There are two difficulties, however. The print is too small in the body of the text and is nearly microscopic in the footnotes and diagrams. Reading thus becomes almost painful. Margins to the left, right, top and bottom of the pages are practically nonexistent. On occasion footnote material is misplaced--for example, the comment on Strang's article as originally published elsewhere should be on p. 184, not on p. 187, of Volume One. But a greater problem is the fact that almost all the articles on metaphysics and epistemology are by linguistic analysts. Vlastos in his introductory remarks admits as much: "Volume One is heavily weighted on the 'analytical' side." He reports the statement of an un-named advocate of conceptual analysis "that these [analytic] methods now enable us to understand Plato better than he was ever understood by anyone in history--better than by any of his own contemporaries, even better than by himself!" He disclaims such euphoria but insists "there is an element of truth in it after all" insofar as analytic tools can alert a student to ambiguity and its consequences in some of Plato's sentences. Hence, "if we come across such sentences in Plato, it would be plainly true to say that we can understand them better than he did and even to add that we can, therefore, understand him better, since we can see both what he meant to say and the logical liabilities of his incautious sentences." All this is true enough, but a warning still is in order. Linguistic analysts tend to read only some of Plato's dialogues and, even within them, to concentrate on some passages only. This is understandable in view of their interests and the capacity of the analytic technique. But that selectivity might lead them to believe that the Plato thus revealed is the complete and authentic Plato, which it is not. Hence, in reading and teaching Plato one must complement language- and concept-analysis with other approaches. Vlastos himself is aware of this necessity : [[sic]] "Once we have made full allowance for what modern semantics and logic can do to make Plato more intelligible and alive for us today, we should be quick to concede that borrowings from this quarter must be used with economy and discretion, and that continuing reliance on older linguistic and historical disciplines is as essential now as it has ever been in the past if the object of our inquiries is Plato himself, instead of some mock-up more pleasing to current taste." Zeller pointed out that a succession of single worlds is grounded in the principles of the system. ‘Things perish into that from which they had their birth… according to the order of Time,’ a cycle of birth, existence, and destruction. (...) A world ends, and the living divine stuff begets a new world to take its place. On the other hand, there is much in the system to contradict the idea of coexistent worlds. Anaximander's successors, Anaximenes, Anaxagoras, and Diogenes, show that this idea is not a necessary consequence of the unlimitedness of the original world-stuff. Nothing in the appearances of Nature suggests it. Anaximander is a monistic hylozoist, whereas Democritus is a pluralist with his innumerable independent atoms producing, by similar processes, independent world-systems in different parts of an infinite void. This paper considers the justifiability of criminalising anti-social behaviour through two-step prohibitions such as the Anti-Social Behaviour Order (ASBO). The UK government has recently proposed to abolish and replace the ASBO; however, the proposed new orders would retain many of its most controversial features. The paper begins by criticising the definition of anti-social behaviour employed in both the current legislation and the new proposals. This definition is objectionable because it makes criminalisation contingent upon the irrational judgements of (putative) victims, and (...) its often modest preventive benefits come at a high cost to citizens’ liberty and autonomy. The paper then goes on to propose a new definition of anti-social behaviour that would meet these objections: that is, as a course of conduct that causes others to experience serious and justifiable anxiety about the safety of their local community. Whilst this definition identifies a serious form of wrongdoing, its precise scope is inevitably uncertain. The paper thus concludes that we have good reason to use two-step prohibitions such as the ASBO to regulate such conduct, so as to enable the use of the criminal law against it whilst minimising possible concerns of legality arising from the proposed definition’s uncertain scope. This review article examines Jeremy Horder’s proposals for reform of the law of homicide in his book Homicide and the Politics of Law Reform. It focuses on Horder’s defence of the Law Commission’s proposals for a three-tier structure of homicide offences, and the ‘moderate constructivist’ theory that he relies upon in mounting this defence. Horder’s theory, it is argued, fails to provide sound normative foundations for his preferred structure. However, a qualified defence is offered of another of Horder’s proposals: to (...) give public opinion research a role in homicide reform. This would help to give substance to the principle of fair labelling in an area of the law where this principle is frequently invoked, but is also uncertain in its implications and force. (shrink)

Aristotle is asking why the heaven revolves in one direction rather than the other. His answer is based on his earlier proof that the Universe has a top and a bottom, a right and a left. The upper region, as the place of divinity, is prior or superior to the lower; so upward motion is prior to downward motion. Right is similarly prior and superior to left. The present problem can be solved by supposing that the world has also a (...) front and a back, and hence a forward motion, which will be prior and superior to backward motion. Since Nature always follows the best course, the reason for the direction of the heaven's revolution will be that that direction is forward and therefore better. (shrink)

Both law and morality routinely distinguish between direct wrongs of causing harm oneself and indirect wrongs of contributing to another’s harmful actions. This article asks whether this distinction matters for the purposes of a theory of criminalisation. It argues that, in some respects, the distinction matters less than is often supposed: generally, the potential future actions of others have at least some relevance to what we ought to do. However, it is morally significant that criminal liability for indirect wrongdoing can (...) make our freedom to do valuable things contingent upon others’ failure to comply with their moral obligations. This raises substantial concerns of autonomy and fairness that tell against the creation of some – but by no means all – indirect crimes. (shrink)

In Seeing Things as They Are (Searle 2015), Searle developed a direct realist’s theory of perception. According to direct realism, physical objects are directly and immediately perceived. Searle claims that Berkeley’s theory of perception goes against direct realism. For Searle, Berkeley’s theory suggests that only subjective experiences (ideas) are directly and immediately perceived, not physical objects. Contrary to Searle, G. S. Pappas claims that Berkeley’s theory of perception is consistent with the view that physical objects are immediately perceivable (Pappas (...) 1982; Pappas 1987). Given the conflicting interpretations of Berkeley’s theory of perception, this paper attempts to defend Searle’s position on Berkeley’s theory of perception. It refutes Pappas’ interpretation by arguing that he is inconsistent with Berkeley’s theses of ontological phenomenalism and heterogeneity thesis. (shrink)

Define teleology as the view that requirements hold in virtue of facts about value or goodness. Teleological views are quite popular, and in fact some philosophers (e.g. Dreier, Smith) argue that all (plausible) moral theories can be understood teleologically. I argue, however, that certain well-known cases show that the teleologist must at minimum assume that there are certain facts that an agent ought to know, and that this means that requirements can't, in general, hold in virtue of facts about (...) value or goodness. I then show that even if we grant those 'ought's teleology still runs into problems. A positive justification of teleology looks like it will require an argument of this form: O(X); if X, then O(Y); therefore O(Y). But this form of argument isn't in general valid. I conclude by offering two positive suggestions for those attracted to a teleological outlook. (shrink)

Recent studies have renewed focus on Martin Buber’s “theopolitics” in contrast to “theological politics.” The present study expands this work by looking at what Buber meant by God. His approach to the Bible, informed by his view that “extended, the lines of relationship meet in the Eternal Thou,” illuminates his analysis of the five types of biblical leadership. That analysis, far from separating “religion” and “politics,” seemed to assume what might be designated a civil religion. The social order was (...) integrated with religious concerns. Underneath the socio-religious surface, however, Buber discerned universal principles of relationship. Analyzing each stage in biblical leadership as Buber presented it shows how he extended the lines of historical relationships to reveal an aspect of the Eternal Thou. (shrink)

The authors of Habits of the Heart charge that America is losing the institutions that help “to create the kind of person who could sustain a connection to a wider political community and thus ultimately support the maintenance of free institutions.” Bellah fears that “individualism may have grown cancerous – that it may be destroying those social integuments that Tocqueville saw as moderating its more destructive potentials, that it may be threatening the survival of freedom itself.” Proponents of the liberal (...) free market order should, I will argue, take seriously the concerns that motivate Bellah and company: citizens of a liberal regime cannot live by exchanges alone. Liberal constitutionalism depends upon a certain level and quality of citizen virtue. But while the need for virtue is often neglected by liberal theorists, it is far from clear that the actual workings of liberal institutions have drastically undermined virtue in the way Bellah's dire account suggests. That analysis serves, moreover, as the springboard for a radically transformist argument that seeks, not so much to elevate and shape, but to transcend and deny, the self-interestedness that the free market exercises. Having argued against Bellah's analysis and prescriptions, I shall attempt to show how the phenomena he describes are open to an interpretation that is happier from the point of view of a concern with virtue. I shall end by using Tocqueville to suggest that combining liberal capitalism with intermediate associations like voluntary groups and state and local government helps elevate and shape self-interest, promoting a citizenry capable of and insistent upon liberal self-government. This remarkable book--the fruit of almost two decades of study--traces in compelling fashion the changes in Western attitudes toward death and dying from the earliest Christian times to the present day. A truly landmark study, The Hour of Our Death reveals a pattern of gradually developing evolutionary stages in our perceptions of life in relation to death, each stage representing a virtual redefinition of human nature. Starting at the very foundations of Western culture, the eminent historian Phillipe Aries shows how, (...) from Graeco-Roman times through the first ten centuries of the Common Era, death was too common to be frightening; each life was quietly subordinated to the community, which paid its respects and then moved on. Aries identifies the first major shift in attitude with the turn of the eleventh century when a sense of individuality began to rise and with it, profound consequences: death no longer meant merely the weakening of community, but rather the destruction of self. Hence the growing fear of the afterlife, new conceptions of the Last Judgment, and the first attempts (by Masses and other rituals) to guarantee a better life in the next world. In the 1500s attention shifted from the demise of the self to that of the loved one (as family supplants community), and by the nineteenth century death comes to be viewed as simply a staging post toward reunion in the hereafter. Finally, Aries shows why death has become such an unendurable truth in our own century--how it has been nearly banished from our daily lives--and points out what may be done to "re-tame" this secret terror. The richness of Aries's source material and investigative work is breathtaking. While exploring everything from churches, religious rituals, and graveyards (with their often macabre headstones and monuments), to wills and testaments, love letters, literature, paintings, diaries, town plans, crime and sanitation reports, and grave robbing complaints, Aries ranges across Europe to Russia on the one hand and to England and America on the other. As he sorts out the tangled mysteries of our accumulated terrors and beliefs, we come to understand the history--indeed the pathology--of our intellectual and psychological tensions in the face of death. Lapo da Castiglionchio the Younger was a Florentine Renaissance humanist who died in 1438 at the age of thirty-three. He took part in one of the most interesting phases of Italian Renaissance humanism and achieved in his short lifetime a modest reputation as a first-rate Greek to Latin translator. Less well known is the fact that he wrote a fair amount of prose works. One of the most interesting of these is a treatise which he composed in the year of (...) his death, entitled De curie commodis, or, On the Benefits of the Curia, a portrait of the papal Curia which is written elegantly, learnedly, earnestly, and angrily. ;The goal of this study is to discuss this dialogue in its intellectual and social contexts; there are three chapters. The first is a general introduction to Lapo's life and work, to the dialogue itself, and to the historiography on the De curie commodis. The second chapter discusses the manner in which Lapo employs the virtues in a Stoicizing fashion as persuasive tools in the environment of Italian humanism. It is argued that his particular treatment of the virtues can serve as a key for interpreting the dialogue as a whole. The third chapter touches both on social historical issues in the De curie commodis and on Lapo's defense or curial wealth. ;There has been no adequate edition of the Latin text, based on a wide enough variety of extant manuscripts, nor has the De curie commodis ever been translated into English . Therefore, a thorough critical edition of the Latin text along with an annotated English translation follows the discussion. ;The treatise has been notoriously difficult to interpret and seems often to prevaricate. The interpretive conclusion of this study is that Lapo wrote as a well-informed but liminal figure in the socio-cultural environment of the papal Curia--as an outsider who desired to become a full-fledged insider. The De curie commodis is not the parting shot of a fed-up hanger-on; it is instead Lapo's last-ditch, highly critical but nonetheless sincere attempt to find a patron who would allow him to join a cultural ambient at which he marvelled but from which he felt himself unjustly excluded. Donald MacKay's description of the embodiment of an efficacious conscious mind is reviewed as a version of non-reductive physicalism. Particular focus is given to MacKay's analysis of the emergence of consciousness in the capacity for self-evaluation which results from informational feedback regarding the results of action. Unique to MacKay's posthumously published Gifford Lectures is his analysis of agents in dialog as a particular form of an environmental feedback loop. His analysis of dialog is reviewed and expanded to encompass concepts of (...) a First and Second Order Theory of Mind. Finally, MacKay's view of the status of the soul is considered, and the particular role of dialogue as critical to the instantiation of soul is suggested. (shrink)

In the book, basic principles of syncretic logic (sycretics) are expounded upon, with the help of which group relationships of a philosophical nature are treated. Classical philosophical laws are analyzed, new assertions are formulated, laying claim to the position of laws. Syncretic logic is used for constructing the axiomatic theory of carriers and the analysis of its consequences. The problem of the origins of life is considered, the connection between the course of existence and the laws of conservation in physics (...) is expounded upon, the universal scheme of logical operations is described, the components of the structure of a world view are specified. As a spiritual autobiography, Kierkegaard's The Point of View for My Work as an Author stands among such great works as Augustine's Confessions and Newman's Apologia pro Vita Sua. Yet Point of View is neither a confession nor a defense; it is an author's story of a lifetime of writing, his understanding of the maze of greatly varied works that make up his oeuvre. Upon the imminent publication of the second edition of Either/Or, Kierkegaard again intended to cease (...) writing. Now was the time for a direct "report to history" on the authorship as a whole. In addition to Point of View, which was published posthumously, the present volume also contains On My Work as an Author, a contemporary substitute, and the companion piece Armed Neutrality. Taking up the controversial issue of the value of the laws of non-ideal cities in Plato’s Statesman, the paper argues for a modified version of the traditional interpretation, as defended against Christopher Rowe’s influential criticism. The paper agrees with the traditional view that the established laws of non-ideal cities are assumed to be good laws and that the Eleatic Stranger’s justification for this assumption can be found in 300b. But it also argues that this defence of the traditional interpretation (...) must be based on a revised understanding of the role of legislation in the Stranger’s conception of ideal rule. The unique contribution of the expert to good government consists in his distinctive ability to judge what is appropriate in each case, not in his work as legislator, which, on closer inspection, turns out to be based on the very same ancestral traditions that the second best city must resort to. Must bargainers abandon the no-harm principle? Prisoners of Reason recalls that classical liberal capitalism exalted the no-harm principle. Although imperfect and exclusionary, modern liberalism recognized individual human dignity alongside individuals' responsibility to respect others. Neoliberalism, by contrast, views life as ceaseless struggle. Agents vie for scarce resources in antagonistic competition in which every individual seeks dominance. This (...) political theory is codified in non-cooperative game theory; the neoliberal citizen and consumer is the strategic rational actor. Rational choice justifies ends irrespective of means. Money becomes the medium of all value. Solidarity and good will are invalidated. Relationships are conducted on a quid pro quo basis.
