Can quantum theory provide examples of metaphysical indeterminacy, indeterminacy that obtains in the world itself, independently of how one represents the world in language or thought? We provide a positive answer assuming just one constraint of orthodox quantum theory: the eigenstate-eigenvalue link. Our account adds a modal condition to preclude spurious indeterminacy in the presence of superselection sectors. No other extant account of metaphysical indeterminacy in quantum theory meets these demands.

The duty to protect patient welfare underpins undergraduate medical ethics and patient safety teaching. The current syllabus for patient safety emphasises the significance of organisational contribution to healthcare failures. However, the ongoing over-reliance on whistleblowing disproportionately emphasises individual contributions, alongside promoting a culture of blame and defensiveness among practitioners. Diane Vaughan’s ‘Normalisation of Deviance’ provides a counterpoise to such individualism, describing how signals of potential danger are collectively misinterpreted and incorporated into the accepted margins of safe operation. NoD is an (...) insidious process that often goes unnoticed, thus minimising the efficacy of whistleblowing as a defence against inevitable disaster. In this paper, we illustrate what can be learnt by greater attention to the collective, organisational contributions to healthcare failings by applying NoD to The Morecambe Bay Investigation. By focusing on a cluster of five ‘serious untoward incidents’ occurring in 2008, we describe a cycle of NoD affecting trust handling of events that allowed poor standards of care to persist for several years, before concluding with a poignant example of the limitations of whistleblowing, whereby the raising of concerns by a senior consultant failed to generate a response at trust board level. We suggest that greater space in medical education is needed to develop a thorough understanding of the cultural and organisational processes that underpin healthcare failures, and that medical education would benefit from integrating the teaching of medical ethics and patient safety to resolve the tension between systems approaches to safety and the individualism of whistleblowing. This essay argues that deflationism is incompatible with the phenomenon of referential indeterminacy. This puts the deflationist in the difficult position of having to deny the possibility of what otherwise seems like a manifest and theoretically important phenomenon. Section 1 provides background on deflationism. Section 2 considers an intuitive argument by Stephen Leeds to the effect that deflationism precludes RI; the essay argues that this argument does not succeed. The rest of the essay presents its own, distinct argument for the (...) incompatibility of deflationism and RI. Section 3 argues that direct RI—RI that is not simply a derivative of some other, nonreferential instance of indeterminacy—is strictly incompatible with deflationism. Section 4 considers a couple of different ways the deflationist might try to achieve indirect RI—via indeterminate identity and indeterminate synonymy—and argues that each is unsatisfactory. Discussions of “indeterminacy” customarily distinguish two putative types: semantic indeterminacy (SI)—indeterminacy that’s somehow the product of the semantics of our words/concepts—and metaphysical indeterminacy (MI)—indeterminacy that exists as a mind/language-independent feature of reality itself. A popular and influential thought among philosophers is that all indeterminacy must be SI. In this paper we challenge this thought. Our challenge is guided by the question: What, exactly, does it take for a case of indeterminacy to count as SI? We argue that the only satisfactory (...) answer to this question must take SI to be grounded in a more basic type of MI. We conclude that SI cannot be made sense of without implicating MI. The current literature on indeterminacy centers around two projects. One concerns the logic of indeterminacy; the other concerns its nature or source. The aim of this paper is to introduce, motivate and go some way toward addressing a new, third project: that of providing what I call a minimal characterization of indeterminacy. An MC, to a first approximation, is a relatively pre-theoretical characterization of indeterminacy that is neutral between the various substantive theories of the nature and logic of indeterminacy. An (...) MC thus captures a generic sense of indeterminacy that, at least in principle, is recognized by all parties to the debate over the phenomenon’s underlying nature and logic. I begin by introducing the concept of an MC and outlining some of the main theoretical virtues of providing an MC. I then establish some desiderata on a suitable MC, and use these desiderata to rule out various initially attractive proposals. In the final part of the paper I sketch the beginnings of my own MC and defend it against objections. (shrink)

Softlifting, or the illegal duplication of copyrighted software by individuals for personal use, is a serious and costly problem for software developers and distributors. Understanding the factors that determine attitude toward softlifting is important in order to ascertain what motivates individuals to engage in the behavior. We examine a number of factors, including personal moral obligation (PMO), perceived usefulness, and awareness of the laws and regulations governing software acquisition and use, along with facets of personal self-identity that may play a (...) role in the development of attitudes and therefore intentions regarding this behavior. These factors are examined across multiple settings expected to be pertinent to our survey respondents: home, work and school. Personal moral obligation and perceived usefulness are significant predictors of attitude across all settings. Past behavior is a significant predictor of intention across all settings, and a significant predictor of attitude in the home setting. We find evidence that awareness of the law causes a less favorable evaluation of softlifting in the school setting only, but has little effect in the home and work settings. As in previous studies, attitude is a significant predictor of intent. We do not find indications that one’s personal self-identity influences one’s attitude towards the behavior and the intention to perform it, except in the case of legal identity, where marginally significant effects are found in the work environment. This article illustrates ways in which the concepts of the norm and normativity are implicated in relations of power. Specifically, I argue that these concepts have come to function in a normalizing manner. I outline Michel Foucault’s thinking on the norm and normalization and then provide an overview of Jürgen Habermas’s thinking on the norm and normativity in order to show that Habermas’s conceptualizations of the norm and normativity are not, as he posits, necessary foundations for ethics and politics, but (...) in fact simply one philosophical approach among many. Uncritically accepting a Habermasian framework therefore produces normalizing effects and inhibits alternative and potentially emancipatory thinking about ethics and politics. Having problematized the requirement of normative foundations as it is currently articulated, I conclude by examining the emancipatory potential of a particular aspect of Foucault’s work for the practice of philosophy. Michigan is a critical agricultural state, and small family farms are a crucial component of the state’s food sector. This paper examines how the race/ethnicity of the family farm owners/operators is related to farm characteristics, financing, and impacts of the pandemic. It compares 75 farms owned/operated solely by Whites and 15 with People of Color owners/operators. The essay examines how farmers finance their farm operations and the challenges they face doing so. The article also explores how the Coronavirus-19 pandemic affected (...) farming operations, the financial viability of farms, and how farmers responded to the challenges posed by the pandemic. The study found that People of Color farm owners/operators were younger than White farm owners/operators. The People of Color farm owners/operators tended to manage smaller farms for shorter periods than White farm owners/operators. Though two-thirds of the Farmers of Color owned their farms, they were more financially vulnerable than White farm owners/operators. The farmers studied had difficulty obtaining loans to finance their farms. Farmers reported increasing requests from people for food assistance during the pandemic. Farmers responded to the pandemic by participating in government programs such as the Farm to Families Food Box Program that purchased their produce. It allowed farmers to supply emergency food assistance programs with products from their farms. The products went to families receiving food assistance from soup kitchens, food banks, and other community-based nonprofits. (shrink)

This paper problematizes the claim that Michel Foucault's work is normatively lacking and therefore possesses only limited political relevance. While Foucault does not articulate a traditional normative framework for political activity, I argue that his work nonetheless reflects certain normative commitments to, for example, practicing freedom and improving the state of the world. I elucidate these commitments by sketching out Foucault's notion of critique as a mode of existence characterized by practices of the self, arguing that such practices possess political (...) significance within the context of what Foucault refers to as a way of life, and analyzing points of intersection and departure between Kant's and Foucault's respective responses to the question `What is Enlightenment?' in order to clarify the connection Foucault makes between self-practices and freedom. Through this analysis I also show that Foucault reconceptualizes normative concepts such as obligation, freedom, autonomy and publicity in non-normalizing, politically compelling ways, and argue that his work opens onto a similar reconceptualization of the notion of political unity. I conclude with a preliminary investigation into the political efficacy of Foucault's ethos by discussing its relevance specifically for feminist politics. (shrink)

Moral choice, as a precursor to behaviour, has an important influence on the success or failure of business entities. According to Rest, 1983, Morality, Moral Behavior and Moral Development (John Wiley & Sons, New York), moral choice is prompted, amongst other things, by a motivational component. With this in mind, data obtained from a sample of four hundred financial sector operatives, employed in a rapidly developing region of China, was used to construct a relatively stable set of motivational typologies which (...) could be used to predict choice within an agency-based context. A non-egoist version of the agency theory was developed, which permitted the modelling of alternative heuristic patterns. Altruists and persons identified as bordering on the verge of being classified as psychological egoists, refused to reorganize their motives when responding to a problem that included both moral hazard and adverse selection criteria. It was also possible to identify certain personal and contextual issues which discriminated between the typologies. (shrink)

This essay makes a case for the relevance of Foucault’s critique of modern Western subjectivity for feminist efforts toward countering sexual violence against women. In his last four Collège de France courses, Foucault shows that subjectivity produces a normalizing relation of the self to itself, the effects of which extend beyond the self in equally harmful ways. As I see it, this harm is especially damaging to women who have experienced sexual violence; moreover, it inhibits effective feminist resistance to such (...) violence. Through analyzing a particular instance of feminist activism, I argue for the anti-normalizing potential of a contemporary mode of self-relation that functions in a way analogous to that fostered by the ancient practice of parrhēsia. Many of Hannah Arendt's readers argue that differences between her earlier and later work on judgment are significant enough to constitute an actual break or rupture. Of Arendt's completed works, the 'Postscriptum' to Thinking , the first volume of The Life of the Mind , and her Lectures on Kant's Political Philosophy are widely considered to be her definitive remarks on judgment. These texts are privileged for two primary reasons. First, they were written after Arendt's controversial text, Eichmann in Jerusalem (...) . It was Arendt's recognition of the role that Eichmann's inability to think played in his war crimes which motivated her to analyse more fully not only the 'mental activity' of thinking, but those of willing, and judging as well. Second, in The Life of the Mind and the Kant Lectures , Arendt treats judgment as a distinct mental activity; in her earlier work judgment is connected to both politics and thought. In this essay I argue that while Arendt does indeed reformulate her notion of judgment, she does not depoliticize it. I begin by calling into question Ronald Beiner's claim that Arendt's later work on judgment can stand in for the unwritten third volume of The Life of the Mind . I then consider two more specific claims, the first of which is that judgment is relevant only in 'rare' times of 'crisis'. I argue that a crisis as Arendt understands it is not necessarily and merely a 'rare' and short-lived phenomenon. The effects of what Arendt refers to as 'dark times' are long-term and pervasive and, moreover, the function of making judgments within such an expanded context is politically germane. Second, I problematize the idea that conceiving of judgment as a distinct mental faculty necessarily disconnects it from politics. I examine the nature of Arendt's relationship to Kant and argue that she appropriates and reconceptualizes his work in such a way that judgment, while a distinct faculty, nonetheless retains its political relevance. I conclude by suggesting that the impulse to systematize Arendt's unsystematic treatment of judgment ought to be resisted. (shrink)

Feminism and the Final Foucault is the first systematic offering of contemporary, international feminist perspectives on the later work of philosopher Michel Foucault. Rather than simply debating the merits or limitations of Foucault's later work, the essays in this collection examine women's historical self-practices, conceive of feminism as a shared ethos, and consider the political significance of this conceptualization in order to elucidate, experiment with, and put into practice the conceptual "tools" that Foucault offers for feminist ethics and politics. The (...) volume illustrates the ways in which Foucault's later thinking on ethics as "care of the self" can reintroduce a number of issues and themes that feminists jettisoned in the wake of postmodernism, including consciousness raising, feminist therapy, the subject woman, identity politics, and feminist agency. Taken as a whole, the diversity of feminist viewpoints presented provide important new insights into "the final Foucault," and thus serve as a productive intervention in current Foucault scholarship. In his final, incomplete Tractatus Politicus (1677), Spinoza’s account of human power and freedom shifts towards a new, teleological interest in the ‘highest good’ of the state in realising the freedom of its subjects. This development reflects, in part, the growing influence of Aristotle, Machiavelli, Dutch republicanism, and the Dutch post-Rampjaar context after 1672, with significant implications for his view of political power and freedom. It also reflects an expansion of his account of natural right to include independence of mind, (...) a model of autonomy that in turn shapes the infamous sui juris exclusions of his unfinished account of democracy. This article focuses specifically on the Tractatus Politicus, a hitherto under-addressed work in Spinoza’s corpus and one too often considered indistinct from his earlier Tractatus Theologico-Politicus (1670). It argues for a reconsideration of its importance to early modern political thought, particularly regarding the role of the state in realising the freedom and harmony of its subjects through reasonable laws. Understanding the origins of human social cognition is a central challenge in contemporary science. In recent decades, the idea of a ‘Theory of Mind’ (ToM) has emerged as the most popular way of explaining unique features of human social cognition. This default view has been progressively undermined by research on ‘implicit’ ToM, which suggests that relevant precursor abilities may already be present in preverbal human infants and great apes. However, this area of research suffers from conceptual difficulties and empirical limitations, (...) including explanatory circularity, over-intellectualisation, and inconsistent empirical replication. Our article breaks new ground by adapting ‘script theory’ for application to both linguistic and non-linguistic agents. It thereby provides a new theoretical framework able to resolve the aforementioned issues, generate novel predictions, and provide a plausible account of how individuals make sense of the behaviour of others. Script theory is based on the premise that pre-verbal infants and great apes are capable of basic forms of agency-detection and non-mentalistic goal understanding, allowing individuals to form event-schemata that are then used to make sense of the behaviour of others. We show how script theory circumvents fundamental problems created by ToM-based frameworks, explains patterns of inconsistent replication, and offers important novel predictions regarding how humans and other animals understand and predict the behaviour of others. This chapter begins by drawing upon Judith Butler’s work in order to analyze how gender frames women’s lives as not fully livable and, in doing so, differentially exposes women to sexual violence. It proceeds by presenting the ambivalent moral and emotional responses with which sexual violence against women is met within contemporary Western societies such as the United States as an effect of such framing. The chapter concludes by considering how the author’s own analysis is framed and to what effect, (...) and reflects upon possibilities for countering the gendered framing that promotes ignoring, minimizing, and excusing sexual violence against women. We implement a recent characterization of metaphysical indeterminacy in the context of orthodox quantum theory, developing the syntax and semantics of two propositional logics equipped with determinacy and indeterminacy operators. These logics, which extend a novel semantics for standard quantum logic that accounts for Hilbert spaces with superselection sectors, preserve different desirable features of quantum logic and logics of indeterminacy. In addition to comparing the relative advantages of the two, we also explain how each logic answers Williamson’s challenge to any (...) substantive account of determinacy: For any proposition p, what could the difference between “p” and “it’s determinate that p” ever amount to? _The Autobiography of Malcolm X_ highlights the eponymous subject’s conversion from aimless rage and criminality to a form of militant study while in prison, a conversion dedicated to understanding the societal foundations of power and racial inequality. Central to this understanding is the idea that new philosophical perspectives and ‘thought-patterns’ are necessary to reprogramme dominant or ‘brainwashed’ mindsets towards organising political resistance. In this article, I explore Malcolm X’s concepts of ‘conversion’ and ‘prison’, identifying them, not only as mere spatiotemporal (...) locations, but also as larger frames in which Malcolm conceives of domination and freedom. I identify Malcolm’s three-aspect account of domination through which radical education and mental liberation drive his project of Black nationalism. I then consider the significance of an unexpected ally invoked by Malcolm: the 17th century philosopher Benedict de Spinoza, described as a ‘Black Spanish Jew’ and presented as an oppositional figure to the western philosophical canon. While this alliance is partly rhetorical, if overlooked, both work through problems of ‘epistemic agency’ and ‘democratic civic agency’ as vital for ameliorating domination and enhancing freedom. Malcolm and Spinoza offer distinct but significant contributions to ideas of domination and freedom in terms of both an individual and a collective capacity to think and act. (shrink)

In this paper, we draw upon José Esteban Muñoz and Ytasha Womak to consider how utopian thinking through the lenses of queer futurity and Afrofuturism provides a way to dismantle the hegemonic and proleptic trappings of music education and (...) contemplate how music learners and teachers might enact emancipatory utopias relevant to their own historically lived experiences. Restrictive visitation policies produce inequities in healthcare that have meaningful consequences for patients’ health and well-being. There is a surplus of existing literature exploring the consequences of reduced visitation in the setting of pediatric patients lacking decision-making capacity, but relatively little scholarship addressing visitation restriction for less vulnerable adults possessing capacity. Here, we present the case of a patient who suffered serious complications of childbirth, during the delivery of her healthy newborn, leading to prolonged hospitalization. During her treatment course, she (...) was subsequently denied visitation with her newborn, who had been discharged from the hospital, and this had detrimental effects on her recovery. Hospital policies restricting visitation during the COVID-19 pandemic were intended to reduce the risk of disease exposure for both patients and staff, despite conflicting evidence demonstrating this benefit. In contrast, they often have negative effects on patient stress, mood, and physical recovery. The sequelae of this US-based case study argue the need for more holistic hospital visitation policies, placing a specific lens on adult patients receiving a visitation from their newborn children. This following essay explores the meaning and implications of philosophical critique and creativity within the work of Gilles Deleuze and Michel Foucault. The two philosophers’ appeals to ontology, as an important site upon which their ethico-political commitments to critique and creativity simultaneously converge and diverge, frame this exploration. The first part of the essay shows how Deleuze’s and Foucault’s respective ontologies further critique and creativity. The second part of the essay focuses on a point of divergence in the two thinkers’ (...) appeals to ontology: the relationship between philosophy and history. From a Foucauldian perspective, the ahistorical character of Deleuze’s ontology of difference threatens to undermine its transformative potential, whereas from a Deleuzian perspective, the historical character of Foucault’s ontology of the present, while it may not undermine transformation, certainly does not facilitate it. In conclusion, I argue that it is precisely from within these tensions that important, productive, and transformative aspects of Deleuze’s and Foucault’s work emerge. (shrink)

One of the most popular and enduring approaches to indeterminacy phenomena (e.g., vagueness) over the past several decades has been some form or another of supervaluationism. I argue that supervaluationism is inadequate as a model of indeterminacy: There is an entire class of examples of indeterminacy, characterized by a common “branching” structure, that cannot be modeled in the way supervaluationism proposes. I demonstrate my conclusion explicitly with respect to two specific examples—indeterminate personal identity and indeterminate reference—showing how supervaluationism can model (...) neither. Importantly, my arguments apply to both traditional “semantic” and more recent “metaphysical” versions of supervaluationism. (shrink)

Feminists have generally found Foucault's analyses of the workings of modern power and his genealogy of sexuality useful in analyzing and critiquing gender oppression. The feminist view of subjectivity as facilitating or even as being central to emancipatory ethical and political projects goes a long way toward explaining the “tension” that continues to characterize the relationship between feminism and the work of Foucault. The chapter shows that Foucault's critique of subjectivity as such facilitates his articulation of alternative ways of constituting, (...) understanding, and relating to ourselves. To be sure, Foucault's critique of subjectivity, and the politics of ourselves to which it gives rise, appear to and in many ways in fact do conflict with prevailing feminist views about how to articulate and engage in effective politics. We thank the commentators for their thoughtful engagement with our paper.1 In different ways, they make the same substantial point: our suggested interventions are not enough to solve the problems of organisational failure. On this we wholeheartedly agree. Organisational failure in healthcare is complex and multifaceted, it cannot be solved by one intervention in medical education. We did not intend to imply that our proposals alone would solve organisational failure, and this positioning misconstrues the aims of our paper. We had (...) more modest ambitions, we wanted to shift the analytical emphasis away from the individual and explore the implications raised by our analysis for our piece of the jigsaw—medical education. Having stepped away from such grand claims, the commentators make some valid points to which we would like to respond more specifically. Jesudason makes the distinction that normalisation of deviance (NoD) is well suited to understand institutional misfeasance but not malfeasance.2 We are inclined to agree; NoD can do some things but not all. Neo-Fregeanism is a family of positions in the philosophy of mathematics that combines a certain type of platonism about mathematical abstracta with a certain type of logicism about the foundations and epistemology of mathematics. This paper addresses the following question: what sort of theory of reference can/should NF be committed to? The theory of reference I propose for NF comes in two parts. First, an alethic account of referential success: the fact that a term ‘a’ succeeds in referring to something (...) depends on facts about truth. Second, a deflationary account of referential specification: given that ‘a’ refers to something, the fact that ‘a’ refers to b specifically follows from the disquotational schema for reference together with the fact that b = a. In the first section of the paper I argue that NF should be committed to the first part of this theory. This a point on which there is already agreement. The bulk of the paper is therefore devoted to arguing that NF should be committed to the second part, given that it is committed to the first part. I close the paper by indicating some significant implications and a possible problem for this theory of reference. (shrink)

The idea of there being “no fact of the matter” (NFM) features centrally in Quine’s indeterminacy theses. Yet there has been little discussion of how exactly Quine understands this idea. In this paper I identify, develop and then critically evaluate Quine’s conception of NFM. In Sects. 3–4 I consider a handful of intuitive semantic and ontological conceptions of NFM and argue that none is workable from within Quine’s philosophy. I conclude that the failure of each of these proposals is due (...) to the immanent status of truth and existence for Quine. In Sect. 5 I then present Quine’s official conception of NFM. Briefly, Quine’s idea is that there is NFM between two theories of translation iff those theories are physically equivalent. I develop this idea in detail. Finally, I raise two independent problems for this conception of NFM. In Sect. 6 I argue that Quine’s definition is too strong: given what he means by NFM, his arguments for indeterminacy—even granting all their premises and internal reasoning—simply cannot support his claim that there is NFM regarding translation; instead they establish a strictly weaker conclusion. In Sect. 7 I argue that Quine’s conception of NFM is in significant tension with his thesis of physicalism, and that he must give up one or the other. (shrink)
