practical consequences, it is of some importance for Hobbes to find a solution to this problem. The paper examines several possible Hobbesian solutions to the problem. There is, however, reason to think that these suggested solutions cannot completely solve the problem. The paper concludes, then, by arguing that double and inconstant signification would always be a danger, even in a properly constituted Hobbesian commonwealth. (shrink)

One increasingly popular view in the philosophy of perception isexternalismabout sensible qualities, according to which sensible qualities such as colors, smells, tastes, and textures are features, not of our minds, but of mind-independent, external objects in the world. The primary motivation for this view is that perceptual experience seems to betransparent—that is, when we attend to sensible qualities, it seems like what we are attending to are features of external objects, not our own minds. Most (if not all) externalists are (...) either naïve realists or externalist representationalists. However, in this article, I argue that those who are moved by the primary motivation for externalism should instead be sense-datum theorists, for externalists’ primary motivation supports the sense-datum theory, not their actually favored views. I argue that externalists should focus on different motivations, get new ones, or become sense-datum theorists. (shrink)

Hegel is often read as defending private property and property rights on the basis of the so-called “developmental thesis,” which holds that the institution of private property is a necessary condition for individuals to develop the basic capabilities required for free choice. In this paper, I challenge the developmental thesis, and present my own interpretation of Hegel's justification of private property and theory of property rights. Reconstructing Hegel's theory requires that we read the Philosophy of Right as a whole and (...) consider the role of property within the context of the political system that Hegel sketches there, rather than merely looking at the Property subsection of the work in isolation, as works that argue for the developmental thesis tend to do. In this book encounter with Kostas Axelos' Introduction to Future Ways of Thought: On Marx and Heidegger, I introduce Axelos as an imaginative reader of Marx and Heidegger. His approach draws on their parallels to imagine what is possible. I argue that Axelos makes three unique contributions to the Heideggerian-Marxist project. First, Axelos’ understanding of the planetary epoch relies on a reading of Marx that is heavily influenced by Heidegger’s concept of “world”. Second, he builds on the idea of an (...) “open world” meant to combat the technological over-determination characteristic of the planetary era. Third, Axelos preserves the significance of Heidegger and Marx to outline the possibilities of a thinking that, as of yet, remain a future undertaking. I conclude with some ideas about how Axelos' thinking may be further developed. (shrink)

Many philosophers read Hegel as rejecting Kant's ethics of duty and advocating a more or less Aristotelian conception of virtue. However, in the Philosophy of Right Hegel sharply criticizes the ancient conception of virtue, or “virtue proper,” in his terms, and distinguishes it from a more modern concept of virtue, which he calls “rectitude.” In this paper I argue that interpretations that overlook or downplay the significance of the distinction between rectitude and virtue proper are wrong, and I also put (...) forward my own positive interpretation of Hegel's views on virtue. I am mainly concerned with defending two sets of claims: (1) Rectitude is fundamentally different from Aristotelian and other ancient conceptions of virtue. (2) Hegel believes that in modern society acting with rectitude is, in all normal circumstances, superior to attempting to use virtue proper to try to figure out what one should do. I also argue that the conception of virtue I attribute to Hegel has some distinct advantages over Aristotelian conceptions of virtue. (shrink)

In this essay, I argue that it is morally wrong for police to lie to suspects in interrogations and that it should be legally prohibited. I base my argument on broadly Kantian considerations about respect for autonomy: Respect for rational agency forbids lying to suspects and there is no plausible and compelling rationale for allowing police to lie to suspects in typical cases of interrogation.
