O propósito deste artigo é analisar a obra de Carl Schmitt sob o prisma do pensamento conservador. Isso será realizado em três momentos: a primeira seção apresenta de forma sucinta alguns elementos caracterizadores do pensamento conservador; a segunda seção procura identificar tais elementos na obra de Carl Schmitt e, por fim, a terceira seção analisa os reflexos da vinculação de Schmitt a um determinado tipo de conservadorismo na sua concepção de democracia.

For Hobbes, the human nature is selfishness, and this is translated in individual isolation, or hostile attitude--"war of everything against all"--in effect, each one sees in himself his only purpose. In consequence, what pushes the main to join with other men in a stable and rigidly organized society as the state is, it is not the benevolence, but the reciprocal fear of the inevitable evil that constantly threaten the individual in his "natural state". This paper analyses the relationship between Rousseau’s political philosophy and the concept of democracy, while focusing on the debate about the admissibility of deliberation and discussion at the assemblies. After presenting different readings of Rousseau’s views of deliberation, we advocate from a distinction drawn between debate and discussion that the central goal of Rousseau’s political philosophy is not to avoid public deliberation, but to avoid or mitigate the influence of rhetoric in the public space. Throughout the paper, we also point (...) out a series of comparisons between Rousseau’s democratic theory and ancient and contemporary political ideas, in this case, those of philosophers such as Plato, Tocqueville, Schmitt and Kelsen. The purpose of this article is to initiate a philosophical discussion about the ethical component of professional competence in nursing from the perspective of Brazilian nurses. Specifically, this article discusses professional competence in nursing practice in the Brazilian health context, based on two different conceptual frameworks. The first framework is derived from the idealistic and traditional approach while the second views professional competence through the lens of historical and dialectical materialism theory. The philosophical analyses show that the idealistic view of (...) professional competence differs greatly from practice. What type of speech act is a norm of action, when the norm is agreed upon as the conclusion of an argumentative dialogue? My hypothesis is that, whenever a norm of action is the conclusion of an argument, it should be analyzed as the statement of a norm and thus as a verdictive speech act. If the context is appropriate, and the interlocutors are sincerely (or institutionally) committed to their argumentative exchange and its conclusion, then this verdictive motivates and institutes (...) a new one with the force of an exercitive. The aim of this paper is to explore the viability of accounting for presumptions as a subtype of verdictives, within the framework of the Austinian approach to speech acts. The available set of felicity conditions is examined and worked out, in order to try and account in particular for a main feature of presumptions, namely, their function in shifting the burden of proof. Within the Gricean framework in pragmatics, communication is understood as an inferential activity. Other approaches to the study of linguistic communication have contended that language is argumentative in some essential sense. My aim is to study the question of whether and how the practices of inferring and arguing can be taken to contribute to meaning in linguistic communication. I shall suggest a two-fold hypothesis. First, what makes of communication an inferential activity is given with its calculability, i.e. with the possibility (...) to rationally recover the assigned meaning by means of an explicit inference. Secondly, the normative positions that we recognize and assign each other with our speech acts comprise obligations and rights of a dialectical character; but this fact does not entail nor presuppose an argumentative nature in language or speech. The work that we have the honour to present here in its first Italian translation is a short essay published by Carl Schmitt in the first half of the ‘10s in the German Journal Die Rheinlande and titled Don Quixote and the public. A very brief but at the same time dense piece of literary criticism in which the future Kronjurist of the Third Reich, in those years still engaged in his legal practice, offers to the readers a juvenile (...) proof of his vastly and heterogeneous interests, trying to determine which is the proper interpretation of the renowned masterpiece of Miguel de Cervantes: Don Quixote of the Mancha. A juvenile work, therefore, in which Schmitt, as we will try to highlight in the introduction that accompanies the translation, offers an interpretation of the novel and particularly of its main character focusing on the contraposition between the level of the simple reading and that of erudite valorisation, applying a methodology similar to that he used in the coeval Law and Judgement that in some ways anticipate the critique of Romanticism that he will develop just a few years later in Political Romanticism. The aim of this article is to contribute detailed ethnographic material to broaden the scope of what we mean by reproductive technology. Technology can be defined not only by a series of laboratory techniques that are drafted into the daily management of the animal body, but also by a range of on-farm management strategies and working routines, as well as the cultural dispositions, social networks and tacit knowledge of the actors involved. RT is communicated to lay operators and disseminated amongst (...) semi-professional figures such as breed experts, herd inspectors and technical consultants. The practical contexts in which reproductive knowledge is popularized and applied provide ample scope for local negotiations, resistance and conflict. Professional knowledge about breed-improvement is personalised and appropriated by operators and plays a role in power relations and the exercise of personal charisma as well as being specific to context, in particular the nuances of pre-existing relationships of trust, friendship, kinship or hierarchy. No wonder then that many ambivalences and compromises coexist in the practice of applying ‘reproductive knowledge’ to breed selection. (shrink)

Es gibt kaum einen literaturtheoretischen Text, der über Jahrhunderte hin eine solche Autorität ausgeübt hat wie Aristoteles’ kleiner Traktat "Über die Dichtkunst". Die "Poetik" gilt seit der Renaissance als Text, der einen "neuen", der Welt zugewandeten Aristoteles zeigt, der der Dichtung die Aufgabe zugewiesen habe, die empirische Wirklichkeit selbst nachzuahmen. Dem Dichter war dadurch eine rationale Aufgabe gestellt: Er sollte die Ordnung der Welt erkennen und darstellen. Der Zweifel an der Ordnung und Schönheit der Welt und die so genannte Genieästhetik (...) führten im 18. Jahrhundert zu einem Bruch mit der "aristotelischen" Nachahmungspoetik. Die Probleme, die die Umdeutung der "Poetik" zu einer "Nachahmungspoetik" in der Frühen Neuzeit mit sich brachten, wurden in der Forschung oft zu wenig beachtet. Der Aufgabe, die wirkungsgeschichtlichen Vorgaben der modernen Aristoteles-Deutung intensiver mit zu bedenken, stellt sich der Kommentar von Arbogast Schmitt, der auch die anthropologische Verortung der Dichtung, wie sie bei Aristoteles selbst und bei den spätantiken und mittelalterlichen Kommentatoren vorgenommen wird, berücksichtigt. Er versucht auf diese Weise, die Intention der "Poetik" dem modernen Leser näher zu bringen. This book argues that philosophical pessimism can offer vital impulses for contemporary cultural studies. Pessimist thought offers ways to interrogate notions of temporality, progress and futurity. When the horizon of future expectation is increasingly shaped by the prospect of apocalypse and extinction, an exploration of pessimist thought can help to make sense of an increasingly complex and uncertain world by affirming rather than suppressing the worst. This book argues that a cultural logic of the worst is at work in a (...) substantial section of contemporary philosophical thought and cultural representations. Spectres of pessimism can be found in contemporary ecocritical thought, antinatalist philosophies, political thought, and cultural theory, as well as in literature, film, and popular music. In its unsettling of temporality, this new pessimism shares sensibilities with the field of hauntology. Both deconstruct linear narratives of time that adhere to a stable sequence of past, present and future. Mark Schmitt therefore couples pessimism and hauntology to explore the spectres of pessimism in a range of theories and narratives—from ecocriticism, antinatalism and queer theory to utopianism, from afropessimism to the fiction of Hari Kunzru and Thomas Ligotti to the films of Camille Griffin, Gaspar Noé, Denis Villeneuve and Lars von Trier. First, it attempts to tell us the personal stories of two individuals who were working at the highest level in a very abstract Weld, namely G.yH. Hardy (1877–1947) and Srinivasa Ramanujan (1887–1920) during their collaboration on pure mathematics between spring 1914 and spring 1919. Obviously the same problems would arise in trying to tell the personal story of Bertrand Russell’s supervision of Ludwig Wittgenstein in mathematical logic, which occurred at Cambridge University in the years just before the start of the Great War. It is a great challenge to try to tie personal dynamics and abstract thought into a single coherent narrative. There are implications for the philosophy of mathematics and the history and sociology of science. So, of course, we have to ask: how does author David Leavitt rise to this challenge? Wheatley had been the chair of the Committee on Social Thought at the University of Chicago; so, he knew something about such matters, as he did about many things involving humans, human settlements, and their arrangement in the world. The fathers and sons, from Arthur down to Alexander, all wrote for a living, witty, stylish prose, and sometimes poetry. They especially liked writing about each other in letters, essays, and novels, often to each other in public letters and dedications; and as a consequence Alexander’s book is rich, amusing, intimate, and a bit indiscrete. Arthur’s turn-of-the-century avoidance of emotion in sentimentality grew outmoded, but it was replaced in the family business with newer models, with more Xash and cynicism. This article presents an approach to the way in which Bolívar Echeverría, based on his reformulation of Marxist criticism, attempts to locate in the truncated configurations of Latin American modernity potentials for resisting the universal expansion of the value form. Drawing on his distinction between modernity and capitalism, as well as his interpretation of the fundamental tension between natural form and value form, the article exposes Exheverría’s historical analysis of the triumph of the realist ethos over the baroque ethos of (...) Latin American modernity. Nevertheless, the remnants of the latter constitute for Echeverría a possible counter-figure of the realistic ethos embodied by Whiteness. This is how his approach attempts to go beyond both Eurocentrism and the postmodern rejection of modernity, aiming to save the hope of a concrete universalism against the purely abstract universalism of capitalist modernity. This paper confronts the medieval Church with Foucault´s conceptualization of Christendom in his writing on governmentality. In order to do so, this paper analyzes the formation of an ecclesiastical dual rule –jurisdiccional and pastoral– from the perspective of a genealogy of western political forms. For this purpose, a critical dialogue is stablished with Foucault’s analytics of pastoral power and of the subjectivation technologies involved in it. While the transformations supported by the pontifical power gave rise to the first western juridical (...) system, the ecclesiastical institution implemented services of c ura animarum throughout Christianity. Further, this salvation economy leaned on an unprecedented legal rule that turned pastoral power into a twofold rule, both sovereign and governmental. This paper argues that such an interpretation expounds the problems of the dichotomy government/sovereignity, on which Foucault founds his analytics of pastoral power and his genealogy of governmentality. As sociedades contemporâneas se encontram diante de uma dupla relação entre o poder judiciário e a política: no âmbito normativo a imparcialidade figura como um pressuposto; no âmbito descritivo a imparcialidade não se configura. Este artigo analisa este descompasso entre os âmbitos normativo e descritivo da relação entre poder judiciário e política em três momentos: primeiramente, apresenta-se a distinção entre julgamentos políticos e julgamentos judiciais elaborada por Nadia Urbinati; em segundo lugar, a partir da obra de Jeremy Waldron, questiona-se a (...) tese da imparcialidade judicial e apresenta-se a defesa feita pelo autor de um modelo de revisão judicial em sentido fraco; em terceiro lugar, também a partir da obra de Waldron, mostra-se como a atuação política do judiciário afeta o ideal de Estado de Direito. Primeiramente, apresenta-se o diagnóstico de época elaborado por Habermas que o leva à defesa da constitucionalização do direito internacional. Em um segundo momento, apresenta-se o prognóstico, isto é, a proposta de Habermas para constitucionalização do direito internacional. Ao final, analisa-se em que medida o arcabouço institucional-democrático delineado por Habermas para uma ordem política internacional oferece respostas para os problemas por ele (...) mesmo suscitados. In the first section we briefly describe methodological assumptions of point-free geometry and topology. We also outline history of geometrical theories based on the notion of emph{region}. The second section is devoted to concise presentation of the content of the LLP special issue on point-free theories of space.

Discursive theories of justice have been questioned for putting forward high-level principles that should nevertheless play a role in practical discourses in which the justice of a claim is at stake. Here, I will critically examine and systematize the main tenets in Rawls’s and Habermas’s discursive theories, and will suggest that the principles of justice (Rawls) and universalization (Habermas) can and play the role of mandates of optimalization in real deliberations on justice.

When, if ever, do we wrong ourselves? The Self-Other Symmetric answer is: when we do to ourselves what would wrong a consenting other. The standard objection, which has gone unchallenged for decades, is that Symmetry seems to imply that we wrong ourselves in too many cases—where rights are unwaivable, or “self-consent” is lacking. I argue that Symmetry not only survives these would-be counterexamples; it explains and unifies them. The key to Symmetry is not, as critics have supposed, the bizarre claim (...) that we must literally give ourselves consent if we are to avoid wronging ourselves. Instead, it is that we authorize ourselves simply by making decisions, just as we can authorize others by making decisions jointly. (shrink)

Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. In a dissonance case, a person sincerely and with conviction asserts that P, while her overall automatic behaviour suggests that she believes that not-P. In contrast with several mainstream views, this paper defends the contradictory-belief view of some relevant dissonance cases and explores its consequences regarding Moorean propositions. The paper argues that in relevant cases, the dissonant person is justified in asserting a Moorean proposition on the grounds of her explicit view on the subject matter and the recognition of her (...) opposing beliefs. The person is irrational in being dissonant, but not in asserting a Moorean proposition. (shrink)

In The Grammar of Society, first published in 2006, Cristina Bicchieri examines social norms, such as fairness, cooperation, and reciprocity, in an effort to understand their nature and dynamics, the expectations that they generate, and how they evolve and change. Drawing on several intellectual traditions and methods, including those of social psychology, experimental economics and evolutionary game theory, Bicchieri provides an integrated account of how social norms emerge, why and when we follow them, and the situations where we are (...) most likely to focus on relevant norms. Examining the existence and survival of inefficient norms, she demonstrates how norms evolve in ways that depend upon the psychological dispositions of the individual and how such dispositions may impair social efficiency. By contrast, she also shows how certain psychological propensities may naturally lead individuals to evolve fairness norms that closely resemble those we follow in most modern societies. (shrink)

In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. In Stability and Justification in Hume’s Treatise, Louis Loeb ascribes to Hume a naturalistic account of justified belief, one on which Hume is fundamentally concerned with the question whether stable belief can be achieved. Loeb’s interpretation is systematic, richly explanatory, and powerfully argued. He makes a compelling case that stability plays a central role in Hume’s epistemology. Loeb’s case is so compelling indeed that anyone who wants to defend an alternative interpretation will now have to assimilate or deflect the massive (...) textual evidence in favor of the stability interpretation. I will argue here that, for some passages Loeb cites in favor of the stability interpretation, a veritistic interpretation explains the text at least as well as the stability interpretation does. Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Sie sind zugleich ein spannendes Zeitdokument und ein Beitrag zur Geistesgeschichte Deutschlands und Spaniens. (shrink)

This book articulates a participatory conception of deliberative democracy that takes the democratic ideal of self-government seriously. It aims to improve citizens' democratic control and vindicate the value of citizens' participation against conceptions that threaten to undermine it. The book critically analyzes deep pluralist, epistocratic, and lottocratic conceptions of democracy. Their defenders propose various institutional ''shortcuts'' to help solve problems of democratic governance such as overcoming disagreements, citizens' political ignorance, or poor-quality deliberation. However, all these shortcut proposals require citizens to (...) blindly defer to actors over whose decisions they cannot exercise control. Implementing such proposals would therefore undermine democracy. Moreover, it seems naive to assume that a community can reach better outcomes 'faster' if it bypasses the beliefs and attitudes of its citizens. Unfortunately, there are no 'shortcuts' to make a community better than its members. The only road to better outcomes is the long, participatory road that is taken when citizens forge a collective will by changing one another's hearts and minds. However difficult the process of justifying political decisions to one another may be, skipping it cannot get us any closer to the democratic ideal. Starting from this conviction, the book defends a conception of democracy ''without shortcuts''. This conception sheds new light on long-standing debates about the proper scope of public reason, the role of religion in politics, and the democratic legitimacy of judicial review. It also proposes new ways to unleash the democratic potential of institutional innovations such as deliberative minipublics. (shrink)
